Énoncés de principes de l’École du Barreau du Québec concernant les conditions de stage Declaration of principles on articling conditions by the École du Barreau du Québec ÉNONCÉS DE PRINCIPES DE L’ÉCOLE DU BARREAU DU QUÉBEC CONCERNANT LES CONDITIONS DE STAGE DECLARATION OF PRINCIPLES ON ARTICLING CONDITIONS ADOPTED BY THE BAR SCHOOL OF THE BARREAU DU QUÉBEC PRÉAMBULE PREAMBLE CONSIDÉRANT que le deuxième volet du programme de formation professionnelle des avocats prévoit un stage pour le candidat ayant terminé avec succès la formation professionnelle à l’École du Barreau; WHEREAS the second division of the professional training program for advocates is comprised of an articling period for the applicant that has successfully completed his professional training at the Bar School; CONSIDÉRANT que le stage doit contribuer adéquatement à la préparation de la profession d’avocat; CONSIDÉRANT que le stage doit permettre au stagiaire de mettre en pratique les compétences acquises au cours de la formation professionnelle de l’École du Barreau; CONSIDÉRANT que le maître de stage assume l’encadrement du stagiaire en milieu de travail; CONSIDÉRANT qu’il est dans l’intérêt du public qu’à la suite de leur passage à l’École du Barreau, les futurs avocats poursuivent adéquatement leur formation professionnelle; CONSIDÉRANT que l’École du Barreau est, par règlement, chargée de dispenser les activités de formation professionnelle et en définit les modalités; CONSIDÉRANT que le Barreau du Québec a confié à l’École du Barreau le mandat d’analyser la possibilité de procéder à une réforme de son programme et que dans le cadre de cette analyse, l’École a notamment amorcé une réflexion sur le stage; CONSIDÉRANT que dans l’attente d’une politique sur le stage qui pourrait être adoptée dans le cadre de cette réforme, l’École du Barreau a jugé opportun d’adopter les présents énoncés de principes minimaux concernant les conditions du stage, le tout, en conformité et sous réserve des dispositions du Règlement sur la formation professionnelle des avocats; CONSIDÉRANT que le devoir de l’avocat envers la profession consiste notamment, dans la mesure de ses capacités, à aider au développement de sa profession par l'échange de ses connaissances et de son expérience avec les autres avocats, les étudiants et les stagiaires; WHEREAS the articling period shall contribute adequately to preparing the candidate for the practice of law; WHEREAS the articling period shall allow the articled student to put into practice the skills acquired in the professional training program acquired at the Bar School; WHEREAS the articling supervisor shall be responsible for overseeing the articled student in the work place; WHEREAS it is in the public interest that future advocates follow adequate professional training after they successfully completed the Bar School; WHEREAS the Bar School is, by law, responsible for all professional training activities and sets its terms and conditions; WHEREAS the Barreau du Québec mandated the Bar School to analyze the possibility of a reform of its program and as part of that analysis, the School initiated a reflection on the conditions of articling; WHEREAS pending a policy on articling that could be adopted as part of this reform, the Bar School has seen fit to adopt the following principles concerning the minimal conditions related to articling conditions, all in accordance and subject to the By-law respecting the professional training of advocates; WHEREAS a lawyer must, to the extent it is possible for him, assist in the development of his profession through the exchange of his knowledge and experience with other lawyers, students and articling students and through his participation in courses and professional training periods; WHEREAS a lawyer and the articlrd student is a servant of justice and the practice of the profession of lawyer is based on the following values and principles enacted in the Code of Professional Conduct of 1 Énoncés de principes de l’École du Barreau du Québec concernant les conditions de stage Declaration of principles on articling conditions by the École du Barreau du Québec Lawyers; CONSIDÉRANT que l’avocat et le stagiaire sont au service de la justice et que l’exercice de la profession d’avocat repose sur la prise en considération des valeurs, principes, obligations et devoirs édictés dans le Code de déontologie des avocats; THEREFORE, the Bar School restates the following declaration of principles relative to the conditions of articling : L’École du Barreau souhaite affirmer les principes suivants relativement aux conditions de stage : CHAPITRE I. DÉFINITION ET CHAMP D’APPLICATION CHAPTER I. DECLARATORY AND INTERPRETATIVE PROVISIONS 1. Est considéré comme un «stage» au sens du présent énoncé de principes, le travail accompli par un stagiaire auprès d’un avocat, ou d’un membre de la magistrature, aux conditions établies par le Règlement sur la formation professionnelle des avocats. 1. In the present declaration of principles, the expression «articling period» means the work accomplished by an articled student with an advocate or a member of the judiciary as per the conditions set under the By-law respecting the professional training of advocates. 2. Les termes «stagiaire» et «maître de stage» ont le sens qui leur sont attribués par le Règlement sur la formation professionnelle des avocats. 2. The expression «articled student» and «articling supervisor» have the meaning provided under the By-law respecting the professional training of advocates. 3. Le présent énoncé a pour but d’énumérer les droits et les obligations du stagiaire et les obligations du maître de stage pendant la durée du stage accompli pour l’obtention du permis d’exercice. 3. The present declaration aims to state the rights and obligations of the articled student and the obligations of the articling supervisor during the articling period performed to obtain the permit. CHAPITRE II DISPOSITIONS GÉNÉRALES CHAPITRE II GENERAL PROVISIONS SECTION I Durée du stage DIVISION I Articling Period 4. Le candidat ayant réussi ses examens de l’École du Barreau doit accomplir un stage d’une durée de six mois, à temps plein, sous la supervision d’un maître de stage, selon les conditions établies par le Règlement sur la formation professionnelle des avocats. 5. The candidate who has successfully completed the professional training of the Bar School shall accomplish an articling period lasting for six consecutive months, completed on a full-time basis, under the supervision of an articling supervisor, subject to the conditions set under the By-law respecting the professional training of advocates. SECTION II Rémunération 6. L’École du Barreau estime que la rémunération 5. The articled student has the right to the working conditions and to the remuneration agreed upon in exchange of its work. DIVISION III Terms relative to the eligibility of an articling supervisor 8. The articling supervisor has the responsibility to provide a valid preparation for the practice of law to the articled student pursuant to the By-law respecting the professional training of advocates. 12. The articling supervisor promotes and allows the articled student to follow continuing education, for instance by granting to the articled student the necessary time and resources. 13. The articling supervisor must ensure that the articled student acquires the knowledge related to the regulations regarding the profession of advocates, including the rules related to the respect to the public, of the profession, and of the judiciary as well as related to the courtesy amongst colleagues. Le maître de stage s’entretient de manière régulière avec le stagiaire afin de s’assurer du bon déroulement de son stage, de la variété des tâches effectuées par le stagiaire et de la progression constante de son apprentissage. 14. CHAPITRE IV : RÉSOLUTION DE CONFLITS CHAPTER IV : CONFLICT RESOLUTION SECTION I Comité de la formation professionnelle DIVISION I Committee for Professional Education 31.
