“Tell us how we did today” (the “Contest”)

“Tell us how we did today” (the “Contest”) is conducted by Imvescor Restaurant Group Inc. (referred
to herein as the “Sponsor”)
OFFICIAL CONTEST RULES AND REGULATIONS (the “Rules”)
CONTEST PERIOD:
1. The Contest takes place in Canada and starts on Wednesday June 15th, 2016 at 10:00:01 a.m. Eastern
Standard Time (EST), and ends on Wednesday June 14th, 2017 at 23:59:59 p.m. EST (the “Contest
Period”).
ELIGIBILITY:
2. To enter and be eligible to win, a person must be a resident of Quebec, Ontario or Nova Scotia who
has reached the legal age of majority in the jurisdiction in which he/she resides. Despite the foregoing,
employees, representatives or agents, a member of the jury (and the persons with whom they are
domiciled) of the Sponsor, the Sponsors franchisees, the affiliated companies or agents, the consulting,
advertising and promotion agencies of the Sponsor (collectively the “Contest Parties”), are not eligible
to enter or participate in the Contest.
HOW TO ENTER:
3. NO PURCHASE IS NECESSARY TO ENTER OR WIN. During the Contest Period, the Individual is entered
by registering and signifying his/her agreement that you have read and agree to be legally bound by the
terms and conditions of the Rules of the Contest through the online registration form at
www.opinionsBR.com (the “Registration Form”). To register, fully complete the Registration Form with
all required information. To be eligible, your Registration Form must be submitted and received in
accordance with the Rules during the Contest Period. 4. For the purposes of these Rules, the entrant is,
according to the registration procedure detailed in this paragraph, the individual whose email address
appears on the Registration Form. It is this said individual to whom the prize will be awarded if he or she
is declared a winner. Entries are limited to one (1) every seven (7) days for a maximum of fifty (50)
entries during the Contest Period.
PRIZE:
5. Odds of winning a prize depend on the number of eligible entries registered during the Contest
Period. All entries are validated at Market Force Information’s discretion; only validated entries will be
accepted. There will be 12 $25.00 Bâton Rouge Gift Card prizes (each, a “Bâton Rouge Gift Card Prize”).
Each Bâton Rouge Gift Card Prize consists of one (1) x $25.00 Bâton Rouge Gift Card. Each potential
Bâton Rouge Gift Card Prize winner will be selected based on a random draw every first Monday of the
month during the Contest Period (July 4, 2016, August 1, 2016, September 5, 2016, October 3, 2016,
November 7, 2016, December 5, 2016, January 2, 2017, February 6, 2017, March 6, 2017, April 3, 2017,
May 1, 2017 and June 5, 2017). Each Bâton Rouge Gift Card Prize is subject to the Bâton Rouge gift card
terms and conditions. The currency of each Bâton Rouge Gift Card Prize will be in Canadian Dollars
(CAD).
6. Each Bâton Rouge Gift Card Prize is non-exchangeable, non-refundable, non-transferable and is nonconvertible to cash. Each Bâton Rouge Gif Card Prize does not have a resale value and must be accepted
by the Winner (as hereinafter defined) as awarded in the form solely decided upon by the Sponsor. No
interest will be paid on any Bâton Rouge Gift Card Prize. The Contest Sponsor does not make any
express or implied warranty about the Bâton Rouge Gift Card Prizes, and, as such, is not responsible for
any dissatisfaction or malfunction with the Bâton Rouge Gift Card Prizes or for any taxes, and other
charges and surcharges that may be applicable. The Sponsor reserves the right to substitute a prize of
equal or greater value in the event that the Bâton Rouge Gift Card Prize is unavailable due to
circumstances beyond the Sponsor’s control, at its sole and absolute discretion, subject to the approval
of the Régie des alcools, des courses et des jeux au Québec, if required. Arrangements will be made by
the Sponsor to deliver the Prize to the Winner. The Sponsor will be responsible for a one time delivery
fee to the Winner’s residential address through a registered mail service and will not be responsible for
the loss or damage of the Bâton Rouge Gift Card Prize resulting from the said mail service’s fault, action
or omission. The Winner must meet all other eligibility criteria as well as any applicable company
policies of the Contest Sponsor before being declared the Winner. Date of delivery of the Prize to the
Winner will be subject to availability of service provider and, the Sponsor does not make any
representation and/or warranties as to when the Bâton Rouge Gift Card Prize will be made available.
The delivery of the Bâton Rouge Gift Card Prize to the Winner will be made within 2-4 weeks after
verification and receiving a properly filled and signed Release Form(as defined below). Sponsor is not
responsible for any change of email address, mailing address and/or telephone number by entrants.
SELECTION:
7. There will be one random draw (as specified above) every first Monday of the month during the
Contest Period at 10:00:01 EST (each, the “Draw Date”) at the Sponsor's office located at 8250 Decarie
Blvd., Suite 310, Montréal, QC, H4P 2P5. Any entry that is incomplete, fraudulent, lost, in violation of the
Rules, or received after the Contest Period closes will be automatically rejected and will not give any
right to a Bâton Rouge Gift Card Prize. The decision of the Sponsor and its agents is final and binding. All
entries received meeting the eligibility criteria herein will be part of the same draw and will be treated
equally for the purposes of selecting an entrant (the “Selected Entrant”). The number of Bâton Rouge
Gift Card Prizes available to be won will decrease throughout the Contest Period as they are claimed in
accordance with these Rules.
8. Each potential Selected Entrant of the draw will be notified by email 48 hours of the Draw Date and
will be required to follow the emailed instructions to claim his/her Bâton Rouge Gift Card Prize. . If the
Selected Entrant cannot be contacted within five (5) business days of the Draw Date, or if there is a
return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the
Sponsor, be disqualified (and if disqualified, will forfeit all rights to the applicable Bâton Rouge Gift Card
Prize) without compensation and an alternate Selected Entrant will be randomly drawn by the Sponsor
from the remaining applicable entries. The Released Parties are released from all responsibility related
to the entry of an invalid email address and/or telephone number by the entrant. Once successfully
contacted, the Selected Entrant will then have 20 business days to be required to respond to the
Sponsor and (i) correctly answer a time-limited, mathematical skill-testing question, and (b)
acknowledge, sign, complete and return the Sponsor’s release form(the “Release Form”) by email or by
fax to be declared a winner (the “Winner”) which (among other things): (i) confirms compliance with
these Rules; (ii) acknowledge acceptance of the applicable Bâton Rouge Gift Card Prize (as awarded); (iii)
releases Released Parties from any and all liability in connection with the Contest, his/her participation
therein and/or the awarding and use/misuse of the applicable Bâton Rouge Gift Card Prize or any
portion thereof; and (iv) agrees to the publication, reproduction and/or photograph or other likeness
without further notice or compensation, in any publicity or advertisement carried out by or on behalf of
the Sponsor in any manner or medium whatsoever, including print, broadcast or the internet. If the
Selected Entrant:
a. fails to respond to the Sponsor within the allotted time;
b. fails to correctly answer the time-limited, skill-testing question, also located on the Release Form;
c. fails to complete and return the Release Form to the Contest Sponsor within the allotted time;
d. cannot accept (or is unwilling to accept) the applicable Bâton Rouge Gift Card Prize (as awarded) for
any reason; and/or
d. is ineligible or determined to be in violation of these Rules (all as determined by the Sponsor in its
sole and absolute discretion) for any reason stated herein;
then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified,
will forfeit all rights to the applicable Bâton Rouge Gift Card Prize) and a new Selected Entrant will be
drawn until a Winner is declared for the Bâton Rouge Gift Card Prize following the completion of all
eligibility criteria’s. The Sponsor will arrange with the Winner to have the Bâton Rouge Gift Card Prize
delivered to the Winner’s place of residence. The Sponsor cannot be held responsible if the Winner does
not provide the correct mailing address in the Release Form.
GENERAL RULES:
9. The total value of all the Bâton Rouge Gift Card Prizes is $300 CAD.
10. The Sponsor reserves the right, in its sole discretion, subject only to the approval of the Régie des
alcools, des courses et des jeux in Québec (the “RACJ”), to modify, cancel or suspend this Contest should
an event beyond its reasonable control corrupt the security or proper administration of the Contest. The
Sponsor, with the consent of the RACJ, reserves the rights to cancel, amend or suspend this Contest, or
to amend these Rules, in any way without prior notice or obligation, in the event of any accident,
printing, administrative, or other error of any kind, or for any other reason whatsoever. Without limiting
the generality of the foregoing, the Sponsor reserves the right, in its sole and absolute discretion, to
administer an alternative test of skill as it deems appropriate based on the circumstances and/or to
comply with applicable law.
10. The Sponsor and its affiliates may, at their sole discretion and without liability, rescind or amend this
Contest at any time. The Released Parties:
i) make no warranty, guarantee or representation, express or implied of any kind relative to any Bâton
Rouge Gift Card Prize,
ii) are not liable for injury, loss, or damage of any kind resulting from the acceptance or use or misuse of
any Bâton Rouge Gift Card Prize.
11. For Quebec residents only: Any litigation respecting the conduct or organization of a publicity
contest may be submitted to the RACJ for a ruling. Any litigation respecting the awarding of a prize may
be submitted to the board only for the purpose of helping the parties reach a settlement.
12. In the event of any discrepancy or inconsistency between the terms and the conditions of the English
rules and disclosures or other statements contained in any Contest-related materials, including but not
limited to: Registration Form, Website, French version of these Rules and/or point of sale, print or online
advertising; the terms and conditions of the English rules shall prevail, govern and content to the latest
extent permitted by the law.
13. Any person entering this Contest or trying to do so by any means which would be unfair to the other
entrants, contrary to the Rules or illegal, including computer hacking, amongst others, will be
automatically disqualified and may be subject to prosecution, as the case may be. Decisions by the
Sponsor in regard to this paragraph are final and binding.
14. Except where prohibited, by participating in the Contest, entrants agree and hereby (i) release and
hold harmless Sponsor, the Contest Parties and each of their respective agents, employees, directors,
members, successors, and assigns (the “Released Parties”) from and against any claim, loss , damage or
cause of action arising out of his/her participation in the Contest and, if applicable, with respect to the
awarding, receipt and/or use or misuse of any Bâton Rouge Gift Card Prize, including, but not limited to:
(a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers,
providers, printers or telephone or network lines; (c) printing errors; (d) errors in the administration of
the Contest or the processing of entries; (e) late, lost, or undeliverable mail; or (f) injury or damage to
persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s
participation in the Contest or receipt of any prize; (ii) agree that, without limiting the generality of the
foregoing and for greater certainty, under no circumstances will he/she be permitted to obtain awards
for, and hereby waives all rights to claim, punitive, incidental, consequential, or any other damages; (iii)
agree (to the maximum extent permitted by law) that all causes of action arising out or connected with
this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class
action; and (iv) agree (to the maximum extent permitted by law) that any and all claims, judgements,
and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court
costs. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or
otherwise destroyed or corrupted, entrant’s sole remedy is another entry, if it is possible.
15. By entering this Contest, the Selected Entrant consents to the collection, use and disclosure of
his/her personal information for the purposes of administering the Contest and authorizes the Sponsor
to use as required, his/her name, photograph, picture, place of residence, voice and/or statement in
connection with the Contest and/or Prize, for advertising or publicity purposes in any media or formats,
including but not limited to the Internet, without further notice or permission and without
remuneration or compensation of any kind. Except as otherwise set out in these Rules, no
communication, commercial or otherwise, that is not related to this Contest will be sent to entrants by
the Sponsor, unless the entrant has otherwise authorized the Sponsor, or its affiliated companies, when
applicable, to do so. Personal information will not otherwise be used or disclosed without consent.
16. The Sponsor is not responsible for website loading, screening or posting errors, software, hardware,
mail, telephone, network or server errors and the Sponsor reserves the right to modify, cancel,
terminate, or suspend the Contest in whole or in part, at its sole discretion, in the event a virus,
computer bug, unauthorized human intervention, or any other occurrence beyond their control corrupts
or adversely affects the administration, security, impartiality or normal operation of the Contest, subject
to the approval of the RACJ, if applicable.
17. The Selected Entrants release and indemnify the Sponsoras well as its affiliates, advertising and
promotion agencies, and their partners, employees, agents and representatives, from all responsibility
for any damage sustained as a result of the acceptance and/or use (or non-acceptance or non-use) of
their applicable Bâton Rouge Gift Card Prizes.
18. The Released Parties are released from all responsibility related to the malfunctioning of any
software components, software, or lines of communication; related to the loss or absence of any
communication network; or related to any failed, delayed, misdirected, incomplete, illegible or erased
transmission by any computer or network; and which could limit, or prevent, the possibility of any
person from entering the Contest. The Released Parties are released from all responsibility for any
damage or loss whatsoever that could be caused, directly or indirectly, in whole or in part, by
downloading any software and by the transmission of any information required for entry in the Contest.
The Released Parties are released from all responsibility for any damage or loss whatsoever caused by
late, lost, misdirected, unreadable entries, incompatible or incomplete Registration Forms or any other
Contest-related information (collectively, “Contest-related Information”), all of which are void.
19. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise
destroyed or corrupted, entrant’s sole remedy is another entry, if it is possible. If the Contest, or any
part of it, is discontinued for any reason, Sponsor, in its sole discretion, subject to the RACJ, may elect to
hold a random drawing from among all eligible entries received up to the date of discontinuance for any
prize offered herein. No more than the stated number of prizes will be awarded. In the event that
production, technical, seeding, programming or any other reasons cause more than the stated number
of prizes as set forth herein to be available and/or claimed, Sponsor reserves the right to award only the
stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
20. If it is discovered by the Sponsor (using any evidence or other information made available to or
otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits or
restrictions provided in these Rules; and/or (ii) use multiple names, identities, email addresses,
Facebook accounts, and/or any automated, macro, script, robotic or other system(s) or program(s) to
enter, register, or otherwise participate in or to disrupt this Contest; then he/she may be disqualified
from the Contest in the sole and absolute discretion of the Sponsor. Your Registration Form may be
rejected if (in the sole and absolute discretion of the Sponsor) your Registration Form is not fully
completed with all required information and submitted and received in accordance with these Rules
during the Contest Period.
21.
All Contest-related Information becomes the property of the Sponsor and will not be returned
to the individual. Sponsor reserves the right at its sole and absolute discretion, to disqualify any
individual (and all of his or her Bâton Rouge Gift Card Prize claim) who tampers with the registration
process or the Website.
22. The Contest is subject to all federal, provincial and municipal laws and regulations.
23. The interpretation and the enforcement of the Contest shall be made in accordance with the laws of
the Province of Quebec and the applicable laws in Canada.
CAUTION: ANY ATTEMPT BY AN ENTRANT OR OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE
WEBSITE OR ANY OTHER WEBSITE OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS
A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE CONTEST
SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT
PERMITTED BY LAW. ENTRANTS WHO CHOOSE TO PARTICIPATE VIA A COMPATIBLE MOBILE DEVICE ARE
SOLELY RESPONSIBLE FOR STANDARD DATE USE AND SERVICE RATES THAT APPLY, WHICH VARY
ACCORDING TO THE APPLICABLE MOBILE DEVICE PACKAGE AND MOBILE SERVICE PROVIDE (PLEASE
CONTACT YOUR MOBILE SERVICE PROVIDER FOR DETAILS BEFORE PARTICIPATING IN THIS CONTEST
USING A COMPATIBLE MOBILE DEVICE).
24. Without limiting the generality of the foregoing and for greater certainty, by entering the Contest,
each entrant consents to being contacted (including by email) by Sponsor for Contest-related purposes,
which included but is not limited to Bâton Rouge Gift Card Prize eligibility notifications and prize claim
reminders notifications. You may unsubscribe from these notices by e-mailing
[email protected] in which case your registration in the Contest will be deleted and you may
no longer be eligible to participate in the Contest, unless you re-register.
25. By entering this Contest, you acknowledge having read and understood these Rules and agree to
abide by them and by the decision of the contest sponsor, which are final and binding on all matters
pertaining to the contest.

RÈGLES ET LES RÈGLEMENTS OFFICIELS DU CONCOURS (le « Règlement »)
DURÉE DU CONCOURS:
1. Le Concours prend place au Canada et débute le mercredi 15 juin 2016, à 10 h 00 min 01 s heure de
l’Est (HE), et se termine à 23 h 59 min 59 s, HE, le mercredi le 14 juin 2017 (la « Durée du Concours »).
ADMISSIBILITÉ:
2. Pour participer au Concours et être admissible de gagner, une personne doit résider au Québec, ou en
Ontario ou en Nouvelle-Écosse et avoir atteint l’âge de la majorité dans sa juridiction de résidence.
Malgré ce qui précède, ne sont pas admissibles à s’inscrire au Concours ou à y participer les employés,
représentants ou mandataires, un membre du jury (et les personnes avec qui ils sont domiciliés) du
Commanditaire, des franchisés du Commanditaire, les sociétés affiliées au Commanditaire du Concours,
des agences de conseils, de publicité et de promotion du Commanditaire (collectivement, les « Parties
au Concours »).
COMMENT S’INSCRIRE:
3. Aucun achat n’est nécessaire pour s’inscrire au Concours ou le gagner. Durant la Durée du Concours,
la personne s’inscrit au Concours et indique son accord comme quoi il ou elle a lu et convenu d’être
lié(e) par les modalités et conditions du présent Règlement, via le formulaire d’inscription en ligne à
www.opinionsBR.com (le « Formulaire d’inscription »). Pour s’inscrire, il suffit de remplir le Formulaire
d’inscription intégralement en y précisant toutes les informations requises. Pour être admissible, votre
Formulaire d’inscription doit être transmis et reçu conformément au présent Règlement pendant la
Durée du Concours.
4. Aux fins du présent Règlement, le participant est, selon la procédure d'inscription détaillée dans le
présent paragraphe, la personne dont l'adresse de courriel est inscrite sur le Formulaire d'inscription.
C'est cette dite personne à qui le prix sera remis si elle est déclarée gagnante. Les participations sont
limitées à une (1) chaque sept (7) jours jusqu’à concurrence d’un maximum de 50 entrées au cours de la
Durée du Concours.
PRIX:
5. Les chances de gagner un prix dépendent du nombre de participations admissibles inscrites et reçues
pendant la Durée de Concours. Toutes les entrées sont validées à la discrétion de Market Force
Information, seules les inscriptions validées seront acceptées. Il y a 12 prix de cartes-cadeau Bâton
Rouge de 25$ (chacun un « Prix de Carte Bâton Rouge ») à gagner. Chaque Prix de Carte Bâton Rouge
consiste en une (1) carte-cadeau Bâton Rouge de 25$. Chaque gagnant éventuel d’un Prix de Carte
Bâton Rouge sera sélectionné en fonction d’un tirage au hasard chaque premier lundi du mois pendant
la Durée du Concours (4 juillet 2016, 1er août 2016, 5 septembre 2016, 3 octobre 2016, 7 novembre
2016, 5 décembre 2016, 2 janvier 2017, 6 février 2017, 6 mars 2017, 3 avril 2017, 1er mai 2017 et 5 juin
2017). Chaque Prix de Carte Bâton Rouge est assujetti aux modalités et conditions de la carte-cadeau
Bâton Rouge. La devise en laquelle sera libellé chaque Prix de Carte Bâton Rouge sera en dollars
canadien (CA).
6. Le Prix de Carte Bâton Rouge est non échangeable, non remboursable et non transférable. Il n’est pas
monnayable. Chaque Prix de Carte Bâton Rouge n'a pas de valeur de revente et doit être accepté par le
Gagnant (tel que défini ci-après) tel qu’il est décerné dans la forme déterminée par le Commanditaire à
son entière discrétion. Aucun intérêt n’est versé sur un Prix de Carte Bâton Rouge. Le Commanditaire ne
fait aucune garantie expresse ou implicite sur le Prix de Carte Bâton Rouge, et, en tant que tel, n’est pas
responsable de l'insatisfaction ou du dysfonctionnement avec le Prix de Carte Bâton Rouge ou de toutes
les taxes et autres frais et suppléments qui peuvent être applicables. Le Commanditaire se réserve le
droit de substituer un prix par un autre de valeur égale ou supérieure dans le cas où le prix indiqué est
non disponible en raison de circonstances indépendantes de la volonté du Commanditaire, à son entière
discrétion, sous réserve de l'approbation de la Régie des alcools, des courses et des jeux au Québec, si
requise. Des dispositions seront prises par le Commanditaire afin de remettre le prix au Gagnant. Le
Commanditaire sera responsable une seule fois des frais de livraison du prix à l'adresse résidentielle du
Gagnant par un service de courrier recommandé et ne sera pas responsable de la perte ou des
dommages du Prix de Carte Bâton Rouge résultant d'une faute, une action ou une omission de l'audit
service de messagerie. Le Gagnant doit répondre à tous les autres critères d'admissibilité ainsi que les
politiques de l'entreprise applicables du commanditaire du concours, avant d'être déclaré gagnant. Date
de remise du prix au gagnant sera sujette aux disponibilités du prestataire de services et, le
Commanditaire ne fait aucune représentation et/ou garantie à quand le Prix de Carte Bâton Rouge sera
mis à disposition. La remise du Prix de Carte Bâton Rouge au Gagnant sera effectuée dans les 2 à 4
semaines après la vérification et la réception d'un Formulaire de quittance (tel que défini ci-après)
dument rempli et signé. Le Commanditaire n’est pas responsable d’un changement d’adresse de
courriel, d’adresse postale et/ou de numéro de téléphone par les participants.
SÉLECTION:
7. il y aura un tirage au hasard (tel que spécifié précédemment) chaque premier lundi du mois pendant
la Durée du Concours, à 10 h 00 min 01 s (HE) (chacun, la « Date de Tirage ») au bureau du
Commanditaire situé au 8250 boul. Decarie, Suite 310, Montréal, QC, H4P 2P5. Toute inscription qui est
incomplète, frauduleuse, perdue, en violation des règles, ou reçue après la fermeture de la Durée du
Concours sera automatiquement rejetée et ne donnera pas droit à un Prix de Carte Bâton Rouge. La
décision du Commanditaire et de ses mandataires est final et lie le participant. Toutes les inscriptions
reçues répondant aux critères d’admissibilité feront partie du même tirage et seront traitées
équitablement aux fins de la sélection d’un participant (le « Participant Sélectionné »). Le nombre de
Prix de Carte Bâton Rouge à gagner diminuera tout au long de la Durée du Concours au fur et à mesure
qu’ils sont réclamés conformément au présent Règlement.
8. Chaque Participant Sélectionné éventuel de chaque tirage sera avisé par courriel dans les 48 heures
de la Date de Tirage et sera requis de suivre les instructions communiquées par courriel pour réclamer
son Prix de Carte Bâton Rouge. Si un Participant Sélectionné ne peut pas être contacté(e) dans les 5
jours ouvrables suivant la Date de Tirage, ou si la notification est retournée comme n’étant pas livrable,
le Commanditaire peut alors, à son entière discrétion, le disqualifier (et, s’il est disqualifié, il perdra tous
ses droits de réclamer le Prix de Carte Bâton Rouge) sans compensation aucune et un autre Participant
Sélectionné sera tiré au hasard par le Commanditaire parmi toutes les participations restantes
applicables. Les Parties libérées sont dégagées de toute responsabilité reliée à l’entrée d'un numéro de
téléphone et/ou d’une adresse courriel incorrecte par le participant. Une fois contactés avec succès, le
Participant Sélectionné aura alors 20 jours ouvrables pour être requis de répondre au Commanditaire et
(i)répondre correctement, dans un délai prescrit, à une question d’habileté mathématique et (b)
reconnaître, signer, compléter et retourner le formulaire de quittance du Commanditaire (le
« Formulaire de quittance »), par courriel ou par télécopieur pour être déclaré un gagnant (le « Gagnant
»)qui prévoit, entre autres, ce qui suit : (a) confirme le respect du présent Règlement; (ii) reconnaît
accepter le Prix de Carte Bâton Rouge concerné (tel qu’attribué); (iii) donne quittance aux Parties
Libérées à l’égard de toute responsabilité dans le cadre du présent Concours, de sa participation à celuici et/ou de l’attribution et de l’utilisation à mauvais escient du Prix de Carte Bâton Rouge ou de toute
partie de celui-ci; et (iv) convient de la publication, reproduction et/ou autre utilisation de ses nom,
adresse, voix, déclarations au sujet du Concours et/ou photographie ou autre image sans autre avis ou
rémunération, dans toute publicité ou annonce faite par le Commanditaire ou pour son compte de
quelque manière et sur quelque support que ce soit, y compris dans les médias imprimés, par radio ou
télédiffusion ou sur Internet. Si le Participant Sélectionné:
a. omet de répondre au Commanditaire dans le délai prescrit;
b. répond incorrectement à la question d’habileté mathématique, indiquée sur le Formulaire de
quittance, dans le délai prescrit;
c. omet de compléter et de retourner le Formulaire de quittance au Commanditaire dans le délai
prescrit; et/ou
d. ne peut accepter (ou n’est pas disposé à accepter) le Prix de Carte Bâton Rouge (tel qu’attribué) pour
quelque motif que ce soit;
e. est inadmissible ou est jugé avoir violé le présent Règlement (le tout tel que décidé par le
Commanditaire à son entière discrétion), pour une raison quelconque;
alors le Commanditaire peut alors, à son entière discrétion, le disqualifier (et, s’il est disqualifié, il perdra
tous ses droits de réclamer le Prix de Carte Bâton Rouge et un autre Participant Sélectionné sera tiré au
hasard jusqu’à ce qu’un Gagnant soit déclaré pour le Prix de Carte Bâton Rouge. Le Commanditaire
prendra les dispositions nécessaires avec le Gagnant pour livrer le Prix de Carte Bâton Rouge au lieu de
résidence du Gagnant. Le Commanditaire ne peut être tenu responsable si le Gagnant ne fournit pas une
adresse postale valide dans le Formulaire de quittance.
RÈGLEMENTS GÉNÉRAUX :
9. La valeur totale de l’ensemble des Prix de Carte Bâton Rouge est de 300$ CA.
10. Le Commanditaire se réserve à sa seule discrétion, sous réserve de l’approbation de la Régie des
alcools, des courses et des jeux au Québec (la « Régie »), le droit de modifier, d’annuler ou de suspendre
le Concours en cas d’un virus d’ordinateur, d’un « bug », échappant au contrôle du Commanditaire, qui
pourrait affecter la sécurité ou la gestion efficace de ce Concours. Le Commanditaire, avec le
consentement de la Régie, se réserve le droit de d’annuler, de modifier ou de suspendre ce Concours,
ou de modifier le présent Règlement, de quelque manière que ce soit sans préavis ni obligation, dans
l’éventualité d’un accident, d’une erreur d’impression, administrative, ou autre de quelque nature, ou
pour tout autre motif quelconque. Sans limiter la généralité de ce qui précède, le Commanditaire se
réserve le droit, à son entière discrétion, d’administrer une autre épreuve d’habilité, selon ce qu’il juge
indiqué, en fonction des circonstances et/ou en vue de se conformer au droit applicable.
11. Le Commanditaire et ses sociétés affiliées peuvent, à leur entière discrétion et sans préjudice,
amender le Concours en tout temps. Les Parties Libérées :
i) ne font aucune représentation ou garantie d’aucune sorte concernant tout Prix de Carte Bâton Rouge,
ii) sauf lorsque cela est interdit par la loi, déclinent toute garantie tacite, et
iii) ne sont pas responsables de blessures, pertes, ou dommages de toute nature résultant de
l’acceptation, de l’utilisation ou de la mauvaise utilisation de tout Prix de Carte Bâton Rouge.
12. Pour les résidents de la province de Québec seulement: Tout litige concernant la conduite ou
l’organisation d’un concours publicitaire peut être soumis à la Régie pour une décision. Tout litige
concernant l’attribution d’un prix pourra être soumis à la Régie uniquement aux fins d’aider les parties à
parvenir à un règlement.
13. En cas de divergence ou d'incohérence entre les termes et les conditions, les règles Anglaises et les
divulgations ou tout autre énoncé et contenu dans le matériel du Concours, y compris, mais sans s'y
limiter: Formulaire d'inscription, le Site Web, la version française de ce Règlement et/ou points de
vente, la publicité imprimée ou en ligne; les termes et conditions des règles anglaises prévaudront et le
contenu de la dernière mesure permise par la loi.
14. Toute personne s’inscrivant à ce Concours ou essayant de le faire par des moyens qui seraient
injustes envers les autres participants, contraires aux Règlements ou illégaux, y compris, mais non limité,
le piratage informatique, sera automatiquement disqualifiée et pourra faire l’objet de poursuites, le cas
échéant. Les décisions prises par le Commanditaire à l’égard de ce paragraphe sont définitives et
exécutoires.
15. Sauf en cas d'interdiction, en participant au Concours, les participants acceptent de libérer de toute
responsabilité le Commanditaire les Parties au Concours et chacun de leurs mandataires, employés,
administrateurs, membres, successeurs et ayants cause ou ayants droit respectifs (les «Parties
Libérées») à l’égard de toute réclamation, perte, dommage ou cause d’action découlant de la
participation au Concours et, le cas échéant, de l’attribution, de la réception ou de l'utilisation ou de
l’utilisation à mauvais escient de tout Prix de Carte Bâton Rouge concerné, y compris, mais sans s'y
limiter: (a) intervention humaine non autorisée dans le Concours; (b) des erreurs techniques liées aux
ordinateurs, aux serveurs, des fournisseurs, des imprimantes ou du réseau téléphonique ou
électronique; (c) des erreurs d'impression; (d) des erreurs dans l'administration du concours ou le
traitement des inscriptions; (e) des retards, pertes, ou le courrier non distribuable; ou (f) de dommages
causés à des personnes ou des biens pouvant être causés, directement ou indirectement, en tout ou en
partie, de la participation au Concours ou par la réception d'un prix; (ii) sans limiter la généralité de ce
qui précède, il est entendu qu’en aucun cas un participant ne saurait être autorisé à obtenir un
jugement en dommages-intérêts punitifs, accessoires, consécutifs ou d’autres dommages-intérêts, et le
participant renonce par les présentes à tout droit de réclamer de tels dommages-intérêts; (iii) (dans la
pleine mesure autorisée par la loi) toutes les causes d’action découlant du présent Concours ou d’un
prix attribué, ou s’y rapportant, doivent être réglées séparément, sans intenter une forme quelconque
de recours collectif; et (iv) (dans la pleine mesure autorisée par la loi) l’ensemble des réclamations, des
jugements et des montants adjugés se limite aux menues dépenses réellement engagées, à l’exclusion
des frais et honoraires d’avocats et des frais judiciaires. Si pour une raison quelconque l'inscription d'un
participant est confirmée, avoir été supprimée par erreur, perdue, détruite ou endommagée, le seul
recours du participant est une autre entrée, si elle est possible.
16. En participant à ce Concours, le Participant Sélectionné consent à la collecte, l'utilisation et la
divulgation de ses renseignements personnels aux fins de l'administration du Concours et autorise et
accepte que le Commanditaire utilise au besoin son nom, sa photographie, son lieu de résidence, sa voix
et/ou sa déclaration au sujet du Concours et/ou du Prix de Carte Bâton Rouge, à des fins publicitaires,
dans n'importe quel média ou formats, y compris, mais non limité à l'Internet, sans avis préalable ni
autorisation et sans rémunération ni compensation d'aucune sorte. Sauf comme indiqué autrement
dans le présent Règlement, aucune communication, commerciale ou autre, qui n'est pas liée à ce
Concours ne sera envoyée aux participants par le Commanditaire , à moins que le participant a par
ailleurs autorisé le Commanditaire ou sess sociétés affiliées, le cas échéant, de le faire. Les
renseignements personnels ne seront pas autrement utilisés ou divulgués sans consentement.
17. Le Commanditaire n’est pas responsable du chargement du Site web, du dépistage ou de l’affichage
d’erreurs, ou de celles résultant de logiciels, de hardware, du courrier, du téléphone, du réseau ou du
serveur; le Commanditaire se réserve le droit de modifier, de suspendre ou d’annuler le Concours en
tout ou en partie, à sa seule discrétion, en cas d’un virus, d’un bug informatique, d’une intervention
humaine non autorisée, et de tout autres causes hors de son contrôle qui pourrait corrompre ou
affecter la gestion, la sécurité, l’impartialité ou le déroulement normal du Concours, sous réserve de
l'approbation de la Régie, le cas échéant.
18. Les Participants Sélectionnés indemnisent le Commanditaire, ainsi que ses filiales, ses agences de
publicité de et marketing ainsi que leurs partenaires, employés, agents et représentants, de toute
responsabilité pour tout dommage subi du fait de l'acceptation et/ou utilisation (ou la non-acceptation
ou non-utilisation) de leur Prix de Carte Bâton Rouge concernés.
19. Le Commanditaire et ses agents sont libérés de toute responsabilité pour le mauvais fonctionnement
des composants logiciels, logiciels ou voies de communication; associés à la perte ou l'absence de tout
réseau de communication ; ou liés à des transmissions ayant échouées, retardées, mal acheminées,
incomplètes, illisibles ou effacées par tout ordinateur ou réseau; et qui pourrait limiter ou empêcher, la
possibilité de toute personne de s'inscrire au Concours. Les Parties Libérées sont libérées de toute
responsabilité pour tout dommage ou perte que ce qui pourraient être causés, directement ou
indirectement, en tout ou en partie, par le téléchargement de tout logiciel et par la transmission de
toute information requise pour l'participation dans le Concours. Les Parties Libérées sont libérées de
toute responsabilité pour tout dommage ou perte que ce soit causé par des inscriptions tardives, mal
acheminées, perdues ou illisibles ou par des Formulaires d’inscription incompatibles ou incomplets ou
par tous autres renseignements liés au Concours (collectivement, les « Renseignements liés au
Concours »), lesquels sont tous invalides.
20. Si pour une raison quelconque l'inscription d'un participant est confirmée, d’avoir été supprimée
par erreur, perdue, détruite ou endommagée, le seul recours du participant est une autre entrée, si elle
est possible. Si le concours, ou une partie de celui-ci est interrompue pour une raison quelconque, le
commanditaire, à sa seule discrétion, sous réserve de la Régie, peut décider de faire un tirage au sort
parmi tous les bulletins de participation admissibles reçus jusqu'à la date de cessation de tout prix
proposé ici. Pas plus prix que le nombre de prix mentionnés ne sera attribué. Dans le cas où la
production, la technique, la répartition, la programmation ou de tout autres natures causant un plus
grand nombre de prix que stipulé au présent règlement pour être disponible et / ou réclamé, le
commanditaire se réserve le droit d'attribuer seulement le nombre de prix indiqué par un tirage au
hasard, parmi toutes les réclamations légitimes, non attribués, des prix admissibles.
21. Si le Commanditaire découvre (en se fiant à des éléments de preuve ou à d’autres renseignements
qui sont portés à sa connaissance ou qu’il met au jour autrement) qu’une personne a tenté : (i) de
dépasser les limites ou restrictions prévues dans le présent Règlement; et/ou (ii) d’utiliser plusieurs
noms, identités, adresses de courriel, comptes de Facebook et/ou des programmes automatisés, des
macro programmes, des scripts, des programmes robotisés ou d’autres systèmes ou programmes pour
s’inscrire, utiliser une partie à jouer, ou par ailleurs pour participer au présent Concours ou pour le
perturber, elle peut être disqualifiée du Concours à l’entière discrétion du Commanditaire. Votre
Formulaire d’inscription peut être rejeté si, à l’entière discrétion du Commanditaire ce formulaire n’est
pas rempli intégralement et ne renferme pas tous les renseignements exigés et n’est pas présenté et
reçu conformément au présent Règlement pendant la Durée du Concours.
22. Tous les Renseignements liés au Concours deviennent la propriété du Commanditaire et ne seront
pas retournés à la personne. Le Commanditaire se réserve le droit, à son entière discrétion, de
disqualifier toute personne (et l’ensemble de son ou sa réclamation de Prix de Carte Bâton Rouge) qui
intervient de façon illicite dans le processus d’inscription ou le Site Web.
23. Le Concours est assujetti à toutes les lois fédérales, provinciales et municipales.
24. L'interprétation et l'application du concours seront effectuées en conformité avec les lois de la
province du Québec et les lois applicables du Canada.

TENTATIVE, LE COMMANDITAIRE DU CONCOURS RÉSERVE LE DROIT DE RÉCLAMER DES DOMMAGES DE
CETTE PERSONNE DANS TOUTE LA MESURE PERMISE PAR LA LOI. LES PARTICIPANTS QUI CHOISISSENT
DE PARTICIPER AU MOYEN D’UN APPAREIL MOBILE COMPATIBLE SONT EXCLUSIVEMENT RESPONSABLES
DES TAUX RÉGULIERS D’UTILISATION DE DONNÉES ET DE SERVICE QUI S’APPLIQUENT, LESQUELS
VARIENT SELON LE FORFAIT APPLICABLE À L’APPAREIL MOBILE ET LE FOURNISSEUR DE SERVICE MOBILE
(VEUILLEZ COMMUNIQUER AVEC VOTRE FOURNISSEUR DE SERVICE MOBILE POUR OBTENIR DES DÉTAILS
AVANT DE PARTICIPER AU PRÉSENT CONCOURS EN VOUS SERVANT D’UN APPAREIL MOBILE
COMPATIBLE).
25. Sans limiter la généralité de ce qui précède, il est entendu qu’en participant au Concours, chaque
participant consent à recevoir une communication de la part du Commanditaire à des fins liées au
Concours, ce qui comprend, sans s’y limiter, des notifications d’admissibilité à un prix et des
notifications de rappel de réclamation de prix. Vous pouvez vous désabonner de ces avis en envoyant un
courriel à l’adresse [email protected] , auquel cas votre inscription au Concours sera
supprimée et vous ne serez plus admissible à participer au Concours à moins de vous réinscrire.
26. En participant à ce concours, vous reconnaissez avoir lu et compris ces règlements et vous vous
engagez à les respecter et les décisions du Commanditaire, lesquelles décisions sont définitives à tous
égards.
