Gewinnspiel DriveGuard Bluetooth Speaker - Bedingungen
Zusammenfassung
Die vorliegenden Bedingungen gelten für Ihre Teilnahme am Wettbewerb „DriveGuard
Bluetooth Speaker“. Sie können über unsere Facebook an diesem Gewinnspiel teilnehmen.
Um an dem Gewinnspiel teilzunehmen, müssen die Teilnehmer zum Zeitpunkt der
Teilnahme mindestens 18 Jahre alt und ihren Wohnsitz in Frankreich, Deutschland, Spanien
oder Großbritannien haben. Ein Kauf ist nicht erforderlich. Gewinner sind die
teilnahmeberechtigten Teilnehmer, die an der „Bluetooth DriveGuard Speaker“
teilgenommen. Die Gewinner erhalten ein DriveGuard Bluetooth speaker im Wert von
€20.09.
Bitte lesen Sie sich diese Gewinnspielregeln sorgfältig durch, bevor Sie an dem Gewinnspiel
teilnehmen.
Artikel 1 – Begriffsbestimmungen

 Annahmeschluss: der Annahmeschluss für die Teilnahme an der InternetUmfrage, 23:59 Uhr am 13/03/2016
1.4. Teilnehmer: Eine am Gewinnspiel teilnehmende Person, die gemäß Artikel 2 der
Gewinnspielregeln teilnahmeberechtigt ist.
1.5. Preise: Die Gewinner erhalten ein DriveGuard Bluetooth speaker im Wert von €20.09.
1.6. Veranstalter: Bridgestone Europe NV mit eingetragenem Firmensitz in Kleine
Kloosterstraat 10, 1932 Zaventem (Belgien), Unternehmensnummer 0441.192.820,
als Veranstalter des Gewinnspiels.

1.7. Teilnahmebedingungen: Die für das Gewinnspiel geltenden Regeln, die vom
Veranstalter auf der in Artikel 1.2 genannten Website angekündigt werden

Artikel 2 - Teilnahmeberechtigung
2.1
Um an dem Gewinnspiel teilzunehmen, müssen die Teilnehmer zum Zeitpunkt der
Teilnahme mindestens 18 Jahre alt sein und ihren Wohnsitz in Frankreich,
Deutschland, Polen, Spanien oder Großbritannien haben.
2.2
Mitarbeiter des Veranstalters, deren direkte Angehörige, mit dem Veranstalter
verbundene Unternehmen sowie alle anderen Personen, die direkt oder indirekt an der
Ausrichtung des Gewinnspiels bzw. des Preises oder deren Übergabe beteiligt sind,
sind von der Teilnahme ausgeschlossen.
2.3
Es werden nur Beiträge von Privatpersonen akzeptiert. Alle anderen Einsendungen,
darunter Einsendungen von Vermittlern, organisierten Gruppen oder automatisch
computergenerierte Einsendungen werden nicht akzeptiert.
2.4
Personen, die teilnehmen möchten, müssen die Website besuchen. Um am
Gewinnspiel teilnehmen zu können, müssen die Teilnehmer an der Umfrage
teilnehmen, die Stichfrage beantworten und die Pflichtfelder des Teilnahmeformulars
vollständig ausfüllen.
2.5
Die Teilnahme ist nur online auf der Website möglich, eine Einsendung per Post ist
nicht möglich.
2.6
Die Registrierung für das Gewinnspiel ist kostenlos, d. h. sie erfordert keinen Kauf
oder sonstige vom Teilnehmer zu tragenden Kosten, die über die Kosten hinausgehen,
die dem Teilnehmer ohnehin entstehen, z. B. für den Internetanschluss.
2.7
Bei der Anmeldung zum Gewinnspiel können Teilnehmer angeben, dass sie MarketingMaterial vom Veranstalter erhalten möchten. In diesem Fall stimmen die Teilnehmer
zu, dass ihre Anmeldedaten in den Verteiler des Veranstalters aufgenommen werden
und sie dessen Newsletter per E-Mail erhalten. Teilnehmer können sich jederzeit
wieder aus dem Verteiler streichen lassen, indem sie den zugeschickten Anweisungen
zur Abmeldung folgen.
2.8
Auf der Website können die Gewinnspielregeln, die Datenschutzrichtlinie und die
Cookie-Richtlinie eingesehen werden.

2.9 Der Veranstalter behält sich das Recht vor, Teilnehmer auszuschließen, die
unvollständige oder gefälschte Adressen oder Namen verwenden, und Einsendungen
von Teilnehmern auszuschließen, die die Gewinnspielregeln missbrauchen,
manipulieren, umgehen oder versuchen, diese zu manipulieren oder zu umgehen, oder
Betrug, in welcher Form auch immer, begehen.
2.10 Teilnehmer können nur während des Gewinnspielzeitraums und in der in diesen
Gewinnspielregeln beschriebenen Weise an dem Gewinnspiel teilnehmen.
2.11 Jeder Teilnehmer darf nur einmal am Gewinnspiel teilnehmen.
2.12 Um teilnehmen zu können, muss der Teilnehmer von einem Computer, Smartphone
oder sonstigen Endgerät aus Zugriff auf eine Highspeed-Internetverbindung haben.
Artikel 3 – Gewinner
3.1
Die Gewinner erhalten ein DriveGuard Bluetooth speaker im Wert von €20.09.
3.2
Gewinner sind die teilnahmeberechtigten Teilnehmer, die an der „Bluetooth
DriveGuard Speaker“ teilgenommen. Die Gewinner erhalten ein DriveGuard Bluetooth
speaker im Wert von €20.09. Bei mehreren richtigen Antworten wird der endgültige
Gewinner ausgelost.
3.3
Die Gewinner werden innerhalb von zehn Werktagen nach dem Enddatum jedes
Monats ermittelt. Die Ermittlung der Gewinner ist nicht anfechtbar.
3.4
Die Preise sind ausschließlich personenbezogen. Eine Barauszahlung sowie ein Tausch
gegen Waren und/oder Dienstleistungen sind nicht vorgesehen. Der Ultimative Preis
ist nur nach vorheriger schriftlicher Zustimmung des Veranstalters übertragbar.
3.5
Sollte der unwahrscheinliche Fall eintreten, dass einer der Preise aus irgendeinem
Grund nicht verfügbar ist, behält sich der Veranstalter das Recht vor, den nicht
verfügbaren Preis jederzeit gegen einen anderen Preis von gleichem oder höherem
Wert auszutauschen.
3.6
Der Vornamen des Gewinners und sein Wohnort werden auf der Website veröffentlicht.
3.7
Der Gewinner erhält innerhalb von zwei Wochen nach Ende des Gewinnspielzeitraums
per E-Mail die Benachrichtigung, dass er einen der Preise gewonnen hat.
3.8
Wenn ein Gewinner seinen Preis nicht innerhalb von 3 Tagen ab dem Versanddatum
der Gewinnbenachrichtigung per E-Mail in Anspruch nimmt, indem er in einer Antwort
auf diese E-Mail seine vollständige Postadresse und Telefonnummer angibt, behält sich
der Veranstalter das Recht vor, gemäß dem unter 3.1 und 3.2 erläuterten Verfahren
einen neuen Gewinner für den Preis zu ermitteln.
4
§ 4: Haftungsausschluss
4.1
Der Veranstalter, seine Mitarbeiter, seine Vertragspartner und sonstige beteiligte
Dritte übernehmen keine Verantwortung für Schäden, die durch den Preis (oder
dessen Übergabe und/oder Nutzung) oder die Teilnahme an dem Gewinnspiel
entstehen. Dies gilt nicht im Falle von Vorsatz oder grober Fahrlässigkeit, und dann
nur für Personenschäden oder Todesfälle oder in Bezug auf die wesentlichen
Vertragspflichten des Veranstalters.
4.2
Der Veranstalter, seine Mitarbeiter, seine Vertragspartner oder sonstige beteiligte
Dritte übernehmen keine Verantwortung für verloren gegangene, verspätete oder
fehlerhafte Einsendungen von Teilnehmern, die Folge von Ereignissen sind, die
außerhalb der Kontrolle des Veranstalters liegen, wie beispielsweise Störungen
jeglicher Art in Bezug auf die Software, das Endgerät des Teilnehmers, sein Netzwerk,
seine Internetverbindung usw.
4.3
Der Veranstalter gibt keinerlei Garantie hinsichtlich der übergebenen Preise ab und ist
diesbezüglich (außer im Falle von Vorsatz oder grober Fahrlässigkeit) nicht haftbar.
Der Veranstalter haftet nicht für etwaige Mängel der Preise, beispielsweise falls der
Preis später als angekündigt übergeben oder angenommen wird oder falls der (Ersatz)Preis von dem ursprünglich vorgesehenen Preis abweicht.
4.4
In einigen Rechtsprechungen ist es nicht zulässig, die Haftung unter einigen oder allen
der oben angegebenen Umstände auszuschließen oder zu beschränken. In diesen
Rechtsprechungen wird die Haftung des Veranstalters im größten gesetzlich zulässigen
Maß begrenzt.
4.5
Sämtliche Steuern, die gemäß für den Teilnehmer geltender lokaler oder sonstiger
Gesetze ganz oder teilweise auf den Werts des Preises zu entrichten sind, sind vom
Teilnehmer zu tragen und können in keiner Weise vom Veranstalter eingefordert
werden.
§ 5: Datenschutz
Alle personenbezogenen Daten, die vom Veranstalter im Zusammenhang mit dem
Gewinnspiel erhoben werden, werden streng vertraulich und im vollen Einklang mit der
Datenschutzrichtlinie (www.bridgestone.eu/privacy-policy) und den geltenden
Datenschutzgesetzen behandelt. Im Sinne der im belgischen Recht verankerten EURichtlinie 95/46/EC ist der Datenverantwortliche Bridgestone Europe NV/SA. Von den
Teilnehmern bereitgestellte Daten werden für die Verwaltung und Durchführung des
Gewinnspiels genutzt. Durch Annahme der Gewinnspielregeln erkennen die Teilnehmer an,
dass ihre personenbezogenen Daten auf diese Weise genutzt werden, dass sie die
Datenschutzrichtlinie des Veranstalters gelesen haben und dieser uneingeschränkt
zustimmen.

§ 6: Beschwerden
6.1

Bei einem Streitfall hinsichtlich der Durchführung des Gewinnspiels und aller auf das
Gewinnspiel bezogenen Angelegenheiten ist die Entscheidung des Veranstalters
endgültig und bindend und es wird keinen diesbezüglichen Schriftverkehr oder
Gespräche geben.
§ 7 – Verschiedenes
7.1
Der Veranstalter behält sich das Recht vor, (i) das Gewinnspiel ohne vorherige
Ankündigung zu verändern oder zu verlängern oder das Enddatum zu verlegen, wenn
ihm dies angemessen erscheint, (ii) die Gewinnspielregeln ohne Angabe von Gründen
im alleinigen Ermessen zu ändern und (iii) das Gewinnspiel zurückzuziehen, wenn
Gründe vorliegen, die sich seiner Kontrolle entziehen.
7.2
Die Einsendungen der Teilnehmer, einschließlich sämtlicher geistigen Eigentumsrechte
an den Einsendungen, gehen mit der Einreichung in das Eigentum des Veranstalters
über. Die Teilnehmer verzichten hinsichtlich ihrer Einsendungen auf jedwede
moralischen oder anderen Ansprüche und erklären, dass sie alle erforderlichen Rechte
haben, um die in diesen Gewinnspielregeln dargelegten Rechte einzuräumen.
7.3
Alle Fragen oder Angelegenheiten, die nicht durch diese Gewinnspielregeln abgedeckt
sind, werden ausschließlich vom Veranstalter entschieden.
7.4
Sollte ein Gericht feststellen, dass eine oder mehrere der Gewinnspielregeln (oder
Teile der Regeln) ungültig, rechtswidrig oder undurchsetzbar sind, soll der betreffende
Teil im erforderlichen Maße als aus den Gewinnspielregeln entfernt gelten. Die
Gültigkeit und Vollstreckbarkeit der übrigen Gewinnspielregeln bleibt hiervon
unberührt.
7.5
Diese Gewinnspielregeln unterliegen belgischem Recht.
7.6
Bei einem Streitfall in Bezug auf das Gewinnspiel oder diese Regeln sind ausschließlich
die entsprechenden belgischen Gerichte zuständig, jedoch erst, nachdem Veranstalter
und Teilnehmer sich bemüht haben, den Streit einvernehmlich beizulegen.

The present Terms apply when you participate in the “DriveGuard Bluetooth Speaker”. It is
possible to enter this Competition via our Facebook page.
To enter the Competition, Entrants must be at least 18 years of age at the time of
participating and a resident of France, Germany, Spain or the UK. No purchase is required.
The Winners will be the eligible Entrants who have (i) participated in the DriveGuard
Bluetooth Speaker and (ii) answered the elimination question. The winner wins a
DriveGuard Bluetooth speaker worth €20.09.
Please read these Terms carefully before participating in the Competition.
Article 1 – Definitions
1.1 Competition: the “DriveGuard Bluetooth Speaker” as described in further detail in Article
3.

“DriveGuard Bluetooth Speaker”, being 08/03/2016
 Closing Date: the closing date for receipt of entries to the “DriveGuard
Bluetooth Speaker”, which is at 11.59pm 13/03/2016
1.11. Entrant: a person who participates in the Competition and is entitled to do so based on
Article 2 of the Terms.
1.12. Prize: The winner wins a DriveGuard Bluetooth speaker worth €20.09.
1.13. Promoter: Bridgestone Europe NV, having its registered offices at Kleine Kloosterstraat
10, 1932 Zaventem (Belgium), with company number 0441.192.820, being the
organizer of the Competition.

1.14. Terms: these terms and conditions that apply to the Competition announced by the
Promoter on the Website referred to in Article 1.2
1.15. Winner(s): the Entrants winning the Prizes as determined in accordance with Article
3.1.
Article 2 – Eligibility to Participate
2.13 The Competition is open to residents of France, Germany, Italy, Spain and the UK who
are aged 18 or over at the time of entry.
2.14 This Competition is not open to employees (or their immediate families) of the
Promoter or any company affiliated with the Promoter, nor to any persons directly or
indirectly involved with the organization of the Competition or the Prize (or supply
thereof).
2.15 Only entries from individuals in their personal capacity will be accepted; any other
entries including entries from agents, organized groups or entries automatically
generated by computer will not be accepted.
2.16 To enter, the Entrant must go to the Website. To qualify for entry into the
Competition, Entrants must take part in the “DriveGuard Bluetooth Speaker”, answer
the elimination question, and fully complete the mandatory fields of the entry form.
2.17 Entries can only be submitted online on the website and cannot be sent via post.
2.18 Registration to the Competition is free of charge, which means it does not require any
purchase or other cost by the Entrant on top of costs already borne, e.g. for internet
connection.
2.19 When registering to enter the Competition, Entrants may opt in to receiving marketing
material from the Promoter. If the Entrant opts in to receiving such material, the
Entrant consents to their registration details being added to the Promoter’s mailing
list, and they may receive newsletters from the Promoter via email. Entrants can leave
the mailing list at any time by following the simple ‘unsubscribe’ instructions included
on the communication.
2.20 The Terms, the Privacy Policy and the Cookies Policy can be consulted on the Website.
2.21 The Promoter reserves the right to exclude Entrants who use incomplete or fake
addresses or names, and to exclude entries from Entrants who abuse, manipulate,
circumvent or attempt to manipulate or circumvent the Terms or commit any kind of
fraud.

2.22 Entrants can only participate in the Competition during the Competition Period and in
the manner as described in these terms.
2.23 Only one entry per Entrant is permitted.
2.24 To be able to participate, the Entrant needs to have access to a high-speed internet
connection from a computer, smartphone or other terminal device.
Article 3 – Winners
3.1 The winner wins a DriveGuard Bluetooth speaker worth €20.09.
3.2 The Winners will be the eligible Entrants who have (i) participated in the DriveGuard
Bluetooth Speaker and (ii) answered the elimination question.
3.3 The Winners will be determined within 10 working days after the closing date of each
month. The determination of the Winners cannot be appealed.
3.4 The Prizes are strictly personal and non-exchangeable for money, goods and/or
services. The Ultimate Prize is not transferable without the prior written consent of the
Promoter.
3.5 In the unlikely event that any of the Prizes are not available for any reason, the
Promoter reserves the right to substitute the non-available Prize for a similar prize of an
equal or greater value at any time.
3.6 The first name of the Winner and their city of residence will be published on the Website
and
3.7 The winner will receive, at the latest within two weeks of the end of the Competition
Period, a message by e-mail, informing him/her that he or she has won one of the Prize.
3.8 If a Winner does not claim his or her Prize within 3 days from the date on which the
winner notification e-mail was sent, by replying to the notification e-mail stating his full
postal address, the Promoter reserves the right to select a new Winner for the Prize in
accordance with the procedure as set out in Article 3.1 and 3.2 .
3.9 After the Winner or Runner-up has contacted the Promoter for acceptance of his or her
Prize, the Prize will be made available to him or her, subject to the fulfillment of the
condition as mentioned in Article 3.1 in respect of the Ultimate Prize.

Article 4 – Exclusion of liability
4.1
The Promoter, its employees, its contractual parties or other involved third parties will
not, except in case of intentional or gross negligence and only for personal injury or
death or with regard to the Promoter’s essential contractual obligations, be responsible
for any damage caused by the (making available and/or use of the) Prizes or
participation in the Competition.
4.2
The Promoter, its employees, its contractual parties or other involved third parties will
not be responsible for any lost, late, incomplete or corrupted entries from Entrants
which result from events beyond the control of the Promoter, such as disturbances of
any kind with regard to the software, terminal device of the Entrant, his or her
network, internet connection, etc.
4.3
The Promoter does not provide any guarantee in relation to the Prizes that are made
available and shall not be liable in this regard (except in case of intentional or gross
negligence). The Promoter is not liable for any defaults in the Prizes, for instance if a
Prize is made available or received later than announced or if the (replacement) Prize
differs from the Prize that was initially proposed.
4.6
Some jurisdictions do not allow for the exclusion or limitation of liability in or under
some or all of the situations or conditions referred to above. In such jurisdictions, the
Promoter’s liability shall be limited to the maximum extent as permitted by law.
4.7
Any and all taxes to be paid under the Entrant’s local or other law on the whole or part
of the value of the Prize shall be borne by the Entrant and can in no way be claimed
from the Promoter.
Article 5 – Privacy
All personal data obtained by the Promoter in the context of the Competition will be treated
as being strictly confidential and in full conformity with the privacy policy
(www.bridgestone.eu/privacy-policy) and applicable privacy laws. For the purposes of the
Belgian law implementing European Directive 95/46/EC, the data controller is Bridgestone
Europe NV/SA. Information provided by Entrants will be used for the administration and
management of the Competition. By accepting the Terms, the Entrant agrees to their
personal information being used in this way, and acknowledges that they have read and
fully agree with the privacy policy of the Promoter.

Article 6 - Complaints
6.1

In the event of any dispute regarding the conduct of the Competition and all matters
relating to the Competition, the decision of the Promoter is final and binding and no
correspondence or discussions will be entered into.
Article 7 – Miscellaneous
7.1
The Promoter reserves the right to (i) amend or extend the Competition and the
Closing Date if it deems appropriate and without notice; (ii) change the Terms at its
discretion for any reason, and (iii) withdraw the Competition where it is necessary due
to circumstances outside the Promoter’s control.
7.2
All entries will become the property of the Promoter upon submission, including all
intellectual property rights in the entry. Entrants agree to irrevocably and
unconditionally waive any and all moral and other rights vesting in their entry and
warrant that they have all rights necessary to grant the rights provided for in these
Terms.
7.3
Any matter or subject not covered by these Terms shall be exclusively determined by
the Promoter.
7.4
If a court or any other competent authority finds that any of the Terms (or any part of
any term) is invalid, illegal or unenforceable, that term or part of that term shall, to
the extent required, be deemed deleted, and the validity and enforceability of the
other Terms shall not be affected.
7.5
Belgian law applies to these Terms.
7.6
Any dispute relating to the Competition or these Terms will be subject to the exclusive
jurisdiction of the competent Belgian courts, but only after the Promoter and the
Entrant have first attempted to resolve their dispute amicably.

Resumen
Las presentes Reglas se aplican a todas aquellas personas que participen en el concurso

Artículo 2 – Participación

El Concurso no está abierto a empleados (ni familiares directos) de la Organización o
de las filiales de la Organización, ni a personas directa o indirectamente relacionadas
con la organización del Concurso, el Premio o el suministro del Premio.
2.3
Solo se aceptará la participación de personas a título individual; no se aceptarán la
participación de agentes o grupos organizados ni las participaciones generadas
automáticamente por ordenador.
2.4
Para enviar sus respuestas, el Participante debe acceder al Facebook. Para poder
tomar parte en el Concurso, el Participante debe realizar la encuesta, responder la
pregunta de desempate y rellenar todos los campos obligatorios del formulario de
participación.
2.5
Las participaciones únicamente pueden enviarse a través del sitio web, y en ningún
caso por vía postal.
2.6
Registrarse en el Concurso es gratis, lo que significa que no requiere que el
Participante realice ninguna compra ni incurra en ningún gasto aparte de los gastos ya
soportados (por ejemplo, la conexión a Internet).
2.7
A la hora de registrarse para participar en el Concurso, el Participante puede decidir si
desea recibir materiales promocionales de la Organización. Si el Participante indica
que desea recibir ese tipo de materiales, en ese caso consiente que los datos
utilizados para el registro se añadan a la lista de distribución de correo de la
Organización; asimismo, puede recibir boletines de la Organización por correo
electrónico. El Participante puede anular la suscripción a la lista de distribución de
correo siguiendo las sencillas instrucciones de anulación de la suscripción incluidas en
los mensajes que reciba.

Las Reglas, la Política de Privacidad y la Política de Cookies pueden consultarse en el
sitio web.

2.9 La Organización se reserva el derecho de excluir a aquellos Participantes que utilicen
nombres o direcciones falsos o incompletos, así como de excluir las respuestas de
aquellos Participantes que infrinjan, manipulen o evadan (o intenten manipular o
evadir) las Reglas o cometan cualquier tipo de fraude.
2.10 Los Participantes únicamente pueden participar en el Concurso durante el Periodo del
Concurso y de la forma que se describe en estas Reglas.
2.11 Solo se aceptará una única participación por persona.
2.12 Para poder participar, el Participante tiene que disponer de un ordenador, smartphone
u otro terminal con conexión a Internet de alta velocidad.
Artículo 3 – Ganadores
3.1
Los Ganadores recibirán un DriveGuard Bluetooth Speaker, valorado en 20.09 €.
Los Ganadores serán aquellas personas que: (i) hayan realizado la encuesta sobre
el Facebook; y, (ii) cuya respuesta a la pregunta de desempate esté más próxima
al valor real. Los Ganadores recibirán un DriveGuard Bluetooth Speaker, valorado
en 20.09 €.
3.2

Los Ganadores se anunciarán dentro de los 10 días laborables siguientes a la Fecha de
Finalización del mes correspondiente. La decisión sobre los Ganadores será final e
inapelable.
3.4
Los Premios son estrictamente personales y no podrán intercambiarse por dinero,
bienes y/o servicios. El Premio no será transferible sin la autorización por escrito de la
Organización.
3.5
En el improbable caso de que alguno de los Premios no esté disponible por cualquier
motivo, la Organización se reserva el derecho a sustituir el Premio no disponible por
un premio similar de igual o mayor valor en todo momento.
3.6
El nombre de pila y la ciudad de residencia del Ganador se publicarán en el sitio web.
3.7
El Ganador recibirá, en el plazo máximo de dos semanas a contar desde la Fecha de
Finalización del Concurso, un correo electrónico informándole de que es la persona que
ha ganado el Premio.
3.8. Si un Ganador no reclama su Premio dentro de los 3 días siguientes a la fecha de
envío de la notificación por correo electrónico de que ha ganado, respondiendo a dicha
notificación con su dirección postal completa y su número de teléfono, la Organización
se reserva el derecho de seleccionar un nuevo Ganador para el Premio según el
procedimiento especificado en los apartados 3.1. y 3.2. del Artículo 3.

Artículo 4 – Exclusión de responsabilidad
4.1
La Organización, sus empleados, partes contratantes o terceros no serán
responsables, excepto en caso de negligencia intencionada o imprudencia grave y sólo
en caso de daños personales o muerte o en lo que respecta a sus obligaciones
contractuales básicas, de ningún daño causado por los Premios o el uso/entrega de los
mismos o por la participación en el Concurso.
4.2
La Organización, sus empleados, partes contratantes o terceros no serán responsables
de ninguna participación perdida, fuera de plazo, incompleta o corrupta provocada por
situaciones ajenas a su control como desajustes de cualquier tipo en el software, el
terminal del Participante, su red, conexión a Internet, etc.
4.3
La Organización no aporta ninguna garantía con respecto a los Premios otorgados y no
se hace responsable de ellos (excepto en caso de negligencia intencionada o
imprudencia grave). La Organización no se hace responsable de ningún defecto en los
Premios, por ejemplo si estos se envían o reciben más tarde de lo anunciado o si el
Premio de sustitución difiere del inicialmente propuesto.
4.4
Algunas jurisdicciones no permiten la exclusión o limitación de responsabilidad en
algunas o ninguna situación o condiciones arriba mencionadas. En estas jurisdicciones,
la responsabilidad de la Organización se limitará al máximo permitido por ley.
4.5
Todos los impuestos que haya que pagar por el valor del premio o parte de él según la
legislación del país del Participante u otra legislación vigente serán abonados por el
Participante y en ningún caso podrán ser reclamados a la Organización.
Artículo 5 – Privacidad
Los datos personales obtenidos por la Organización en el transcurso del Concurso se
tratarán con la máxima confidencialidad y de conformidad con nuestra política de privacidad
(www.bridgestone.eu/privacy-policy) y con la legislación aplicable en materia de privacidad.
A efectos de la transposición de la Directiva Europea 95/46/CE a la legislación belga, el
controlador de los datos es Bridgestone Europe NV/SA. La información facilitada por los
Participantes se empleará para la administración y gestión del Concurso. Al aceptar las
Reglas del Concurso, el Participante accede a que sus datos personales se empleen con
estos fines y confirma que acepta la política de privacidad de la Organización.
Artículo 6 – Quejas
6.1
Para quejas, preguntas y/o comentarios, pueden ponerse en contacto con el servicio

Si existiera algún problema con respecto a cualquier aspecto relacionado con el

Artículo 7– Miscelánea
7.1
La Organización se reserva el derecho a (i) cambiar o ampliar el Concurso y la Fecha
de Finalización si lo considera adecuado sin previo aviso; (ii) cambiar las Reglas del
Concurso según su criterio por cualquier razón, o a (iii) cancelar el Concurso de ser
necesario debido a circunstancias fuera de su control.
7.2
Todas las participaciones pasarán a ser propiedad de la Organización, y esto incluye
todos los derechos de propiedad intelectual sobre la participación. Los Participantes
acceden a ceder todos los derechos sobre su entrada, ya sean morales o de otra
índole, de forma irrevocable e incondicional, y declaran que cuentan con todos los
derechos necesarios para poder cederlos según este reglamento.
7.3
Cualquier asunto no contemplado en este reglamento será exclusivamente
determinado por la Organización.
7.4
Si un tribunal o cualquier otra autoridad competente determina que cualquiera de las
Reglas (o parte de alguna de ellas) es inválida, ilegal o no ejecutable, esa Regla se
considerará eliminada hasta el punto que se considere necesario sin que por ello se
vea afectada la validez y ejecutabilidad del resto.
7.5
Las Reglas del Concurso se rigen por la legislación belga.
7.6
Cualquier disputa relativa al Concurso o a estas Reglas quedará sujeta a la jurisdicción
exclusiva de los tribunales belgas competentes, pero únicamente tras haber tratado de
resolver estas diferencias de forma amistosa.

Article 2 – Conditions d'admission
2.1
Le Concours est ouvert aux résidents d'Allemagne, d'Espagne, de France ou du

Les Participants doivent concourir en leur nom propre. Toute inscription par un

s'inscrire valablement, les Participants doivent répondre à l'Enquête en ligne, donner
une réponse à la question subsidiaire et dûment remplir les champs obligatoires du

2.5
Les participations doivent se faire exclusivement en ligne via le Site Web et ne
peuvent pas être envoyées par la poste.
2.6
L'inscription est gratuite et sans obligation d'achat ni frais accessoires pour les
Participants, à l'exception des frais déjà pris en charge, par exemple les frais d'accès à

2.7
Lorsqu'ils s'inscrivent pour participer au Concours, les Participants peuvent choisir de
recevoir du matériel de marketing de la Société Organisatrice. Si le Participant accepte
de recevoir ce matériel, il consent à l'ajout de ses coordonnées dans la liste de
diffusion de la Société Organisatrice et à recevoir des lettres d'information par e-mail
de la part de la Société Organisatrice. Les Participants peuvent se désinscrire de la

2.9
La Société Organisatrice se réserve le droit d'exclure les Participants qui utilisent des
noms ou adresses incomplets ou faux, ainsi que ceux qui abusent du Règlement, le
manipulent, le contournent ou tentent de le manipuler ou de le contourner, ou se
rendent coupables de tout type de fraude.
2.10 Les Participants peuvent prendre part au Concours uniquement pendant la Période du
Concours et conformément au présent Règlement.
2.11 Une seule inscription par Participant est autorisée.
2.12 Pour pouvoir participer, les Participants doivent disposer d'une connexion haut débit à
Internet à partir d'un ordinateur, d'un smartphone ou d'un autre terminal.
Article 3 – Gagnants
3.1
Les Gagnants recevront un DriveGuard Bluetooth Speaker, d'une valeur de
20.09 €.
3.2
Les Gagnants seront les Participants qui auront (i) répondu à la question sur Facebook
et (ii) donné la réponse la meilleure réponse à la question. Les Gagnants recevront un

3.3
La sélection des Gagnants s'effectuera dans les 10 jours ouvrables suivant la Date de
clôture. Cette décision sera définitive et ne pourra pas être contestée.
3.4
Les Prix sont strictement personnels et ne peuvent pas être échangés contre de
l'argent, des biens et/ou des services. Le Prix final ne peut être transféré sans accord
écrit préalable de la Société Organisatrice.
3.5
Dans l'hypothèse peu probable où un Prix annoncé ne serait pas disponible, la Société
Organisatrice se réserve le droit de le remplacer à tout moment par un prix d'une
valeur égale ou supérieure.
3.6

3.7
Les Gagnants recevront, au plus tard dans les deux semaines suivant la fin de la

3.8
Si un Gagnant ne réclame pas son Prix dans les 3 jours suivant la date d'envoi de l'email de notification, en répondant à l'e-mail de notification en mentionnant son
adresse postale complète et son numéro de téléphone, la Société Organisatrice se
réserve le droit de sélectionner un nouveau Gagnant pour le Prix, conformément à la
procédure décrite aux articles 3.1. et 3.2.

Article 4 – Exclusion de responsabilité
4.1
La Société Organisatrice, ses employés, ses parties contractantes et tout autre tiers
impliqué ne pourront en aucun cas, sauf négligence intentionnelle ou grave entraînant
des préjudices corporels ou un décès ou manquement aux obligations contractuelles
essentielles de la Société Organisatrice, être tenus responsables d’un quelconque
dommage résultant du Prix (de sa mise à disposition et/ou de son utilisation) ou de la
participation au Concours.
4.2
La Société Organisatrice, ses employés, ses parties contractantes et tout autre tiers
impliqué ne pourront être tenus responsables d’aucune perte ni d’aucun retard
d’inscription des Participants résultant d’événements indépendants de la volonté de la
Société Organisatrice, tels que des dysfonctionnements du logiciel, du terminal des
Participants, de leur réseau, de leur connexion Internet, etc.
4.3
La Société Organisatrice ne fournit aucune garantie en ce qui concerne les Prix mis à
disposition et se décharge de toute responsabilité à cet égard (hormis en cas de
négligence intentionnelle ou grave). La Société Organisatrice ne pourra pas être tenue
responsable d’un quelconque défaut relatif aux Prix, notamment de retard de mise à
disposition ou de réception des Prix par rapport à ce qui a été annoncé, ou si le Prix
(de remplacement) est différent du Prix initialement proposé.
4.4
Certaines juridictions ne permettent pas d’exclusion ou de limitation de responsabilité
dans certaines ou toutes les situations ou conditions susmentionnées. Dans ces
juridictions, la responsabilité de la Société Organisatrice sera limitée dans toute la
mesure permise par la loi.
4.5
Tous les impôts devant être payés aux termes de la législation locale ou autre du
Participant sur la totalité ou une partie de la valeur du prix seront à la charge du
Participant et ne pourront en aucun cas être réclamés à la Société Organisatrice.
Article 5 – Respect de la vie privée
Toutes les données personnelles obtenues par la Société Organisatrice dans le cadre du
Concours seront traitées comme étant strictement confidentielles et entièrement conformes
à la politique de confidentialité (www.bridgestone.eu/privacy-policy) et aux lois sur le
respect de la vie privée applicables. La législation belge mettant en œuvre la Directive
européenne 95/46/CE désigne Bridgestone Europe NV/SA comme étant le responsable du
traitement. Les informations fournies par les Participants seront utilisées à des fins
d’administration et de gestion du Concours. En acceptant le Règlement, les Participants
acceptent ces conditions d’utilisation de leurs informations et reconnaissent avoir lu et
accepter la politique de confidentialité de la Société Organisatrice.

La Société Organisatrice se réserve le droit (i) de modifier ou de repousser le Concours
et la Date de clôture sans préavis si les circonstances l'exigent ; (ii) de modifier le
Règlement à sa discrétion pour tout motif, et (iii) d’annuler le Concours si des
circonstances indépendantes de sa volonté l’exigent.
7.2 Tous les formulaires d’inscription deviendront la propriété de la Société Organisatrice à
compter de leur soumission, y compris tout droit de propriété intellectuelle y afférent.
Les Participants renoncent de manière irrévocable et sans condition à tout droit moral
et autre droit sur leur inscription et déclarent y être habilités conformément au
présent Règlement.
7.3
Toute question ou tout sujet non couvert par le présent Règlement sera soumis à
l’interprétation exclusive de la Société Organisatrice.
7.4
Si un tribunal ou toute autre autorité compétente juge l’une quelconque des
dispositions du Règlement (ou une partie seulement) invalide, illégale ou inapplicable,
ladite disposition ou partie de disposition devra être ignorée, dans la mesure requise,
et la validité et l’applicabilité des autres dispositions ou parties de dispositions du
Règlement n’en seront pas affectées.
7.5
Le présent Règlement est régi par le droit belge.
7.6
Tout litige relatif au Concours ou au présent Règlement sera soumis à la compétence
exclusive des tribunaux belges, uniquement après une première tentative de la
Société Organisatrice et du Participant de trouver un règlement à l’amiable.
