Zoning Amendment Bylaw (No. 3 - Medical Marijuana),2013
The council of The Corporation of the District of North Cowichan, enacts as follows:

Zoning Byløw, No. 2950, is amended by:
(a)
slriking oul subsection 4.1 [agricultureJ of section 12 [DefinitionsJ and
s ubstituting th e follow ing :
"agriculture" means the use of land, buildings and structures
(a) to raise livestock,
(b) to grow, rear, produce, and harvest agricultural products,
(c) to process crops grown on the land,
(d) to store or repair farm equipment used on the land,
(e) to sell agricultural products,
(Ð for aquaculture,
(g) for horticulture,
(h) for mariculture, and
(i) for silviculture,
but does not include the operation of feedlots, fur farms, piggeries, poultry farms,
mushroom farms, or medical marijuana production facilities.,
(b)
adding thefollowing to section 12 [De/ìnitionsJ:

"medical marijuana production facility" means a facility, licensed by the
Federal Government, used solely for the production, manufacturing,
processing, testing, packaging, and shipping of marijuana and marijuana
products for medical purposes,, øzd
inserting "Medical Marijuanø Production Facilities" inlo the permilted uses of
Induslriøl Light (11) zone - section 76 (1), and Industrial Heavy (12) zonesection 77 (1).

Access Regulations - MMAR (June L6, zoor) will
be repealed March 3r't, zor4.
o Current MMAR permits several types of licenses:
Auth orization to possess - amount based on
daily prescription limit - average 10 grams/day
2. Personal use production license - based on
average daily prescription up to 49 plants
permitted per harvest.
3- Designated-person production license permitted to grow for licensed users
4. Licensed dealer - under contract with the
Federal government to sell to licensed users.

Scope of registered party wall agreements
"party wall agreement" means an instrument that contains a grant of one or more
positive covenants in relation to any of the following:
(a) altering, decorating, maintaining, repairing, replacing or taking down the party
wall;
(b) carrying out procedures to ascertain the location of cables, drains, pipês, sewers,
wires or other conduits in or near the party wall and clearing, repairing or replacing
them;
(c) repairing damage as a result of doing anything referred to in paragraph (a) or (b);
(d) carrying out inspections, obtaining professional advice, drawing up plans and
performing other tasks requisite for doing anything referred to in paragraphs (a) to
(c);
(e) allocating between the owners of adjoining parcels the costs and expenses of
doing anything referred to in paragraphs (a) to (d) and requiring the owners to pay
the costs and expenses as allocated;
(f) carrying insurance in respect of a party wall.

Zoning Bylaw to define and allow for facilities for the production of marihuana for medical purposes as a
permitted use in industrial and specific agricultural areas.
Background
On December 16, 2012 Health Canada announced changes to Federal Legislation regarding the
production and distribution of marijuana for medical purposes. The Marihuana for Medical Purposes
Regulations (MMPR) is proposed to become fully implemented by April 1"t,2014. Until such time, the
current Marihuana Medical Access Regulations, June 16th, 2OO1 apply but will be phased out in time for
the new regulations to be adopted. Within the phase out period all authorizations to possess, and
licenses to produce will expire, and all individuals that require marihuana for medical purposes will have
to purchase from licensed producers. The Government will no longer produce and distribute marihuana
for medical purposes which will open the market to private companies which meet strict security
requirements.
Under the current Marihuana Medical Access Regulations, there are four different types of licensed or
authorizations which include:
1.
An "authorization to possess" which allows someone to possess and use marihuana for medical
purposes.
2. A "personal-use
production license" which allows someone to grow medical marihuana for their
personal use.
3. A "designated-person

production license" which allows someone to grow medical marihuana for
others with an "authorization to possess".
A "licensed dealer" which allows a person producing marihuana under contract with the federal
government to sell marijuana to others with an "authorization to possess".
Without access to information regarding individuals who carry any of the above noted licenses there is
no data available as to how many licences exist specifically within the North Cowichan region. lt is
known, however; that within British Columbia there are, as of December 2012,13,362 persons with the
authorization to possess marihuana for medical purposes. During routine inspections carried out by
emergency officials throughout Canada production facilities are discovered and in many cases there
are fire and electrical concerns which raise safety concerns.
The number of plants an individual may be permitted to produce is determined by a formula based on
how much the individual is prescribed to consume on a per-day basis. For example based on a
prescription of 10 grams of marihuana per day, a licensed individual would be able to grow 49 indoor
plants at any one time. This also raises concerns as to air quality and potential for mildew or mould as
soils and plants transpire moisture which without adequate ventilation can lead to other health
concerns.

As there is a lack of Federal resources allocated to the monitoring and inspection of licensed producers
the Federal Government feels there is high potential for abuse. Health Canada has stated in the recent
media release that, "while courts have ordered that there must be reasonable access to marihuana for
medical purposes for patients that are seriously ill, this must be done in a controlled fashion in order to
protect public safety". The proposed regulations are therefore an attempt to "balance the needs of
patients with public health, security and safety concerns and strengthen the safety of Canadian
communities". lt also returns Health Canada to its traditional role as a regulator.
Discussion
ln light of these changes to Federal regulations, the Municipality of North Cowichan should consider
accommodating and clearly defining this use within one of the designations within the Zoning Bylaw.
There are a number of considerations with regards to where to appropriately allow facilities for the
production of marihuana for medical purposes, whilst ensuring public safety and impact concerns are
appropriately considered.
ln regard to zoning, this will immediately raise questions as to whether this land use, which is
essentially a horticultural use with onerous security requirements, is permitted by existing commercial,
industrial or agricultural zoning regulations and, if so, whether the use should continue to be permitted
given the particular land use impacts associated with the production of a federally controlled substance
(which might be different from those associated with the production of other plant-based medical
products like ginseng); and if not, whether and where the use might be suitable ín the Municipality or
rural area in question.
ln order to attain a license from the Federal Government an applicant will have to meet strict policies.
Production sites may only be indoors and not within a private dwelling. Key personnel, directors, and
officers of the facility will have to hold valid security clearance issued by the Minister of Health. Written
notification of the license application must be made to local police, fire departments, and local
governments. ln addition to these strict policies a license holder must provide a description of physical
security measures, keep records of all activities of the facility, and provide quality assurance reports
that show buildings, equipment, and proposed sanitation programs meeting the required "Good
Practices Production" as administered by the Federal Government. There must be physical security for
the entire site as well as restricted access areas which include laboratories, production rooms and
packaging/shipping/receiving areas. The Ministry of Health also retains the right to revoke a license if
there are any reported contraventions, to local officials, by the facility or people involved in its operation.
The above noted requirements clearly illustrate that the proposed use could be appropriate within both
the lndustrial and Agricultural zones and that measures required by the regulations aim to greatly
reduce impacts to public health and safety.
As part of the research on this report staff consulted The Agricultural Land Commission. The ALC in
their response to the District has stated that:
"we do not consider marihuana to be much different, agriculturally speaking, than any other
crop. Provided that the activities assocrafed with the facility fall within the paramefers of what is
permitted under our Act and regulations we have no problem with it within the ALR."
At present, staff are of the opinion that Medical Marihuana Growing Facilities, while not specifically
defined, would be considered a permitted use under the definition of Agriculture in the District's Zoning
Bylaw (2950), which states:

Agriculture - means the use of land, buildings and structures for growing, rearing, producing,
and haruesting agricultural products or raising livestock. Agriculture includes processrng crops
grown on the land, storing and repairing farm equipment used on the land, hotticulture, and the
limited sale of agricultural products produced on or off the land. ln the context of this Bylaw,
"agriculture" also includes aquaculture, mariculture, and silviculture, but excludes the operation
of feedlots, fur farms, piggeries, poultry farms or mushroom farms.
It must be noted that the intent of the some of the excluded uses is to reduce the potential for offensive
odours in the agricultural areas, some of which abut or are adjacent to residential areas. lt will need to
be clearly demonstrated that, where a marihuana production facility operates on an agricultural
property, measures must be taken to mitigate any odours which occur as a result of production.
It is also very important to note that Agriculture is currently a permitted use, not only within all of the
Agriculture zones (A1-45) but also in the R1 and R3 (Residential Districts)zones. Staff would strongly
urge both the Committee and Council to support changes that would limit the existing regulations and
ensure that we do not end up with this type of facility within an existing R3 or R1 residential
neighbourhood, or even within an A3 or A5 area, as the majority of these agriculturally' zoned lands
areas are largely smaller estate residential properties.
Within agricultural areas, staff feel that A1 and M zoned lands would be the most appropriate location
for these types of facilities if in fact we wish to facilitate them in rural lagricultural areas.
lndustrial zones may also be appropriate land use zones for medical Marihuana Production Facilities. ln
most cases they are close to major roads and urban centres where emergency response would be
improved. ln addition, many industrial sites have high visual permeability and, as such, lend themselves
well to video surveillance to monitor vehicular activity. As facilities will require elaborate air filtration
systems and multiple levels of security, including substantial perimeter fencing, and backup power
supply for security reasons which necessitate installation of onsite generators, they may be more
appropriate in the industrial settings rather than in the rural landscape where they could be seen as
intrusive and potentially be a visual impact to rural character.
ln addition, the District has a Development Permit Area (DPA-1) for industrial zoned sites, which
requires a Development Permit to be submitted for new buildings in these areas. This additional step
would add a further layer of control on their use, and potential impact on a community.
lmplications
As sited from Young Anderson Barristers & Solicitors, Client Bulletin, January 16,2013, the case law
on the Controlled Drugs and Suösfances Act has established that individuals who need marihuana for
medical purposes have a right to reasonable access to a legal source of marihuana under the
Canadian Cha¡'ter of Rights and Freedorns, and the proposed changes to the federal regulations are an
attempt on the part of Health Canada to accommodate this right. Municipalities are also subject to the
Cha¡1er, and we have in the past suggested that local zoning regulations that prohibit the growing of
medical marihuana under a personal uses license may be unconstitutional. Whether municipalities are
required to accommodate commercial marihuana production under the proposed new federal scheme
is a different question.
As a general proposition, it is not necessary for a local government to permit every conceivable land
use in its zoning regulations. lf patients with marihuana prescriptions are able to fill the prescription by
registered mail or bonded courier, or by dealing with a licenced producer/supplier in a neighbouring
municipality, they might be considered to have reasonable access to the drug such that a local
prohibition of this use would not be contravention of the Charter.

Options
Without amending the current definition of agriculture, it is unlikely that the Municipality will have the
ability to prohibit production facilities within all agricultural zones as well as a number of existing
residential zones, as the current definition of agriculture makes prohibition difficult to legally defend.
Council may also consider whether or not to include Medical Marihuana Production Facilities within
some or all of the Agricultural, lndustrial and Commercial zones. To do so will require a concise
definition of Medical Marihuana Production Facility, which would then be included as a permitted use in
each of the specific zones in which we wish to facilitate that use.
Staff support the creation of a bylaw that would amend the Zoning Bylaw to specifically define Medical
Marihuana Production Facilities and amend the definition of Agriculture. Further, staff also support the
inclusion of Medical Marihuana Production Facility as a permitted use in the A1 and A2 agricultural
zones as well as in the l1 and 12 industrial zones. Staff do not support allowing Medical Marihuana
Production Facilities as a permitted use in any commercial or residential zones.
Recommendation
That the Community Planning Advisory Committee support the following proposed amendments to the
Zoning Bylaw (2950):
1. Create a new definition for Medical Marihuana Production Facilities;
2. Amend the existing definition of Agriculture to specifically exclude Medical Marihuana Production
Facility in order to prohibit Medical Marihuana Production Facilities within rural residential zones
where agriculture is currently a permitted use; and
3. Add Medical Marihuana Production Facilities as a permitted use in the:
a. 11 - Light lndustrial zone
b. 12- Heavy lndustrialzone
c. A1 - Agricultural Zone

Medical Maríhuana Production Facilities
Purpose
To present to Council a number of proposed amendments to the Zoning Bylaw to define and allow for
facilities for the production of marihuana for medical purposes as a permitted use in industrial areas.
Background
On December 16, 2012 Health Canada announced changes to Federal Legislation regarding the
production and distribution of marijuana for medical purposes. The Marihuana for Medical Purposes
Regulations (MMPR) is proposed to become fully implemented by April 1,2014. Until such time, the
current Marihuana Medical Access Regulations, June 16,2001 apply, but will be phased out in time for
the new regulations to be adopted. Within the phase out period all authorizations to possess, and
licenses to produce will expíre, and all individuals that require marihuana for medical purposes will have
to purchase from licensed producers. The Government will no longer produce and distribute marihuana
for medical purposes which will open the market to private companies which meet certain requirements
including strict security conditions.
Under the current Marihuana Medical Access Regulations, there are four different types of licensed or
Authorizations, which include:
1. An "authorization to possess" which allows someone to possess and use marihuana for medical
purposes.
2. A "personal-use production license" which allows someone to grow medical marihuana for their
personal use.
3. A "designated-person production lícense" which allows someone to grow medical marihuana for
others with an "authorization to possess".
4. A "licensed dealer" which allows a person producing marihuana under contract with the federal
government to sell marijuana to others with an "authorization to possess".
Without access to information regarding individuals who carry any of the above noted licenses there is
no data available as to how many licences exist specifically within the North Cowichan region. lt is
known, however; that within British Columbia there are, as of December 2012, 13,362 persons with the
authorization to possess marihuana for medical purposes. During routine inspections carried out by
emergency officials throughout Canada production facilities are discovered and in many cases there
are fire and electrical concerns which raise safety concerns.
The number of plants an individual may be permitted to produce is determined by a formula based on
how much the individual is prescribed to consume on a per-day basis. For example based on a
prescription of 10 grams of marihuana per day, a licensed individual would be able to grow 49 indoor
plants at any one time. This also raises concerns such as air quality and potential for mildew or mould

as soils and plants transpire moisture which without adequate ventilation can lead to other health
concerns.
As there is a lack of Federal resources allocated to the monitoring and ínspection of licensed producers
the Federal Government feels there is high potential for abuse. Health Canada has stated in the recent
media release lhat, "while courfs have ordered that there must be reasonable access to marihuana for
medical purposes for patients that are seriously ill, this must be done in a controlled fashion in order to
protect public safety". The proposed regulations are therefore an attempt lo "balance the needs of
patients with public health, security and safety concerns and strengthen the safety of Canadian
communities". lt also returns Health Canada to its traditional role as a regulator.
Discussion
ln light of these changes to Federal regulations, the Municipality of North Cowichan should consider
whether it wishes to accommodate this use within the Municipality. There arc a number of
considerations with regards to where to appropriately allow or disallow facilities for the production of
marihuana for medical purposes, whilst ensuring public safety and impact concerns are appropriately
considered. ln regard to zoning, this will immediately raise questions as to whether this land use, which
is essentially a horticultural / production use with onerous security requirements, is permitted by
existing commercial, industrial or agricultural zoning regulations and, if so, whether the use should
continue to be permitted given the particular land use impacts associated with the production of a
federally controlled substance (which might be different from those associated with the production of
other plant-based medical products like ginseng); and if not, whether and where the use might be
suitable in the Municipality or rural area in question.
ln order to do properly address the above-noted issues, we must first determine whether or not we wish
to support the use or not. Regardless of the decision to support it or not support it will be important to
amend the Zoning Bylaw to introduce a new and very specific definition for "Medical Marihuana
Production Facility" and to amend the definition of "Agriculture". lf we do not wish to accommodate the
use it would be defined and specifically prohibited. lf we wish to accommodate the use it must be
defined and then we must specifically identify which areas we wish to permit these facilities to be
located within by adding the use as a "Permitted Use" to one or more zones.
ln order to attain a license from the Federal Government an applicant will have to meet strict policies.
Production sites may only be indoors and not within a private dwelling. Key personnel, directors, and
officers of the facility will have to hold valid security clearance issued by the Minister of Health. Written
notification of the license application must be made to local police, fire departments, and local
governments. ln addition to these strict policies a license holder must provide a description of physical
security measures, keep records of all activities of the facility, and provide quality assurance reports
that show buildings, equipment, and proposed sanitation programs meeting the required "Good
Practices Production" as administered by the Federal Government, There must be physical security for
the entire site as well as restricted access areas which include laboratories, production rooms and
packaging/shipping/receiving areas. The Ministry of Health also retains the right to revoke a license if
there are any reported contraventions, to local officials, by the facility or people involved in its operation.
The above noted requirements and discussion suggest that the proposed use could be appropriate
within either the lndustrial and/or the Agricultural zones and that measures required by the regulations
aim to greatly reduce impacts to public health and safety.
As part of the research on this report, staff also consulted the Agricultural Land Commission to discuss
this issue in relation to ALR and agricultural lands. The ALC in their response to the District has stated
that:

"we do not consider marihuana to be much different, agriculturally speaking, than any other
crop. Provided that the activities assocrafed with the facility fall within the parameters of what is
permitted under our Act and regulations we have no problem with it within the ALR."
At present, staff are of the opinion that Medical Marihuana Growing Facilities, while not specifically
defined, would be considered a permitted use under the definition of Agriculture in the District's Zoning
Bylaw (2950), which states:
Agriculture - means the use of land, buildings and structures for growing, rearing, producing,
and harvesting agricultural products or raising livestock. Agriculture includes processing crops
grown on the land, storing and repairing farm equipment used on the land, horticulture, and the
limited sale of agricultural products produced on or off the land. ln the context of this Bylaw,
"agriculture" also includes aquaculture, mariculture, and silviculture, but excludes the operation
of feedlots, fur farms, piggeries, poultry farms or mushroom farms.
It is important to note that Agriculture is currently a permitted use, not only within all of the Agriculture
zones (41-45) but also in the Rl and R3 (Residential Districts) zones.
Having reviewed the background information and relevant comments from other Municipalities and
referral agencies staff believe that the industrial zones (11 and 12) are the most appropriate zones for
inclusion of Medical Marihuana Production Facilities as a Permitted Use. ln most cases they are close

Also of note, when Staff prepared the report and presented these proposed amendments to the Zoning
Bylaw to the Community Planning Advisory Committee (CPAC) at their meeting held March 11,2013, it
did so with a position and recommendation that Medical Marihuana Production Facilities could be
permitted within select agricultural zones (A1 and A2) as well as the l1 and 12 zones. CPAC supported
the proposed changes and recommended that Council amend the Zoning Bylaw to do the following:
1. Create a new definition for Medical Marihuana Production Facilities;
2. Amend the existing definition of Agriculture to specifically exclude Medical Marihuana
Production Facilities in order to prohibit this type of facility within rural residential zones where
agriculture is currently a permitted use; and
3. Add Medical Marihuana Production Facilities as a permitted use in the following zones:
a. lndustrial Light Zone (11),
b. lndustrial Heavy Zone (12),
c. AgriculturalZone (41), and
d. Rural Zone (A2).
Following the March 11,2013 CPAC meeting, Staff were able to meet with and further discuss the
proposed amendments with the local RCMP detachment, whom identified several concerns regarding
production facilities located specifically within the agricultural zones. The Municipality covers a very
large area and many agricultural properties are in remote locations which are difficult to monitor from a
public safety perspective, which therefore potentially increases the risk of illegal activity. By permitting
production facilities only within the industrial zones there is a much higher level of natural surveillance
as well as the ability to require a Development Permit for the construction of the facility,
Following the meeting with the RCMP, staff have reconsidered their position and have amended the
staff recommendation to eliminate support for these facilities on A1 and A2 zoned properties and would
recommend that Council consider only authorizing this use on 12 and 12 zoned properties.
Options
Without specifically defining Medical Marihuana Production Facility and amending the current definition
of Agriculture, it is unlikely that the Municipality will have the ability to prohibit production facilities within
all agricultural zones as well as a number of existing residential zones, as the current definition of
agriculture makes prohibition difficult to legally defend.
At this time Council has the following options:
1.
lf Council wishes to allow for this use in industrial areas they should provide first and second
reading to the attached bylaw, which would (if ultimately adopted):
a. Define Medical Marihuana Production Facility;
b. Amend the definition of Agriculture (to specifically exclude it from that definition); and,
c. Amend the existing l1 and 12 zones to add Medical Marihuana Production Facility as a
Permitted Use in those zones.
2. lf Council wishes to specifically
prohibit this use from occurring anywhere in the Municipality,
they should direct staff to amend the bylaw to:
a. Define Medical Marihuana Production Facility; and,
b. Amend the definition of Agriculture (to specifically exclude it from that definition);
3.
Refer this item back to CPAC for further discussion in light of the comments from the RCMP.

Amend the bylaw prior to first and second reading in order to either increase or decrease the
number of zones in which this use would be permitted.
Based on the above background and discussion, which includes comments from the RCMP, staff are in
support of Option #1 above which would specifically define this use and allow for it as a Permitted Use
only in the l1 and 12 zones.
lf Council provides fírst and second reading to the bylaw, a Public Hearing will be scheduled, at which
time the general public will have an opportunity to provide comments on the proposed bylaw prior to
consideration of adoption of the bylaw by Council.

ABcann is an Ontario corporation whose intent is to become an industry leading partner
through working with Health Canada and other federal, provincial and local
governments, educational institutions and law enforcement agencies, in the safe and
secure delivery of medical marihuana to approved users. The core strategy will be in
building scalable (an initial 35,000 sq, fr-) greenhouse facllities în western and eastern
Canada, conforming to Good Production Practices, Food and Drug Act, Certrfied
Organíc standards as well as accommodatíng the market needs. ABcann will be a
professionally managed
and licensed company ensuring quafity and reliability in
growîng, processing and distributing of medical-grade cannabis.
ABcann will folfow the "Directive on Physical Security Requirements for Controlled
Substances" for the production, storage and handling of a controlfed substance
scheduled under the 'The Controlled Drug and Substance Act". A8cann's Security
Officer, is a former RCMP officer with training in both Federal Drug Enforcement and
Organized Crime Enforcement. ABcann wifl be exceeding the requirements with the
implementation of a company policy providing 24 hour securiÇ guards on site. We feel
the safety of the community and our staff is paramount in the implementation of this
project.
ABcann has successfully obtained Municipal.approval in Ontario in the Town of Greater
Napanee, and the Townships of Loyalist and Stone Mills. ABcann has identifìed and
chosen Eastern Ontario locations for our first research and production facility. Town of
Greater Napanee located in Lennox and Addington County, during a Council meeting in
December 2A12, approved our proposal for a large scale production facility. We have
selected this area because of its proximity to Ottawa and Health Canada, As we hope
to be one of the fìrst large scale production faoilitìes in Canada! we are centered in the
largest population base in Canada. ABcann has chosen a Western Canada location in
the Rural Municipality Big Guill, Saskatchewan. On July 6th, 2012 they approved our

and outtake air handling systems will be fittered. The¡e will be no odors emitted from the
building. Vüater will be supplied from drilled wells for the potable and growing
requirements. To limit water consumption for growing, we will be using rainwater
collections systems from the roof and recycling the water from wîthin the plant.

farm. He operates one of the largest organic hemp farms in Canada. His unique
background in medicine and organic farming make him a vital member of our

ln the past, methods used to produce high quality Medical Cannabis were non-existent.
We are excited to announce ABcann has and is developing relationships with lndustry
Leaders of Formulation and Manufacturing of Natural Health Products in producing high
quality and safe Medical Gannabis products. The Napanee production facility is well
positioned near educational institutions such as Loyalist College, University of Guetph

of the Marijuana for Medical Furposes Regulation (Mñ1PR)to regulate the commercial pro-duction of
