1995 CHAPTER C-6.1 An Act respecting Changes of Name PART I Short Title and Interpretation Short title 1 This Act may be cited as The Change of Name Act, 1995. Interpretation 2(1) In this Act: Aapplication@ means an application for a change of name required pursuant to section 5; (*demande+) Achange@ means, with respect to a person's name, a change by way of alteration, substitution, addition or abandonment; (*changement+) Achild@ means a person under 18 years of age who has never been married; (*enfant+) Adirector@ means the Director of Vital Statistics; (*directeur+) Agiven name@ means a name other than a surname; (*prénom+) Alegal custodian@ means a person having lawful custody of a child within the meaning of The Children's Law Act, but does not include the Minister of Social Services or an agency within the meaning of The Adoption Act; (*gardien légal+) Aname@ means a person's given name or surname or both; (*nom+) Aprescribed@ means prescribed in the regulations; (version anglaise seulement) Asurname@ includes the family name. (*nom de famille+) (2) For the purposes of this Act, a name is to be written entirely in characters of the Roman alphabet. 1995, c.C-6.1, s.2. How Act to be interpreted 3 This Act is to be interpreted in a manner that achieves uniformity in the interpretation of similar laws respecting changes of name that are in force in other provinces and territories of Canada. 1995, c.C-6.1, s.3. PART II Change of Name by Application When change of name is effective 4(1) No change of name is effective unless it is made pursuant to this Act. (2) Notwithstanding subsection (1), a change of name may be made: (a) pursuant to sections 6, 13, 14, 32 and 33 of The Vital Statistics Act, 1995; (b) pursuant to section 6 of The Vital Statistics Act as that section existed on the day before the coming into force of The Vital Statistics Amendment Act, 1993; or (c) pursuant to section 19 of The Adoption Act. 1995, c.C-6.1, s.4. Application for registration required 5(1) Subject to subsection (2) and to Part III, a person wishing to make a change of name pursuant to this Act shall file with the director an application for a change of name. (2) No person shall file an application with the director unless that person: (a) is ordinarily resident in Saskatchewan; (b) has actually resided in Saskatchewan for at least three consecutive months in the 12-month period preceding the date of his or her application; (c) is legally entitled to remain in Canada; and (d) is at least 18 years old or is married, widowed or divorced. (3) Subject to sections 6 to 9, a person mentioned in subsection (1) may apply for a change of name for his or her spouse and any child of whom he or she is the legal custodian. 1995, c.C-6.1, s.5. Contents of application 6(1) Every application must be in the prescribed form. PARTIE II Changement de nom sur demande Validité du changement 4(1) Seuls sont valides les changements de nom effectués en conformité avec la présente loi. (2) Par dérogation au paragraphe (1), un changement de nom peut être effectué selon : a) les articles 6, 13, 14, 32 et 33 de la loi intitulée The Vital Statistics Act, 1995; b) l'article 6 de la loi intitulée The Vital Statistics Act tel qu'il était libellé avant l'entrée en vigueur de la loi intitulée The Vital Statistics Amendment Act, 1993; c) l'article 19 de la loi intitulée The Adoption Act. 1995, ch.C-6,1, art.4. Demande d'enregistrement obligatoire 5(1) Sous réserve du paragraphe (2) et de la partie III, la personne qui souhaite effectuer un changement de nom conformément à la présente loi doit déposer une demande auprès du directeur. (2) Seule la personne qui remplit les conditions suivantes peut déposer une demande auprès du directeur : a) elle réside ordinairement en Saskatchewan; 1 décembre 1994 - 13 h 30 1995 c.C-6.1 CHANGE OF NAME 2 (2) Every application must be accompanied by: (a) the consent of every person that is required pursuant to this Act or an order dispensing with consent; (b) an affidavit of qualification and bona fides; and (c) the prescribed fee. (3) The director may require an applicant to provide, at any time, any other information or documentary evidence that the director considers necessary to determine whether to register the application. 1995, c.C-6.1, s.6. Consents: change of name by married person, spouse 7(1) Every application for a change of name of a married person must be accompanied: (a) by proof of notice of the application to the person's spouse; or (b) by an affidavit signed by the applicant stating that the spouses are living separate and apart from each other. (2) No person shall file an application for a change of name for his or her spouse unless the application is accompanied by the written consent of his or her spouse. 1995, c.C-6.1, s.7. Consents: change of name by legal custodian 8(1) Where a person who meets the requirements of clauses 5(2)(a), (b) and (c) is the legal custodian of a child, that person may file an application for a change of name for the child. (2) An application pursuant to subsection (1) must be accompanied: (a) by the written consent of every other person who is a legal custodian of the child mentioned in subsection (1); and (b) if the child is 14 years of age or older, by the written consent of that child. 1995, c.C-6.1, s.8. Dispensing with consent 9 Where an applicant is unable to obtain a consent required pursuant to section 7 or 8, the applicant may apply to a judge of the Court of Queen's Bench for an order dispensing with the consent, and the judge may grant or refuse to grant the order. 1995, c.C-6.1, s.9. When director may register change of name 10 The director may register the change of names requested in an application that has been filed with the director if, in the opinion of the director: (a) the application is complete; and (b) the applicant has complied with the other provisions of this Act. 1995, c.C-6.1, s.10. Effect of registration 11 The registration of a change of name pursuant to section 10 effects for all purposes the change of name requested in the application. 1995, c.C-6.1, s.11. Records and certificate of registration 12(1) Registration of a change of name pursuant to section 10 is completed when the director has: (a) completed and signed the form entitled ARegistration of Change of Name@; (b) indexed the registration by noting the registration on the annual index for the year in which the application requesting the change of name is filed; and (c) filed the registration in numerical sequence beginning with the number one on the first day of January in each year. (2) The director shall maintain for each year an annual index in which the director shall note the registration pursuant to section 10 or 15 of changes of names requested in applications filed in that year. (3) The annual indexes and registrations of changes of name are to be kept in the office of the director. (4) After registering a change of name, the director shall issue a certificate to the applicant setting out the change of name. 1995, c.C-6.1, s.12. Alteration of vital statistics records 13(1) On registration of a change of name pursuant to section 10, the director shall alter the vital statistics records maintained pursuant to The Vital Statistics Act, 1995 or any former Vital Statistics Act so that they conform with a registered change of name. (2) The director shall not charge a fee to alter the vital statistics records. 1995, c.C-6.1, s.13. Contenu de la demande 6(1) La demande doit être rédigée selon le formulaire réglementaire. (2) La demande doit être accompagnée : a) du consentement de toute personne dont le consentement est requis par la présente loi ou d'une ordonnance dispensant de ce consentement; b) d'un affidavit attestant de l'habilité à changer de nom et de la bonne foi; c) des droits prescrits. (3) Le directeur peut exiger de l'auteur de la demande qu'il fournisse, à tout moment, tout autre renseignement ou preuve documentaire qu'il juge nécessaire pour lui permettre de décider s'il doit enregistrer la demande. 1995, ch.C-6,1, art.6. Consentements : changement de nom par une personne mariée, un conjoint 7(1) La demande de changement du nom d'une personne mariée doit être accompagnée : a) soit d'une preuve de l'avis de la demande à son conjoint; b) soit d'un affidavit signé par l'auteur de la demande indiquant que les conjoints vivent séparément. (2) Nul ne peut déposer une demande pour le compte de son conjoint à moins que la demande ne soit accompagnée du consentement écrit de ce dernier. 1995, ch.C-6,1, art.7. Consentements : changement de nom par le gardien légal 8(1) Si la personne qui satisfait aux exigences des alinéas 5(2)a), b) et c) est le gardien légal de l'enfant, elle peut déposer une demande de changement du nom de l'enfant. (2) La demande présentée en conformité avec le paragraphe (1) doit être accompagnée : a) du consentement écrit de tout autre gardien légal de l'enfant visé au paragraphe (1); b) du consentement écrit de l'enfant, s'il a quatorze ans ou plus. 1995, ch.C-6,1, art.8. Dispense du consentement 9 Si l'auteur de la demande est incapable d'obtenir le consentement requis par l'article 7 ou 8, il peut demander au juge de la Cour du Banc de la Reine de rendre une ordonnance le dispensant du consentement. Le juge peut accorder l'ordonnance ou la refuser. 1995, ch.C-6,1, art.9. Enregistrement du changement de nom par le directeur 10 Le directeur peut enregistrer le changement de nom formulé dans la demande déposée auprès de lui, s'il est d'avis : a) que la demande est complète; b) que l'auteur de la demande s'est conformé aux autres dispositions de la présente loi. 1995, ch.C-6,1, art.10. Effet de l'enregistrement 11 L'enregistrement du changement de nom conformément à l'article 10 opère, à toutes fins que de droit, le changement de nom requis dans la demande. 1995, ch.C-6,1, art.11. 1 décembre 1994 - 13 h 30 1995 c.C-6.1 CHANGE OF NAME 3 Notice of change of name 14(1) Subject to the regulations, the director shall publish in the Gazette a notice of each change of name that results from registration pursuant to section 10. (2) The notice mentioned in subsection (1) is to include the name and former name of every person whose name is changed as a result of the registration of the change of name pursuant to section 10. (3) The director may decide that publication of the notice pursuant to subsection (1) is not to be made where the person to whom the change of name applies files a statutory declaration with the director stating that the person assumed the name proposed in the application prior to May 1, 1933 and has continued to use that name. 1995, c.C6.1, s.14. Procedure if change of name has been made in another jurisdiction 15(1) Where a change in a person's name has been made in accordance with the laws of another jurisdiction, the director may register the change of name where that person or another person on behalf of that person: (a) files with the director an application for registration of the change of name; (b) provides proof satisfactory to the director of the change of name; and (c) pays the prescribed fee. (2) Registration of a change of name pursuant to this section is completed when the director has: (a) completed and signed the form entitled ARegistration of Change of Name Effected Outside the Province of Saskatchewan@; (b) indexed the registration by noting the registration on the annual index maintained pursuant to section 12 for the year in which the application requesting the change of name is filed; and (c) filed the registration in numerical sequence beginning with the number one on the first day of January in each year. (3) After registering a change of name, the director shall: (a) issue a certificate of registration to the applicant setting out the change of name; and (b) alter the vital statistics records maintained pursuant to The Vital Statistics Act, 1995 or any former Vital Statistics Act so that they conform with a registered change of name. (4) The director shall not charge a fee to alter the vital statistics records. 1995, c.C-6.1, s.15. Application for duplicate certificates 16 Any person may apply to obtain a duplicate certificate of any change of name made pursuant to this Part by filing with the director an application in the prescribed form and paying the prescribed fee. 1995, c.C-6.1, s.16. Evidentiary value of certificate and duplicate certificates 17 A certificate or duplicate certificate of change of name issued pursuant to this Part is proof, in the absence of evidence to the contrary, of its contents without proof of the appointment or signature of the director. 1995, c.C-6.1, s.17. Substitution of new name in documents 18 Without restricting the effect that a change of name may have at law, a change of name pursuant to this Part entitles the person whose name was changed to have the new name substituted for the former name in every record, certificate, instrument, document, contract or writing whatsoever, whether public or private, where the person: (a) produces the certificate or duplicate certificate of change of name; (b) produces satisfactory proof of his or her identity; and (c) pays any fee or fees that may be prescribed pursuant to any statute or law for the substitution to be made. 1995, c.C-6.1, s.18. (3) Les répertoires annuels et les enregistrements de changements de nom sont gardés au bureau du directeur. (4) Après l'enregistrement du changement de nom, le directeur délivre à l'auteur de la demande, un certificat précisant le changement de nom. 1995, ch.C-6,1, art.12. Modifications des dossiers de l'état civil 13(1) Après enregistrement du changement de nom en conformité avec l'article 10, le directeur modifie les dossiers de l'état civil tenus en conformité avec la loi intitulée The Vital Statistics Act, 1995 ou toute loi antérieure intitulée Vital Statistics Act de façon à les rendre conformes au changement de nom enregistré. (2) Le directeur ne perçoit aucun droit pour la modification des dossiers de l'état civil. 1995, ch.C-6,1, art.13. Avis de changement de nom 14(1) Sous réserve des règlements, le directeur fait publier dans la Gazette avis de tout changement de nom résultant d'un enregistrement en conformité avec l'article 10. Changement de nom à l'extérieur de la Saskatchewan 15(1) Lorsqu'un changement de nom a été fait en conformité avec les lois d'une autre autorité législative, le directeur peut enregistrer le changement de nom si la personne visée par le changement ou une autre personne agissant pour son compte : a) dépose auprès du directeur une demande d'enregistrement du changement de nom; b) fournit une preuve du changement de nom jugée satisfaisante par le directeur; c) paie les droits prescrits. (2) L'enregistrement du changement de nom en conformité avec le présent article est effectué après que le directeur : a) a rempli et signé la formule intitulée * Enregistrement de changement de nom effectué à l'extérieur de la province de la Saskatchewan +; b) a répertorié l'enregistrement en le notant dans le répertoire annuel de l'année au cours de laquelle la demande a été déposée, lequel répertoire est tenu en conformité avec l'article 12; c) a classé l'enregistrement par ordre numérique, en commençant par le numéro un au premier janvier de chaque année. Application not required 20 A person who elects to use a surname in accordance with section 21 or 23 is not required to submit an application for a change of name with respect to that election. 1995, c.C-6.1, s.20. Married persons 21(1) In this section, Apre-marriage surname@ means the legal surname that a married person was using immediately prior to his or her current marriage. (2) A married person who is a resident of Saskatchewan may elect to use one of the following as a legal surname: (a) the married person's pre-marriage surname; (b) the married person's birth name; (c) subject to subsections (3) and (4), the surname of the married person's spouse; (d) subject to subsections (5) to (7) and sections 22 and 24, a double surname. (3) A married person may elect to use his or her spouse's surname as a legal surname only where the spouse, as a married person, elects to use: (a) the spouse's pre-marriage surname; or (b) the spouse's birth name. (4) A married person who elects to use his or her spouse's surname in accordance with this section may continue to use that surname notwithstanding that the spouse subsequently changes his or her surname: (a) by an election pursuant to this section; or (b) by any other means authorized pursuant to this Act. (5) Where a married person elects to use a double surname and his or her spouse does not elect to use a double surname, the married person may use a double surname consisting of: (a) the married person's: (i) birth name; or (ii) pre-marriage surname; and (b) the surname that the spouse as a married person elects to use in accordance with subsection (2). (6) Where a married person elects to use a double surname and his or her spouse also elects to use a double surname, the married person may use a double surname consisting of: (a) the married person's: (i) birth name; or (ii) pre-marriage surname; and (b) the spouse's: (i) birth name, where the spouse, as a married person, uses his or her birth name as part of his or her double surname; or (ii) pre-marriage surname, where the spouse, as a married person, uses his or her pre-marriage surname as part of his or her double surname. (7) A married person who elects to use a double surname in accordance with this section may continue to use that double surname notwithstanding that his or her spouse subsequently changes his or her surname: (a) by an election in accordance with this section; or (b) by any other means authorized pursuant to this Act. 1995, c.C-6.1, s.21. Procedure re double surname 22(1) A married person who elects pursuant to section 21 to use a double surname shall file a notice in the prescribed form with the director. (2) The director shall register each notice filed pursuant to subsection (1) when it is received and retain the notice as part of the director's records. (3) On registering a notice pursuant to subsection (2), the director shall issue a copy, certified by the director to be a true copy, of the notice to the person who filed it. (4) On request by any person and on payment by that person of the prescribed fee, the director shall issue to that person a copy, certified by the director to be a true copy, of a notice registered pursuant to subsection (2). 1995, c.C6.1, s.22. Substitution du nouveau nom dans les documents 18 Sans restreindre les effets qu'un changement de nom peut avoir en droit, le changement de nom effectué en conformité avec la présente partie confère à la personne dont le nom a été changé le droit d'obtenir la substitution du nouveau nom à l'ancien dans tout dossier, certificat, instrument, document, contrat ou écrit, qu'il soit public ou privé, si elle remplit les conditions suivantes : a) elle produit le certificat de changement de nom ou le duplicata; b) elle produit une preuve de son identité, jugée satisfaisante; c) elle paie les droits prescrits par une loi ou une règle de droit pour la substitution. 1995, ch.C6,1, art.18. PARTIE III Changement de nom par choix Définitions 19 Les définitions qui suivent s'appliquent à la présente partie. *nom à la naissance+ Nom de famille légal d'une personne enregistré dans les dossiers d'enregistrement des naissances de l'autorité législative où elle est née. (Abirth name@) *résidant de la Saskatchewan+ Celui qui : a) réside ordinairement en Saskatchewan; b) a effectivement eu sa résidence en Saskatchewan pendant au moins trois mois consécutifs des douze mois qui précèdent la date de son choix; c) est légalement habilité à rester au Canada. (Aresident of Saskatchewan@) 1995, ch.C-6,1, art.19. Demande non requise 20 La personne qui choisit d'utiliser un nom de famille en conformité avec l'article 21 ou 23 n'est pas tenue de présenter une demande à cet effet. 1995, ch.C-6,1, art.20. Personnes mariées 21(1) Dans le présent article, *nom de famille avant le mariage+ signifie le nom de famille légal qu'une personne portait immédiatement avant son mariage actuel. (2) La personne mariée qui réside en Saskatchewan peut choisir de porter l'un des noms suivants comme nom de famille légal : a) son nom de famille avant le mariage; b) son nom à la naissance; c) sous réserve des paragraphes (3) et (4), le nom de famille de son conjoint; 1 décembre 1994 - 13 h 30 1995 CHANGEMENT DE NOM ch.C-6,1 5 d) sous réserve des paragraphes (5) à (7) et des articles 22 et 24, un nom de famille double. (3) Une personne mariée ne peut choisir d'utiliser le nom de famille de son conjoint comme nom de famille légal que si le conjoint, comme personne mariée, choisit d'utiliser : a) soit son nom de famille avant le mariage; b) soit son nom à la naissance. (4) La personne mariée qui choisit d'utiliser le nom de famille de son conjoint en conformité avec le présent article peut continuer d'utiliser ce nom de famille même si le conjoint change son nom de famille par la suite, dans les cas suivants : a) en faisant un choix en conformité avec le présent article; b) par tous autres moyens authorisé par la présente loi. (5) Si la personne mariée choisit d'utiliser un nom de famille double et que son conjoint ne fasse pas le même choix, la personne mariée peut utiliser un nom de famille double composé des noms suivants : a) son nom à la naissance ou son nom de famille avant le mariage; b) le nom de famille qu'elle a choisi d'utiliser comme personne mariée en conformité avec le paragraphe (2). (6) Si une personne mariée choisit d'utiliser un nom de famille double et que son conjoint choisisse aussi d'utiliser un nom de famille double, la personne mariée peut utiliser un nom de famille double composé des noms suivants : a) son nom à la naissance ou son nom de famille avant le mariage; b) l'un des noms suivants du conjoint : (i) soit son nom à la naissance, si le conjoint, comme personne mariée, utilise son nom à la naissance comme partie de son nom de famille double; (ii) soit son nom de famille avant le mariage si le conjoint, comme personne mariée, utilise le nom de famille qu'il portait avant le mariage comme partie de son nom de famille double. (7) La personne mariée qui choisit d'utiliser un nom de famille double en conformité avec le présent article peut continuer d'utiliser ce nom de famille double même si son conjoint change son nom de famille par la suite : a) en faisant un choix conformément au présent article; b) par tous autres moyens autorisés par la présente loi. 1995, ch.C-6,1, art.21. Procédure relative au nom de famille double 22(1) La personne mariée qui choisit d'utiliser un nom de famille double en conformité avec l'article 21 doit déposer auprès du directeur un avis rédigé selon le formulaire réglementaire. (2) Le directeur enregistre chaque avis déposé en conformité avec le paragraphe (1) au moment où il le reçoit et garde l'avis dans ses dossiers. (3) Après l'enregistrement de l'avis en conformité avec le paragraphe (2), le directeur délivre à la personne qui l'a déposé une copie certifiée conforme par lui. (4) Sur demande et après paiement des droits prescrits, le directeur délivre une copie de l'avis enregistré en conformité avec le paragraphe (2), certifiée conforme par lui. 1995, ch.C-6,1, art.22. Nom de famille d'une personne divorcée ou veuve 23(1) Dans le présent article, *nom de famille avant le mariage+ s'entend du nom de famille légal qu'une personne portait immédiatement avant son plus récent mariage. (2) Le résidant de la Saskatchewan qui n'est pas marié et dont le plus récent mariage a été annulé peut choisir de porter comme nom de famille légal l'un des noms suivants : a) le nom de famille légal qu'il portait en conformité avec la présente loi au moment de l'annulation; b) son nom de famille avant le mariage; c) son nom à la naissance. 1 décembre 1994 - 13 h 30 1995 c.C-6.1 CHANGE OF NAME 5 Surname of divorced or widowed person 23(1) In this section, Apre-marriage surname@ means the legal surname that a person was using immediately prior to his or her most recent marriage. (2) A resident of Saskatchewan who is not married and whose most recent marriage has been annulled may elect to use one of the following as a legal surname: (a) the legal surname that the person was using in accordance with this Act at the time of the annulment; (b) the person's pre-marriage surname; (c) the person's birth name. (3) A resident of Saskatchewan who is not married and who has been granted a divorce with respect to that person's most recent marriage may elect to use one of the following as a legal surname: (a) the legal surname that the person was using in accordance with this Act at the time of the divorce; (b) the person's pre-marriage surname; (c) the person's birth name. (4) A resident of Saskatchewan whose most recent spouse has died may elect to use one of the following as a legal surname: (a) the legal surname that the person was using in accordance with this Act when the spouse died; (b) the person's pre-marriage surname; (c) the person's birth name. 1995, c.C-6.1, s.23. PART IV General Double surnames 24(1) For the purposes of this Act, no double surname may consist of more than two components. (2) The two components of a double surname may be joined by a hyphen. 1995, c.C-6.1, s.24. Director may annul registration if fraud or misrepresentation 25(1) The director may, by order, annul a change of name or a registration made pursuant to this Act if satisfied that a change of name has been obtained by fraud or misrepresentation. (2) An order to annul a change of name or a registration is effective from the date set out in the order, and a memorandum of the order is to be endorsed on the folio in which the change of name or registration appears in the annual index maintained pursuant to section 12. (3) The director shall publish a notice of the annulment in the Gazette. (4) When an order is made pursuant to subsection (1), the director shall make any necessary alterations in the vital statistics records maintained pursuant to The Vital Statistics Act, 1995 or a former Vital Statistics Act. (5) The director shall also file a copy of the order with: (a) the registrar of every land titles office; (b) the local registrar of the Court of Queen's Bench at every judicial centre; (c) the sheriff at each judicial centre; and (d) if the registration of the change of name was made pursuant to section 15, the appropriate registry of the jurisdiction in which the change of name was made. (6) On receipt of a copy of the order mentioned in subsection (5), the persons mentioned in clauses (5)(a) to (c) shall make any alterations to their records that are necessary as a result of the order. 1995, c.C-6.1, s.25. Requirement to return certificates 26(1) Where a registration of a change of name has been annulled pursuant to section 25, the director may, by order, require any person to whom a certificate or a duplicate certificate has been issued pursuant to this Act to return the certificate or duplicate certificate immediately. (2) No person shall refuse to comply with an order of the director made pursuant to subsection (1). (3) Every person who fails to comply with an order made pursuant to subsection (2) is guilty of an offence and is liable on summary conviction to a fine not exceeding $100. 1995, c.C-6.1, s.26. Offences 27(1) No person shall apply for a change of name for a fraudulent or improper purpose. (2) No person shall obtain a change of name pursuant to this Act by fraud or misrepresentation. (3) No person shall obtain a registration of a change of name pursuant to section 15 by fraud or misrepresentation. PARTIE IV Généralités Noms de famille doubles 24(1) Pour l'application de la présente loi, aucun nom de famille double ne peut comporter plus de deux parties. (2) Les deux parties du nom de famille double peuvent être réunies par un trait d'union. 1995, ch.C-6,1, art.24. Annulation de l'enregistrement en cas de fraude ou d'assertions inexactes 25(1) S'il est convaincu qu'un changement de nom a été obtenu par la fraude ou des assertions inexactes, le directeur peut, par arrêté, annuler le changement de nom ou l'enregistrement effectués en conformité avec la présente loi. (2) L'arrêté prescrivant l'annulation d'un changement de nom ou d'un enregistrement entre en vigueur à la date précisée dans l'arrêté; l'arrêté est mentionné sur le folio dans lequel le changement de nom ou l'enregistrement apparaît dans le répertoire annuel tenu en conformité avec l'article 12. (3) Le directeur publie un avis d'annulation dans la Gazette. (4) Lorsqu'un arrêté est pris en conformité avec le paragraphe (1), le directeur apporte les modifications qui s'imposent aux dossiers de l'état civil tenus en conformité avec la loi intitulée The Vital Statistics Act, 1995 ou toute loi antérieure intitulée Vital Statistics Act. (5) Le directeur dépose aussi une copie de l'arrêté auprès des personnes suivantes : a) tous les registrateurs de titres de biens-fonds; b) le registraire local de la Cour du Banc de la Reine dans tous les centres judiciaires; c) les shérifs de tous les centres judiciaires; d) si l'enregistrement du changement de nom a été fait en conformité avec l'article 15, le bureau d'enregistrement approprié de l'autorité législative où le changement de nom a été fait. Appeal 28(1) Any person aggrieved as a result of any of the following of the director's decisions may appeal the decision to a judge of the Court of Queen's Bench: (a) a refusal to register an application for a change of name; (b) an annulment of a change of name pursuant to section 25. (2) A person wishing to appeal shall file the appeal within 30 days of the date of the decision of the director. (3) An appeal is to be by notice of motion and is to be served on the director and any other person that the court may direct. (4) On hearing evidence and considering submissions by the parties, the judge may make an order affirming the decision of the director, directing the registration of the change of name or reversing the annulment of the change of name. (5) There is no further appeal from the order of the court mentioned in subsection (4). 1995, c.C-6.1, s.28. Signature of director 29(1) Where the signature of the director is required for any purpose pursuant to this Act, the signature may be written, engraved, lithographed or reproduced by any other mode of reproducing the signature in a visible form. (2) Every document issued pursuant to this Act under the signature of the director remains valid notwithstanding that the director has ceased to hold office before the document was issued. 1995, c.C-6.1, s.29. Regulations 30 The Lieutenant Governor in Council may make regulations: (a) prescribing any forms for the purposes of this Act; (b) prescribing the contents of any application, affidavit, consent, certificate or other document required for this Act; (c) prescribing and requiring the payment of fees for any service performed by the director pursuant to this Act; (d) exempting, on any terms or conditions, any person, category of persons, application or category of applications for a change of name from all or any of the requirements of Part II; (e) respecting any other matter or thing that is required or authorized by this Act to be prescribed in the regulations; (f) respecting any other matter or thing that the Lieutenant Governor in Council considers necessary to carry out the intent of this Act. 1995, c.C-6.1, s.30. PART V Transitional, Repeal, Coming into Force Transitional 31 All changes of name that were registered pursuant to The Change of Name Act, as that Act existed on the day before the coming into force of this Act, remain valid as if they were made pursuant to this Act and may be dealt with as if they were made pursuant to this Act. 1995, c.C-6.1, s.31. Repeal 32 The Change of Name Act is repealed. 1995, c.C-6.1, s.32. Coming into force 33 This Act comes into force on proclamation. 1995, c.C-6.1, s.33. Appel 28(1) Quiconque se sent lésé par l'une des décisions suivantes du directeur peut en interjeter appel devant un juge de la Cour du Banc de la Reine : a) le refus d'enregistrer une demande de changement de nom; b) l'annulation du changement de nom en application de l'article 25; (2) Celui qui souhaite interjeter appel doit déposer l'appel dans les trente jours de la date de la décision du directeur. (3) L'appel est fait par voie d'avis de motion et est signifié au directeur et à toute autre personne selon les directives de la cour. (4) Après avoir entendu la preuve et examiné les mémoires des parties, le juge peut rendre une ordonnance confirmant la décision du directeur, prescrivant l'enregistrement ou infirmant l'annulation du changement de nom. (5) Il ne peut y avoir d'autre appel de l'ordonnance de la cour mentionnée au paragraphe (4). 1995, ch.C6,1, art.28. Signature du directeur 29(1) Dans le cas où la signature du directeur est obligatoire pour l'application de la présente loi, celle-ci peut être écrite, gravée, lithographiée ou reproduite par tout autre moyen mécanique. (2) Tous les documents délivrés au titre de la présente loi sous la signature du directeur sont valides même si celui-ci a cessé d'exercer ses fonctions avant leur délivrance. 1995, ch.C-6,1, art.29. Règlements 30 Le lieutenant-gouverneur en conseil peut, par règlement : a) prévoir les formulaires nécessaires à l'application de la présente loi; b) déterminer le contenu d'une demande, d'une requête, d'un affidavit, d'un consentement, d'un certificat ou de tout autre document requis par la présente loi; c) prévoir et exiger le paiement de droits pour tout service rendu par le directeur en conformité avec la présente loi; d) soustraire, selon certaines modalités ou conditions, une personne ou une catégorie de personnes, une demande ou une catégorie de demandes aux exigences de la partie II; e) prendre toute autre mesure réglementaire requise ou permise par la présente loi; f) prendre toute autre mesure réglementaire que le lieutenant-gouverneur en conseil juge nécessaire pour l'application de la présente loi. 1995, ch.C-6,1, art.30. PARTIE V Dispositions transitoires, abrogation et entrée en vigueur Dispositions transitoires 1 décembre 1994 - 13 h 30 1995 ch.C-6,1 CHANGEMENT DE NOM 8 31 Les changements de nom enregistrés en conformité avec la loi intitulée The Change of Name Act, telle qu'elle était libellée le jour précédant l'entrée en vigueur de la présente loi, sont valides et peuvent être traités comme s'ils avaient été effectués en conformité avec la présente loi. 1995, ch.C-6,1, art.31. Abrogation 32 Est abrogée la loi intitulée The Change of Name Act. 1995, ch.C-6,1, art.32.
