Partant du point où la limite séparant les comtés de Westmorland et de Kent intersecte la limite séparant les paroisses de Moncton et de Shediac; de là, en direction sud-est, le long de la limite séparant les paroisses de Moncton et de Shediac jusqu’à un point situé sur la limite ouest du lot portant le NID 70202213; de là, en direction sud, le long de la limite ouest dudit lot et de son prolongement jusqu’à un point situé sur la limite nord du lot portant le NID 1057678; de là, en direction ouest, le long de la limite nord dudit lot jusqu’à son angle nord-ouest; de là, en direction sud, le long de limite ouest dudit lot portant le NID 1057678 jusqu’à un point situé sur la limite nord du lot portant le NID 70309836; de là, en direction est, le long de la limite nord dudit lot jusqu’à son angle nord-est; de là, en direction sud, le long de la limite est du lot portant le NID 70309836, traversant les terrains des Chemins de fer du Canadien national, jusqu’à un point situé sur la limite de l’emprise nord-est de la route transcanadienne (Route 2), ladite route transcanadienne (Route 2) étant la même que celle mentionnée au paragraphe 3(2) de l’Arrêté du district d’aménagement du Grand Moncton Loi sur l’urbanisme; de là, en direction sud-est, suivant les divers tracés de ladite limite de l’emprise jusqu’à l’angle sud-est du lot portant le NID 926030, ledit angle étant aussi sur la limite de l’emprise nord de la Route 132; de là, en direction sud, suivant une ligne droite, traversant la Route 132, jusqu’à l’angle nord-est du lot portant le NID 927855; de là, en direction sud-ouest, le long des limites nord, ouest et sud dudit lot, ladite limite nord dudit lot comprenant la limite nord du lot portant le NID 927251, jusqu’à un point situé sur la limite de l’emprise nord-est de ladite route transcanadienne (Route 2), ledit point étant aussi l’angle sud-est dudit lot; de là, en direction sud, le long de ladite limite de l’emprise jusqu’à un point situé sur la limite séparant les paroisses de Moncton et de Dorchester; de là, en direction sud-ouest, le long de la limite séparant les paroisses de Moncton et de Dorchester, traversant ladite route transcanadienne (Route 2), jusqu’à l’angle le plus au nord du village de Memramcook; de là, en direction sud-ouest, le long de la limite nord du village de Memramcook, jusqu’à un point situé sur la limite séparant le village de Memramcook et la cité de Dieppe; de là, en direction sud-est et sud-ouest, suivant les divers tracés de ladite limite séparant le village de Memramcook et la cité de Dieppe, jusqu’à un point situé sur la limite séparant les comtés d’Albert et de Westmorland, ladite limite séparant les comtés étant le point médian de la rivière Petitcodiac; de là, en direction sud-est, le long de ladite limite séparant les comtés jusqu’au prolongement est de la limite nord du village de Hillsborough; de là, en direction ouest, le long dudit prolongement est de la limite nord et de la limite nord du village de Hillsborough jusqu’à la limite ouest dudit village; de là, en direction sud, le long de ladite limite ouest du village de Hillsborough jusqu’à la PART A TITLE AND AREA DESIGNATION 1 This Regulation may be cited as the Greater Moncton Planning Area Rural Plan Regulation - Community Planning Act. 2 The area of land within the counties of Albert and Westmorland, as shown on the attached Schedule A and described as follows, is designated for the purposes of the adoption of a rural plan and is the area to which this Regulation applies: Beginning at the point where the boundary between the counties of Westmorland and Kent meets the boundary between the parishes of Moncton and Shediac; thence southeasterly along the boundary between the parishes of Moncton and Shediac to a point on the western boundary of the lot with PID 70202213; thence southerly along the western boundary of the said lot and its prolongation to a point on the northern boundary of the lot with PID 1057678; thence westerly along the northern boundary of the said lot to its northwestern corner; thence southerly along the western boundary of the said lot with PID 1057678 to a point on the northern boundary of the lot with PID 70309836; thence easterly along the northern boundary of the said lot to its northeastern corner; thence southerly along the eastern boundary of the lot with PID 70309836, crossing the lands of Canadian National Railways, to a point on the northeastern right-of-way limit of the Trans-Canada Highway (Route 2), the said Trans Canada Highway (Route 2) being the same as referred to within subsection 3(2) of Greater Moncton Planning District Order - Community Planning Act; thence southeasterly along the various courses of the said right-of-way limit to the southeastern corner of the lot with PID 926030, said corner being also on the northern right-of-way limit of Route 132; thence southerly along a straight line, crossing Route 132, to the northeastern corner of the lot with PID 927855; thence southwesterly along the northern, western, and southern boundary of the said lot, the northern boundary of the said lot to include the northern boundary of the lot with PID 927251, to a point on the northeastern right-of-way limit of the said Trans-Canada Highway (Route 2), said point being also the southeastern corner of the said lot; thence southerly along the said right-of-way limit to a point on the boundary between the parishes of Moncton and Dorchester; thence southwesterly along the boundary between the parishes of Moncton and Dorchester, crossing the said Trans Canada Highway (Route 2), to the most northerly corner of the village of Memramcook; thence southwesterly along the northern boundary of the village of Memramcook to a point on the boundary between the village of Memramcook and the city of Dieppe; thence southeasterly and southwesterly along the various courses of the said boundary between the village of Memramcook and the city of Dieppe to a point on the boundary between the counties of Albert and Westmorland, said county line being the mid-point of Petitcodiac River; thence southeasterly along the said county line to the eastern prolongation of the northern boundary of the village of Hillsborough; thence westerly along the said eastern prolongation of the northern boundary and the northern boundary of the village of Hillsborough to the western boundary of the said village; thence southerly along the said western boundary of the village of Hillsborough to the western limit of the New Brunswick Electric Power Commission line The Royal Gazette — January 26, 2005 0067 right-of-way; thence southerly along the said right-of-way limit to the point of intersection with the boundary between the parishes of Hillsborough and Hopewell; thence westerly along the boundary between the parishes of Hillsborough and Hopewell to the boundary between the parishes of Hillsborough and Elgin; thence northwesterly along the boundary between the parishes of Hillsborough and Elgin to a point on the southern limit of lands known as Protected Areas - Turtle Creek Watershed – Moncton, more particularly depicted by Schedule A-11 of the Watershed Protected Area Designation Order - Clean Water Act; thence southwesterly and northwesterly along the various courses of the said southern limit to a point on the line maintaining a southerly offset distance of 152.4 metres from the southern right-ofway limit of Prosser Brook Road; thence running westerly and parallel to the southern right-of-way limit of Prosser Brook Road, and maintaining the offset distance of 152.4 metres, to the centerline of Upham Brook; thence northerly along the centreline of Upham Brook to the centreline of Prosser Brook; thence westerly and northerly along the centreline of Prosser Brook to the centreline of Little River; thence northerly along the centreline of Little River to the centreline of Petitcodiac River; thence northeasterly along the centerline of Petitcodiac River to the southern prolongation of the eastern boundary of the village of Salisbury; thence northerly along the said prolongation to the eastern boundary of the said village; thence northerly and westerly along the said eastern boundary of the village of Salisbury to the boundary between the parishes of Moncton and Salisbury; thence northerly along the boundary between the parishes of Moncton and Salisbury to the boundary between the counties of Westmorland and Kent; thence easterly along the boundary between the counties of Westmorland and Kent to the place of beginning; saving and excluding all lands lying within the territorial limits of the city of Dieppe, the city of Moncton and Town of Riverview, as described respectively by subsection 3.1(2), subsection 6(2) and subsection 20(2) of Municipalities Order - Municipalities Act. 3 The Greater Moncton Planning Area Rural Plan contained in this Regulation is hereby adopted for the Greater Moncton Planning Area as described in section 2. 4(1) This regulation repeals the following ministerial regulations: (a) Ministerial Regulation 96-MON-013-00, Greater Moncton Planning District Basic Planning Statement Adoption Regulation - Community Planning Act; and (b) Ministerial Regulation 96-MON-014-00, Greater Moncton Planning District Zoning Regulation - Community Planning Act. 4(2) This regulation does not come into effect until Regulation 88-160, entitled Greater Moncton Planning District Basic Planning Statement Adoption Regulation - Community Planning Act, and Regulation 89-28, entitled Greater Moncton Planning District Zoning Regulation - Community Planning Act, are repealed. PART B POLICIES AND PROPOSALS The Greater Moncton Planning District is an area consisting of the cities of Dieppe and Moncton, the town of Riverview, and the villages of Petitcodiac, Salisbury, Hillsborough, Riverside-Albert and Alma, as well as, the unincorporated areas of the County of Albert and the parishes of Moncton and Salisbury within the County of Westmorland. This area has experienced a great deal of new development in recent years. Since 1997, slightly over 459 building permits were issued for residential development in the unincorporated area. In addition, over 198 permits were issued for mini home or cottage use for the same period. Approximately 1,431 subdivision plans have been processed over 171 Gazette royale — 26 janvier 2005 limite ouest de l’emprise de la ligne 0067 de la Société d’énergie du Nouveau-Brunswick; de là, en direction sud, le long de ladite limite de l’emprise jusqu’au point d’intersection avec la limite séparant les paroisses de Hillsborough et de Hopewell; de là, en direction ouest, le long de la limite séparant les paroisses de Hillsborough et de Hopewell jusqu’à la limite séparant les paroisses de Hillsborough et de Elgin; de là, en direction nord-ouest, le long de la limite séparant les paroisses de Hillsborough et de Elgin jusqu’à un point situé sur la limite sud des terres connues sous le nom de Secteurs Protégés - Bassin Hydrographique du Ruisseau Turtle - Moncton illustrées plus précisément à l’Annexe A-11 du Décret de désignation du secteur protégé de bassins hydrographiques - Loi sur l’assainissement de l’eau; de là, en direction sudouest et nord-ouest, le long des divers parcours de ladite limite jusqu’à un point situé sur la ligne maintenant une distance de 152,4 mètres au sud de la limite de l’emprise sud du chemin Prosser Brook; de là, en direction ouest et parallèlement à la limite sud de l’emprise du chemin Prosser Brook, et maintenant la distance de 152,4 mètres, jusqu’à la ligne médiane du ruisseau Upham; de là, en direction nord, suivant la ligne médiane du ruisseau Upham jusqu’à la ligne médiane du ruisseau Prosser; de là, en direction ouest et nord, le long de la ligne médiane du ruisseau Prosser jusqu’à la ligne médiane de la rivière Little; de là, en direction nord, le long de la ligne médiane de la rivière Little jusqu’à la ligne médiane de la rivière Petitcodiac; de là, en direction nord-est, le long de la ligne médiane de la rivière Petitcodiac jusqu’au prolongement sud de la limite est du village de Salisbury; de là, en direction nord, le long dudit prolongement de la limite est dudit village; de là, en direction nord et ouest, le long de ladite limite est du village de Salisbury jusqu’à la limite séparant les paroisses de Moncton et de Salisbury; de là, en direction nord, le long de la limite séparant les paroisses de Moncton et de Salisbury jusqu’à la limite séparant les comtés de Westmorland et de Kent; de là, en direction est, le long de la limite séparant les comtés de Westmorland et de Kent, jusqu’au point de départ; sauf et excluant tous les terrains se trouvant à l’intérieur des limites territoriales des cités de Dieppe et de Moncton, et de la ville de Riverview, comme il est décrit respectivement aux paragraphes 3.1(2), 6(2) et 20(2) du Décret sur les municipalités - Loi sur les municipalités. 3 Le Plan rural du secteur d’aménagement du Grand Moncton qui figure dans le présent règlement est adopté pour le secteur d’aménagement du Grand Moncton comme il est décrit à l’article 2. 4(1) Le présent règlement remplace les règlements ministériels suivants : a) Règlement ministériel 96-MON-013-00, Règlement d’adoption des déclarations des perspectives d’urbanisme du district d’aménagement du Grand Moncton - Loi sur l’urbanisme; b) Règlement ministériel 96-MON-014-00, Règlement de zonage du district d’aménagement du Grand Moncton - Loi sur l’urbanisme. 4(2) Le présent règlement entrera en viguer lorsque le Règlement 88-160, intitulé Règlement d’adoption des déclarations des perspectives d’urbanisme du district d’aménagement du Grand Moncton - Loi sur l’urbanisme, et le Règlement 89-28, intitulé Règlement de zonage du district d’aménagement du Grand Moncton - Loi sur l’urbanisme, seront abrogés. PARTIE B PRINCIPES ET PROPOSITIONS Le district d’aménagement du Grand Moncton couvre un secteur comprenant les cités de Dieppe et de Moncton, la ville de Riverview, et les villages de Petitcodiac, Salisbury, Hillsborough, Riverside-Albert et Alma, ainsi que les secteurs non constitués en municipalités du comté d’Albert, et les paroisses de Moncton et de Salisbury dans le comté de Westmorland. This development pressure has provided the impetus for the Minister of Environment and Local Government to protect the rural character of the unincorporated area and enhance the quality of life the inhabitants have enjoyed. Given the growth rate in the area, and in the interest of improving efficiency in administering planning regulations, the Minister wishes to convert the existing Basic Planning Statement and Zoning Regulation into one rural plan regulation for the unincorporated areas of the Greater Moncton Planning District. This rural plan will incorporate changes to modernize the zoning provisions and to more accurately reflect modern development trends, as well as, new standards and guidelines. This plan will also contain changes to accommodate recent amendments to the Highways Act, the Livestock Operations Act, as well as, the Clean Water Act. Residential Uses Policy 5 It is a policy to conserve the rural residential nature within the area of the Regulation by considering existing residential uses and historical developments. Proposals 6(1) It is proposed to provide for residential development in areas suitable for communal or on-site water and septic service systems. 6(2) It is proposed to permit residential development only on lots that have Department of Environment and Local Government and Department of Health and Wellness approvals as required. 6(3) It is proposed to create a residential low-density zone permitting single-unit dwellings. 6(4) It is proposed to permit two-unit dwellings within residential low-density zones relative to subsections 6(1) and 6(2). 6(5) It is proposed to establish provisions within residential lowdensity zones dealing with accessory buildings, structures and secondary uses, such as, accessory apartments, tourist homes and the lodging of boarders, and home occupations. 6(6) It is proposed to maintain the character of residential lowdensity zones by prohibiting the placement or erection of mini or mobile homes and controlling the parking or storage of vehicles. 6(7) It is proposed to create a residential high-density zone permitting the traditional mixture of land uses along major roadways. 6(8) It is proposed that the residential higher-density zone will permit single and two-unit dwellings, as well as, mini and mobile homes in parks or individual sites. 6(9) It is proposed that the residential high-density zone will accommodate compatible uses, such as, community halls, churches and neighbourhood variety stores, subject to any relative requirements. 6(10) It is proposed to permit single-unit and two-unit dwellings within residential high-density zones relative to subsections 6(1) and 6(2). 6(11) It is proposed to establish provisions within residential highdensity zones dealing with accessory buildings, structures and secondary uses, such as, accessory apartments, tourist homes and the lodging of boarders, and home occupations. Commercial or Industrial Uses Policy 7 It is a policy to control the type and location of commercial or industrial developments within the area of the Regulation by considering potential impacts upon surrounding lands. 172 Gazette royale — 26 janvier 2005 lotissement ont été examinés au cours de la même période. Vu le taux de croissance du secteur et l’intérêt manifesté pour accroître l’application des règlements d’aménagement, le ministre souhaite modifier le Règlement de zonage des déclarations des perspectives d’urbanisme actuel en un règlement du plan rural pour les secteurs non constitués en municipalités du district d’aménagement du Grand Moncton. Le présent plan rural comporte des modifications visant à moderniser les dispositions sur le zonage et à mieux refléter les tendances d’aménagement modernes ainsi que les nouvelles normes et directives. Ce plan contiendra aussi des changements qui tiennent compte des modifications récentes à la Loi sur la voirie, à la Loi sur l’élevage du bétail ainsi qu’à la Loi sur l’assainissement de l’eau. Usages résidentiels Principe 5 En principe, il faut sauvegarder le caractère résidentiel rural du secteur visé par le règlement, tout en tenant compte des usages résidentiels et des aménagements historiques actuels. Propositions 6(1) Il est proposé de prévoir des aménagements résidentiels dans les secteurs où peuvent être installés des systèmes de fosses septiques et d’eau individuels ou collectifs. 6(2) Il est proposé d’autoriser les aménagements résidentiels uniquement sur les lots qui ont été approuvés par le ministère de l’Environnement et des Gouvernements locaux et par le ministère de la Santé et du Mieux-être au besoin. 6(3) Il est proposé de créer une zone résidentielle à faible densité afin d’autoriser les habitations à un logement. 6(4) Il est proposé d’autoriser les habitations à deux logements dans les zones résidentielles à faible densité, sous réserve des paragraphes 6(1) et 6(2). 6(5) Il est proposé d’adopter des dispositions dans les zones résidentielles à faible densité portant sur les bâtiments, les constructions ou les usages secondaires accessoires, comme les appartements, les maisons de touristes et de pension, et les activités professionnelles à domicile. 6(6) Il et proposé de maintenir le caractère des zones résidentielles à faible densité en interdisant la mise en place ou l’érection de minimaisons ou de maisons mobiles, et en contrôlant le stationnement ou l’entreposage des véhicules. 6(7) Il est proposé de créer une zone résidentielle à forte densité afin d’autoriser le mélange traditionnel d’usage des terres le long des principales routes. 6(8) Il est proposé d’autoriser, dans une zone résidentielle à haute densité, des habitations à un et à deux logements ainsi que des mini-maisons et maisons mobiles dans des parcs ou sur des sites individuels. 6(9) Il est proposé d’autoriser, dans une zone résidentielle à haute densité, des usages compatibles comme les salles communautaires, églises et magasins de quartier, sous réserve de toute condition relative. 6(10) Il est proposé d’autoriser, dans les zones résidentielles à haute densité, des habitations à un et à deux logements relatives aux paragraphes 6(1) et 6(2). 6(11) Il est proposé d’adopter des dispositions dans les zones résidentielles à haute densité portant sur les bâtiments, constructions et usages secondaires accessoires comme les appartements, maisons de touristes et de pension, et activités professionnelles à domicile. Usages commerciaux ou industriels Principe 7 En principe, il faut contrôler le type et l’emplacement des aménagements commerciaux ou industriels à l’intérieur du secteur visé par le règlement en tenant compte des impacts possibles sur les terrains avoisinants. The Royal Gazette — January 26, 2005 Proposals 8(1) It is proposed to establish a commercial-retail zone permiting residential uses. 8(2) It is proposed to control aspects of commercial development, such as parking, access, landscaping and screening protection to nearby residential uses, by providing a safe and acceptable setting. 8(3) It is proposed to permit accessory buildings, structures and uses within commercial-retail zones. 8(4) It is proposed that commercial-industrial zones permit commercial-retail zone uses and such other uses as warehouse or storage facility, transportation centre and heavy or light industry. 8(5) It is proposed to establish commercial-industrial zones permitting accessory buildings, structures and uses. 8(6) It is proposed to permit gravel pit or rock quarry operations within commercial-industrial zones, subject to terms and conditions as imposed by the District Planning Commission. Institutional Uses or Recreational Facilities and Public Open Spaces Policy 9 It is a policy to control the type and location of institutional and recreational development and public open space uses within the area of the Regulation by considering potential impacts upon surrounding lands. Proposals 10(1) It is proposed to permit residential, recreational and specified commercial activities within a parks and institutional zone. 10(2) It is proposed to permit accessory buildings, structures and uses within parks and institutional zones. Resource Uses Policy 11 It is a policy to conserve the land-based resources within the area of the Regulation by coordinating development with existing rural traditions. Proposals 12(1) It is proposed to create an agricultural zone. 12(2) It is proposed to permit residential-low density and residential high-density zone uses within the agricultural zone on lands meeting the requirements for such developments. 12(3) It is proposed that agricultural and forestry uses be permitted as main uses within the agricultural zone, subject, where applicable, to the Livestock Operations Act. 12(4) It is proposed that commercial uses within an agricultural zone, such as, motels, farm machinery dealerships and public garages, be permitted subject to terms and conditions as imposed by the District Planning Commission. 12(5) It is proposed that an agricultural zone will permit such uses as multiple-unit dwellings, nursing homes, neighbourhood convenience stores, and churches or community halls. 12(6) It is proposed that the agricultural zone will continue to permit cottage industries. Protection of Water Supplies Turtle Creek watershed is the water supply area for Town of Riverview, the city of Dieppe and the city of Moncton. This reservoir provides approximately 11 million gallons of water per day to the Moncton urban community and has been designated as a protected watershed under the Clean Water Act. Policy 13 It is a policy to preserve the water quality and integrity of the Turtle Creek water supply area. 173 Gazette royale — 26 janvier 2005 Propositions 8(1) Il est proposé d’établir une zone commerciale et de vente au détail afin d’autoriser les usages résidentiels. 8(2) Il est proposé de contrôler les aspects du développement commercial comme le stationnement, l’accès, l’aménagement paysager et la protection des usages résidentiels à proximité, en créant un milieu sécuritaire et acceptable. 8(3) Il est proposé d’autoriser les bâtiments, constructions et usages accessoires dans les zones commerciales et de vente au détail. 8(4) Il est proposé d’autoriser, dans les zones industrielles et commerciales, des usages de zones commerciales et de vente au détail, et tout autre usage comme un entrepôt ou une installation d’entreposage, un centre de transport et une industrie lourde ou légère. 8(5) Il est proposé d’établir des zones commerciales et industrielles autorisant les bâtiments, constructions et usages accessoires. 8(6) Il est proposé d’autoriser des exploitations de carrières ou de gravières dans les zones industrielles et commerciales, sous réserve des modalités et conditions imposées par la Commission du district d’aménagement. Usages institutionnels ou installations récréatives et espaces publics ouverts Principe 9 En principe, le type et l’emplacement des usages institutionnels et récréatifs, et des espaces publics ouverts doivent être contrôlés dans le secteur visé par le règlement, en tenant compte des impacts possibles sur les terrains avoisinants. Propositions 10(1) Il est proposé d’autoriser des activités résidentielles, récréatives et commerciales précisées dans une zone de parcs ou d’installations collectives. 10(2) Il est proposé d’autoriser les bâtiments, constructions et usages accessoires dans les zones de parcs et d’installations collectives. Usages des ressources Principe 11 En principe, les ressources terrestres doivent être conservées dans le secteur visé par le règlement par l’harmonisation de l’aménagement avec les traditions rurales. Protection des sources d’approvisionnement en eau Le bassin hydrographique du ruisseau Turtle est la zone d’approvisionnement en eau de la ville de Riverview, et des cités de Dieppe et de Moncton. Le réservoir fournit environ 11 millions de gallons d’eau par jour à la communauté urbaine de Moncton. Le secteur a été désigné un bassin hydrographique protégé en vertu de la Loi sur l’assainissement de l’eau. Heritage Buildings and Sites of Historical or Archeological Interest Policy 15 It is a policy to recognize and preserve, where possible, significant heritage resources in the Planning Area. Proposals 16(1) It is proposed that historic sites be targeted where land dedications for public purposes are made through the development approval process. 16(2) It is proposed that development preserve significant archaeological areas, aboriginal cultural heritage resources, and other historic sites and structures that possess the following characteristics: (a) architectural, cultural, social, political, economic, and military patterns of the Province’s history; and (b) associated with specific individuals, events, communities, or institutions that have shaped the history. Conservation of the Physical Environment Policy 17 It is a policy to protect the quality of life for residents, minimize environmental impacts and maintain the aesthetic features of the area. Proposal 18 It is proposed that a rezoning request for an industrial use may be subject to such reasonable terms and conditions concerning the quality of life for residents of adjacent properties, the minimization of environmental impacts and the maintenance of the aesthetic features of the area. PART C ZONING PROVISIONS ZONING MAP & INTERPRETATION 19 The Zoning Map included as Schedule A and entitled “Greater Moncton Planning Area Zoning Map” is the zoning map designated for this Regulation. 20 In this Regulation “accessory building” means a detached subordinate building, located on the same lot as the main building, structure or use to which it is accessory, the use of which is naturally or customarily incidental and complementary to the main use of the land, building or structure; “accessory structure” means a structure located on the same lot as the main building, structure or use to which it is accessory, the use of which is naturally or customarily incidental and complementary to the main use of the land, building or structure; “accessory use” means a use, of land or a building or portion thereof, other than a secondary use, which is naturally or customarily incidental and subordinate to the main use of the land, building or structure located on the same lot; “Act” means the Community Planning Act; “agricultural use” means any use of land for the purpose of producing crops or raising livestock and includes sod farming, the stripping of topsoil, beekeeping, plant nursery, greenhouse, riding school, riding stable and a dog kennel; and may involve the processing and marketing of any products produced; “alter” means to make any change, structurally or otherwise, to a building or structure which is not for the purpose of maintenance only; “building” means a roofed construction with solid exterior walls that is used or intended to be used as a shelter for persons, animals or chattels; 174 Gazette royale — 26 janvier 2005 Proposition 14 Il est proposé de créer une zone de bassin hydrographique, où seraient autorisées les activités résidentielles et de ressources minimales sous réserve des dispositions de la Loi sur l’assainissement de l’eau. Propositions 16(1) Il est proposé de cibler les lieux historiques lorsque le terrain est réservé à des fins publiques au cours du processus d’approbation des aménagements. 16(2) Il est proposé de sauvegarder les secteurs archéologiques importants, les ressources du patrimoine culturel autochtone, et les autres lieux et bâtiments historiques qui possèdent les caractéristiques suivantes : a) aspect architectural, culturel, social, politique, économique et militaire de l’histoire de la province; et b) association à des particuliers, événements, communautés ou établissements qui ont façonné l’histoire. Conservation du milieu physique Principe 17 En principe, il faut protéger la qualité de vie des résidents, réduire l’impact sur l’environnement et conserver les caractéristiques esthétiques du secteur. Proposition 18 Il est proposé d’assujettir toute demande de rezonage pour un usage industriel aux modalités et aux conditions raisonnables concernant la qualité de vie des résidents des biens-fonds avoisinants, la réduction de l’impact sur l’environnement et le maintien des caractéristiques esthétiques du secteur. PARTIE C DISPOSITIONS SUR LE ZONAGE CARTE DE ZONAGE ET INTERPRÉTATION 19 La carte de zonage qui figure à l’annexe A et intitulée « Carte de zonage du secteur d’aménagement du Grand Moncton » est la carte de zonage désignée pour le présent règlement. 20 Dans le présent règlement, « activité professionnelle à domicile » désigne un usage secondaire auquel est affectée une habitation ou un bâtiment accessoire comme gagne-pain; « affiche » désigne un objet, un dispositif, une installation ou une construction située à l’extérieur et utilisé pour annoncer, identifier ou montrer un objet, une personne, une institution, une organisation, une activité, un produit, un service, un événement ou un lieu, ou diriger ou attirer l’attention vers eux par des moyens comprenant des mots, lettres, chiffres, dessins, symboles, agencements, couleurs, éclairages ou projections d’images; « animal familier » désigne un animal domestique gardé ordinairement dans une habitation, ou dans un parc ou bâtiment extérieur dans un but unique de loisir plutôt qu’utilitaire et comprend les chiens, chats, lapins, petits oiseaux et rongeurs, mais ne comprend pas le bétail, les moutons, les chevaux, les cochons, la volaille, les abeilles et les animaux gardés ordinairement comme animaux de ferme; The Royal Gazette — January 26, 2005 “building inspector” means a person appointed under section 6 of the Provincial Building Regulation - Community Planning Act, being New Brunswick Regulation 81-126; “Commission” means the Greater Moncton Planning District Commission; “Director” means the Provincial Planning Director appointed under section 4 of the Act; “dwelling” means a main building or portion of it, other than a mobile home or mini home, containing one or more dwelling units; “dwelling unit” means a room or suite of two or more rooms designed occupied or intended for occupancy as separate living quarters, with culinary, sleeping and sanitary facilities provided within the confines of the space for the exclusive use of the person or persons maintaining the household; “erect” means to construct, build, assemble or relocate a building or structure, and any physical operations preparatory to the construction, building, assembly or relocation of the building or structure; “family” means one or more persons, not necessarily related, occupying a premises and living as a single housekeeping unit, as distinguished from a group occupying a hotel or boarding or rooming house; “forestry use” includes a sawmill and a woodworking shop; “home occupation” means a secondary use conducted in a dwelling or accessory building for monetary gain; “household pet” means a domestic animal customarily kept within a dwelling or in an outside pen or building for the sole purpose of pleasure rather than utility and includes dogs, cats, rabbits, small birds and rodents but excludes cattle, sheep, horses, pigs, poultry, bees and animals customarily kept as farm animals; “lot” means a parcel of land or two or more adjoining parcels held by the same owner and used or intended to be used as the site for a building or structure or an appurtenance to the building or structure; “main building” means a building in which is conducted the main or principal use of the lot on which the building is located; “mini home” means a mini home as defined in the Provincial Mobile Home Parks and Sites Regulation - Community Planning Act, being New Brunswick Regulation 84-291 under the Community Planning Act; “Minister” means the Minister of Evironment and Local Government; “mobile home” means a mobile home as defined in the Provincial Mobile Home Parks and Sites Regulation - Community Planning Act, being New Brunswick Regulation 84-291 under the Community Planning Act; “mobile home park” means a mobile home park as defined in the Provincial Mobile Home Parks and Sites Regulation - Community Planning Act, being New Brunswick Regulation 84-291 under the Community Planning Act; “multiple-unit dwelling” means a dwelling containing more than two dwelling units; “private stable” means a building or enclosure for the keeping of birds or domestic animals other than dogs; “secondary use” means a use, other than a main use or an accessory use, permitted on a lot; “service shop” means a building or part of a building used for the sale and repair of household articles and shall include a glass replacement shop, a repair shop for appliances, radios, televisions and other electronic devices, but shall not include industrial uses, manufacturing or motor vehicle repair shops, repair shops for industrial machinery, vehicles, heavy equipment or tractor trailers; “sign” means an object, device, display or structure situated outdoors that is used to advertise, identify, display, direct or attract attention to an object, person, institution, organization, business, product, service, event or location by any means including words, letters, figures, design, symbols, fixtures, colors, illumination or projected images; “single-unit dwelling” means a dwelling containing only one dwelling unit; “structure” means a construction other than a building or a power, or telephone pole or lines; “two-unit dwelling” means a dwelling containing two dwelling units; “use” means the purpose for which land or a building or structure or any combination of land, buildings or structures are designed, arranged, erected, intended, occupied or maintained; “width”, in relation to a lot, means (a) where the side lot lines are parallel, the distance across the lot at right angles to such lines; or (b) where the side lot lines are not parallel, the distance measured across the lot along a line drawn parallel to a line joining the points at which the side lot lines intersect the limits of the abutting street, such parallel line being drawn through the point at which the line of minimum set-back intersects a line drawn from mid-point of and perpendicular to the line to which it is parallel. 21 PURPOSE, ADMINISTRATION, CLASSIFICATION AND CONFORMITY Purpose The purpose of Part C is (a) to divide the area referred to in section 2 of Part A, into zones; (b) to prescribe, subject to powers reserved to the Commission, (i) the purpose for which land, buildings and structures in any zone may be used, (ii) standards to which land use and the placement, erection, alteration and use of buildings and structures must conform; and (c) to prohibit the use, placement, erection or alteration of land, buildings or structures, other than in conformity with the purposes and standards mentioned in paragraph (b). Powers of the District Planning Commission 22(1) No building or structure may be erected on any site where it would otherwise be permitted under this Regulation when, in the opinion of the Commission, the site is marshy, subject to flooding, excessively steep or otherwise unsuitable for a proposed purpose by virtue of its soil or topography. 22(2) The Commission may, subject to such terms and conditions as it considers fit (a) authorize, for a temporary period not exceeding one year, a development otherwise prohibited by this Regulation; and (b) require the termination or removal of a development authorized under paragraph (a) at the end of the authorized period. Modifications 23(1) Toute personne désirant faire modifier le présent règlement doit a) adresser une demande signée au directeur; The Royal Gazette — January 26, 2005 (b) where the application involves rezoning of a parcel of land, include with the application (i) a statement as to the ownership of the land to be rezoned, and (ii) the signature of at least one owner for each parcel of land in the area to be rezoned; and (c) pay a fee of $1,000, payable to the Greater Moncton District Planning Commission to be paid into a Consolidated Fund, and to be credited to the cost of the delivery of the land use planning service under subsection 27.2(2) of the Municipalities Act. 23(2) On the advice of the Minister, the Greater Moncton District Planning Commission may return to the applicant all or any part of a fee mentioned in paragraph (1)(c). 23(3) An application shall include such information as may be required by the Minister or Greater Moncton District Planning Commission. Classification 24(1) For the purposes of this Regulation, the area is divided into zones as delineated on the plan attached as Schedule A, entitled “Greater Moncton Planning Area Zoning Map”. 24(2) The zones mentioned in subsection (1) are classified and referred to as follows: (a) Residential Zones (i) Single-Unit Residential - R1 Zone, and (ii) Multiple-Unit Residential - R2 Zone; (b) Commercial Zones (i) Commercial-Retail - C1 Zone, and (ii) Commercial-Industrial - C2 Zone; (c) Institutional Zones (i) Parks and Institutional - P & I Zone; (d) Rural Zones (i) Agricultural - A Zone, (ii) Watershed - W Zone, and (iii) Rural Residential – RR Zone. Conformity 25 In any zone, all land shall be used and all buildings or structures, or parts of the buildings or structures, shall be placed, erected, altered or used only in conformity with the requirements of, except as otherwise provided, the part of this Regulation pertaining to such zone. RESIDENTIAL ZONES Single-Unit Residential Zone - R1 Zone Permitted Uses 26(1) In an R1 zone, any land, building or structure may be used for the purposes of, and for no other purpose than, (a) one of the following main uses: (i) a single-unit dwelling, or (ii) a two-unit dwelling; (b) one or more of the following secondary uses: (i) subject to subsection (4), an apartment in conjunction with a detached single-unit dwelling, (ii) a boarding house for not more than six boarders, (iii) a tourist home or a bed and breakfast establishment, (iv) subject to section 40, a home occupation; and (c) any accessory building, accessory structure or accessory use. 26(2) No two-unit dwelling may be placed, erected or altered, and no building or structure may be altered to become a two-unit dwelling, unless such two-unit dwelling is serviced by a sewerage system for public use or a private sewage disposal system that has been certified by the regional medical health officer. 26(3) No mini home or mobile home may be placed or erected in an R1 zone. 177 Gazette royale — 26 janvier 2005 b) si la demande comporte un rezonage d’une parcelle de terrain, inclure avec celle-ci (i) une déclaration de propriété du terrain devant être rezoné, et (ii) la signature d’au moins un propriétaire de chaque parcelle de terrain dans le secteur devant être rezoné; c) verser à la Commission du district d’aménagement du Grand Moncton un droit de 1 000 $ qui doit être déposé au Fonds consolidé et être crédité au coût de la prestation du service de planification de l’utilisation des terres en vertu du paragraphe 27.2(2) de la Loi sur les municipalités. 23(2) Sur l’avis du ministre, la Commission du district d’aménagement du Grand Moncton peut restituer, en tout ou en partie, le montant mentionné à l’alinéa (1)c). 23(3) La demande doit comprendre les renseignements qui peuvent être requis par le ministre ou la Commission du district d’aménagement du Grand Moncton. Classification 24(1) Aux fins du présent règlement, le secteur est divisé en zones délimitées sur le plan qui figure à l’annexe A et intitulé « Carte de zonage du secteur d’aménagement du Grand Moncton ». 24(2) Les zones visées au paragraphe (1) sont classées et désignées comme suit : a) Zones résidentielles (i) Zone R1 - Habitations à un logement, (ii) Zone R2 - Habitations à logements multiples, b) Zones commerciales (i) Zone C1 - Commerce et ventes au détail, (ii) Zone C2 - Zone commerciale et industrielle, c) Zones instutionnelles (i) Zone P et I - Parcs et installations collectives; d) Zones rurales (i) Zone A - Agriculture, (ii) Zone BH - Bassin hydrographique, (iii) Zone RR - Zone résidentielle rurale. Conformité 25 Dans toute zone, tous les terrains doivent être utilisés et les bâtiments ou constructions, ou toute partie de ceux-ci, doivent être implantés, édifiés, modifiés ou utilisés, uniquement en conformité avec les prescriptions fixées par la partie du présent règlement les concernant, sauf dérogations expresses. ZONES RÉSIDENTIELLES Zone R1 - Habitations à un logement Usages permis 26(1) Les terrains, bâtiments ou constructions d’une zone R1 ne peuvent servir qu’aux fins a) d’un des usages principaux suivants : (i) habitation à un logement, ou (ii) habitation à deux logements; b) des usages secondaires suivants : (i) sous réserve du paragraphe (4), un appartement dans une habitation à un logement séparée, (ii) une pension pour six pensionnaires au plus, (iii) une maison de touristes ou un gîte touristique, (iv) sous réserve de l’article 40, l’exercice d’une activité professionnelle à domicile, c) d’un bâtiment, d’une construction ou d’un usage accessoire. 26(2) Aucune habitation à deux logements ne peut être implantée, édifiée ni modifiée et aucun bâtiment ou construction ne peut être modifié pour devenir une habitation à deux logements non desservie par un réseau d’égout pour usage public ou par un réseau privé d’élimination des eaux usées certifié par le médecin-hygiéniste régional. 26(3) Aucune mini-maison ou maison mobile ne peut être implantée ou édifiée dans une zone R1. The Royal Gazette — January 26, 2005 26(4) No apartment shall exceed sixty-five square metres in floor area. 26(5) No accessory building shall (a) be used for keeping of animals other than household pets; or (b) have a ground floor area that exceeds the lesser of twelve per cent of the area of the lot upon which it is located or one hundred square metres. 26(6) Parking of vehicles shall be incidental to the main use and subject to the provisions of section 39. Multiple-Unit Residential Zone - R2 Zone Permitted Uses 27(1) In an R2 zone, any land, building or structure may be used for the purposes of, and for no other purpose than, (a) Subject to section 38, one or more of the following main uses: (i) subject to section 26, any main use permitted in an R1 zone, (ii) a mini home or mobile home, (iii) a mini home or mobile home park, (iv) a multiple-unit dwelling, (v) a nursing home, or special care home, (vi) a neighbourhood convenience store, (vii) a church or community hall, or (viii) a daycare; and (b) one or more of the following secondary uses: (i) subject to section 38, any secondary use permitted in an R1 zone, (ii) subject to subsection (2), the sale of gasoline in connection with a neighbourhood convenience store, (iii) subject to subsections 31(3) and 31(4), a cottage industry; and (c) any accessory building, accessory structure or accessory use. 27(2) The sale of gasoline in connection with a neighbourhood convenience store is a particular purpose in respect of which the Commission may, subject to subsection 34(4) of the Act, impose terms and conditions or prohibit where compliance with terms and conditions imposed cannot be expected. 27(3) For this zone, a private stable shall be deemed to be an accessory use and shall not be located on a lot in such a manner that any part of it is within (a) eighteen metres of a street line; (b) six metres of a side lot line or rear lot line; (c) nine metres of a dwelling on the same lot; or (d) twenty four metres of a dwelling on an adjacent lot. 27(4) A private stable shall house no more than two livestock and six poultry for each one thousand four hundred square metres of lot area and, in no case, shall a private stable house more than 19 livestock, other than poultry, or more than 199 poultry. 27(5) No accessory building shall have a ground floor area that exceeds the lesser of twelve per cent of the area of the lot upon which it is located or one hundred square metres. COMMERCIAL ZONES Commercial-Retail - C1 Zone Permitted Uses 28(1) In a C1 zone, any land, building or structure may be used for the purposes of, and for no other purpose than, (a) subject to section 38, one or more of the following main uses: (i) subject to sections 26 and 27, respectively, a use permitted in an R1 Zone or R2 Zone, (ii) an automobile sales room or sales lot, (iii) an art gallery, library or museum, (iv) a bank, 178 Gazette royale — 26 janvier 2005 26(4) Aucun apartement ne peut avoir une aire de plancher dépassant soixante-quinze mètres carrés. 26(5) Nul bâtiment accessoire ne peut a) être utilisé pour l’élevage d’animaux, à l’exception d’animaux familiers; b) avoir une aire de plancher qui dépasse douze pour cent de la superficie du lot sur lequel il est situé ou cent mètres carrés, la plus petite superficie étant à retenir. 26(6) Le stationnement des véhicules doit être accessoire à l’usage principal et sous réserve des dispositions de l’article 39. ZONES COMMERCIALES Zone C1 - Commerce et ventes au détail Usages permis 28(1) Les terrains, bâtiments ou constructions d’une zone C1 ne peuvent servir qu’aux fins, a) sous réserve de l’article 38, d’un ou plus des usages principaux suivants : (i) sous réserve des articles 26 et 27 respectivement, tout usage principal permis dans une zone R1 ou R2, (ii) une salle ou un terrain de montre d’automobiles en vue de la vente, (iii) une galerie d’art, une bibliothèque ou un musée, (iv) une banque, The Royal Gazette — January 26, 2005 (v) a bakery, (vi) an entertainment or recreational use, (vii) a premises licensed for the sale of alcohol, (viii) any government building or use, (vix) a funeral home or crematorium, (x) an office, (xi) a hotel or motel, (xii) a plant nursery or greenhouse, (xiii) a restaurant or take-out restaurant, (xiv) a retail store or service, (xv) a service shop, (xvi) a service station, public garage or gas bar, or (xvii) a farm machinery dealership; and (b) any accessory building, accessory structure or accessory use. 28(2) A lot shall not be developed for a purpose permitted under this section unless the driveways and off-street parking areas are paved with asphalt or Portland Cement pavement and the remainder of the lot, other than that part devoted to buildings, structures and parking, is landscaped in accordance with section 37. 28(3) Where yard lights are provided in connection with a permitted use, all such lighting shall be directed inwardly toward the subject lot. 28(4) Except for a parking lot associated with a main use, an automobile sales lot, a service station or gas bar, no use is permitted unless it is contained in a completely enclosed building or structure with no outside storage of merchandise or equipment, and no part of a parking lot may be located closer to the street line than one metre nor closer to a side lot line than 3 metres when it abuts a lot zoned for non-commercial use or a lot containing a residential use. 28(5) Where a lot abuts an R1 Zone, an R2 Zone or a use permitted under subparagraph (1)(a)(i), such lot shall not be developed for a use permitted under subparagraphs (1)(a)(ii) to (xxi) unless a screening facility, such as an earth berm, hedge, fence or a combination of such screening facilities, is provided and maintained by the owner of the said lot near or along the common property lines. Commercial-Industrial - C2 Zone Permitted Uses 29(1) In a C2 zone, any land, building or structure may be used for the purposes of, and for no other purpose than, (a) subject to section 38, one or more of the following main uses: (i) subject to section 28, a use permitted in a C1 Zone, (ii) a warehouse or storage facility, (iii) a transportation centre, (iv) a heavy or light industry, or (v) subject to subsection 29(2), a gravel pit or rock quarry; and (b) any accessory building, accessory structure or accessory use. 29(2) The use of land for the purposes of a gravel pit or rock quarry is a particular purpose in respect of which the Commission may, subject to subsection 34(4) of the Act, impose terms and conditions or prohibit where compliance with the terms and conditions imposed cannot reasonably be expected. RURAL ZONES Agricultural - A Zone Permitted Uses 31(1) In an A zone, any land, building or structure may be used for the purposes of, and for no other purpose than, (a) subject to section 38, one or more of the following main uses: (i) subject to sections 26, 27, and 33, respectively, a use permitted in an R1, R2 or RR Zone, (ii) subject to subsection 31(5) and to the Livestock Operations Act, an agricultural use, (iii) a forestry use, (iv) a restaurant or take-out restaurant, (v) a roadside stand for the sale of agricultural produce, (vi) a television or radio tower or other communication tower, (vii) subject to subsections (3) and (4), a cottage industry, (viii) a veterinary clinic or animal hospital, (vix) a public park or cemetery, (x) a sports or recreation field, (xi) a golf course, (xii) a hunting or fishing camp, or (xiv) a sugar camp; and (b) any accessory building, accessory structure or accessory use. 31(2) The use of land, building or structure for the purposes of a private club or fraternal building or use shall be subject to subsection 34(4) of the Act, whereby the Commission may impose terms and conditions or prohibit where compliance with the terms and conditions imposed cannot reasonably be expected. 31(3) Subject to subsection (4), the following occupations may be conducted as a cottage industry: (a) an antique shop; (b) an art gallery or studio; (c) a crafts shop; (d) a gift shop; (e) a museum; (f) a pottery shop; or (g) a woodworking shop. 31(4) A cottage industry is subject to the requirements that (a) not more than two persons, in addition to the residents of the dwelling unit located on the same lot, are engaged; (b) not more than one hundred square metres of building floor area are devoted to it; and (c) it is conducted within a completely enclosed building. 180 Gazette royale — 26 janvier 2005 a) sous réserve de l’article 38, d’un ou plus des usages principaux suivants : (i) une habitation à un logement, (ii) un parc public ou un cimetière, (iii) un terrain de sport ou de loisirs, (iv) un terrain de camping pour tentes ou roulottes, (v) un bureau de tourisme, (vi) un terrain de golf, (vii) un camp de chasse ou de pêche, (viii) un usage instutionnel, gouvernemental ou éducatif, ou (ix) une garderie; et b) d’un bâtiment, d’une construction ou d’un usage accessoire. Watershed - W Zone Permitted Uses 32(1) In a W zone, any land, building or structure may be used for the purposes of, and for no other purpose than, (a) subject to section 38, one or more of the following main uses: (i) a single-unit dwelling, (ii) mobile home or mini home, (iii) an agricultural use, with fewer than 20 livestock, other than poultry, and fewer than 200 poultry, (iv) a forestry use, (v) a hunting or fishing camp, or (vi) a sugar camp; and (b) one or more of the following secondary uses: (i) subject to section 26, any secondary use permitted in an R1 zone, or (ii) subject to subsections 31(3) and 31(4), a cottage industry; and (c) any accessory building, accessory structure or accessory use. 32(2) An agricultural use with fewer than 20 livestock, other than poultry, and fewer than 200 poultry is only permitted on condition that no livestock facility shall be located on a lot in such manner that any part of it is within (a) eighteen metres of a street line; (b) six metres of a side lot or rear lot line; (c) nine metres of a main building on the same lot; or (d) twenty-four metres of any residence on an adjacent lot. 32(3) No dwelling may be constructed or located on a lot unless the owner of the lot has obtained a permit from the Department of Health and Wellness for the installation of a sewage disposal system. 32(4) Uses permitted herein are subject to the Clean Water Act and any regulation there under, more particularly, the Watershed Protected Area Designation Order - Clean Water Act. 32(5) Development and building permits within this zone will only be issued upon receipt of the appropriate permits or agreements issued under the acts or regulations identified within this section. Rural Residential - RR Zone Permitted Uses 33(1) Subject to this section, in an RR zone any land, building or structure may be used for the purposes of, and for no other purpose than, (a) subject to section 38, one or more of the following main uses: (i) subject to sections 26 and 27, respectively, any main secondary or accessory use permitted in an R1 Zone or R2 Zone, (ii) an agricultural use with fewer than 20 livestock, other than poultry, and fewer than 200 poultry, (iii) a roadside stand for the sale of agricultural produce, (iv) a television or radio tower or other communication tower, or (v) a veterinary clinic or animal hospital; and (b) the following secondary uses in conjunction with a singleunit dwelling; 181 Gazette royale — 26 janvier 2005 31(5) Un usage agricole comprenant moins de 20 animaux, autres que la volaille, et moins de 200 volailles est uniquement autorisé si aucune installation d’élevage de bétail n’est située sur le lot de telle manière qu’une partie quelconque soit : a) à dix huit mètres de l’alignement de la rue, b) à six mètres de la limite latérale ou arrière d’un lot, c) à neuf mètres d’une habitation sur le même lot, ou d) à vingt-quatre mètres d’une habitation sur un lot adjacent. Zone résidentielle rurale – Zone RR Usages permis 33(1) En application du présent article, les terrains, bâtiment ou constructions d’une zone RR ne peuvent servir qu’aux fins, a) sous réserve de l’article 38, d’un ou plus des usages principaux suivants : (i) sous réserve des articles 26 et 27 respectivement, tout usage principal, secondaire ou accessoire permis dans une zone R1 ou R2, (ii) un usage agricole comptant moins de 20 animaux, autres que la volaille, et moins de 200 volailles, (iii) un éventaire au bord de la route pour la vente de produits agricoles, (iv) une tour de télévision ou de radio, ou autre tour de communication, ou (v) une clinique de vétérinaire ou un hôpital pour animaux; et b) des usages secondaires suivants ayant trait à une habitation à un logement; The Royal Gazette — January 26, 2005 (i) a tourist home, (ii) subject to subsections 31(3) and 31(4), a cottage industry, (iii) a public garage for the repair of automobiles, a repair shop for small engines, garden equipment appliances, glass replacement or a shop in connection with the construction trades such as an electrician, plumber, cabinetmaker, carpenter, or welder, (iv) an office use, or (v) a retail or wholesale use not exceeding 500 square metres of floor area; and (b) any accessory building, accessory structure or accessory use. 33(2) No structure for the purposes of any use listed in subparagraphs (ii), (iii), (iv) or (v) of paragraph 33(1)(b) shall be permitted except where the building is located at least four metres from any property line, no outdoor storage shall be permitted except within a fully fenced opaque enclosure of at least 1.5 metres and no more than 2 metres in height and such storage compound shall be at least 18 metres from any public street line. 33(3) Not more than 2 vehicles may be displayed or stored for sale on a lot in connection with an automobile repair shop mentioned in subparagraph 33(1)(b)(iii). 33(4) A private stable shall be deemed to be an accessory use and shall not (a) be located on a lot in such manner that any part of it is within: (i) eighteen metres of a street line, (ii) six metres of a side lot or rear lot line, (iii) nine metres of a main building on the same lot, or (iv) twenty-four metres of any residence on an adjacent lot; nor (b) house more than two livestock and six poultry for each one thousand four hundred square metres of lot area and in no case shall a private stable house more than 19 livestock, other than poultry, or more than 199 poultry. GENERAL PROVISIONS Lot Sizes 34(1) No building or structure may be built, located or relocated, altered or replaced on a lot unless the lot meets the requirements of this section. 34(2) Where a lot is serviced by both a water system for public use and a sewer system for public use, the lot shall have and contain (a) for a single-unit dwelling or a building or structure not used for residential purposes, (i) a width of at least 18 metres, (ii) a depth of at least 30 metres, and (iii) an area of at least 540 square metres; (b) for a two-unit dwelling, (i) a width of at least 23 metres, (ii) a depth of at least 30 metres, and (iii) an area of at least 818 square metres; and (c) for a three-unit dwelling, (i) a width of at least 27 metres, (ii) a depth of at least 30 metres, and (iii) an area of at least 1,090 square metres; and (d) for a multiple-unit dwelling, (i) a width of at least 36 metres, plus 1.5 metres for each dwelling unit in excess of four, (ii) a depth of at least 30 metres, and (iii) an area of at least 1,272 square metres, plus 68 square metres for each dwelling unit in excess of four. 34(3) Where a lot is serviced by a sewer system for public use, and not by a water system for public use, the lot shall have and contain, 182 Gazette royale — 26 janvier 2005 (i) une maison de touristes, (ii) sous réserve des paragraphes 31(3) et 31(4), une industrie artisanale, (iii) un garage public pour la réparation des automobiles, un atelier de réparation de petits moteurs, d’appareil d’équipement de jardinage, de remplacement de vitres ou un atelier lié aux métiers de la construction comme un électricien, un plombier, un ébéniste, un menuisier ou un soudeur, (iv) un bureau, ou (v) un usage de vente au détail ou en gros ne dépassant pas une aire de plancher de 500 mètres carrés; et b) d’un bâtiment, d’une construction ou d’un usage accessoire. 33(2) Nulle construction aux fins d’un usage précisé au sous-alinéa 33(1)b) (ii), (iii), (iv) ou (v) n’est autorisée sauf si le bâtiment est situé à moins de quatre mètres de la limite du bien-fonds, aucun entreposage extérieur ne sera autorisé sauf à l’intérieur d’un enclos opaque entièrement clôturé d’au moins 1,5 mètre et d’au plus 2 mètres de hauteur et une telle installation d’entreposage doit être située à au moins 18 mètres de la limite d’une rue publique. 33(3) Deux véhicules au plus peuvent être montrés ou entreposés à des fins de vente sur un lot d’un atelier de réparation automobile précisé au sous-alinéa 33(1)b)(iii). 33(4) Une écurie privée est réputée être un usage accessoire et ne doit pas a) être située sur un lot de telle manière qu’une partie quelconque soit (i) à dix-huit mètres de l’alignement de la rue, (ii) à six mètres de la limite latérale ou arrière d’un lot, (iii) à neuf mètres d’un bâtiment principal sur le même lot; ou (iv) à vingt-quatre mètres de toute résidence sur un lot adjacent; ni b) abriter plus de deux animaux et six volailles pour chaque tranche de mille quatre cents mètres carrés de superficie et, en aucun cas, plus de 19 animaux, autres que la volaille, ou plus de 199 volailles. DISPOSITIONS GÉNÉRALES Dimensions des lots 34(1) Il est interdit d’édifier, d’implanter, de réimplanter, de modifier ou de remplacer un bâtiment ou une construction sur un lot qui ne répond pas aux prescriptions du présent article. 34(2) Les lots desservis par un réseau de distribution d’eau et un réseau d’égout publics doivent avoir, a) dans le cas d’une habitation à un logement, d’un bâtiment ou d’une construction qui ne servent pas à des fins résidentielles, (i) une largeur minimale de 18 mètres, (ii) une profondeur minimale de 30 mètres, (iii) une superficie minimale de 540 mètres carrés; b) dans le cas d’une habitation à deux logements, (i) une largeur minimale de 23 mètres, (ii) une profondeur minmale de 30 mètres, (iii) une superficie minimale de 818 mètres carrés; c) dans le cas d’une habitation à trois logements, (i) une largeur minimale de 27 mètres, (ii) une profondeur minimale de 30 mètres, (iii) une superficie minimale de 1 090 mètres carrés; d) dans le cas d’une habitation à logements multiples, (i) une largeur minimale de 36 mètres à laquelle il faut ajouter 1,5 mètre par logement au-delà de quatre, (ii) une profondeur minimale de 30 mètres, (iii) une superficie minimale de 1 272 mètres carrés à laquelle il faut ajouter 68 mètres carrés par logement au-delà de quatre. 34(3) Les lots desservis par un réseau public d’égout, mais non par un réseau public de distribution d’eau doivent avoir, The Royal Gazette — January 26, 2005 (a) for a single-unit dwelling or a building or structure not used for residential purposes (i) a width of at least 23 metres, (ii) a depth of at least 30 metres, and (iii) an area of at least 690 square metres; or (b) for a two-unit dwelling, (i) a width of at least 27 metres, (ii) a depth of at least 30 metres, and (iii) an area of at least 1,022 square metres; or (c) for a three-unit dwelling, (i) a width of at least 32 metres, (ii) a depth of at least 30 metres, and (iii) an area of at least 1,363 square metres; or (d) for a multiple dwelling, (i) a width of at least 36 metres, plus 1.5 metres for each dwelling unit in excess of four, (ii) a depth of at least 30 metres, and (iii) an area of at least 1,545 square metres, plus 102 square metres for each dwelling unit in excess of four. 34(4) Where a lot is not serviced by a sewer system for public use, the lot (a) shall have and contain (i) a width of at least 54 metres, (ii) a depth of at least 38 metres, and (iii) an area of at least 4,000 square metres; and (b) shall not be used as the location for a two-unit dwelling or multiple dwelling. 34(5) Notwithstanding subsection (4), any lot that is serviced by a private sewage disposal system that has been certified by the regional medical health officer may be used as the location for (a) a two-unit dwelling, if it has (i) a width of at least 59 metres, and (ii) an area of at least 5,350 square metres; or (b) a three-unit dwelling, if it has (i) a width of at least 63 metres, and (ii) an area of at least 6,700 square metres; or (c) a four-unit dwelling, if it has (i) a width of at least 68 metres, and (ii) an area of at least 8,050 square metres; or (d) a senior citizens home. 34(6) Paragraphs (b), (c) or (d) of subsection (2) do not apply to lots resulting from the subdivision of a parent lot along the party wall of a dwelling. Size of Dwellings and Dwelling Units 35(1) No dwelling may be placed, erected or altered so that it has a ground floor area less than 45 square metres. 35(2) No dwelling unit may have a floor area less than (a) 32 square metres, in the case of a dwelling unit in a multiple-unit dwelling containing a combination living room and bedroom with no separate bedroom, commonly known as a bachelor apartment; (b) 45 square metres, in the case of a dwelling unit in a multiple-unit dwelling containing one bedroom; or (c) 45 square metres, in the case of a dwelling unit other than one mentioned in paragraph (a) or (b). 35(3) For the purposes of this section, ground floor area or floor area does not include garages, carports, porches, verandas, breezeways, approach halls or stairways that are not completely contained in a dwelling unit. 183 Gazette royale — 26 janvier 2005 a) dans le cas d’une habitation à un logement, d’un bâtiment ou d’une construction qui ne servent pas à des fins résidentielles, (i) une largeur minimale de 23 mètres, (ii) une profondeur minimale de 30 mètres, (iii) une superficie minimale de 690 mètres carrés; b) dans le cas d’une habitation à deux logements, (i) une largeur minimale de 27 mètres, (ii) une profondeur minimale de 30 mètres, (iii) une superficie minimale de 1 022 mètres carrés; c) dans le cas d’une habitation à trois logements, (i) une largeur minimale de 32 mètres, (ii) une profondeur minimale de 30 mètres, (iii) une superficie minimale de 1 363 mètres carrés; d) dans le cas d’une habitation à logements multiples, (i) une largeur minimale de 36 mètres à laquelle il faut ajouter 1,5 mètre par logement au-delà de quatre, (ii) une profondeur minimale de 30 mètres, (iii) une superficie minimale de 1 545 mètres carrés à laquelle il faut ajouter 102 mètres carrés par logement au-delà de quatre. 34(4) Les lots non desservis par un réseau public d’égout a) doivent avoir (i) une largeur minimale de 54 mètres, (ii) une profondeur minimale de 38 mètres, (iii) une superficie minimale de 4 000 mètres carrés; b) ne peuvent servir à l’implantation d’une habitation à deux logements ou à logements multiples. 34(5) Par dérogation au paragraphe (4), tout lot qui sera desservi par un réseau privé d’évacuation des eaux usées et qui a été agréé par le médecin-hygiéniste régional peut servir à l’implantation a) d’une habitation à deux logements, s’il a (i) une largeur minimale de 59 mètres, (ii) une superficie minimale de 5 350 mètres carrés; b) d’une habitation à trois logements, s’il a (i) une largeur de 63 mètres carrés, (ii) une superficie minimale de 6 700 mètres carrés; c) d’une habitation à quatre logements, s’il a (i) une largeur minimale de 68 mètres carrés, (ii) une superficie minimale de 8 050 mètres carrés; ou d) d’un foyer de personnes âgées. 34(6) Les alinéas (2)b), c) ou d) ne s’appliquent pas aux lots résultant du lotissement du lot original à partir d’un mur mitoyen de logements. The Royal Gazette — January 26, 2005 Location of Buildings and Structures on a Lot 36(1) No main building or structure shall be placed, erected or altered so that any part of it (a) is less than (i) 15 metres from the boundary of an arterial or collector highway, or (ii) 7.5 metres from the boundary of a street, private access, lane, right-of-way or highway other than an arterial or collector highway; and (b) with respect to a side or rear lot line, is within (i) one metre in the case of a lot serviced by both a water system for public use and a sewer system for public use, or (ii) one and one-half metres, in the case of any other lot. 36(2) Subject to subsection (3), a building or structure may be placed, erected or altered so that it is as close to the boundary of a public road, highway or private road used as a street or other access for vehicles as existing buildings or structures provided that (a) the existing buildings or structures are on each side of and immediately adjacent to such building or structure; and (b) the nearest side of each existing building or structure immediately adjacent thereto is within 30 metres of the nearest side of the building or structure to be placed, erected or altered. 36(3) Notwithstanding subsection (2), no main building or structure, mentioned in subsection (2), shall be placed, erected or altered so that any part of it is within 4.5 metres of the boundary of a public road, highway or private road. 36(4) No accessory building or structure shall be placed, erected or altered so that any part of it is within (a) 15 metres of the boundary of an arterial or collector highway, or 7.5 metres of the boundary of a street or highway, other than an arterial or collector highway; (b) 1 metre of a side or rear lot line; or (c) 1.5 metres from a side lot line or rear lot line, for accessory buildings or structures of more than 4.5 metres in height. 37 Landscaping The owner of a lot shall landscape (a) the front yard of the main building; and (b) that part of the lot within two metres of any building on it. Number of Main Buildings or Structures on a Lot 38(1) Subject to subsection (2), no more than one building containing one or more residential dwelling units may be placed or erected on a lot, and no building or structure may be altered to become a second building containing a residential unit. 38(2) Subsection (1) does not apply where a caretaker’s residence is located on the same lot as the principal dwelling in the case of a farm consisting of 20 hectares or more, a mini home or mobile home park or a temporary residence permit issued under the Provincial Building Regulation. Aménagement paysager 37 Le propriétaire d’un lot doit aménager a) la cour avant du bâtiment principal; b) une bande de terre de deux mètres de largeur tout autour de tout bâtiment qui s’y trouve. Nombre de bâtiments principaux ou de constructions principales 38(1) Sous réserve du paragraphe (2), il est interdit d’implanter ou d’édifier plus d’un bâtiment comprenant une unité de logement ou plus sur un lot et de modifier un bâtiment ou une construction de façon à créer un deuxième bâtiment comptant une unité de logement. 38(2) Le paragraphe (1) ne s’applique pas à la résidence d’un fournisseur de soins située sur le même lot que le logement principal dans le cas d’une exploitation agricole de 20 hectares ou plus, d’un parc de mini-maisons ou de maisons mobiles, ou d’un permis de résidence temporaire délivré en vertu du Règlement provincial sur la construction. The Royal Gazette — January 26, 2005 39(2) Off-street vehicular parking spaces mentioned in subsection (1) shall be provided as follows: (a) for a dwelling - one space for each dwelling unit; (b) for a residential apartment building designed specifically for senior citizens - not less than one space per three dwelling units; (c) for a residential care facility - not less than one space for three beds; (d) for a bed and breakfast - one space plus one space per guestroom; (e) for boarding or rooming houses or a bed and breakfast one space plus one space per guestroom; (f) for a retail store or service - not less than one space for each 40 square metres of retail sales floor space; (g) for a bank, financial institution or office use - not less than one space for each 50 square metres of gross floor area; (h) for restaurants - not less than one space for each 4 seats; (i) for drive-in restaurants or take-out restaurants - not less than one space for every 5 square metres of gross floor area; (j) for licensed beverage rooms, lounges and cabarets - not less than one space for every 10 square metres of gross floor area; (k) for theatres - not less than one space for every 5 seats; (l) for a hotel, motel or a motor inn - 2 spaces plus one space for each unit; (m) for an institutional use, other than a public school - not less than one space for every 10 square metres of gross floor area; (n) for a public school - one space for each classroom and not less than one space for each ten seats where an auditorium is included; (o) for a hospital - .5 spaces per bed; (p) for a daycare - not less than one space for every 38 square metres of gross floor area; (q) for a medical clinic or the office of any health practitioner - 3 spaces per examination room; (r) for funeral homes and crematoria with associated chapple 15 spaces per viewing room and not less than 1 space for each five square metres of gross floor area used for a chapple; (s) for a warehouse - five spaces; (t) for a transportation terminal - not less than one space for 100 square metres of gross floor area; (u) for a manufacturing or processing use - not less than one space for every 50 square metres of gross floor area; (v) for a television or radio studio - not less than one space for every 50 square metres of gross floor area; and (w) for a use not otherwise provided for in this subsection - not less than one for each fifty square metres of gross floor area. 39(3) An off-street vehicular parking space shall (a) have a width of at least 2.8 metres and a length of at least 5.5 metres; and (b) be readily accessible from a public street. Activité professionnelle à domicile 40(1) Sous réserve du paragraphe (2), lorsque l’exercice d’une activité professionnelle à domicile est permis, le bâtiment principal ou un bâtiment accessoire situé sur le même lot que le bâtiment principal peut servir à l’exercice de l’une des activités professionnelles suivantes : a) médecin, dentiste, architecte, artiste, comptable, photographe, avocat ou ingénieur professionnel; The Royal Gazette — January 26, 2005 (b) a dressmaker, tailor, real estate or insurance salesman or a consulting business; (c) a day-care centre, day nursery or kindergarten, for not more than fifteen children in attendance at any time; (d) the making of crafts; (e) a beauty parlour or barber shop or other personal service shop for not more than two customers at a time; (f) a computer based business; (g) an office use; or (h) a business involving the repair of household articles, appliances, radios, televisions, computers and similar items. 40(2) A home occupation is subject to the requirements that (a) the floor area of the dwelling unit which is devoted to the home occupation does not exceed the lesser of (i) twenty percent of the floor area of the dwelling unit, or (ii) 75 square metres; (b) no change, except for a sign, is made to the outside appearance of the dwelling unit; (c) no goods or services other than those directly pertaining to the home occupation are supplied or sold in or from the main building or accessory building; (d) no equipment or material used in connection with the home occupation is stored other than in a completely enclosed building; and (g) two off-street parking spaces are provided in excess of those required under section 39. Stripping of Topsoil 41(1) Except in an A Zone, no person may strip, excavate or otherwise remove the topsoil for sale or for other commercial use from a lot or other parcel of land except in accordance with this section. 186 Gazette royale — 26 janvier 2005 b) couturière, tailleur, agent immobilier, agent d’assurance ou expert-conseil; c) garderie de jour, jardin d’enfants ou maternelle pour au plus quinze enfants présents à toute heure; d) travaux d’artisanat; e) salon de beauté ou de coiffure, ou autre boutique de service personnel pour au plus deux clients en même temps; f) entreprise informatisé; g) bureau; h) entreprise comportant la réparation d’appareils et d’articles ménagers, de radios, de télévisions, d’ordinateurs et d’articles semblables. 40(2) L’exercice d’une activité professionnelle à domicile est soumis aux conditions suivantes : a) l’aire de plancher du logement qui lui est affectée ne peut dépasser la moindre des deux dimensions suivantes : (i) vingt pour cent de l’aire de plancher du logement, ou (ii) soixante-quinze mètres carrés; b) à l’exclusion d’une affiche, il ne peut être apporté à l’aspect extérieur du bâtiment aucun changement; c) nul bien ni service, à l’exclusion de ceux directement liés à l’activité professionnelle visée, ne peut être vendu ou fourni dans le bâtiment principal ou accessoire, ou à partir de celui-ci; d) l’équipement ou le matériel servant à cette activité ne peut être entreposé dans un bâtiment entièrement clôturé; Existing Undersized Lot 43 A lot, vacant on the effective date of this regulation, having less than the minimum frontage, depth or area herein required, may be used for any purpose permitted within the zone in which the lot is located and a building or structure may be placed, erected or altered on the said lot, provided that all other applicable provisions of this regulation, and other acts and regulations, are satisfied. g) deux espaces de stationnement hors voirie sont fournis en plus de ceux requis à l’article 39. Panneaux 42 Les panneaux doivent être conformes au Règlement sur la publicité routière - Loi sur la voirie, Règlement du Nouveau-Brunswick 97-143. Lot n’atteignant pas la taille minimale 43 Un lot vacant à la date d’entrée en vigueur du présent règlement d’une façade, profondeur ou superficie inférieure au minimum requis peut servir à toute fin permise dans la zone où il est situé et un bâtiment et un ouvrage peut être situé, érigé ou modifié sur ledit lot pourvu que toutes les autres dispositions applicables du présent règlement et autres lois et règlements soient respectés.
