Detention:

- right to not make a statement
You only have to give the police your address, status in
Spain, identification (name, …)
If you apply for asylum or say that you have fear of
returning to your home country they have to research if
you have the right to international protection and they
don't have the right to deport you. Often they deny your
rights but don't hesitate to demand again and again to
get them.
Regularization:
To apply for asylum you have to go to CEAR (Comisión
Española de Ayuda al Refugiado). See in Contacts!

What happens if I want to apply for asylum in
another country of the EU but not in Spain?
According to European law, you have to apply for asylum
in the first European country where you arrive. Practically,
this is the first European country where you are being
registered with your fingerprints upon arrival. If you apply
for political asylum in another country, that country might
send you back to Spain if they can prove you have been
in Spain before and If you are an adult. This European law
is called Dublin. There are several possibilities to avoid a
Dublin-deportation. Read more on:

This leaflet aims to inform through providing
useful advice and contacts for migrants and
refugees on their way to and through Europe,
especially in the transit-country Morocco and
at the EU-outer-border-country Spain. As the
political situation in Europe produces many
difficulties we want to give you some very
basic advice for your journey, arrival and stay.

The Moroccan authorities receive money from the EU to
prevent migrants from entering Europe. Often, people
who succeed to cross are directly deported back to
Morocco.
These practices of the Spanish and Moroccan

groups are in solidarity with persons who migrate so they
may support by publishing these actions which are clear
violations of fundamental European rights. You can also

But an ALARM NUMBER to support rescue operations!
What to do if you are in distress at sea and pushbacks:
1. First call the coast guards and tell them about your
situation of distress.
2. Then call the Alarm Phone. We will make sure that
your distress call is noted and acted upon.
3. If you are not promptly rescued by the coast guards,
call the Alarm Phone again. We will inform the public
media and politicians to put pressure on the rescue
services.
We know coastguards act quite differently. There are
areas where they do their job well and rescue promptly.
But migrants also report that they get pushed back by
coast guards or are treated violently. When a distress call
is received, we will call the coast guards ourselves, and
follow up on their response, making known to them that
we are informed and ‘watching’ them.

Detention: Its possible that you will be put in detention.
They can bring you to the police station and/or
sometimes to a so called CIE (Centro de Internamiento de
Extranjeros). They are not allowed to hold you longer
than 72 hours at the police station. In the CIE they must
release after a maximum of 60 days. Spain has
agreements with Senegal, Cameroon, Mali and Nigeria.
The Spanish authorities have the power to deport people
from these countries directly after their arrival. If you are
registered with another nationality you have better
chances to be released in Spain and continue your
journey.
