Bulgaria Bulgarie Bulgarien Report Q 151 by the Bulgarian Group The impact of advertising restrictions on trademarks In Bulgaria the main legal acts containing provisions restricting the exercise of advertising are the following: - Law on Radio and Television (LRTV) Law on Protection of Consumers and on the Commercial Rules (LPC) Law on Public Health (LPH) Law on Protection of Plants (LPP) Law on Tobacco (LT) Regulations for the Conditions and the Rules for Approval of the Advertising of Pharmaceutical Products (RAAPhP) The Law on Protection of Consumers contains the general prohibition for misleading and unfair advertisements, defining both of them in an non- exhaustive way. The Law on Radio and Television explicitly provides that the advertising of goods and services the production or trade of which requires special permission can be included in the programs of the radio and TM operators only upon presentation of the necessary permission. The particular products to which the restrictions relate are: 1. Pharmaceutical products and medical treatment The LPH prohibits the advertising of pharmaceutical products unless they are approved according to the rules established in the special law. The Law on Pharmaceutical Products lays down the rules for the registration and approval of the pharmaceutical products. The RAAPhP stipulates that the advertisement of pharmaceutical products could be spread only after the approval of its content by the Director of the National Institute for Pharmaceutical Products. The RAAPhP differentiates between the advertisements of pharmaceutical products for the public, and the advertisements intended for medical specialists. Advertisements in the mass media of pharmaceutical products for the public is permitted only for medicaments which can be purchased without medical prescription. The LRTV prohibits the advertising of medicaments and medical treatment which are permitted for use only with a medical prescription. 1 2. Biological and phytopharmaceutical products The LPP prohibits the advertisements of the above preparations unless they are registered for use in Bulgaria 3. Tobacco and tobacco products, smoking The LT prohibits the advertising in any way of tobacco and tobacco products outside the factories where they are produced, and outside the places where they are sold. The LRTV prohibits any advertising of tobacco products and smoking by radio and TV operators. The LPH prohibits the advertising of tobacco products on radio and TVs, near places for children, and schools and with methods addressed to the minors. 4. Alcohol The LPH introduces the following restrictions in advertising of alcohol. The advertising of all and any kind of alcoholic drinks shall not: - be directed to under aged and in broadcastings for them; associate the use of alcohol with driving vehicles; represent restraint or moderation in drinking alcohol in negative light The LRTV adds the following requirements for advertising of alcoholic drinks. The advertising shall not: - 5. use as performers under aged associate the use of alcohol with sports achievements state that the use of alcoholic drinks has therapeutical qualities, that they have stimulating and soothing effect, or that they solve personal problems encourage excessive consumption of alcoholic drinks suggest that the high content of alcohol contributes to positive characteristics of the alcoholic drinks Narcotics and psychotropic substances The LRTV contains an absolute prohibition for the advertisement of the above products. The sanctions are only administrative. No penal rules. None of the laws or regulations contain specific provisions to trademarks. The present Bulgarian Law on Trademarks and Industrial Designs, as well as the Draft Law of Marks and Geographical Indications do not contain provisions prohibiting the registration of marks in respect of products in relation to which advertising is prohibited or strictly regulated. 2 There are no provisions allowing third parties to intervene in the process of registration of a mark or to ask its cancellation on the basis of the advertising restrictions. Cancellation on the basis of non use of a mark is provided by the Bulgarian law. The advertising restrictions do not affect the real use of the mark on goods for sale, or for example on commercial documents which is explicitly envisaged as use of the mark in the Draft Law on Marks and Geographical Indications. The advertising restrictions do not affect the validity of a mark. There are no specific rules relating to restrictions in regard to indirect advertising and there is no practice with regard to it. The law does not apply different criteria for marks designating products or services subject to advertising restrictions. Résumé En Bulgarie les actes normatifs en matière de mesures restrictives dans le domaine de la publicité sont les suivants: - La Loi sur la Radio et la Télévision (LRTV) La Loi sur la Protection des Consommateurs et les Règles en matière du Commerce (LPC) La Loi sur la Santé Publique (LSP) La Loi sur la Protection des Plantes (LPP) La Loi sur le Tabac (LT) Le Règlement des Conditions et les Règles de l'approbation de la publicité des produits pharmaceutiques (RCRAPPh) La Loi sur la Protection des Consommateurs prévoit une interdiction totale d'une publicité frauduleuse ou incorrecte, mais sans les interpréter d'une manière exhaustive. La Loi sur la Radio et la télévision stipule que la publicité de marchandises et de services dont la production ou le commerce exigent une autorisation spéciale, ne peut être inclure dans les programmes des radio- et télé-operateurs qu'apres l'autorisation respective présentée. Les produits faisant objet des mesures restrictives sont indiqués ci-dessus: 1. Produits pharmaceutiques et soins médicaux La Loi sur la protection des consommateurs interdit la publicité de produits pharmaceutique à moins qu'ils ne sont pas approuvés d'après les règles établies par une loi spéciale. La Loi sur les Produits pharmaceutiques détermine les règles d'enregistrement et d'approbation des produits pharmaceutiques. Le RCRAOOh stipule que l'exercice de la publicité pour les produits pharmaceutiques ne peut être autorisée qu'après l'approbation de son contenu par 3 le Directeur de l'Institut National des Produits Pharmaceutiques. Ce Règlement indique une différenciation entre les messages publicitaires pour les produits pharmaceutiques adresses au grand public et les messages publicitaires adressés aux spécialistes dans le domaine de la médecine. Les messages publicitaires pour des produits pharmaceutiques, adressés au public sont autorisés seulement pour les médicaments qui peuvent être achetés sans prescription médicale. La LRTV interdit la publicité des médicaments et des soins médicaux pour lesquels est exigée une prescription médicale. 2. Produits biologiques et phytopharmaceutiques La LPP interdit la publicité pour les produits ci-dessus à moins qu'ils soient enregistrés pour usage en Bulgarie. 3. Tabac et produits de tabac, tabagisme La LT interdit n'importe quelle publicité pour le tabac et les produits du tabac en dehors des fabriques de leur production et en dehors des endroits de leur vente. La LRTV interdit la publicité des produits de tabac et le tabagisme exercée par la radio et la télévision. La LSP interdit la publicité des produits de tabac par la radio et la télévision, dans des endroits destinés aux enfants, dans les écoles et par des méthodes qui peuvent touchés les mineurs. 4. Alcool La LSP stipule les restrictions suivantes concernant l'alcool. Les messages publicitaires pour les boissons alcoolisés de n'importe quel genre - ne peuvent pas être adressés aux mineurs, ni inclus dans des programmes adressés aux mineurs; ne peuvent pas lier la consommation d'alcool à la conduite de voitures ne peuvent pas présenter la consommation d'alcool restreinte ou modérée sous un jour défavorable. La LRTV évoque les exigences suivantes concernant la publicité des boissons alcoolisées. Les messages publicitaires ne doivent pas faire participer des mineurs ne doivent pas lier la consommation d'alcool aux compétitions sportives ne doivent pas maintenir que les boissons alcoolisées ont une action thérapeutique, stimulante ou tranquillisante, ou bien qu'elles peuvent aider à la solution de problèmes personnels ne doivent pas encourager la consommation excessive d'alcool ne doivent pas suggérer que la haute teneur en alcool contribue à la bonne qualité des boissons alcoolisées. 5. Stupéfiants et substances psychotropes 4 La LRTV interdit absolument la publicité des produits ci-dessus. Elle ne prévoit que des sanctions administratives. Il n'existent pas de sanctions pénales. Aucune des lois ou des règlements ne contient pas de clauses concernant les marques de commerce. La Loi bulgare sur les marques de commerce et les modelés industriel, en vigueur actuellement, de même que le projet de la Loi des Marques et des Indications géographiques ne contiennent pas des clauses qui interdisent l'enregistrement des marques pour des clauses qui interdisent l'enregistrement des marques pour les produits pour lesquels la publicité est prohibitée ou strictement réglementée. Il n'existe non plus de clause autorisant des tiers à intervenir au cours de la procédure d'enregistrement d'une marque ou à solliciter sa révocation à la suite des mesures restrictives en matière de la publicité. La loi bulgare stipule la révocation d'une marque lorsque cette dernière n'est pas exploitée. Toutefois les restrictions en matière publicité n'empêchent pas l'exploitation réelle d'une marque des produits à vendre. Les restrictions en matière de publicité ne doivent pas avoir un effet sur l'exercice de la marque, ou bien sur l'exercice de la marque sur un document de commerce ce qui est prévu comme l'exercice de la marque dans le Projet de la Loi sur les marques et les indications géographiques. Les restrictions en matière de publicité ne doivent pas avoir un effet sur la validité de la marque. Il n'existe pas de règles spécifiques relatives aux restrictions en matière de publicité indirecte, ni des pratiques en la matière. La loi n'exige pas de critères différents pour des marques relatives aux produits ou services faisant objet des mesures restrictives. Zusammenfassung Die Hauptrechtsakten in Bulgarien welche werbebeschränkende Bestimmungen enthalten, sind: - das Gesetz über Radio und Television (RTVG), das Gesetz zum Verbraucherschutz und Reglementieren des Handels (VSRHG), das Gesundheitsgesetz (GG), das Pflanzenschutzgesetz (PSG). das Gesetz über Tabak (TG), Regelungen über die Bedingungen und das Verfahren zur Werbezulassung für pharmazeutische Produkte (RBWPhP). Im VSHRG werden die allgemeinen Bestimmungen über irreführende und unehrliche Werbung festgelegt, wobei diese beide eindeutig als gesetzwidrig erklärt worden sind. 5 Der RTVG bestimmt ausdrücklich, dass die Werbung für Waren und Dienstleistungen, für derer Herstellung bzw. für den Handel damit eine Sondergenehmigung verlangt wird, in Radio- bzw TV-Programme nur nach Vorlage einer diesbezüglichen Sondergenehmigung seitens des Werbers aufgenommen werden darf. Diese Werbebeschränkungen beziehen sich auf folgende Produkte: 1. Pharmazeutische Mittel und medizinische Behandlung GG verbietet die Werbung für pharmazeutische Mittel, welche nicht ordnungsgemäss lt. der in den RBWPhP angegebenen Bestimmungen zum Verbrauch zugelassen worden sind. Die RBWPhP regelt die Eintragungs- und Abnahmebedingungen für pharmazeutische Mittel. Nach den darin enthaltenen Bestimmungen ist die Werbung für pharmazeutische Produkte erst nach erfolgter Abnahme ihrer Zusammensetzungskomponenten durch den Direktor des Nationalinstitutes für pharmazeutische Mittel möglich. Dabei unterscheiden die RBWPhP bei den pharmazeutischen Mitteln zwischen einer Werbung für die Öffentlichkeit und einer Werbung für medizinische Spezialisten. In den Massenmedien ist eine Werbung für pharmazeutische Mittel nur für jene Medikamente möglich, für welche keine ärztliche Verschreibung erforderlich ist. Das RTVG verbietet die Werbung für Medikamente bzw. für medizinische Behandlung, für welche eine ärztliche Verschreibung eine Bedingung ist. 2. Biologische und phytopharmazeutische Produkte Im PSG ist ein Verbot für die Werbung für biologische und pharmazeutische Mittel, die keine ordnungsgemässe Zulassung zur Anwendung im Lande besitzen, vorgesehen. 3. Tabak und Tabakwaren, Rauchen Das TG enthält ein Werbeverbot für Tabak und Tabakwaren ausserhalb der jeweiligen Produktions- bzw. Verkaufsstellen. Laut RTVG ist jede Werbung für Tabak und Tabakwaren sowie für Rauchen in den Rundfunk- und TV-Programmen verboten. Das GG sieht auch einen Verbot für die Werbung für Tabak und Tabakwaren im Radio und TV, in der Nähe von Kinder- und Schulanstalten sowie durch alle möglichen, an die Minderjährigen adressierten Werbemethoden vor. 4. Alkohol Das GG enthält folgende Werbebeschränkungen: Die Werbung für Spirituosen aller Art - kann nicht an die Minderjährigen adressiert werden und in Sendungen für die Minderjährigen aufgenommen werden; 6 - den Verbrauch von Alkohol darf nicht mit der Lenkung von Motorfahrzeugen in irgendwelcher Weise in Verbindung gesetzt werden; die Abstinenz bzw. die Enthaltsamkeit gegen Alkoholverbrauch ist auf keine Art und Weise im ungünstigen Licht zu zeigen. Im RTVG sind nachstehende Werbebeschränkungen für Spirituosen vorgesehen: Die Werbung für Alkoholgetränke darf nicht - - 5. Minderjährige Schauspieler und Teilnehmer beschäftigen; den Verbrauch von Alkohol mit Sportleistungen in Verbindung setzen; Behauptungen zulassen, dass Spirituosen eine therapeutische, stimulierende bzw. beruhigende Wirkung haben oder persönliche Probleme mildern können; behaupten, dass der hohe Alkoholgrad für eine bessere Qualität der Spirituosen beiträgt. Betäubungsmittel und psychotropische Substanzen Das RTVG sieht einen absoluten Werbeverbot für solche Substanzen vor. Die Sanktionen jedoch sind administrativen Charakters, es gibt keine strafrechtliche Vorschriften. Das zur Zeit in Bulgarien geltende Gesetze über Marken und Modelle sowie das neue Gesetzentwurf über Marken und geographische Angaben enthalten keine Sonderbestimmungen, welche die Eintragung von Marken für Waren mit Werbeverbot bzw. mit Sonderwerbereglemente verbieten. Es fehlen gesetzliche Regelungen, welche es Dritten gestatten, ins Markeneintragungssystem zu intervenieren oder die Gültigkeit einer Marke auf der Grundlage von Werbebeschränkungen zu bestreiten. Die bulgarische Gesetzgebung lässt die Löschung einer eingetragenen Marke wegen Nichtbenutzung als Nichtigkeitsgrund zu. Die Werbebeschränkungen haben keine Auswirkung auf die tatsächliche Benutzung der Marken für Handelswaren oder z.B. in Handelspapieren, wie dies ausdrücklich als Benutzung einer Marke im Gesetzentwurf über Marken und geographische Angaben klassifiziert worden ist. Die Werbebeschränkungen haben keine Auswirkung auf die Gültigkeit einer Marke. Es sind keine Sonderbestimmungen in Bezug auf die Werbebeschränkungen für indirekte Werbung und man kann sich auf keine herkömmliche Praxis im Lande berufen. Das Gesetz stellt keine unterschiedlichen Kriterien für Marken fest, die für Waren bzw. Dienstleistungen eingetragen und benutzt werden, für welche Werbebeschränkungen bestehen. 7
