CONDIZIONI GENERALI DI VENDITA Le presenti condizioni generali, che annullano le precedenti, sono applicabili a tutte le ordinazioni pervenuteci dopo la data di emissione del presente listino, sono soggette a cambiamento senza alcun preavviso e s’intendono integralmente accettate con il conferimento dell’ordine. 1. Prezzi: i prodotti saranno fatturati ai prezzi in vigore alla data di consegna; i prezzi del presente listino s’intendono IVA ESCLUSA. 2. Ordini: tutti gli ordini acquisiti dal ns. Funzionario o Agente sono validi solo dopo ns. conferma o fattura. 3. Termini di consegna: pronta salvo il venduto. È facoltà del venditore evadere l’ordine in più riprese senza che ciò dia diritto all’annullamento dell’ordine o parte di esso. 4. Resa: la merce è venduta franco nostro magazzino di Rosolini (SR), Italia, salvo accordi contrari. 5. Spedizioni: nei casi in cui il mezzo di spedizione non sia esplicitamente indicato dal committente, la spedizione sarà effettuata nel modo ritenuto più idoneo dal venditore. La merce viaggia a rischio e pericolo del committente, anche se spedita in porto franco. L’assicurazione viene coperta solo su richiesta ed è a carico del committente. Per le eventuali spedizioni in porto franco la scelta del modo di spedizione è a carico del venditore. 6. Imballo: normale, gratis. Imballi particolari se richiesti saranno addebitati al costo. 7. Arrotondamenti: gli ordini vengono arrotondati in eccesso, in conformità agli imballi minimi riportati sul presente listino. GENERAL SALES CONDITIONS The present sale conditions update the previous ones and are applicable to every order received after the publication of the present price list. HYDRO TECH Ltd may change them without notice and they would be considered as fully accepted as the order is confirmed. 1. Prices: products are invoiced at the prices in effect at the time of delivery; prices of the present price list are intended EXCLUSIVE OF VAT. 2. Orders: all purchases from our officials or agents are valid only after our confirmation or invoice. 3. Terms of delivery: just in time delivery system unless some of the products are not available in our warehouse. The seller may process the order at various times and the Buyer will have no right of cancellation of part or the entire order. 4. Delivery: the goods are sold EX-Works Rosolini (SR) unless otherwise agreed. 5. Shipments: unless a particular means of transport is required we retain the right to execute the shipment with a means of transport of our choice. All goods travel at Buyer’s risk even if they are shipped free port. Insurance is covered on request only and the Buyer pays for them. HYDRO TECH chooses the means of transport in case of free port shipments. 6. Packaging: normal, free. If the Buyer requires special packaging, cost will be invoiced. 7. Rounding: order sizes are rounded up in conformity with the minimum packaging size reported in price list. 8. Garanzia: il nostro materiale s’intende garantito per i guasti dovuti a difetti di fabbricazione a noi imputabili. La garanzia scade qualora: I. Il materiale sia stato usato al di fuori delle condizioni d’esercizio da noi indicate; II. Il materiale sia stato comunque modificato o manipolato; La nostra garanzia si limita alla sostituzione dei prodotti difettosi o alla loro riparazione nella nostra sede, con la completa esclusione di qualsiasi altra responsabilità ed in particolare, con l’esclusione di indennizzi o riconoscimento di danni comunque causati dall’uso dei nostri prodotti. 10. Assistenza tecnica: se richiesto l’intervento del nostro tecnico sul campo, verrà addebitato in ragione di euro 233,00 al giorno più le spese di viaggio e soggiorno al costo. 9. 11. Pagamenti: sui ritardati pagamenti verrà applicato un interesse di mora pari a 4 punti superiore al tasso ufficiale di sconto. 12. Resi: il materiale in restituzione viene accettato solo se preventivamente concordato; il materiale restituito dopo 30 giorni dalla consegna viene riaccreditato con una detrazione del 15% sul prezzo fatturato quale costo di controllo, magazzinaggio, altro. 13. Foro: per ogni controversia comunque discendente dai rapporti contrattuali con la HYDRO TECH SRL unico Foro competente in via esclusiva è quello di Siracusa. N.B. – Le informazioni e le caratteristiche dei prodotti indicati sul presente listino possono essere variate senza preavviso. 8. Forwarding agent: after 8 days from delivery notice, HYDRO TECH Ltd reserves the right to organise the shipment of the goods at the Buyer’s expenses. 9. Guarantee: HYDRO TECH Ltd guarantees its products for 1 year from the date of delivery or shipment. The guarantee shall cease to have effect after 1 year from delivery if the Buyer uses the goods for purposes other then those foreseen or effect changes or have repair works done by people non-authorised by the manufacturer. Our guarantee limits to the supply and free substitution of defective parts due to acknowledged manufacturer defects and does not cover defects resulting from normal wear and tear, accidental causes, damages due to transport. 10. Technical assistance: if required, if the invention on-site by our technician will be charged for a sum of € 233,00 per days plus transfer and overnight stay expenses if needed. 11. Payments: a delay interest equal to 4 points higher than the official discount rate will be applied to the sum in case payments are delayed. 12. Restitutions: returned goods are accepted only if previously agreed; goods which are returned after 30 days from delivery will be credited again with a detraction of 15% on the invoiced price as a control cost, storing, other. 13. Court having jurisdiction: all legal dispute following on contractual provisions with the HYDRO TECH Ltd the sole court having jurisdiction will be the Court of Siracuse. N.B. information and features of the indicated products on the present price list can be varied without notice. CONDITIONS GENERALES DE VENTE Les conditions générales présentes, qui annulent et remplacent les précédentes, sont applicables à toute commande nous parvenant après la date d’émission du barème de vente actuel; elles sont modifiables à tout moment sans aucun préavis et sont considérées intégralement acceptées par la passation de commande. 1. Prix: les produits seront facturés aux prix en vigueur à la date de livraison; les prix s’entendent HORS TVA. 2. Commandes: toutes les commandes traitées par nos Fonctionnaires ou Agents sont valides seulement après confirmation ou facture de notre part. 3. Délais de livraison: selon les stocks disponibles. Le vendeur peut décider d’échelonner l’expédition de la commande sans que cela donne droit à l’annulation d’une partie ou de la totalité de la commande. 4. Livraison: la marchandise est vendue EX-Works Rosolini (SR), Italie, sauf accords contraires. 5. Expéditions: lorsque le mode d’expédition n’est pas explicitement indiqué par le client, l’expédition a lieu selon le mode que nous jugeons le plus approprié. Pendant l’expédition la marchandise voyage aux risques et périls de l’acheteur, même si elle est expédiée franco de port. La marchandise est assurée seulement sur demande et aux frais de l’acheteur. En cas d’expédition franco de port, le choix du mode d’expédition revient au vendeur. 6. Emballage: normal, gratuit. Si requis, les emballages particuliers sont aux frais de l’acheteur. 7. Arrondis: les quantités commandes sont sur arrondies par rapport aux emballages standards reportés sur le présent barème des prix. 8.
