Information sur le droit des produits chimiques Services cantonaux des produits chimiques Notice D05 Page 1 sur 48 Ver. 6.0 – 04/2016 Classification, étiquetage et emballage des huiles essentielles selon le droit des produits chimiques (système SGH/CLP) Cette notice s’adresse: aux fabricants et importateurs d’huiles essentielles, aux points de vente qui remettent et conçoivent des préparations à base d'huiles essentielles. Définition Les huiles essentielles sont des mélanges de composants volatils et parfumés fabriquées par distillation à la vapeur d’eau, par extraction au moyen de solvants ou par pression à froid à partir de matières premières végétales. A la différence des huiles grasses (p. ex. l’huile de tournesol), elles s’évaporent totalement. Les huiles essentielles sont utilisées principalement comme fragrance – pour parfumer une pièce ou un produit cosmétique –, mais aussi comme médicaments et comme exhausteurs de goût dans les condiments. Risques potentiels Les huiles essentielles peuvent irriter la peau, les yeux et les muqueuses et provoquer des réactions cutanées allergiques. Celles dont la viscosité est faible peuvent en outre, si elles sont avalées, pénétrer dans les poumons et les endommager (risque d’aspiration). Eu égard à ces risques potentiels, les huiles essentielles entrent dans bien des cas dans la catégorie des produits chimiques dangereux et doivent, de ce fait, être classées, emballées et étiquetées conformément à la législation y relative. Bases légales La réglementation juridique applicable est fonction de l’utilisation à laquelle est destinée une huile essentielle ou une préparation – voire un objet – qui en contient. Dans certains cas, pour le même mélange d'huiles essentielles, plusieurs dispositions légales s'appliquent selon le type d'utilisation déclaré. Veuillez prendre connaissance du guide Swissmedic à ce sujet: www.swissmedic.ch > Surveillance du marché > Questions de délimitation Normes applicables: loi sur les produits thérapeutiques (RS 812.21), lorsqu’il est présenté comme un médicament ou un dispositif médical (action curative, effet sur la santé), loi sur les denrées alimentaires (RS 817.0), lorsqu’il est présenté comme un additif alimentaire, ordonnance sur les produits cosmétique (RS 817.023.31), lorsqu'il est présenté comme produit cosmétique (parfum, huiles essentielles très diluées pour une application sur le corps comme huile de massage ou comme bain moussant), ordonnance sur les aliments pour animaux (RS 916.307), lorsqu’il est présenté comme un additif pour lesdits aliments, ordonnance sur les produits biocides (RS 813.12), lorsqu’il est présenté, par exemple, comme repulsif, ordonnance sur les produits chimiques (RS 813.11) dans tous les autres cas. Les matières premières tombent elles aussi sous le coup de la législation sur les produits chimiques, quel que soit leur usage ultérieur. Les considérations ci-après concernent exclusivement les devoirs découlant de la législation sur les produits chimiques. Notice D05 Page 2 sur 48 Ver. 6.0 – 04/2016 Devoirs relevant de la législation sur les produits chimiques Classification et étiquetage Il incombe aux fabricants d’huiles essentielles de déterminer si ces dernières risquent de porter atteinte à la vie ou à la santé de l’homme ou à l’environnement. La présente notice a pour objet d’indiquer le mode de classification, d’emballage et d’étiquetage de ces produits. Fiche de données de sécurité Les fabricants sont également tenus d’établir des fiches de données de sécurité en se conformant aux exigences prescrites à l’annexe II du règlement UE-REACH en les adaptant aux exigences suisses (cf. notice C02) et de les remettre gratuitement aux utilisateurs professionnels. Obligation de communiquer Les huiles essentielles doivent être déclarées dans un délai de 3 mois après leur mise sur le marché en vue de leur inscription dans le registre des produits chimiques. Sont soumises à la communication les substances et les mélanges pour lesquels une fiche de données de sécurité est obligatoire (cf. notice C02). Il en va de même pour les produits destinés aux utilisateurs privés. Les produits mis sur le marché uniquement à des fins professionnelles doivent être communiqués dès lors qu'ils sont commercialisés en quantités supérieures à 100kg. Les produits chimiques soumis à l’autorisation (homologation) tels que produits biocides ou phytosanitaires ne sont pas soumis à l’obligation de communiquer. Il en va de même pour : les substances et les préparations (mélanges) destinées à la recherche, aux analyses et à la formation, les substances et les préparations (mélanges) utilisées exclusivement comme matière première pour les denrées alimentaires, les préparations (mélanges) non dangereuses en emballage d'une contenance inférieure à 200ml, à condition d'être produites en Suisse et remises directement du fabricant à l'utilisateur final, les produits cosmétiques (finis). La communication doit contenir les nom et adresse du fabricant ainsi que la classification, l’étiquetage et l’usage prévu. La composition doit figurer sous forme détaillée pour les produits dangereux destinés aux utilisateurs privés et telle qu’elle figure dans la fiche de données de sécurité pour les préparations non dangereuses utilisées à des fins commerciales. S’agissant des produits dangereux pour l’environnement, il convient en outre de préciser la quantité annuelle qui sera mise sur le marché. L’inscription dans le registre des produits chimiques s’effectue en principe par voie électronique via le site www.rpc.admin.ch > Login. De plus amples informations sur l'obligation de communiquer sont décrites dans la notice B01 (substances) et B02 (préparations) sur le site : www.bag.admin.ch/communicationchim. Publicité et échantillons Les huiles essentielles présentées comme repulsifs ou désinfectants sont considérées comme biocides. Les produits biocides ne peuvent pas être mis sur le marché sans autorisation (homologation) L'autorité en la matière est l'organe de réception des notifications des produits chimiques (ONChim) auprès de l'Office fédéral de la santé publique, 3003 Berne (tél.: 058.462.73.05, www.organedenotificationchim.admin.ch). Une fois autorisés, les produits biocides ne doivent pas être communiqués en vue de leur inscription dans le registre des produits chimiques. Pour de plus amples renseignements concernant la mise sur le marché des produits biocides, voir la notice B03. Les huiles parfumées/odorantes ne doivent pas être présentées comme ayant des propriétés curatives (dans le cas contraire, les produits doivent être conformes aux dispositions de la loi sur les produits thérapeutiques et nécessiteront éventuellement une homologation de la part de Swissmedic. Les formulations minimisantes, telles que non toxique, absolument non dangereux, écocompatible ou d'autres formulations similaires sont interdites. Les webshops et les catalogues, avec possibilité de commande et qui s’adressent aux utilisateurs privés, doivent rendre attentifs leurs clients sur la dangerosité des produits (pictogramme(s) de danger, mention d’avertissement, phrases P). Notice D05 Page 3 sur 48 Ver. 6.0 – 04/2016 Application Pour le stockage, l'utilisation et le transvasement, il est nécessaire d'appliquer les indications se trouvant sur l'emballage et dans la fiche de données de sécurité. Conservation Les huiles essentielles ne doivent pas être accessibles aux enfants, ni lors de la vente, ni durant l'utilisation ou l'entreposage. Cas d'urgence En cas d'urgence, il faut sans tergiverser faire le 145 (no d'appel d'urgence du Tox Info Suisse, toxinfo.ch). Si possible, transmettre les indications se trouvant sur l'étiquette. Classification des huiles essentielles pures Seules quelques substances odorantes disposent d’une classification harmonisée à l'annexe VI, partie 3, du règlement européen CLP (CE) no 1272 / 2008 (ci-après règlement UE-CLP). L’IOFI (Organisation internationale de l'industrie de saveur) et l’IFRA (International Fragrance Association) ont publié un guide très utile pour la classification et l'étiquetage d’arômes et de parfums1.. Cette notice se réfère aux classifications proposées dans la publication de IFRA-IOFI pour les huiles essentielles et leurs composants. S'agissant de ces derniers, le guide contient également des indications importantes sur leur type et leur concentration. Des extraits de ce guide sont reproduits dans le présent document. En principe, les huiles essentielles pures doivent être considérées comme des substances, car elles figurent dans l’Inventaire européen des produits chimiques commercialisés (EINECS). Leur classification doit donc être opérée conformément aux critères du règlement UE-CLP, mais les données toxicologiques font souvent défaut. Les huiles essentielles renfermant plusieurs composants (p. ex. du limonène, de l’eugénol, du géraniol) peuvent cependant être classées en fonction de la concentration de ces différents composants et de leurs propriétés. Classification de mélanges d’huiles essentielles Les mélanges d’huiles essentielles doivent être classés selon les critères du règlement CLP, en prenant en compte la concentration des différents composants. Les concentrations maximales des composants de diverses huiles essentielles ainsi que leurs classifications, conformément à l’annexe VI, partie 3, du règlement UE-CLP et aux propositions du guide de l’IFRA-IOFI, sont énumérées à l’annexe IV du présent document. Si les teneurs des substances d’un mélange n’ont pas été mesurées par voie analytique, la classification peut être opérée à l’aide du guide de l’IFRAIOFI. Il n’est par contre pas possible d’évaluer les risques particuliers suivants, que les huiles essentielles comportent souvent: Inflammable (H225, H226) Danger en cas d'aspiration (H304) En règle générale, ces risques peuvent être déterminés uniquement sur la base des paramètres physico-chimiques du produit (point d’éclair, viscosité). Les caractéristiques techniques des fermetures de sécurité pour enfants et des indications de danger décelables au toucher doivent être conformes à la norme SN EN ISO 8317 et respectivement à la norme SN EN ISO 11683 (cf. www.snv.ch). Caractérisation/Etiquetage des huiles essentielles L’étiquetage des substances et des mélanges (préparations) doit comporter les informations suivantes: le nom de la substance ou de la préparation, les nom, adresse et numéro de téléphone du fabricant suisse. Pour les produits qui ne sont pas destinés au grand public, les nom, adresse et numéro de téléphone du fabricant d'un Etat membre de l'EEE suffit. les pictogrammes danger équivalant à la classification, les phrases H et P correspondantes, la quantité de remplissage lorsqu’il s’agit de produits accessibles aux utilisateurs privés, le numéro d’identification (n° CE ou n° d’index) s’il s’agit d’une substance, la désignation chimique des substances dangereuses s’il s’agit d’une préparation (mélange d’huiles essentielles), qui doit être conforme à une nomenclature internationale reconnue. L’étiquetage doit être solidaire de l’emballage, être formulé dans au moins deux langues officielles ou dans la langue du territoire de vente et être clairement visible, facilement lisible et indélébile. La lisibilité requiert, mis à part une bonne qualité d'impression et de contraste, une taille indicative des caractères (hauteur de x) minimale de 1,2 mm (Arial 6-7). Pour les emballages dont la surface est inférieure à 80 cm2, la hauteur de x doit être au minimum de 0,9 mm. Notice D05 Ver. 6.0 – 04/2016 Page 5 sur 48 Caractérisation / Etiquetage des petits emballages Emplacement de l'étiquette Si, en raison de la configuration, de la forme ou de la taille de l'emballage, il n'est pas possible de reporter sur l'étiquette ou l'emballage, les indications obligatoires, les solutions suivantes sont applicables : indications sur une étiquette dépliable indications sur une étiquette accrochée/suspendue indication sur un emballage externe. Dans le cas d’un imballage interne ou d'une étiquette dépliable, seules les indications suivantes sont nécessaires sur la partie externe de l'étiquette : identification du produit les pictogrammes nom et numéro de téléphone du fabricant (sans adresse). Cette règle n'est pas applicable si l'on utilise volontairement plus de langues que demandé. Limite de l'étiquetage Si les dispositions mentionnées ci-dessus ne permettent pas d’avoir un étiquetage complet sur les emballages inférieurs à 125 ml, il est possible d'omettre certains éléments d’étiquetage en fonction de la dangerosité. Classification des diverses substances contenues dans les huiles essentielles Notice D05 Page 6 sur 48 Ver. 6.0 – 04/2016 ANNEXE 1: Les dispositions les plus importantes pour l'étiquetage et l'emballage des huiles essentielles Fermeture Dans le cas d'huiles toxiques, corrosives ou dangereuses par aspiration, une fermeture de sécurité enfant est obligatoire lorsqu'elles sont destinées aux utilisateurs privés (cf. tableau 1). Désignation officiel du produit Nom commercial ou désignation de la substance. Pour les substances pures ont peut aussi mentionner le numéro CE (exemple : 284-515-8 pour l'essence de citron) Pictogrammes de danger * Souvent, pour les huiles essentielles pures, plusieurs pictogrammes de danger sont nécessaires. Chaque pictogramme doit avoir au moins 1 cm de côté, à partir de 125 ml au moins 1,6 cm de côté. Phrases H et P * (indications sur les dangers et sur les mesures de protection) De nombreuses huiles essentielles pures et mélangées ont besoin des phrases suivantes (exemples): (l'indication du numéro n'est pas nécessaire, seul le texte est demandé.) H226 : Liquide et vapeurs inflammables. H304 : Peut être mortel en cas d'ingestion et de prénétration dans les voies respirtatoires. H315 1: Provoque une irritation cutanée H317: Peut provoquer une allergie cutanée H411 1: Toxique poru les organismes aquatiques, entraîne des effets néfastes à long terme. P101 5: En cas de consultation d'un médecin, garder à disposition le récipient ou l'étiquette. P102 5 : Tenir hors de portée des enfants. P280 1, 3 : Porter des gants de protection/des vêtements de protection/un équipement de protection des yeux/du visage. Requit pour les produits avec H317 et aussi en-dessous de 125 ml (évent. P262). La phrase concern4ant l'élimination est nécessaire à partir d'une certaine quantité (volume supérieur à 125 ml), excepter les produits ayant les propriétés dangereuses H224, H304, H314, GHS06 et autres. La formulation de la phrase peut être adaptée. Requis uniquement pour les produits destinés aux utilisateurs privés. Les conteneurs plus grands avec des propriétés particulières (au lieu de P102). Avertissement* En fonction de la dangerosité est inscrite la mention d'avertissement "Attention" ou "Danger" Indication de danger décelable au toucher Triangle d'avertissement décelable au toucher. Est nécessaire par exemple pour les huiles toxiques, corrosives, danger par aspiration destinées aux utilisateurs privés (cf. tableau 1). Quantité de remplissage Indications relatives au fabricant ou à l'importateur suisse Nom de l'entreprise, adresse et numéro de téléphone. Indication(s) sur la(les) substances(s) contenue(s) Dans le cas d'un mélange il est nécessaire d'indiquer les principales substances dangereuses, par exemple : ● contient du limonène ● contient de l'huile de citron Avertissement * Toutes les informations illustrées ci-dessus doivent être en deux langues officielles ou du moins dans la langue du territoire de vente. Le texte doit être bien lisible (Arial 6-7, faire attention au contraste). L'étiquette doit être solidaire à l'emballage. Une exécution particuliaire pour les petits emballages est possible (se référer au chap. "Caractérisation/Etiquetage des petits emballages". En qualité de commerçants, importateurs ou conditionneurs, vous pouvez trouver ces informations (pictogrammes, avertissement, phrases H et P et d'autres informations) sur la fiche de données de sécurité (FDS) des produits (chap. 2 de la FDS). Notice D05 Page 7 sur 48 Ver. 6.0 – 04/2016 ANNEXE 2 : Exemples d’étiquettes Exemple 1 : Huile essentielle pure (par exemple huile d'orange) L'huile est vendue à un utilisateur professionnel (volume de l'emballage : 500 ml) : ● La classification et les éléments ’étiquetage sont traités à l'annexe 3 de cette notice : - Enregistrement : Huile d'orange - No CE 232-433-8 - Pictogrammes de danger GHS02, GHS07, GHS08, GHS09 - Mention d’avertissement "Danger" - Phrases H: H226, H304, H315, H317, H410 - Phrases P: (P101), P280, P301+P330+P331, P405, P501 ● Le nom en allemand ou en français peut être trouvé par exemple dans ESIS : "Orange, süss. Extrakt", "Oranger doux, extraits" (cf. annexe 3) ● Les facilités d’étiquetage en fonction de la contenance ne sont pas applicables. Contient : extrait d'oranger, doux No CE 232-433-8 Duftfabrik AG, Lavoisierstrasse 1, 4000 Bâle Télephone 061 222 11 11 Exemple 2 : Mélange d'huiles essentielles Dans ce cas de figure, il s'agit d'un mélange (50-50%) d'huiles essentielles de mandarine et d’extrait de citron remis à des utilisateurs privés (contenance 50 ml) : ● Conformément à l'annexe 4 de la présente notice, les concentrations sont les suivantes : l'huile de mandarine contient 75% de d-limonène,17% de g-terpinène (p-mentha-1,4 dien, non dangereux), 1,9 % d’alpha –pinène, 1,85% de myrcène, 1,4 % de beta –pinène et 0,8% de terpinolène ; l’extrait de citron contient 70% d’alcool éthylique et 0,1% de d-limonène. ● Sur la base des classifications des composants individuels et de leur concentration (cf. annexe 5), la classification peut être calculée selon les critères du règlement UE-CLP, ce qui donne le résultat suivant pour le mélange : Skin Irrit. 2, Skin sens. 1(B), Aquatic Acute 1, Aquatic Chronic 1. Etant donné que les huiles de bergamote et de citron sont classées toutes deux liquides infalmmables (cf. annexe 3), ces propriétés peuvent aussi être utilisées pour le mélange dans la mesure où il n'existe pas d'autres données. ● En raison d’une teneur supérieure à 10 % en substances dangereuses en cas d’aspiration, cette propriété doit être reprise pour tout le mélange. Notice D05 Page 8 sur 48 Ver. 6.0 – 04/2016 ● Les composants classés comme sensibilisants de la peau doivent être indiqués sur l'étiquette (Skin Sens. 1, H317). Par exemple, le limonène, les a-pinènes et le terpinolène Les huiles essentielles pures peuvent aussi être considérées comme des substances et être déclarées comme telles. En pareil cas, il convient alors d'utiliser les noms tels qu'ils figurent dans l’inventaire CE (http://echa.europa.eu/fr/information-on-chemicals/ec-inventory) ● Les phrases P doivent être choisies selon les critères du règlement CLP. Une aide à ce sujet est donnée dans le guide de l'agence européenne pour les produits chimiques ECHA (« Guide sur l’étiquetage et l'emballage selon le règlement CLP », www.echa.europa.eu). La règle est de ne pas considérer plus de 6 phrases P. Dans l'exemple donné les phrases P sont premièrement orientées en fonction des risques principaux, ce qui veut dire le caractère sensibilisant et le risque par aspiration. De plus, pour les produits destinés aux utilisateurs privés, les phrases P101 et P102 doivent impérativement être associées. ● Les phrases H et P pour les propriétés inflammables, irritantes et dangereuses pour l'environnement peuvent être omises sur les petits emballages (<125 ml), pour un manque de place. Il s'agit en particulier des phrases H225, H315 et H411 accompagnées des phrases P correspondantes (p.ex. P210) qui pourrait déjà être omise en raison du maximum de phrases (6) préconisées. ● Remarque : puisque le mélange d'huile est caractérisé avec la phrase H304 pour le danger par aspiration et qu'il est destiné aux utilisateurs privés, l'emballage doit être doté d'une fermeture de sécurité pour les enfants ainsi qu'une indication de danger décelable au toucher. Exemple d'étiquette : Mandarine Fresh - mélange de parfums Contenan ce 50 ml Danger Peut être mortel en cas d'ingestion et de pénétration dans les voies respiratoires. Peut provoquer une allergie cutanée. En cas de consultation d'un médecin, garder à disposition le récipient ou l'étiquette. Tenir hors de portée des enfants. EN CAS D'INGESTION : contacter immédiatement un centre anti-poison/un médecin. NE PAS faire vomir. Ramener le solde de produit dans un point de vente, un centre de collecte ou comme déchets spéciaux. Contient : limonène, pinène, terpinolène Duftfabrik AG, Lavoisierstrasse 1, 4000 Bâle, tél. :061 222 11 11 Notice D05 ANNEXE 3: Page 9 de 48 Ver. 6.0– 04/2016 Classification, pictogramme de danger, phrases H et P des huiles essentielles pures Le tableau ci-dessous se base sur le « IFRA-OIFI Labelling Manual 2014 » (Attachment IV : NCSs (UVCBs) Hazard classifications) avec certaines huiles provenant des éditions précédentes du guide.
