Descriptif de cours
L’objet du séminaire est d’examiner l’évolution du droit du maintien
de la paix depuis les origines de l’Organisation des Nations Unies
mais plus particulièrement au cours des vingt dernières années
(opération « Desert Storm » en Irak des Etats membres sur
autorisation du Conseil de sécurité).

The aim of the seminar is to examine the evolution of international
law governing the maintenance of peace since the establishment of
the United Nations Organization (UNO), with particular emphasis
on developments that have taken place over the course of the last
twenty years (such as operation ‘Desert Storm’ in Iraq, undertaken
by Member States of the UNO with the authorization of the Security
Council).

Syllabus
La rationalité du système de la sécurité collective dans le cadre de la Charte des Nations Unies, la répartition
institutionnelle des responsabilités entre les organes de l’ONU, l’élargissement progressif de la notion de
sécurité collective à partir des années 90, l’évolution des rapports entre droit du maintien de la paix et droit
international humanitaire à partir de la même période, la question de la légalité des actes du Conseil de sécurité,
celle de la répartition des opérations entre ONU et organisations régionales, la collaboration de l’ONU avec des
organisations telles que l’ OTAN, l’incidence de ces évolutions sur le droit international général seront en
particulier examinés en relation avec les grandes crises et les problèmes majeurs auxquels les organes de l’ONU
et les Etats membres ont été confrontés (crise du Golfe, opérations humanitaires en Somalie et au Darfour,
guerre entre les anciens Etats membres de la Yougoslavie, Kosovo, Timor, Irak depuis 2003, Afghanistan,
Proche Orient).
Les participants au séminaire, qui se déroulera en deux langues (français et anglais) seront invités à réfléchir
tout au long du séminaire sur les scenarios possibles concernant l’avenir de l’ensemble du système.

The seminar will analyze the rationale underpinning the system of collective security in the framework of the
Charter of the United Nations, the institutional division of responsibilities among the different organs of the
UNO, the progressive enlargement of the notion of ‘collective security’ since the 1990s, the evolution of the
relationship between international law governing the maintenance of peace and international humanitarian law,
the legality of certain acts of the Security Council, the partition of operations between the UNO and regional
organizations, and the collaboration of the UNO with organizations like NATO. The impact of these
developments on general international law will be examined in relation to the major crises and principal
problems that the UNO organs and State members have had to confront (the Gulf crisis, humanitarian operations
undertaken in Somalia and Darfur, armed conflicts in States formally part of Yugoslavia, Kosovo, Timor, Iraq
since 2003, Afghanistan, and the Middle East).
The seminar will be run in two languages (English and French). Over the course of the seminar, participants will
be invited to reflect upon possible scenarios concerning the future direction of the system as a whole.
