DECISION OF THE INTERNATIONAL COURT OF APPEAL
The FIA International Court of Appeal met in Paris on Thursday, January 11, 2007, to examine an
appeal lodged by the Fédération Internationale de l’Automobile (FIA) against the decision of the
Belgian National Court of Appeal of 24 October 2006 concerning kart N°50, competitor CRG
S.p.A., driver Jonathan Thonon regarding an event run at Mariembourg (Belgium) on 3
September 2006 and counting towards the 2006 CIK-FIA World Cup Super ICC.
The Panel of the Stewards of the Meeting of the event inflicted a penalty of 10 seconds on the
competitor because the kart moved before the starting signal, in breach of Article 2.20-K of the
CIK-FIA General Prescriptions. The competitor CRG S.p.A. lodged an appeal before the Belgian
National Court of Appeal which decided to quash the decision of the Panel of the Stewards. The
FIA decided to lodge an appeal before the FIA International Court of Appeal.
Having heard the explanations of all parties and having examined the various documents and
video evidence, the Court quashed the decision of the Belgian National Court of Appeal and
imposed a 10-second sanction on the competitor on the grounds that the kart had indeed moved
before the the starting signal.
The International Court of Appeal was presided over by Mr José MACEDO e CUNHA (Portugal),
elected President, and composed of Mr Xavier CONESA (Spain), Mr Christian GROSJEAN
(Switzerland) and Mr Anthony SCRIVENER (Great Britain).

DECISION DU TRIBUNAL D'APPEL INTERNATIONAL
Le Tribunal d'Appel International de la FIA s'est réuni à Paris le jeudi 11 janvier 2007 afin
d'examiner l'appel interjeté par la Fédération Internationale de l’Automobile (FIA) à l'encontre de
la décision prise par le Tribunal d'Appel National belge le 24 octobre 2006 concernant le kart
N°50, concurrent CRG S.p.A., pilote Jonathan Thonon, à l'issue d'une épreuve disputée à
Mariembourg (Belgique) le 3 septembre 2006 et comptant pour la Coupe du Monde CIK-FIA de
Super ICC 2006.
Le Collège des Commissaires Sportifs de l'épreuve a infligé une pénalité de 10 secondes au
concurrent car le kart avait démarré avant le signal de départ, ce qui est contraire à l'Article 2.20K des Prescriptions Générales de la CIK-FIA. Le concurrent CRG S.p.A. a alors introduit un
appel devant le Tribunal d'Appel National belge, lequel a décidé d'infirmer la décision du Collège
des Commissaires Sportifs. La FIA a décidé d'introduire un appel auprès du Tribunal d'Appel
International de la FIA.
Après avoir entendu les parties concernées et examiné les différentes pièces et autres
documents, le Tribunal a infirmé la décision du Tribunal d'Appel National belge et infligé une
pénalité de 10 secondes au concurrent au motif que le kart avait effectivement démarré avant le
signal de départ.
Le Tribunal d'Appel International était présidé par Maître José MACEDO e CUNHA (Portugal),
élu Président, et était composé de Maître Xavier CONESA (Espagne), Maître Christian
GROSJEAN (Suisse) et de Maître Anthony SCRIVENER (Grande-Bretagne).
