University of Saskatchewan, [1984] 4 W.W.R. 238; and R. v. Ironchild, 30 Sask. R. 269; and the cases cited therein. The purpose of this Directive is to provide that clarification. 1 The Court interprets the Rule, as set forth in the Canadian Bar Association Code of Professional Conduct, always to proscribe a lawyer’s appearance except in three situations: (a) where the Rules of Court (“local rules or practice”) expressly permit a lawyer’s appearance despite his or her submission of an affidavit; (b) where the matter deposed to in the affidavit is purely a formal one; (c) where the matter deposed to, although not a mere formality, is uncontroverted, that is, not in issue. 2 What is and what is not a formal matter is usually readily ascertainable but will nevertheless have to be determined by the circumstances of each case. 3 What is uncontroverted may be determined readily by inquiry of the opposing party.
