seekingclarification of my responsedated 16 April 2013.
We are still researching some of the matters raised in your letters brit rvould like
to update you based on the information currently avnilable. I will provide a
further update when we completeour review.
As to the notes of investigator Andrd Delvnux, Trial Chamber II's oral decisionof
30 September2009t decidedthat they necd not be disclosed. You chosenot to
appealthis decision,which therefnrebecarnefinal. Notwithstanding this legal
situation, we have searchedour databasesfor any relevant notes which
investigator Andr6 Delvaux may have taken. Although, we could not find any
such notes to date, we continue to search. Should we find any relevant notes of
investigator Andrd Delvaux, we will determine rvhether they should be clisclosed.
With respect to the testimonies of Casirnir Bizimungu and Prosper Mugiraneza in
the caseof the The Proseattor u. Bisintu,ngtt,et aI. (ICTR-99-50-T), I will provido
you - as a courtesy only and not out of legal obligation - with the open session
transcripts of these testimeinieson CD'Rom, which are otherwise publicly
availableonline.2 Providing this materinl to you doesnot imply a concessionthat
it actually firlis under MICT Rule 73.
We do not deem the closedsessiontestimony of Prospcr Mugiraneza of 20 May
2008 to be potentially exculpatory in the senseof MICT Rule 73. Thereforc, in
compliancewith the protective mcasuresin place for this witness, the Prosecution
cannot discloseit.i]
We are also in the processof identifuing and analyzing the exhibits tcndered
during the testirnoniesof Casimir Bizimungu and Prospcr Mugiraneza as wcll as
