Objet 1- La marque (semi figurative) NF ENVIRONNEMENT, matérialise une certification de produits ou services au sens de l’article L115-27 du code de la consommation (1). Elle a pour objet de certifier la conformité des produits ou services aux documents de normalisation nationaux, européens et internationaux les concernant complétés le cas échéant par d’autres documents de référence dans les conditions définies par des Référentiels de Certification (2) suivant une approche multicritère appliquée, en tant que de besoin, aux différents stades du cycle de vie des produits ou services. La marque NF ENVIRONNEMENT est destinée à certifier que les produits ou services, sur lesquels elle est apposée, présentent un impact négatif moindre sur l’environnement, et une qualité d’usage satisfaisante par rapport à d’autres produits ou services analogues présents sur le marché. Au cas par cas, les Référentiels peuvent intégrer des critères éthiques et sociaux. Pour le contrôle des produits, la marque NF ENVIRONNEMENT peut s’appuyer sur tout ou partie des dispositions des documents de normalisation nationaux, européens et internationaux complétés le cas échéant par d’autres documents de référence en vigueur en matière de protection de l’environnement. Cette marque peut s’appliquer aux produits ou services destinés aux consommateurs et aux produits ou services intermédiaires. Par ailleurs elle peut être attribuée à des produits ou services dont la fonction est utile à la protection de l’environnement. 2- 2. Propriété de la marque NF Environnement La marque NF Environnement est la propriété exclusive d’AFNOR, en vertu de dépôts à titre de marque collective effectués en son nom à l’I.N.P.I. pour la France et à l’O.M.P.I. La marque NF Environnement fait également l’objet d’un dépôt national partout où il est nécessaire pour assurer sa protection dans le monde. La marque NF Environnement est une marque collective de certification qui, en tant que telle, n’est cessible que dans les conditions particulières fixées par loi et est insaisissable. Elle ne peut faire l’objet d’aucune mesure d’exécution forcée. (1) Modifié par la loi n°2008-776 du 4 août 2008 de modernisation de l’économie. Règles générales de la marque NF environnement General rules of NF Environnement mark 3/11 Scope The NF Environnement mark (see logo below) materialises the certification of products or services within the meaning of Article L 115-27 of the French Consumer (1) code . Its purpose is to certify the conformity of products or services to French, European and international standard documents relating to these products or services, and if necessary completed by other documents within the requirements (2) defined by reference documents , according to a multi-criteria approach, which concerns, as far as needed, every stage of the product or service life cycle. The NF Environnement mark aims at certifying that the products or services on which it is affixed have a less negative environmental impact and a satisfying quality of use compared to other similar products or services available on the market. Certain Reference documents may include ethical or social criteria. For the control of products, the NF Environnement mark may rely wholly or partly on the provisions of French, European and international quality assurance standard documents in effect and if necessary completed by other documents in effect concerning the environment protection. This mark may concern products or services intended for consumers, as well as Intermediary products or services. This mark may also suit products or services with an environment protection purpose. Ownership of the NF Environnement mark The NF Environnement mark is the exclusive property of AFNOR by virtue of its registration on AFNOR’s behalf as a collective mark with I.N.P.I for France and with W.I.P.O. The NF Environnement mark is also registered nationally and internationally, in those countries where it is necessary to ensure its protection. The NF Environnement mark is a collective certification mark which, as such, is transferable only within the specific provisions required by the law, and is unattachable. Its property cannot be transferred by any means even by a court decision. 3. 3- Organisation générale La marque NF Environnement est gérée par AFNOR. AFNOR a concédé à AFNOR Certification, SASU, une licence d’exploitation de la marque NF Environnement. Pour certaines applications, AFNOR Certification peut mandater un organisme qui procède, dans le cadre des règles définies dans son mandat, à des opérations concourant à la certification. L’organisme ainsi mandaté notifie aux demandeurs et titulaires les décisions concernant les droits d’usage de la marque NF Environnement pour les produits ou services désignés en annexe au contrat qui le lie à AFNOR Certification, dans le cadre des présentes Règles générales et des référentiels de certification qui s’y rapportent. AFNOR Certification et les organismes mandatés respectent les exigences fixées en matière d’organisme de certification par les normes nationales, européennes et internationales, en particulier : • disposent des garanties suffisantes d’impartialité envers les fabricants ou prestataires, importateurs ou vendeurs des produits ou services pour lesquels la marque NF Environnement est demandée, ainsi qu’à l’égard des utilisateurs desdits produits ou services. • disposent de la compétence et des moyens nécessaires pour assurer le bon fonctionnement de la marque NF Environnement. AFNOR Certification ou l’organisme mandaté peut confier à des organismes ou petrsonnes les fonctions d’essais, d’inspections et d’audits prévues dans le(s) référentiel(s) de certification. AFNOR Certification veille auprès de tous les intervenants à ce que leurs missions soient correctement remplies au regard du rôle et des attributions de chacun d’eux. 4. Conditions d’usage 4.2 Seul le titulaire du droit d’usage peut apposer la marque NF Environnement et faire référence à celle-ci dans sa documentation commerciale, pour les produits ou services définis dans la décision d’accord de droit d’usage de la marque NF Environnement. Le titulaire s’engage par làmême à apposer le logo sur les produits ou services certifiés selon les dispositions particulières prévues par le référentiel de certification. Un demandeur ne peut pas faire état de la marque NF Environnement pendant la durée d’instruction de son dossier. 4.3 Le fait de se prévaloir de la marque NF Environnement ne saurait en aucun cas substituer la responsabilité d’AFNOR, d’AFNOR Certification ni d’un organisme mandaté à la responsabilité du fabricant, distributeur ou importateur du produit ou du prestataire du service. AFNOR Certification ensures that all parties involved perform their missions correctly on the basis of the role and duties assigned to each of them. 4- 4.1 L’usage de la marque NF Environnement n’est autorisé que dans les conditions fixées par les présentes Règles générales et par les référentiels de certification visés à l’article 5 ci-après que le titulaire d’un droit d’usage s’est engagé à respecter. Tout titulaire d’un droit d’usage de la marque NF Environnement s’engage à prendre toute mesure de nature à assurer la continuité du respect de ces exigences. 4/11 General organization The NF Environnement mark is managed by AFNOR. AFNOR has granted AFNOR Certification, a subsidiary company, a license agreement to manage and use the NF Environnement mark. For certain application schemes AFNOR Certification may mandate a body which, within the framework of the rules set out in its mandate, carries out the operations that lead to certification. The mandated body notifies applicants and licensees of all decisions regarding the right to use the NF Environnement mark for the products or services designated in the annex to the contract between them and AFNOR Certification, within the framework of these General Rules and of the relevant Reference documents. AFNOR Certification and the mandated bodies comply with the requirements for a certification body specified in the relevant French, European and International standards and, in particular: provide sufficient evidence of impartiality towards manufacturers or contractors, importers or distributors of the products or services for which application has been made for the NF Environnement mark, and towards the users of such products or services. demonstrate the necessary competence and means required for monitoring the NF Environnement mark. Conditions pertaining to the use of the nf environnement mark 4.1 The use of the NF Environnement mark is authorised only under the conditions set out in these General Rules and in the Reference documents referred to in Article 5 below, with which the licensee has committed to comply. The licensee of the NF Environnement mark undertakes to take all necessary steps to ensure continued compliance with these requirements. 4.2 The NF Environnement mark can only be affixed by a licensee and be referred to in business materials, for the products or services defined in the decision granting the right to use the NF Environnement mark. The licensee undertakes to affix the logo on the certified products or services, provided for by the Reference document. An applicant cannot endorse the NF Environnement mark while the application file is being studied. 4.3 Entitlement to use the NF Environnement mark shall in no event substitute the responsibility of AFNOR, AFNOR Certification or a mandated body for that of the manufacturer, distributor or importer of the product or of the provider of the service. 5. Référentiels de certification 5- Pour chaque application de la marque NF Environnement, AFNOR Certification fixe des règles prises en application des présentes Règles générales qui précise, pour chaque catégorie de produits ou services, les conditions dans lesquelles la marque NF Environnement peut être délivrée aux demandeurs et apposée sur les produits ou services concernés. Les référentiels de certification sont élaborés et validés conformément aux dispositions de l’article 137 loi la loi n° 2008- 776 et de son décret d’application n° 2008-1401 du 19 décembre 2008. 6. Comité de la marque NF 6- Il est institué à titre consultatif un Comité de certification intitulé Comité de la Marque NF traitant de toutes les activités d’AFNOR Certification concernant les marques NF y compris NF Environnement. Sa composition et ses attributions sont données dans les articles 6.1 et 6.2 des présentes règles. 6.1 COMPOSITION Le Comité de la Marque NF est composé de 15 membres, de sorte qu’il comprenne : • 3 représentants des titulaires du droit d’usage de l’une ou l’autre des marques NF, • 1 représentant des consommateurs, • 1 représentant des acheteurs publics, • 4 représentants des organismes mandatés par AFNOR Certification pour le développement et la gestion des marques NF et NF Environnement, • 2 représentants des pouvoirs publics ou d’établissements publics ou parapublics, • 1 représentant de la normalisation, • 3 représentants des prescripteurs. Le Président et tout autre responsable d’AFNOR Certification désigné par lui assistent aux réunions. Les 15 membres du Comité et son Président sont nommés par le Président d’AFNOR Certification pour 3 ans renouvelables. Le Comité peut faire appel à des experts en tant que de besoin. Règles générales de la marque NF environnement General rules of NF Environnement mark 5/11 Reference documents For any application scheme, to which the NF Environnement mark could be granted, AFNOR Certification lays down Specific Rules, written according to these General Rules, which stipulate for each application scheme the conditions under which the NF Environnement mark can be granted to applicants and affixed on the products or services concerned. Reference documents are drawn up and validated in accordance with Article 137 of the Law No. 2008-776 and its enforcement decree No. 2008-1401 of 19 December 2008 NF mark committee A Certification Committee designated as NF Mark Committee acting as an advisory Committee is set up, to deal with all activities of AFNOR Certification in relation with the NF marks, including the NF Environnement mark. Its membership and duties are described in clauses 6.1 and 6.2 below. 6.1 Membership The NF Mark Committee comprises the following 15 members : 3 representatives for the licensees of the NF marks, 1 representative for consumers, 1 representative for the purchase of public agencies, 4 representatives for bodies mandated by AFNOR Certification to manage the NF and NF Environnement marks and their development, 2 representatives for the public authorities or public or quasi-public bodies, 1 representative for standardization, 3 representatives for organizations supporting and promoting the NF marks. The President and any other Director of AFNOR Certification designated by him attend the meetings. The 15 NF Mark Committee members and the President are nominated by the Président of AFNOR Certification for a three-year term renewable. The Committee may appoint experts as needed. 6.2 ATTRIBUTIONS Dans le cadre des présentes Règles générales, le Comité de la Marque NF donne un avis sur : • la politique générale de fonctionnement, de développement, de promotion et de qualité de la marque NF y compris NF Environnement, • les projets de Règles générales de la marque NF Environnement et leurs révisions, • les projets d’accords relatifs à l’activité de certification, y compris les accords de reconnaissance visés à l’article 8, • les projets de mandatement d’organismes, • les recours présentés par les demandeurs ou les titulaires de la marque NF Environnement conformément à l’article 12 ci-après. Le Comité de la Marque NF • surveille la mise en œuvre de la politique générale de fonctionnement et de développement de la marque NF Environnement, • surveille la mise en œuvre de la politique de qualité de la marque NF Environnement par référence aux normes nationales, européennes et internationales, • formule les principes relatifs à l’établissement des référentiels de certification, des contrats-types de mandatement et de sous-traitance, • propose les mesures correctives à mettre en œuvre en cas de déviation ou d’insuffisance. Plus généralement, il traite de toutes questions d’ordre général intéressant la marque NF Environnement. 7. Gestion d’une application de la marque NF Environnement 7.1 La gestion d’une application de la marque NF Environnement implique la réalisation d’opérations telles que : • fixation des référentiels de certification définissant les procédures d’évaluation et de contrôle de la conformité des produits ou services aux critères écologiques, aux critères d’usage du produit ou service, aux critères sur l’information des consommateurs, ainsi que les exigences relatives à la maîtrise par le fabricant ou le prestataire de la qualité des produits ou services, • organisation de la consultation sur le projet de référentiel selon les dispositions du règlement intérieur du Comité Français des Ecolabels et conformément à l’article 5, • instruction des demandes de droit d’usage de la marque NF Environnement, • organisation des contrôles prévus par le référentiel et surveillance de la conformité des produits ou services certifiés NF Environnement, • relations avec les demandeurs, titulaires et tiers notamment pour le contrôle de l’usage correct de la marque NF Environnement, • décisions, sanctions et leur suivi, • promotion sectorielle et développement de l’application concernée, • comptabilité des recettes et des dépenses prévues par le référentiel. Règles générales de la marque NF environnement General rules of NF Environnement mark 6/11 6.2 Duties According to these General Rules, the NF Mark Committee gives advices on the following items : general policy regarding the operation, development, promotion and quality of the NF mark including the NF Environnement mark, drafts General Rules governing the NF Environnement mark and revisions thereof, drafts agreements relating to the certification activity, including the recognition agreements provided for under Article 8, applications of bodies to become mandated bodies, appeals lodged by applicants or licensees of the NF Environnement mark in accordance with Article 12 below, The NF Mark Committee supervises the implementation of the general policy regarding the operation and development of the NF Environnement mark, supervises the implementation of the quality policy of the NF Environnement mark through reference to national, European and international standards, formulates the principles for the drafting of Reference documents and of standard contracts for use in mandating and subcontracting, proposes corrective measures to be implemented in the event of deviation or inadequacy. More generally, the NF Mark Committee deals with all general matters relating to the NF Environnement mark. 7- Management of a specific NF Environnement marking scheme 7.1 The management of a specific NF Environnement marking scheme involves operations such as: setting up of Reference documents relating to assessment and control procedures for the conformity of products and services to environmental and use criteria, consumer information criteria and with requirements about the manufacturer’s or service provider’s control of the quality of the products or services, organization of the consultation about the draft reference document according to the French Ecolabelling Committee’s rules and regulations and in accordance with Article 5, processing of applications for the right to use the NF Environnement mark, organization of the inspections provided for by the Reference documents and supervision of the conformity of the NF Environnement certified products or services, relations with applicants, licensees and third parties, particularly for the purpose of monitoring the correct use of the NF Environnement mark, decisions, sanctions and their follow-up, sectorial promotion and development of the relevant scheme, accountancy of revenues and expenditures as provided for by the Reference documents. 7.2 Lorsque, conformément à l’article 3, AFNOR Certification ou l’organisme mandaté confie des essais de laboratoires, des inspections et audits à des organismes ou personnes tiers, leurs relations sont régies par contrats. Dans ce cas, AFNOR Certification ou l’organisme mandaté s’assure que ces organismes ou personnes se conforment aux prescriptions des normes nationales, européennes et internationales en vigueur qui leur sont applicables. 7.2 When in accordance with article 3 AFNOR Certification or the mandated body subcontracts laboratory testing, inspection and auditing operations to other bodies or third parties, relations with such bodies or persons are governed by a contract. In such cases, AFNOR Certification or the mandated body ensures that these bodies or persons comply with the requirements specified in the relevant national, European and international standards in force. 7.3 COMITÉ FRANÇAIS DES ECOLABELS 7.3 French ecolabelling committee AFNOR Certification sets up an advisory body known as the “French Ecolabelling Committee”. AFNOR Certification met en place une instance consultative, appelée « Comité Français des Ecolabels ». 7.3.1 Composition Le Comité Français des Ecolabels est composé de quatre collèges. • 1) Collège professionnel composé de 4 membres représentant les professions et les entreprises de l’industrie et de la distribution. • 2) Collège associations composé de 4 membres représentant les associations de protection de l’environnement et de défense des consommateurs. • 3) Collège administrations composé de 3 membres représentant les Ministères chargés de l’Environnement, de l’Industrie et de la Consommation. • 4) Collège organismes techniques composé de 3 organismes dont l’ADEME (Agence de l’Environnement et de la Maîtrise de l’Énergie). Les membres du Comité Français des Ecolabels sont nommés par le Président d’AFNOR Certification. La durée de leur mandat est fixée à 3 ans. Ce mandat peut être renouvelé par tacite reconduction. Le Président, choisi parmi les membres du Comité est également nommé par le Président d’AFNOR Certification. La durée de son mandat est fixée à trois ans renouvelables. Chaque membre du Comité ne peut se faire représenter que par un suppléant désigné dans les mêmes conditions. 7.3.2 Attributions Le Comité Français des Ecolabels anime et oriente l'action d'AFNOR Certification pour le développement et la gestion de la marque NF Environnement. À ce titre, il émet un avis sur : • l’opportunité du développement des référentiels pour les catégories nouvelles de produits ou services, • les projets de référentiels et les projets de révision des référentiels approuvés, • les projets d’actions de publicité et de promotion de la marque NF Environnement, • les modifications à apporter aux présentes Règles Générales, • l’examen et la mise en œuvre des accords de reconnaissance, • le traitement des recours éventuels des titulaires si nécessaire en liaison avec le Comité de la Marque NF. Il peut être consulté sur toute autre question intéressant une application particulière et en particulier sur les décisions à prendre sur des dossiers dans le respect des référentiels de certification et sur demande d’AFNOR Certification ou de l’organisme mandaté. Règles générales de la marque NF environnement General rules of NF Environnement mark 7/11 7.3.1 Membership The French Ecolabelling Committee comprises four colleges: 1) the Professional College: 4 representatives for industry and distribution professions and companies, 2) the Associations College: 4 representatives for environmental protection and consumer organizations, 3) the Administrations College: 3 representatives for the Departments in charge of the Environment, the Industry and the Consumption, 4) the Technical Bodies College with 3 bodies, including the ADEME (Environment and Energy Control Agency). The members of the French Ecolabelling Committee are appointed by the President of AFNOR Certification. The term of office is 3 years and may be renewed. This office may be renewed by tacit agreement. The President, chosen among the members of the Committee, is also appointed by the President of AFNOR Certification The term of office is 3 years and may be renewed. A member of the Committee may be represented only by a deputy appointed under the same conditions. 7.3.2 Duties The French Ecolabelling Committee promotes and leads the action of AFNOR Certification relating to the development and management of the NF Environnement mark. Therefore, it gives advice on : the opportunity of drafting Reference documents for new products or services categories draft Reference documents and amendments projects of approved Reference documents, advertising and promotional campaigns planned in relation to the NF Environnement mark, amendments to these General Rules, the review and implementation of recognition agreements the processing of possible appeals filed by licensees, with the help of the NF Mark Committee if necessary. The Committee may be consulted on any other matter regarding a specific application scheme concerned and in particular on the decisions to be taken relating to files in accordance with the Reference documents and upon request of AFNOR Certification or the mandated body. 8. 8- Accords de reconnaissance AFNOR est seule habilitée à conclure avec d’autres organismes français ou étrangers des accords relatifs à la marque NF Environnement. AFNOR Certification est seule habilitée à conclure avec d’autres organismes français ou étrangers des accords de reconnaissance mutuelle portant sur des essais, audits et inspections. AFNOR Certification peut formellement déléguer cette habilitation à un organisme mandaté ou prévoir l’association d’organismes ou de laboratoires à la signature. Les dispositions de ces accords remplacent ou complètent celles des référentiels et de leurs annexes, sans préjudice des autres dispositions qui demeurent applicables. Les dérogations éventuellement nécessaires sont fixées par AFNOR Certification, le cas échéant sur proposition de l’organisme mandaté, et après avis du Comité. 9. Confidentialité, protection des documents Tous les intervenants dans le processus de la marque NF Environnement, y compris les membres du Comité Français des Ecolabels, ainsi que du Comité de la Marque NF sont tenus au secret professionnel. Ils doivent en outre garantir la protection des documents qu’ils gèrent ou qui leur sont confiés contre la diffusion, la destruction matérielle, la falsification et l’appropriation illégale. 10. Information sur les produits ou services bénéficiant de la marque NF Environnement, publicité et promotion 10.1 AFNOR Certification coordonne la gestion des informations sur les produits ou services et les titulaires qui bénéficient de la marque NF Environnement et veille à leur diffusion harmonisée. 10.2 AFNOR Certification est responsable de la promotion collective de la marque NF Environnement, en France et à l’étranger. Les actions collectives de publicité et de promotion de la marque NF Environnement sont définies et réalisées par AFNOR Certification, le cas échéant en concertation avec les organismes mandatés. Les actions collectives de publicité et de promotion d’applications de la marque NF Environnement peuvent également être mises en œuvre par AFNOR Certification ou, le cas échéant, par les organismes mandatés, après accord d’AFNOR Certification. Le Comité est consulté sur ces projets d’actions. Les titulaires peuvent prendre l’initiative, à leurs frais, d’une campagne de publicité sur l’application de la marque NF Environnement qui les concerne, sous le contrôle d’AFNOR Certification ou de l’organisme mandaté. Règles générales de la marque NF environnement General rules of NF Environnement mark 8/11 Recognition agreements AFNOR has exclusive authority to enter into agreements with other French or foreign bodies regarding the NF Environnement mark. AFNOR Certification has exclusive authority to enter into mutual recognition agreements with other French or foreign bodies concerning tests, audits and inspections. AFNOR Certification may formally delegate mandated bodies or associate bodies for the signature of such agreements. The provisions of such agreements replace or supplement the provisions of the Reference documents and annexes thereto, without prejudice to other provisions which remain applicable. Any required waivers shall be decided by AFNOR Certification, where appropriate, upon proposal by the mandated body and following consultation with the Committee. 9- Confidentiality safeguarding of documents All parties involved in the NF Environnement marking process, including the members of the French Ecolabelling Committee and the NF Mark Committee are bound by professional secrecy. In addition, they shall safeguard all documents managed by them or entrusted to their care against circulation, disclosure, physical destruction, falsification or unlawful appropriation. 10 - Information on products or services bearing the NF Environnement mark, advertising and promotion 10.1 AFNOR Certification coordinates the management of the information on products or services and licensees, entitled to use the NF Environnement mark and ensures its proper circulation. 10.2 AFNOR Certification is responsible for the joint promotion of the NF Environnement mark in France and abroad. The joint advertising and promotional activities for the NF Environnement mark are defined and carried out by AFNOR Certification, where appropriate, in consultation with the mandated bodies. The joint advertising and promotional activities for specific NF Environnement marking schemes can also be conducted by AFNOR Certification or, where appropriate, by the mandated bodies, following approval by AFNOR Certification. The Committee is consulted on such planned joint activities. Licensees may take the initiative, at their own cost, of organizing advertising campaigns regarding the NF Environnement mark certification which concerns them, under the control of AFNOR Certification or of the mandated body. 11. Sanctions 11 - Sanctions En cas de manquement de la part d’un titulaire d’un droit d’usage de la marque NF Environnement à l’application des présentes Règles NF générales ou des référentiels de certification, le titulaire se voit notifier son (ses) manquement(s). Il dispose d’un délai raisonnable pour faire part à AFNOR Certification ou, en cas de mandatement, à l’organisme mandaté, de ses observations. Après examen, l’une ou l’autre des sanctions suivantes peut être prononcée : • suspension du droit d’usage de la marque NF Environnement pour une durée déterminée, avec demande d’actions correctives dans un délai donné, • retrait du droit d’usage de la marque NF Environnement, sans préjudice des poursuites éventuelles conformément à l’article 15 ci-après. Ces sanctions motivées sont notifiées à l’intéressé, et prennent effet à compter de la date de ladite notification. La suspension du droit d’usage de la marque NF Environnement a pour effet de priver, pour une durée déterminée, le titulaire de l’usage de ce droit. Le retrait du droit d’usage de la marque NF Environnement annule le droit d’usage de la marque NF Environnement pour le produit ou service considéré. Le type de sanction choisi est fonction du degré de gravité du (des) manquement(s) constaté(s). Les sanctions peuvent s’appliquer à tous les stades de la fabrication et de la commercialisation des produits ou services concernés. En cas d’urgence et notamment pour des manquements graves liés à des obligations de sécurité, AFNOR Certification ou l’organisme mandaté peut prononcer, à titre conservatoire et sans délai, les sanctions de suspension ou retrait provisoires qui s’imposent. AFNOR Certification ou l’organisme mandaté peut prononcer à l’encontre du titulaire un avertissement avec ou sans accroissement des contrôles à sa charge. L’avertissement est accompagné d’une demande d’actions correctives dans un délai donné. L’avertissement ne prive pas le titulaire du droit d’usage de la marque NF Environnement. Règles générales de la marque NF environnement General rules of NF Environnement mark 9/11 In the event of failure on the part of the licensee of the NF Environnement mark to comply with these General Rules or with the Reference documents, the licensee shall be notified of said infringement(s). The licensee shall be allowed in a reasonable time to submit comments to AFNOR Certification, or to the mandated body, if any. After review, one or other of the following sanctions may be pronounced : suspension of the right to use the NF Environnement mark for a limited period, with a request for corrective action within a specified time limit, withdrawal of the right to use the NF Environnement mark, without prejudice to possible legal action in accordance with Article 15 below. Such sanctions and the reasons therefore shall be notified to the licensee and shall come into effect as of the date of notification. Suspension of the right to use the NF Environnement mark deprives the licensee for a specified period of time for that right of use. Withdrawal of the right to use the NF Environnement mark cancels the right to use the NF Environnement mark. The type of sanction shall be chosen on the basis of the seriousness of the noted infringement(s). The sanctions concern every stages from production to marketing and sale of the products or services concerned. In case of urgency, and in particular, in the event of serious infringements of safety obligations, AFNOR Certification or the mandated body may, as a conservatory measure and immediately, apply the requisite temporary suspension or withdrawal sanctions. AFNOR Certification or the mandated body may give the licensee a warning, with or without additional inspections at his expense. A warning is accompanied by a request for corrective action within a specified time limit. A warning does not deprive the licensee of the right to use the NF Environnement mark. 12. Contestation – Recours 12 - Disputes - appeals Le demandeur ou titulaire peut contester une décision le concernant sur la base d’éléments justificatifs en s’adressant à AFNOR Certification ou, en cas de mandatement, à l’organisme mandaté qui peut soumettre l’examen de son dossier au Comité Français des Ecolabels. Le demandeur ou le titulaire est informé des suites données à sa contestation. Au cas où la décision est confirmée, le demandeur ou le titulaire peut présenter un recours contre la décision prise en adressant sa demande au Directeur Général d’AFNOR Certification qui saisit le Comité de la Marque NF. Les recours doivent être présentés dans un délai de quinze jours à compter du jour de la réception de la notification, de la confirmation par lettre recommandée avec accusé de réception, de la décision correspondante. Ils n’ont pas d’effet suspensif. 13. Suspension ou retrait sur demande du titulaire En cas de demande du titulaire de ne plus bénéficier du droit d’usage de la marque NF Environnement, une suspension pour une durée déterminée ou un retrait de ce droit d’usage est prononcé. 14. Validité du droit d’usage de la marque NF Environnement La validité du droit d’usage de la marque NF Environnement s’éteint automatiquement dans les cas suivants : • 1 - la ou les normes ou documents de normalisation auxquels sont soumis les produits ou services ou les référentiels de certification cessent d’être applicables, • 2 - l’application de la marque NF Environnement est supprimée dans les conditions fixées à l’article 17 ci-après. 15. Usage abusif de la marque NF Environnement Outre les sanctions prévues à l’article 11, tout usage abusif de la marque NF Environnement, qu’il soit le fait d’un titulaire du droit d’usage ou d’un tiers, ouvre le droit pour AFNOR et/ou AFNOR Certification à intenter dans le cadre de la législation en vigueur, toute action judiciaire qu’elle juge opportune. 16. Régime financier 13 - Suspension or withdrawal at the request of the licensee Upon request of the licensee to be deprived of the right to use the NF Environnement mark, a suspension for a limited period or the withdrawal of the right of use shall be pronounced. 14 - Validity of the right to use the NF Environnement mark The validity of the right to use the NF Environnement mark shall automatically lapse in the following cases : 1 - the standard(s)or standard-type documents or reference documents to which the products or services comply cease(s) to apply, 2 - the NF Environnement marking scheme is discontinued under the conditions specified in Article 17 below. 15 - Misuse of the NF Environnement mark In addition to the sanctions set out in Article 11, any misuse of the NF Environnement mark by a licensee or by a third party, shall entitle AFNOR and/or AFNOR Certification to take any legal action it may deem appropriate in the framework of current legislation. 16 - Financial framework Un régime financier accompagne chaque référentiel de certification. Les recettes et dépenses relatives à la certification NF Environnement sont encaissées, ordonnancées et supportées par AFNOR Certification ou en cas de mandatement par l’organisme mandaté selon les termes du contrat de mandatement ou par d’autres organismes expressément désignés par AFNOR Certification à cet effet. Règles générales de la marque NF environnement General rules of NF Environnement mark The applicant or licensee may question a decision by forwarding supporting evidences to AFNOR Certification or to the mandated body, if any, who may refer the case to the French Ecolabelling Committee. The applicant or licensee shall be informed of the claim outcome. If the decision is confirmed, the applicant or licensee may appeal the decision by submitting his claim to the Managing Director of AFNOR Certification, who shall refer the case to the NF Mark Committee. Appeals must be lodged by means of registered letter with recorded delivery within 15 days from the date of receipt of the notification confirming the relevant decision. Appeals have no suspensive effect. 10/11 The financial framework is set out in the Reference document. Revenues and expenditures pertaining to the NF Service mark shall be collected, authorised and borne by AFNOR Certification or the mandated body, if any, or by any other body expressly appointed by AFNOR Certification for that purpose. 17. 17 - Discontinuance of a NF Environnement marking scheme Suppression d’une application de la marque NF Environnement AFNOR Certification peut décider après accord du Comité Français des Ecolabels, le cas échéant dans les limites des accords conclus avec les organismes mandatés, la suppression d’une application de la marque NF Environnement. AFNOR Certification en fixe les conditions et délais ; elle en avise tous les intéressés. 18. Approbation 18 - Approval Les présentes Règles Générales ont été approuvées par le Président d’AFNOR après avis favorable du Comité Français des Ecolabels et du Comité de la Marque NF. Elles annulent et remplacent les précédentes Règles Générales adoptées par le Conseil d’Administration d’AFNOR le 15 avril 2005 et ne peuvent être modifiées que par le Président d’AFNOR après avis favorable du Comité Français des Ecolabels et du Comité de la marque NF. Règles générales de la marque NF environnement General rules of NF Environnement mark AFNOR Certification may decide, upon approval of the French Ecolabelling Committee, within the limits of the agreements with the mandated bodies, if any, to discontinue a NF Environnement marking scheme. In that event, AFNOR Certification shall set the corresponding conditions and deadlines and shall advise all parties concerned. 11/11 These General Rules have been approved by the President of AFNOR upon favourable recommendation of the French Ecolabelling Committee and the NF mark Committee. These General Rules supersede the previous Rules adopted by the Board of th AFNOR on April 15 , 2005 and can be amended only by the President of AFNOR, upon favourable recommendation of the French Ecolabelling Committee and NF Mark Committee.
