Article1–Acceptationdesconditionsgénérales
La location d’un véhicule implique acceptation, sans restriction ni réserve, des
présentes conditions générales de location. Le fournisseur se réserve le droit de
modifiercelles-ciatoutmoment,sansavis.
Encasdemodification,lesconditionsapplicablesauClientresterontcellesappliqués
lorsdelademandederéservationeffectuéeparleClientsurlessitesinternetédités
parlefournisseur.
Leclientreconnaîtexpressémentqueseullefournisseurpeutluilouerlevéhiculeet
quetoutetentativedetransfèreousouslocationparuntiersestinterdite.
Le client n’est autorisé à utiliser le véhicule que selon les termes du contrat de
locationetdesprésentesconditionsgénérales.
LeClientestlesignataireducontratdelocation.
Le présent contrat est formé par l'acceptation du Client en ligne des présentes
conditionsgénéralesencliquantsurl'icône"J'accepte".
Article2–Réservation,TarifetPaiement
Le client effectue une réservation en ligne via les sites internet édités par le
fournisseur en communiquant ses coordonnées ainsi les dates de la période de
locationsouhaitéesetdontladisponibilitéestconfirmée,ainsiquesescoordonnées
bancaires.
Lefournisseurenvoiesansdélaiparmaillaconfirmationderéservationetadresseau
Client un récapitulatif chiffré de sa commande avant de procéder à l'encaissement
d'unacomptecorrespondantà50%delasommetotaleduprixdelalocation.Les50%
restantsdelasommeindiquéeserontduslorsdelamiseàdispositionduvéhicule.
Le contrat de location et les confirmations de paiement constituent une preuve de
réservation.
Letarifdelocationapplicableestceluicommuniquéparlefournisseuraumomentde
la réservation, et repris sur le contrat de location. Les prix s’entendent en
euros,toutestaxesincluses.
Leprixestfixeetgaranti,étanttoutefoispréciséquelefournisseurseréserveledroit
de répercuter immédiatement tout changement intervenant dans le taux de TVA
applicable.
Toute modification de la réservation peut engendrer un changement de tarif de
location.Lefournisseurseréserveledroitdemodifiersestarifsàtoutmoment.
Toute modification ultérieure de la réservation peut engendrer un changement du
tarifdelalocation.
- Il est possible de prolonger la durée de la location selon les disponibilités du
véhicule.
-Ilestpossibled'écourterladuréedelalocation,àconditionquelademandesoit
effectuée au moins 6 semaines avant la date de mise à disposition du véhicule.
Ecourter une location sera considérée comme une nouvelle réservation et sera
calculée selon les tarifs en vigueur à la date de cette nouvelle réservation. Le
fournisseur se réserve, dans cette hypothèse, le droit de faire application des
dispositionsdesprésentesrelativesauxconditionsd'annulationpourlaréservation
initiale.
Lestarifscomprennent:

Toutescontraventions.
•
Lespéages.
Article3–Contratdelocation
UncontratdelocationseraétablientreleClientetlefournisseurlorsdelamiseà
dispositionduvéhicule.
La location est personnelle et conditionnée à la présentation par le Client de la
confirmation de réservation qui lui a été adressé par le fournisseur dans les
conditionsreprisesàl'article2.
Le véhicule mis à disposition doit être sûr, propre et fourni avec l’équipement
standard,lesréservoirsdecarburantetd’eaudoiventêtrepleins.
Levéhiculedoitêtrerestituédanslemêmeétat.
L’état du véhicule ainsi que son kilométrage est détaillé lors de l’inventaire
contradictoire effectué lors de la mise à disposition. Il appartient au Client de
contrôler l'état du véhicule et de faire état, dans l'inventaire, de tout dommage /
dégâtsn'yfigurantspas.
LeClientestresponsabledetousdommages/dégâtsnonrépertoriésnonrépertoriés
dans l'inventaire et qui surviennent pendant toute la durée de la location ou sont
constatéslorsdelarestitutionduvéhicule.
EncasdenonrestitutionparleClientdel’équipementstandardoudeséquipements
misàsadispositionenoption,les fraisderemplacementluiserontfacturéssurla
baseduprixdeséquipementsneufscorrespondants.
Parailleurs,descartouchesdegazserontfourniesauClientaumomentdelamiseà
disposition du véhicule, celui-ci devant être rendu avec le même nombre de
cartouchesidentiquespleines.
Danslecascontraire,ilvousserafacturé5€/cartouchemanquanteounonpleine.
Demême,sileClientretournelevéhiculesansavoirfaitlepleindecarburant,illui
serarefacturé1,70€/L.
Enfin,lefournisseurfactureraauClientlasommede70€danstouteshypothèsesoù
levéhiculeneseraitpasrestituépropreàl'intérieurouàl'extérieur.
Article4.Caution
Uneautorisationdeprélèvementcorrespondantàlacautionde1500€(ou1800€
pourleCalifornia)seraeffectuéelejourdelamiseàdispositionduvéhiculepar
empreintedelacartebancaireduClient(ouremisedelasommeenespèce
égalementpossible);afindecouvrirlafranchised’assuranceencasd’accidentou
d'éventuellesdégradations.
La caution sera restituée lors du retour du véhicule conforme à l'état des lieux de
départ.
encasd'accident,collision,dégâtssurlevéhicule,lacautionseraautomatiquement
encaissée.
Touteslesdépensesengagéespourlesréparationsencasdedommagescausésau
véhicule et qui ne sont pas couverts par l'assurance (ex:plein avec le mauvais
carburant),serontfacturéesauClientetdevrontêtrerégléessansdélai.
Lefournisseurseréserveledroitd’augmenterlemontantdudépôtdegarantieencas
d’événementsspécifiques(ex:festival).
Ledépôtdegarantienepeutconstituerenaucuncasunmoyendepaiementdusolde
delalocation.
Article5.Périodedelocation

Il n’est pas possible d’étendre la période de location sans accord préalable du
fournisseur.
Dansl’éventualitéoùlevanneseraitpasrestituéàladateconvenusurlecontratde
location, le fournisseur pourra entamer des procédures officielles pour vol de
véhicule et abus de confiance, notamment, sans préjudice de l'application des
présentesconditionsdelocation.
Tout retard doit être immédiatement signalé au fournisseur. Tout retard notifié
moinsde2heuresavantl'heurederendez-vousserafacturé30€/heurederetard.
Article7.Conditionsrelativesauconducteur
Leconducteurdevraêtretitulairedupermisdeconduiresansrestrictiondepuisplus
de2ans.
Leconducteurdevraprésenter,lorsdelasignatureducontratdelocation,unepièce
d’identitéencoursdevalidité,sonpermisdeconduireencoursdevalidité(aucun
duplicataouphotocopienepourraêtreaccepté)etêtreenpossessionensonnom
d’unecartebancaire,etdevracommuniquersonadresseexacte.
Pour les conducteurs détenant un permis de conduire hors Union Européenene, il
vousserademandédefournirégalementunpermisdeconduiteinternational.
Le conducteur déclare et garantit ne pas faire l'objet, pour la durée de la location,
d'unemesuredesuspensionoud'annulationdesonpermisdeconduire.
Encasdenonprésentationdel’undesesdocumentsousileClientnepeutprocéder
aupaiementdedudépôtdegarantie,lefournisseurseréserveledroitderefuserla
locationduvéhicule.
Danstouslescascités,lefournisseurnepourraêtretenuresponsablepourlerefus
delocationetn’accorderaaucunecompensationauClient.
Unsecondchauffeurpeutêtreassuréencontrepartied’unsupplémentde5€/jour
/chauffeur.Ildevrarespecterlesmêmesconditionsquelechauffeurprincipal.
Aucasoùleconducteurseverraitretirersonpermisdeconduirependantlapériode
de location et qu’il n’y aurait pas de deuxième chauffeur assuré sur le contrat de
location, le client devra procéder au rapatriement du véhicule et ce à son entière
charge.
Article8.ConditionsTerritoriales
Lescampervanspeuventcirculeruniquementdansl’enceintedespaysfigurantsau
dosdela"carteverte"(Unioneuropéenneprincipalement).Encasdenonrespect,
le client ne sera pas couvert par l’assurance et sera entièrement responsable pour
toutdommage,perteouvol.
Article9.Utilisationduvéhicule
Lalocationduvéhiculeimpliquelerespectdesrèglessuivantes,sansquecetteliste
présenteuncaractèreexhaustif.

Article10–Assurance
10.1.Conditionsgénérales
Tousnosvéhiculessontfournisavecuneassurancetousrisquesaunomduchauffeur
indiquésurlecontratdelocation.
•
Lagaranties’appliqueauxrisquessuivants:Accidents,VolsetIncendie,
Intempéries,etprotectionphysiqueduconducteuretdespassagers.
Leconducteurassurelagarde,duvéhiculeetdel'ensembledes
documentsetéquipementsquiluisontconfiés.

10.2.Assistance24H/24–7/7
Estfournieégalement,uneassistance24/24auvéhiculeetauxpassagersencasde
problèmesmécaniquesouaccident.
Cela comprend: les dépenses de remorquage (à hauteur de 300€; prix de l’hôtel +
petit-déj.àhauteurde46€/pers/nuit(maximum2nuits);etsinécessaire,lecoûtde
rapatriementduvéhiculeetdespassagersjusqu’aupointdedépartdelalocation.
L’assistance est valable dans tous les pays apparaissant sur la carte verte de
l’assurance24/247jours/7numérod’appel:0033.1.45.16.66.89.
10.3.Exclusions
Lesdommagessuivantsnesontpascouverts:
•
Utilisationdecarburantinadéquat
•
pneusoubatteriesendommagés
•
Levolducampingcarneserapascouvertparl’assurancesilescléssont
laisséesàl’intérieurduvéhiculeinoccupé;leclientseraalorstenu
commeresponsableetdevrarembourserlevéhicule.
10.4.Obligationencasdesinistre
Afind’êtreprisenchargeparl’assurance,leclients’engageà:
•
déclarersous24heuresàl’équipedufournisseuretauxautoritéstous
accident,volouincendie,etcemêmepartiel;
•
déclarersansdélaiaufournisseurtoutepanneduvéhiculeouaccident
nécessitantdesréparationsurgentes;
•
remplirunconstatetl’envoyerdirectementàlacompagnied’assurance
sousundélaide72haprèsl’accident,unecopieduconstatdevra
égalementêtreenvoyéeaufournisseur.
•
faireétatdansleconstat,descirconstances,date,lieuetheurede
l’accident,ainsiquelesnomsetadressesdestémoins,dunumérodela
plaqued’immatriculationetdunomdelacompagnied’assuranceainsi
quelenumérodecontratd'assurancedestiersimpliqués.
dépenses de remorquage dues à une batterie déchargée ou un plein de carburant
inadéquatparleClientserontainsiimputablesàcelui-ci.
Au cas où le véhicule serait endommagé ou immobilisé, le Client a pour obligation
d'avertirlefournisseursansdélai.
Les réparations ne peuvent être effectuées qu’après accord écrit et selon les
directives du fournisseur. Ils doivent faire l'objet d'une facture au nom du
fournisseur. Il en va de même pour les réparations des équipements se trouvant à
l’intérieurduvéhicule.(chauffage,gaz,pomped'eau,etc.).Enaucuncasleclientne
pourraexigerundédommagementpourleretardoccasionné.
En cas d'accident ou de problème mécanique sérieux, le locataire a obligation
d'avertirlefournisseurimmédiatementetderetournerlevéhiculedèsquepossible,
afindepermettreaufournisseurdedépanneravantl'arrivéeduclientsuivant.
Article12.Infractionaucodedelarouteetviolationdelaloi
Le conducteur est personnellement responsable de toutes les amendes et
contraventionsrelativesauxinfractionsetviolationsducodedelarouteapplicable
enEurope.
Lescontraventionsdoiventêtredirectementpayées,àdéfaut,lefournisseurrecevra
unenotificationd'amendemajoréeetdansl'applicationdel'articleL121-2ducode
delaroute,lefournisseurcommuniqueral'adresseetlescoordonnéesdulocataire
auxautoritésdelapolice.
Lefournisseurestendroitdereprendrepossessionduvéhiculesansavispréalable
etàlachargeduClientsicelui-cinerespectepaslesprésentesconditionsgénérales
ou si le véhicule est illégalement garé, ou encore utilisé à des fins illicites. Aucun
remboursementneseraalorspossible.
Article13.Annulationparlefournisseur
Lefournisseurseréserveledroitd’annuleruneréservationdanslecasoù:
•
Leconducteurn’estpasenmesuredeprésenterunpermisdeconduire
conformeauxconditionsrequises
•
Joindreauconstattoutrapportdepolice,ouexpertise.
•
Nediscuterenaucuncasdelaresponsabilité,ouétabliruncompromis
•
Leconducteurn’estpasenmesuredeprésentersespapiersd’identité
(passeport+permisdeconduire)
aveclestiersencequiconcernel'accident.
Encasdevol,oudetentativedevoloudevandalisme,leclientdevradéposerune
plainte aux autorités locales ( police ou gendarmerie) et ce dans un délai de 48
heures.
Le locataire devra également informer immédiatement le fournisseur et lui
transmettre sans délai l'original de la plainte et en garder une copie. Il devra
égalementremettrelesdocumentsduvéhiculeetdesclefsdanslesplusbrefsdélais.
Dans l’éventualité où les clefs ne seraient pas rendues, l’assurance vol sera
automatiquementannuléeetlevéhiculeseraalorsentièrementrefacturéauclient.
En cas de non-respect de ces règles, le client serait entièrement considéré comme
responsable,etlefournisseurseréserveledroitdel’assignerenjusticeetd’entamer
despoursuitesàsonencontre.
Encasd'accidentprovoquéparleClientendommageantsérieusementlevéhiculeou
l’immobilisantpendant5joursouplus,lefournisseurseréserveledroitdemettrefin
au contrat de location sans compensation ni remboursement.Les coûts des
réparationsetlafranchiserestantdues.
Dansd'effractionduvéhiculeoudommagescausésparleClient,ouenl'absencede
tiers identifié, le Client devra rembourser le fournisseur à hauteur des dépenses
occasionnées(justifiéespardevisdesréparations,estimationdelavaleurmarchande
duvéhicule,desfraisd'immobilisation,desfraisdemaind’œuvre,etc.).
10.5.Exclusiondegarantie
Le Client perdra le bénéfice de toutes assurances ou garanties dans le cas où il ne
respecteraitpasunedesmodalitésducontratdelocation(faussesdéclarationàla
signature du contrat de location et/ou à la déclaration d'accident, de tentative
d'escroquerie,deviolationgravedescodesdelarouteoutoutautrefautecommis
délibérément, tentative de suicide, ou usage à buts illicites.) ou des présentes
conditionsgénérales.
Le non-respect des conditions entrainera automatiquement l'annulation de toutes
assurancesetdegaranties.
Leclientseratenualorscommeentièrementresponsabledesdommages.
Article11.Entretien&Réparation
Toutaccidentoupannedoiventêtredéclaréaufournisseursansdélai.
L'usuremécaniquenormaleestàlachargedufournisseur.
Touteslesréparationsmécaniquesduesàl'inattentionouunusagenonappropriédu
clientserontàlachargedecelui-ci.
Les Clients seront entièrement responsables notamment de surchauffe du moteur,
manqued'huile,manqued'eauderefroidissement,batterieàplatduvéhicule,pneus
crevés,lechoixincorrectdesvitessesayantpourrésultatdesdommagesàlaboîtede
vitesse,carburantincorrectmisdanslevéhicule,enlisementduvéhicule,pertedes
clésouverrouillageduvéhiculeaveclesclésàl'intérieur.
DanslecasoùleClientseraitconsidérécommeresponsabledesdommages,toutes
lesdépensesrelativesàl'assistanceserontcomplétementàsesfrais.parexempleles

N’estpasenmesuredeverserlasommerequisepourledépôtde
garantieduvéhicule
•
Plusde3personnesàbordduTransporterT5ouplusde4personnesà
bordduCalifornia.
•
L'adressesurlepermisdeconduirenecorrespondpasàl’adressede
facturation.Despreuvessupplémentairesd'identificationsontalors
demandées.
Alamiseàdispositionduvéhicule,ilincombeauClientd'avertirlefournisseurencas
deretard.
Passéundélaide24h,sansavertissementdelapartduClient,lefournisseurpeut
déciderdelouerlevéhiculeàunautreClient.Lelocatairenepourraalorsprétendre
à aucun remboursement de l'acompte versé . En cas de non disponibilité du
véhicule,suiteàunproblèmemécaniqueoutoutautreraison,etsiaucunesolution
nepouvaitêtreimmédiatementtrouvée,lefournisseurs’engageànepasfacturerles
jours perdus et à rembourser le cas échéant au Client le trop perçu sur l'acompte
versé.
Si le fournisseur est dans l'obligation de décommander totalement la réservation,
l’acompte sera restitué entièrement au locataire. En aucun cas, le client ne pourra
réclamer de dommages et intérêts pour le retard de livraison d'un véhicule, pour
l'annulationderéservationd’hôtel,vols,billetsdeconcert,etc..
Article14.Annulationparlelocataire
Encasd’annulationparlelocataire;leschargessuivantesserontencourues:
•
Moinsde6semainesavantledébutdelalocation:50%dumontant
totaldelalocationseraperçueparlefournisseur
•
Plusde6semainesavant:l’acompteestdû.
Silelocatairesouhaiteseulementraccourcirlapériodedelocation,cettedemande
sera considérée comme une nouvelle réservation et sera prise en compte, sous
réservededisponibilité,auxconditionstarifairesapplicableaujourdecettenouvelle
réservation.
Silelocataireestenretardlejourdelamiseàdispositionduvéhicule,celui-cinepeut
prétendreàaucuneréduction.
Article15–Laresponsabilitédufournisseur
Lefournisseurnepeutêtreconsidérécommeresponsabledesdommages(indirects
ouimprévisibles),pertesouvolssurvenuslorsdelalocation.
Le fournisseur ne peut en aucun cas être considéré comme responsable des
dommages résultant de la perte ou du vol de la confirmation de la réservation
envoyéeparl'emailaunomduclientnidel'utilisationdecedocumentparuntiers.
Entoutétatdecause,silaresponsabilitédufournisseurdevaitêtreengagée,pour
quelquecausequecesoit,lemontantdesdommagesetintérêtssusceptiblesdelui
êtreréclamésseralimitéaumontantdessommeseffectivementperçuesautitrede
lalocationcorrespondante.
Article16–DonnéesPersonnelles
Lefournisseurappliqueunepolitiquedeconfidentialitédesdonnéesetderespectde
lavieprivée.
Le Client accepte que le fournisseur collecte, traite et utilise les informations
personnellesleconcernant.
Letraitementàfaitl'objetd'unedéclarationauprèsdelaCNIL.
Pourêtreenmesuredeprocéderàunedemandederéservation,leClientdoitremplir
un formulaire en ligne dans lequel il doit fournir notamment ses nom/prénom et
coordonnées. Le Client est informé du fait qu'une information demandée est
obligatoireoufacultative,selonlesindicationsmentionnées.
Encasd'informationsfacultatives,ilconservelafacultédenepasfournircetteouces
informations.
Lesinformationsrecueilliespermettentde:
•
Traiterlesdemandesderéservation;
•
Constitueretmettreàjourlefichierclients(envoied’offres
promotionnelles)
•
Réglertoutlitige,toutproblèmeoupourfaireappliquerlesConditions
généralesdelocation.(transmissiondesdonnéesàdesautorités
judiciairesouauxassurancesetexpertsencasd'accident,devoloutout
autredommage.)
Le Client dispose d'un droit d'accès, de modification, de rectification et de
suppressiondesesdonnéespersonnelles.
Article17-Conventionsurlapreuve
Le founisseur procédera à l'archivage des réservations et confirmations sur un
supportfiableetdurableconstituantunecopiefidèle,conformémentauxdispositions
del'article1348duCodeCivil.
Les serveurs du fournisseur seront considérés par les Parties comme preuve des
communications, réservations, paiements et transactions intervenues entre les
Parties.

Terms&ConditionsofRent
Article1-Acceptanceofthetermsandconditions
Therentalofatherentalcompany’svehicleimpliesacceptance,withnolimit,ofthe
general conditions defined here below. The rental company reserves the right to
modifythepresenttermsandconditionsatanytimewithoutadvancenotice.Incase
ofmodification,theapplicableconditionswillremainthosecurrentonthedayofthe
request of booking by the Hirer. The Hirer declares to have acquainted with these
termsandconditionsofrentandacceptsthemwithoutreserve.
The Hirer recognizes expressly that only the rental company is able to rent the
vehicle.Anyattemptoftransferorsublettingofthevehiclebyanypersonotherthan
therentalcompanywillbeofnoeffect.TheHirerisauthorizedtousethevehicleonly
accordingthetermsoftherentalagreementandthepresenttermsandconditionsof
rent.
Thecustomeristhesignatoryoftherentalagreement.
The contract is formed by the acceptance of the on-line customer of the present
generalconditionsbyclickingtheicon"Iaccept".
Article2–Booking,Rates&Payment
Thehirerwillmakeabookingonlineviaourwebsitebyprovidinghisdetailsanddate
ofhiringperiod.Aftercheckingtheavailability,therentalcompanywillsendtothe
hirerviaemailabookingconfirmationandthepaymentreceiptforthedeposit(50%
ofthetotalamountofthehirerate).
Bypaymentofthedeposit,theHireracceptsthegeneraltermsandconditionsofthe
rentalcompany.Theremaining50%mustbepaidonthepick-upday.Therental
agreementandinvoicewillalsoserveasconfirmation/proofofthebooking.
Theapplicableratesofrentaretheonescommunicatedbytherentalcompanyatthe
time of the booking, and written on the rental agreement. Prices are quoted and
charged in euro, including taxes (French VAT and the other applicable taxes if
necessary). The rental company reserves the right to modify its prices at any
time. The price of the campervan rented is firm and guaranteed and will not be
modifiableanymorebytherentalcompanyincludinginthecaseofafluctuationin
theforeignexchangerate.TheHirercannotaskformodificationofthepricepaidin
caseofpromotionaloffersproposedbytherentalcompany.

The vehicle state is detailed in the inventory made on departure date. The hirer
commitstocheckitandwritedown,beforedeparture,anydamageorlossthatwould
notappearonthedocument.Thehirerisliableforanydamagenotmarkedonthe
inventoryandresponsibleforanythingthathappenstothecampervanwhilstunder
hiscare.
Incaseofnonrestitutionofstandardequipmentoroptionalequipment,theHirer
willhavetosettleasumcorrespondingattheexpensesofrestoration.
Gascartridgeswillbesuppliedonpick-up,thevehiclemustbereturnedwiththesame
numberoffullcartridges.Otherwiseeachcartridgemissingwillbecharged5€.The
nonfullfillingoffueltankwillbebilled1,70€/L.Finally,a70€cleaningfeewillbe
chargedagainstthedepositifthevehicleisnotreturnedincleancondition.Theinside
andtheoutsideofthevehiclewillhavetobeclean.
Article4-Deposit
Ondayofdeparture,theHirerwillhavetodeposit1500€depositor1800€forthe
california)byimprintofcreditcardtocoverboththeinsuranceexcessintheeventof
collisionandtheproperreturnofthevehicleinsameconditionasitwaspresentedto
thehirer.
Intheeventofaccidentorcollision,thedepositwillautomaticallybedebited.Incase
ofinvolvedresponsibilityoftheHirer(bytheinsurance),thedepositwillentirelybe
keptbytherentalcompany.Shouldtheoppositeoccur,thedepositwillberestored
tothehirer.
All the expenses engaged because of a repair of a damage for which the Hirer is
consideredresponsiblewithseriousfault,andthennottakencarebytheinsurance,
will be directly taken from the deposit. The Hirer will be asked to complete the
amountbyeverypossiblemeansiftheamountofexpensesissuperiortotheamount
ofthedeposit.
The rental company reserves the right to increase the security deposit for special

Article3-Rentalagreement
ArentalagreementwillbeestablishedbetweentheHirerandtherentalcompanyon
the pick-up day. The rent is personal, and is only possible on presentation of the
confirmationofbookingduringthesignatureoftherentalagreement.
Thevehicleissuppliedinroadworthycondition,clean,withfuelandwatertanksfull,
fittedwithstandardequipment.Itshallbereturnedinthesamestate.
Article7-Driversrelatedconditions
TheHirerproceedingtoarentwiththerentalcompanymustholdadrivinglicence
for at least 2 years. The Hirer will have to present, at the signature of the rental
agreement, an ID of current validity,his driving license of current validity and
internationaldrivingpermit(fornonEUnonresident)aswellasavisaormastercard
topaythedeposit.Andfinallyheshallsupplyhisexactcurrentaddress.Incaseofno
presentationofanyofthesedocuments,therentalcompanyreservestherightnotto
rentthevehicle.(noduplicateorcopywillbeaccepted).Therentalcompanyalso
reservestherightnottorentthevehicleiftheTenantisnotableofproceedingtothe
payment of the deposit. In every case, the rental company cannot be considered
responsibleforthisrefusalofrentandwillnotgrantanycompensation.
Aseconddrivercanbesuscribedontherentalagreementwithasupplementof5€/

IncasetheHirergetshislicensecancelledduringtherent,andifthereisnosecond

insurancecard).Incaseofnoncompliancewiththisterritory,theHirercannotclaim

beresponsibleforanydamage,lossortheft.
10.1.Generalconditions
Fully comprehensive insurance is provided by the rental company to the driver

10.4.Obligationincaseofincident
Inordertobecoveredbytheinsurance,theHirermakesthecommitmentto:

andthekeysandvehicledocumentsofthevehiclemustbekeptin

mentioninginhis(her)statementthecircumstances,date,placeandthe

securedplaces.TheHireralsomakesacommitmenttoremoveandto
houroftheaccident,nameandaddressofwitnesses,registrationofthe
keepinsecuredplacesanydevicesuchasGPS,carradio,etc.,whenthe
carofthethirdparty,thenameofhis(her)insurancecompanyandits
vehicleisparked;

Thevehicleshouldn’tbeusedtotransportgoodsorobjectsforbidden

Theexcessof1500€(1800€fortheCalifornia)willbeprocessedinthecaseofany
accident,irrespectiveofwhoisatfault.Reimbursementoftheexcesswilloccurwhere
a3rdpartyisdeemedatfaultandrepaircostshavebeenrecovered(administrative
feesdeducted).
Alltheexpensesofassistancewhichcouldbeengenderedfurthertoanincidentliking
oftheresponsibilityofthecustomerwillbecompletelyathisexpense.Theexpenses
oftowingrelativetoabatteryunloadedbythecustomerwillsobechargeabletothis
one.
Incaseofaccidentcausedbythehirerduringwhichthevanisseriouslydamagedor
immobilized for 5 days or more, the rental company reserves the right to end the
rentalcontractwithnocompensationnorrefund.Thecostsofrepairsorbondare
stilltobepaid.
In case of theft of the Vehicle or damages caused because of the Hirer, or in the
absenceofidentifiedthirdparty,theHirerwillhavetoindemnifytherentalcompany
attheleveloftheeffectivelyundergonedamage(estimatebyareportoftherepairs,
marketvalueofthevehicle,expensesofimmobilization,set-upfees,etc.).
10.5.Destitutionofguarantee
TheHirerwilllosetheprofitofalltheinsurancesorguaranteesincasehedoesnot
respect one of the measures of the present terms and conditions, within the
frameworkofafalsestatementintherentalagreementand\orintheaccidentreport,
attempt of fraud, severe violation of the traffic rules or quite other liable fault
committeddeliberately,withintheframeworkofavoluntaryfact,suicideattempt,or
to any illicit purposes. The non respect of conditions of this document will
automaticallyleadtothecancellationofallformsofinsuranceandguarantees.The
bond amount will no more be applicable and the hirer will be responsible for the
wholedamageintheconditionsofhisreliability.

Overoccupancyofvehicle,maximum3occupants,4peopleinthe

•
Addressondrivinglicensedoesnotmatchbillingaddress.Additional
proofofidisrequired.
•
HirersfromoutsideFrancemustprovideavalidpassportandnonEU
residentmustholdainternationaldrivingpermit.
ItistheHirerresponsibilitytowarntherentalcompanyofanydelaywhichhecould
haveforthevehiclepick-up.Therentalcompanycanbeonnoaccountconsideredas
responsible if it decides to make the campervan available without news from the
Hirerwithin48hours.TheHirercanaspireonnoaccounttoanycompensationifin
caseoflatepresentationwithoutwarningtherentalcompany,novehiclecouldbe
available.
Ifadelayintherentmusthappenbecauseofamechanicalproblemorforquiteother
reason,andifnosolutioncouldbefound,therentalcompanymakesacommitment
nottochargethelostdays.Iftherentalcompanyisintheobligationtocanceltotally
thebooking,thedepositwillberestoredentirelytotheHirer.
Innoevent,theHirercanclaimfordamagesforthedelayinthedeliveryofavehicle,
for the cancellation of the rent or the immobilization in the case of repairs in the
courseofrent(flights,concerttickets).
Article14-CancellationbytheHirer
Intheeventofacancellationbythehirerthefollowingchargesshallbeincurred:

Lessthan6weeksbeforethepick-update:50%oftotalhirewillbe
charged.
Article11-Servicing&Repairs
Allbreakdownsoraccidentsmustbedeclaredtotherentalcompanywithnodelay.
Thenormalmechanicalwearisontherentalcompany’scharge.
Allmechanicalrepairscomingfromunusualwearorcarelessnessofhirerwillbeon
hirer’scharge.Hirerswillbefullyaccountablefor,butnotlimitedtothefollowing:
Engine overheating, running out of oil, running out of cooling water, flat vehicle
battery, flat tires, incorrect selection of gears resulting in damage to the gearbox,
incorrectfuelputintovehicle,gettingthevehiclebogged.
Incasethevehiclewouldbedamagedorimmobilized,theHirerhastheobligationto
informtherentalcompanywithoutanydelays.
Therepairscanbemadeonlyafterwrittenagreementandaccordingtothedirectives
oftherentalcompany.Theyhavetobetheobjectofasettledinvoiceintherental
company’s name. It's the same concerning the internal arrangement of the livable
part ( heating, gas, water pump, etc.).In no circumstances the Hirer can demand
compensationforthedelay,thecancellationofrentorimmobilizationinthecaseof
repairsmadeinthecourseofrent.
In the event of an accident or of serious mechanical problem, the Hirer has the
obligation to warn the rental company immediately and to return to his point of
departure at the hour which will then be fixed to him(her) by the rental company
according to the gravity of the accident or otherwise at least 24 hours before the
initiallyplanneddateofreturn,toallowtherentalcompanytomakethenecessary
repairsbeforethearrivalofthefollowingcustomer.
Article12-Violationoftrafficlawsandregulation
Driver(s)arepersonallyliableforalllegalpenaltiesandfeespertainingtoanytraffic
violation infringements under the current Road Traffic Legislation applicable in
Europe. Fines are to be directly settled because, in defect, the rental company will
receiveanoticeofincreasedfineandinapplicationofthearticleL121-2oftheTraffic
rules,therentalcompanywillcommunicatetheaddressanddetailsoftheHirerto
thePolicecourt(s).Incaseofreceptionofpenalty,statementsbytherentalcompany.
•
Morethan6weeksbeforethepick-update:allpaymentalreadymade
willbereimbursedentirely.
IftheHireronlywishestoshortenhisrent,thedaysnotusedwon'tbepaidoff.
IftheHirerislatethepick-upday,thisonecannotaspiretoanyreductionoftheprice
oftherent.
Article15-Responsibilityoftherentalcompany
The rental company cannot be considered responsible for any loss or damage
(indirectorunpredictable)resultingfromtherent,exceptincaseofcarelessnessor
seriousoffenceofitspart.Therentalcompanycan,onnoaccount,beconsideredas
responsibleforanyloss,damageordelayresultingfromthelossorfromthetheftof
the confirmation of booking sent by email to the customer and\or the use of this
documentbyathirdparty.
The rental company cannot be hold responsible for any loss or damage of the
personnal vehicle parked within the rental company’s car park during the rental
period.
Article16-PersonalInformation
Byconcludingarentalagreementwiththerentalcompany,theHireracceptsthatthe
rentalcompanyproceedstothestorageandITprocessingofthedataconcerninghim
withintheframeworkofthepresenttermsandconditions,inthejustifiableinterest
of the rental company, including in the statistical purposes, of banking checks and
protectionofitspossessions.IncaseofviolationonbehalfoftheHirerofthepresent
termsandconditions,thedataconcerninghimcanberevealedorcommunicatedto
thirdparties,inthenecessarymeasureforanyprocedureofcoveringortoprotectits
possessionsagainstanydamages.
TheHirerhastherightofaccess,rectificationand\ordeletionofthedataconcerning
him.Toexercisethisright,he/sheneedtosendamailtotherentalcompany.
Incaseofupdateofitsdata,therentalcompanywillkeeptheinformationinitially
suppliedduringfiveyearstopreventeveryriskoffraudorallowhim(her)toconform
totheregulationsinforce.
Article17-Legalnotices-Announcement
ThepresenttermsandconditionsofrentaresubjectedtotheFrenchlaw.
Anydisputeswhichcouldbebornbetweentherentalcompanyandhis(her)Hirers
willbesubjectedtotheexclusivecompetenceoftheFrenchjurisdictions.
