Benoit Marleau - Foyer St-Viateur Nursing Home Audition à Ottawa le 20 septembre 2010. - A hearing in this matter was held in Ottawa on September 20, 2010 SENTENCE ARBITRALE – AWARD Comme la version anglaise et la version française de la convention collective sont également officelles, cette sentence utilise les deux langues. As the collective agreement recognizes that both the French and English versions of the collective agreement have equal official status, this award is written using both languages. This award concerns the interest arbitration of a first collective agreement. The Home is a for profit nursing home of 57 beds in Limoges, Ontario. The Union was certified on June 26, 2008 as bargaining agent for a unit of some 73 employees, excluding office and supervisory staff. Notice to bargain was given on July 2, 2008 and following extensive negotiation meetings and conciliation, a “no board report” was issued on April 3, 2009. Il est à noter qu’un bon nombre des dispositions de la convention collective sont convenues entre les parties. Ces dispositions, qui apparaissent à l’onglet 3 du deuxième volume du mémoire du syndicat et à l’onglet A du mémoire du Foyer, sont par la présente incorporées comme faisant partie intégrante de cette sentence. Au stade de l’arbitrage il reste donc dix points en litige qui doivent être tranchés par ce tribunal. 1 We deem it important to state certain guiding principles to the making of our decision. Firstly, it is trite to say that a board of interest arbitration should strive, insofar as possible, to fashion an award that would approximate the collective agreement the parties would reasonably have reached themselves through collective bargaining. Care must be taken to fashion an award that conforms to collective agreements freely negotiated in similar nursing homes, regard being had to geographic location, size of home and the maturity of bargaining relationships. If it is true that interest arbitration is not the forum for achieving unprecedented breakthrough provisions, it is also true that care must be taken to recognize that generally the gains of a union are not all realized in a first collective agreement. Collective bargaining is an incremental process, so that the movement of the parties towards the terms of more generous established collective agreements in other institutions is something to be achieved over time, and not entirely in a first collective agreement. That, in our view, would be the outcome of a freely negotiated agreement. Additionally, while we are not bound by current government restraints on compensation, such as Ontario’s Bill 16, we do remain cognizant of the general constraints that influence wage settlements in the current relatively weak economy. 1. Definitions: La définition d’étudiants pour les fins de la convention collective proposée par l’employeur est adoptée. 2. Article 15, Hours of Work: 2 The employer shall make all reasonable efforts to schedule every other weekend as an employee’s days of rest, and in any event shall not schedule less than one out of three week-ends for an employee’s days of rest. 3. L’article 16.06, Indemnité de rappel au travail: La demande du syndicat est accordée, sauf que la garantie de payement minimum sera d’une heure plutôt que de trois heures. 4. Vacation: Article 21.01 as proposed by the Union is awarded, in part. The greatest accumulation of vacation shall be five weeks after fifteen or more years of service, it being understood that “year” means a calendar year. Article 22.01 shall provide: Les employées à temps partiel ont des crédits de service aux fins de vacances, à raison d’une année de service par tranche de 1875 heures travaillées. Les employées à temps partiel ont droit à une indemnité de congé annuel payable le 1er juin et le 1er décembre de chaque année. Article 22.02 shall provide: Les employées ayant accumulé 1 875 heures de travail mais moins de 9 375 heures de travail reçoivent 4% du salaire brut payé dans l’année. 3 Les employées ayant accumulé 9 375 heures de travail mais moins de 18 750 heures de travail reçoivent 6% du salaire brut payé dans l’année. Les employées ayant accumulé 18 750 heures de travail mais moins de 28 125 heures de travail reçoivent 8% du salaire brut payé dans l’année. Les employées ayant accumulé 28 125 heures de travail ou plus reçoivent 10% du salaire brut payé dans l’année. 5. Article 18 – Public Holidays The Board awards the following article respecting the floating day off: The floating day off with pay shall be taken on a day mutually agreed upon between the employee and the Employer, not to be unreasonably denied. Employees shall not be permitted to schedule their floating holiday between December 15th and January 5th. 6. L’article 20/24 – Congés de maternité et parental Le tribunal accorde la position de l’employeur pour le libellé de l’article 20.04 et rejette la proposition du syndicat concernant l’article 24. 7. Article 21 – Health and Welfare Benefits: 4 The Board awards article 21 as proposed by the Employer, save that the “plan” referred to therein shall be the Great West Life Group Benefit Plan contained in tab “C” of the Employer’s brief, or its equivalent. 8. Travail pendant les vacances: Le tribunal ne peut accorder que le salaire des employées qui acceptent volontiers de travailler pendant leur période de vacances soit majoré de moitié, comme le demande le syndicat. Nous accordons, cependant, que l’article 23.01 se lise: “ Il est entendu que l’Employeur ne peut obliger une employée en vacances à se présenter au travail.” 9. Article 22/32 Pension Plan: The Board awards the proposal of the Employer as presented at Tab 9 of its brief. 10. Les articles 33.01 et 33.02, Durée et Rétroactivité: Le tribunal accorde la position du syndicat concernant l’article 33.01. La proposition du syndicat relativement à l’article 33.02, Rétroactivité, est également accordée, sauf que l’échéance pour le paiement prévu sera “…dans un délai n’excédant par quatre-vint- dix (90) jours de la signature de la présente convention collective.” 5 11. Appendix A – Wages The Board awards the wage proposal of the Employer, being a general wage increase of 3% June 29, 2008 (less 1.0% already given on June 29, 2008) and a further increase of 2.75% on July 25, 2009. The Board awards the following specific adjustments for Registered Nurses: June 29, 2008 – 5.0% (less 1.0% already given on June 29, 2008) April 25, 2009 - 5.0% January 31, 2010 – 8.0% Up to a maximum of ONA Master Nursing Homes posted rates: employees must present evidence of years of experience within 60 days of the signing of this Agreement. Additionally, we award wage adjustments of $0.15 for RPN’s in 2009 and a further wage adjustment for RPN’s of $0.15 in 2010. In dealing with the issue of wages we do not consider that it is within the purview of this Board to consider and determine whether the Employer has properly applied Pay Equity adjustments. Should there be any meaningful issue in that regard, it is plainly one for another tribunal. 6 We retain jurisdiction in the event of any dispute concerning the interpretation or implementation of this Award.
