1. MANIFESTO DELL’AVVOCATURA (*)
Oggi 5 giugno 2015, gli Avvocati riuniti in Milano, in occasione del Convegno ‘‘Tutela della vita e della salute e lotta alle frodi’’, promosso con tutti gli
Ordini Forensi nell’ambito delle Manifestazioni per EXPO, e con richiamo alla CARTA DI MILANO che è stata presentata e sottoposta all’attenzione e alla firma di tutti i cittadini del mondo, nell’intendimento di condividere lo spirito e i principi indicati nella CARTA,
RICHIAMATA
– la responsabilità che l’Avvocatura si è storicamente e tradizionalmente assunta, e tuttora si assume, al fine di contribuire all’avanzamento sociale, in
particolare nei confronti delle generazioni future, nel ruolo di tutela e promozione dei diritti nella società civile;
– la necessità di concorrere, nell’ambito delle proprie attività istituzionali, a
superare le attuali problematiche globali per ridurre le disuguaglianze e gli
squilibri, combattere le contraffazioni e le frodi, riequilibrare l’accesso alle risorse e ridurre gli sprechi e le offese al territorio e al suolo;
– l’osservanza dei principi e valori del proprio codice etico e la funzione sociale svolta;
DICHIARANO
– di condividere i principi enunciati nella CARTA DI MILANO e l’affermazione che il diritto alla nutrizione e al cibo è anche il diritto alla dignità e
libertà delle persone e alla tutela della salute, e quindi un diritto umano fondamentale, che pure richiama altri doveri generali a difesa del territorio e dell’ambiente, la distribuzione delle risorse, la sicurezza e il progresso sostenibile;
– di operare a tal fine per bandire le disuguaglianze e le violenze, per com(*) Come abbiamo precisato nella parte II, il Consiglio dell’Ordine degli Avvocati di Milano si è fatto
partecipe degli impegni assunti nella Carta di Milano, proponendo a propria volta un Manifesto dell’Avvocatura, che è stato approvato con la condivisione del Consiglio nazionale e degli altri Ordini forensi
nel corso del convegno indetto il 5 giugno 2015 nell’aula magna del Palazzo di giustizia.
Questa è dunque l’eredità morale di EXPO 2015, una Carta e un Manifesto, per ricordare senza enfasi l’universalità della giustizia e le responsabilità del mondo.
Il Manifesto dell’Avvocatura è stato sottoscritto anche dal Presidente dell’Ordine degli Avvocati di Parigi in occasione della cerimonia d’inaugurazione dell’anno giudiziario che si è tenuta nella capitale francese il 10 dicembre 2015, alla quale è intervenuto il Consigliere dell’Ordine di Milano, Avv. Pietro Traini.

battere le contraffazioni e le frodi, per riconoscere i valori e gli ideali, per rispettare la legge, l’etica e il diritto degli altri;
E SI IMPEGNANO
in ogni sede, nazionale, europea e internazionale,
– a sostenere e dare effettivo riconoscimento a tali fondamentali diritti e a
difenderli in ogni circostanza, rappresentando anche o contribuendo a rappresentare le istanze della società civile nei dibattiti e nei processi di formazione
delle politiche pubbliche;
– a raccogliere le istanze dei cittadini, interloquendo con le istituzioni per
realizzare le legittime domande proposte e per contrastare le sempre ripetute
violazioni, contraffazioni e frodi;
– a incidere sulle cause che portano alla violazione dei diritti, promuovendo
l’educazione alla legalità e coinvolgendo i saperi e i valori di tutte le professioni;
– a tradurre in azioni concrete, in diritti spendibili, in affermazioni di responsabilità i principi fondamentali che toccano la vita, la salute e la dignità
delle persone.

Aujourd’hui 5 juin 2015, les avocats qui participent à la conférence de Milan intitulée ‘‘Protection de la vie et de la santé et lutte aux fraudes’’, parrainée
par toutes les associations d’avocats qui ont pris part aux événements d’Expo,
faisant aussi appel à la Charte de Milan qui a été présentée et soumise à l’attention et à la signature de tous les citoyens du monde, dans l’intention de
partager l’esprit et les principes énoncés dans la Charte

EN RAISON DE
– la responsabilité que le Barreau a historiquement et traditionnellement assumé et prends en charge encore aujourd’hui, afin de contribuer à l’avancement de la vie sociale, en particulier envers les générations futures, avec le but
de protéger et promouvoir les droits de la société civile;
– la nécessité de contribuer, au sein de leurs activités institutionnelles, afin
de surmonter les défis mondiaux actuels visant à réduire les inégalités et les déséquilibres, combattre la contrefaçon et la fraude, équilibrer l’accès aux ressources et réduire les déchets, ainsi que les infractions contre le territoire et le
sol;
– la considération des principes et des valeurs du code de l’éthique et de la
fonction sociale;
DECLARENT
– de partager les principes de la CHARTE DE MILAN ainsi que la conviction que le droit à l’alimentation et à la nutrition est aussi un droit à la dignité et à la liberté des individus et à la protection de la santé, et donc droit humain fondamental, qui implique également d’autres fonctions générales pour
protéger le territoire et l’environnement, la répartition des ressources, la sécurité et le progrès durable;
– de s’engager afin d’interdire l’inégalité et la violence, combattre la contrefaçon et la fraude, pour reconnaı̂tre les valeurs et les idéaux, faire appliquer la
loi, l’éthique et les droits d’autrui;
ET S’ENGAGENT
a tout niveau national, européen et international,
– même représentant, ou aidant à représenter les instances de la société civile dans les débats et dans les processus de formation des politiques publiques;
– à accueillir les instances des citoyens en faisant pression sur les institutions afin qu’elles prennent conscience des réclamations légitimes faites pour
lutter contre les violations répétées, la contrefaçon et la fraude;
– à intervenir sur les causes profondes qui mènent à la violation des droits,
tout en soutenant des programmes d’éducation à la légalité ainsi que les connaissances et les valeurs de toutes les professions;
– à traduire en actions concrètes, en droits utilisables et concrets, en actions
de responsabilité, les principes fondamentaux qui ont à faire avec la vie, la santé et la dignité des gens.

Manifesto of the Legal Profession
Today, June 5th 2015, lawyers gathered in Milan to attend the Convention
titled ‘‘Life and health safeguard and fight against fraud’’ jointly promoted by
all the Italian Bar Associations within the framework of the Milan EXPO, making reference to the principles of the ‘‘CARTA DI MILANO’’ (THE MILAN CHARTER), a document presented and submitted to the attention of
all citizens of the world for them to sign, with the aim to share and spread
the spirit and values of the Charter,
RECALLING
– the responsibility traditionally and historically assumed by the legal profession, especially towards the future generations, with the aim to contribute
to social progress, in their role as guardians and promoters of rights in civil society;
– the need to contribute, as part of their institutional activities, to the solution of today’s global problems with a view to reducing inequality and disparity, fighting fraud and forgeries, rebalancing access to resources, and reducing
waste and damage to the territory and to the soil;
– the compliance with the principles and values of their code of ethics, as
well as the social function they perform;
DECLARE
– to agree with the principles stated in THE MILAN CHARTER and with
the statement therein contained that the right to nutrition and food is also
the right to dignity, to personal freedom and to health protection, and therefore a fundamental human right which also entails other general duties for the
protection of the environment and of the territory, the distribution of resources, the promotion of safety and the achievement of sustainable progress;
– to operate with these ends in mind, in order to ban disparities and violence, to fight fraud and forgeries, to foster the full recognition of values and
ideals, and the respect of the law, ethics and the rights of others;
AND THEY UNDERTAKE
in all Domestic, European and International contexts
– to support and effectively recognize these fundamental rights and to always defend them, representing, solely or jointly with other actors, the requests of civil society in all the debates and public policy decision processes;
– to act as advocates of citizens’ requests, interfacing with institutions in or126

der to meet citizens’ legitimate demands for legal protection, and to oppose
ever repeated violations, frauds and forgeries;
– to effectively address the causes that lead to the violation of rights by promoting the education to legality and relying on the knowhow and values of
all professions;
– to translate into tangible actions, exercisable rights and responsibility statements the fundamental values that have an impact on life, health and people’s dignity.
