ADDENDUM FOR LOCKED-IN PENSION TRANSFERS TO A LOCKED-IN RETIREMENT ACCOUNT (LIRA) For transfers pursuant to the Supplemental Pension Plans Act (Quebec) BMO RETIREMENT SAVINGS PLAN BMO MUTUAL FUNDS RETIREMENT SAVINGS PLAN BMO MUTUAL FUNDS GROUP RETIREMENT SAVINGS PLAN BMO INVESTORLINE SELF-DIRECTED RETIREMENT SAVINGS PLAN Plan Carrier - BMO Trust Company 1 First Canadian Place, 54th Floor, P.O. Box 150, Toronto, Ontario M5X IH3 Acting through its Agent, Bank of Montreal Upon receipt of locked-in pension assets pursuant to the Supplemental Pension Plans Act (Quebec), the Plan Carrier and Planholder agree, further to the declaration of trust for the above-named retirement savings plan, as follows: 1. Pension Legislation. For the purposes of this Addendum the word “Act” means the Supplemental Pension Plans Act (Quebec) and the word “Regulation” means the Regulation Respecting Supplemental Pension Plans made under the Act. 2. Definitions. All terms in this Addendum which are used in the Act or Regulation have the same meaning as under the Act or the Regulation. In this Addendum, “Plan” has the same meaning given in the declaration of trust for the above-named retirement savings plan and “Planholder” means the planholder, accountholder or annuitant under the declaration of trust and application form. 3. Spouse. The word “spouse” means, in relation to the Planholder, another person who, (a) is married to or in a civil union with the Planholder; (b) has been living in a conjugal relationship with the Planholder who is neither married nor in a civil union, whether the person is of the opposite sex or the same sex, or a period of not less than three years, or for a period of not less than one year if: (i) at least one child is born, or to be born, of their union; (ii) they have adopted, jointly, at least one child while living together in a conjugal relationship; or (iii) one of them has adopted at least one child who is the child of the other, while living together in a conjugal relationship. Notwithstanding anything to the contrary contained in the Plan, this Addendum or any endorsements forming a part thereof, for the purposes of any provision of the Income Tax Act (Canada) respecting registered retirement savings plans, “spouse” does not include any person who is not recognized as a spouse or common-law partner under the Income Tax Act (Canada). 4. Transfers Into the Plan. The only assets that may be transferred into the Plan are sums originating, directly or initially, from: (a) the fund of a registered pension plan governed by the Act; (b) a supplemental pension plan not governed by the Act namely: 1. a supplemental pension plan governed by an Act emanating from a legislative authority other than the Parliament of Québec and granting entitlement to a deferred pension; or 2. a supplemental pension plan established by an Act emanating of the Parliament of Québec or from another legislative authority; (c) another locked-in retirement account which is a registered retirement savings plan under the Income Tax Act (Canada) and meets the requirements of the Regulation; (d) a life income fund which is a registered retirement income fund under the Income Tax Act (Canada) and meets the requirements of the Regulation; or (e) an annuity contract referred to in section 30 of the Regulation and in accordance with subsection 146(1) of the Income Tax Act (Canada). Any transfer into the Plan must be on a tax deferred basis under the Income Tax Act (Canada). 5. Requirement to Provide Life Pension. Except as otherwise provided in this Addendum, the balance of the account of the Plan may only be converted into a life pension guaranteed by an insurer and established for the duration of the life of the Planholder alone or for the duration of the life of the Planholder and the life of his spouse. The Planholder may require the conversion at any time, unless the term agreed to for the investments has not expired. The periodic amounts paid under the life pension must be equal, unless each amount to be paid is uniformly increased by reason of an index or a rate provided for in the contract or uniformly adjusted by reason of a seizure effected on the benefits of the Planholder, a redetermination of the Planholder’s pension, partition of the Planholder’s benefits with his spouse, the payment of a temporary pension under the conditions provided for in section 91.1 of the Act or the election provided for under paragraph 3 of the first paragraph of section 93 of the Act. Such life pension must be a qualified investment as an annuity, as provided under section 146 of the Income Tax Act (Canada). 6. Spouse’s Life Pension. The balance of the Plan may not be converted into a life pension guaranteed by an insurer unless, at the death of the Planholder who is a member or former member, a life pension equal to at least 60% of the amount of the Planholder’s pension (including, during the replacement period, the amount of any temporary pension) is granted to the Planholder’s spouse, who has not waived it. 7. No Withdrawals. Except as provided in the Act, the Regulations or this Addendum, any withdrawal, commutation, surrender or transfer of all or part of the balance of the Plan is prohibited (except where an amount is required to be paid to the Planholder to reduce the amount of overcontribution penalty tax payable under Part X.1 of the Income Tax Act (Canada)). 8. Transfers Out of the Plan. The Planholder is entitled, at any time before the conversion of the total balance of the Plan into a life pension as provided under paragraph 5 of the Addendum, to transfer all or part of the balance of the Plan into: (a) the fund of a registered pension plan governed by the Act; (b) a supplemental pension plan not governed by the Act namely: (i) a supplemental pension plan governed by an Act emanating from a legislative authority other than the Parliament of Québec and granting entitlement to a deferred pension; or (ii) a supplemental pension plan established by an Act emanating of the Parliament of Québec or from another legislative authority; (c) another locked-in retirement account which is a registered retirement savings plan under the Income Tax Act (Canada) and meets the requirements of the Regulation; (d) a life income fund which is a registered retirement income fund under the Income Tax Act (Canada) and meets the requirements of the Regulation; or (e) an annuity contract referred to in section 30 of the Regulation, where the transfer is made in accordance with paragraph 60(l) of the Income Tax Act (Canada) provided the term agreed to for the investments under the Plan has not expired. Any transfer out of the Plan must be on a tax deferred basis under the Income Tax Act (Canada). 9. Pension Must Commence Prior to Maturity. The Plan matures by the end of the calendar year in which the Planholder attains the age of 69 or such greater age permitted by the Income Tax Act (Canada). The Planholder must commence receipt of a life pension under paragraph 5 or transfer the balance of the Plan pursuant to paragraph 8 of this Addendum by the maturity date. If the Plan Carrier does not receive instructions from the Planholder by the end of the calendar year in which the Planholder become age 69, the Plan Carrier may in its discretion transfer the balance of the Plan pursuant to subparagraph 8(d) of this Addendum, and the Planholder will be responsible for any related administration expenses. 10. Disability and Shortened Life Expectancy. The Planholder may withdraw all or a part of the balance of the Plan and receive a payment or a series of payments where a physician certifies, in a form satisfactory to the Plan Carrier, that the Planholder’s physical or mental disability reduces the Planholder’s life expectancy. Such certificate must be provided to the Plan Carrier. 11. Payment Due to Non-Residency. The Planholder may, provided the agreed to term of the investments has not expired, require a lump sum withdrawal of the full balance of the Plan if the Planholder provides the Plan Carrier with written evidence satisfactory to the Plan Carrier that he has not resided in Canada for at least 2 years. 12. 13. 14. 15. 16. 17. 18. 19. 20. 21. 22. 23. 24. 25. Lump Sum Withdrawal of Small Amounts. The entire balance of the Plan can be paid in a lump sum to the Planholder, where the Planholder is at least age 65 at the end of the year preceding the application, if the total of the sums credited to him in the following retirement savings instruments: (a) defined contribution pension plans; (b) defined benefit or defined contribution-defined benefit pension plans, in application of provisions similar to those of a defined contribution plan; (c) life income funds; (d) locked-in retirement accounts; (e) retirement savings plans of which the balance must be converted into a life annuity (locked-in RRSPs) does not exceed 40% of the Maximum Pensionable Earnings, determined in accordance with the Act respecting the Québec Pension Plan, for the year in which the Planholder applies for payment. The Planholder’s application to the Plan Carrier must be accompanied with a declaration in conformity with the one prescribed in schedule 0.2 of the Regulation. Death of Planholder. If the Planholder who is a member or former member dies before the conversion of the balance of the Plan into a life pension, the balance of the Plan shall be paid: (a) where the Planholder had a spouse at the date of death who survives the Planholder, to the surviving spouse, unless the spouse has waived entitlement to the death benefits in accordance with paragraph 14 of this Addendum and the spouse has not revoked this waiver before the death of the Planholder; (b) where there is no surviving spouse entitled pursuant to subparagraph (a), to the Planholder’s assigns; or (c) if there is no designated beneficiary, to the personal representative(s) of the Planholder. Waiver of Death Benefits or Joint Life Pension. The Planholder’s spouse may, by giving written notice to the Plan Carrier, waive his right to receive the payment provided for in paragraph 13 or the life pension provided for in paragraph 6 of this Addendum, and may revoke such a waiver. The Planholder’s spouse must deliver a waiver or revocation of waiver to the Plan Carrier by a written notice in a form satisfactory to Plan Carrier before, in the case referred in paragraph 13, the death of the Planholder or, in the case referred to in paragraph 6, the date of conversion, in whole or in part, of the balance of the Plan into a life pension. Marital Breakdown. The Planholder’s spouse ceases to be entitled to the benefits provided under paragraphs 6 or 13 of this Addendum upon separation from bed and board, divorce, annulment of marriage or, in the case of an unmarried spouse, upon cessation of the conjugal relationship, except where: (a) in respect of the benefits payable under paragraph 13, the spouse is, on the day of the Planholder’s death, an assign of the Planholder; (b) in respect of the benefits payable under paragraph 6, the Planholder has notified the Plan Carrier in writing in accordance with section 89 of the Act to make payment of the benefits to the spouse. Unseizability. Unless otherwise provided by the Act, the Regulation, this Addendum or other law, the following amounts are unassignable and unseizable: (a) any amounts transferred into the Plan under paragraph 4 of this Addendum, with accrued interest; (b) any amounts transferred to the Plan of a spouse which were awarded to the spouse following partition or any other transfer of benefits effected pursuant to Chapter VIII of the Act, with accrued interest, and the benefits deriving from such amounts; and (c) any refunds of and benefits resulting from amounts under subparagraphs (a) and (b) except as far as they derive from additional voluntary contributions or represent a portion of the surplus assets allocated after termination of a pension plan. Seizure for Unpaid Alimony. All or part of the balance of the Plan may be paid in a lump sum in execution of a judgment rendered in favour of the Planholder’s spouse that gives entitlement to a seizure for unpaid alimony. An amount payable pursuant to such a judgment is to be paid to the spouse upon receipt of proper documentation by the Plan Carrier, regardless of the term of any investment. The amount paid from the Plan cannot exceed 50% of the balance of the Plan at the time of seizure. The Planholder will have no further claim or entitlement to any pension respecting the amount paid and the Plan Carrier is not liable to any person by reason of having made payment pursuant to such seizure. Plan Carrier’s Responsibility. Where a sum is paid from the Plan contrary to the provisions of this Addendum or the Regulation, the Planholder may, unless the payment is attributable to a false declaration by him, require that the Plan Carrier pay him, as a penalty, a sum equal to the irregular payment. Indemnity. Should the Plan Carrier provide or be required to make a payment to the Planholder pursuant to paragraph 18 of this Addendum, the Planholder or the Planholder’s heirs and/or legal representatives will indemnify and hold harmless the Plan Carrier, to the extent that assets of the Plan were received by or accrued to the benefit of any recipient. Statements. The Planholder is entitled to receive, at least once a year, a statement indicating the sums deposited, their source, the accumulated earnings, the fees debited since the last statement and the balance of the Plan. All Payments. Transfers and other payments under this Addendum (except a payment under paragraph 17) are subject to the terms of the investments under the Plan and are subject to the withholding of any applicable tax and deduction of all proper expenses and charges. Transfer of Securities. A transfer under paragraphs 8 or 24 of this Addendum may, on the instruction of the Planholder, at the option of the Plan Carrier and unless otherwise stipulated, be effected by the remittance of the investment securities respecting the Plan. General Amendments. Subject to paragraph 24 of this Addendum, the Plan Carrier may from time to time in its discretion amend this Addendum by giving 30 days’ notice to the Planholder, provided that such amendment remains in conformity with the standard contract amended and registered with the Régie des rentes du Québec and such amendment does not contravene the Act, the Regulation or the Income Tax Act (Canada). The Plan Carrier may not, except to fulfill requirements under law, make any amendment without having previously notified the Planholder. Amendments Entailing Reduction in Benefits. An amendment to the Plan shall not be made that would entail a reduction of the benefits resulting from the Plan unless the Planholder is entitled, before the date of the amendment, to transfer the balance of the Plan in accordance with paragraph 8 of this Addendum and unless a notice has been delivered to the Planholder at least 90 days before the date on which the Planholder may exercise the entitlement to transfer, describing the amendment and the date from which the Planholder may exercise the entitlement to transfer. Conflict or Inconsistency. The terms and conditions of this Addendum will take precedence over the declaration of trust for the Plan in the case of any conflict or inconsistency. Législation en matière de retraite. Dans le présent addenda, on entend par «Loi» la Loi sur les régimes complémentaires de retraite (Québec) et par «Règlement» son règlement d’application. 2. Définitions. Tous les termes du présent addenda ont le même sens que dans la Loi ou dans le Règlement s’ils sont également utilisés dans ces documents. Dans le présent addenda, «régime» a le même sens que dans la Déclaration de fiducie du régime de retraite susmentionné et «titulaire» s’entend du titulaire du régime, du titulaire du compte ou du rentier désigné dans la Déclaration de fiducie et la demande. 3. Conjoint. Le terme «conjoint» s’entend de la personne qui (a) est mariée ou en union civile avec le titulaire du régime; (b) vit maritalement avec le titulaire du régime, qui n’est ni marié ni en union civile, qu’elle soit de sexe différent ou de même sexe, depuis au moins trois ans ou, dans les cas suivants, depuis au moins un an : (i.) un enfant au moins est né ou à naître de leur union; (ii.) ils ont conjointement adopté au moins un enfant durant leur période de vie maritale; (iii.) l’un d’eux a adopté au moins un enfant de l’autre durant cette période. Nonobstant toute disposition contraire du régime, du présent addenda ou des avenants éventuels au régime, aux fins des dispositions de la Loi de l’impôt sur le revenu (Canada) relatives aux régimes enregistrés d’épargne-retraite, le terme «conjoint» ne saurait s’appliquer qu’à la personne considérée comme l’époux ou le conjoint de fait officiel ou de fait par la Loi de l’impôt sur le revenu (Canada). 4. Transferts dans le régime. Seuls les actifs provenant, directement ou initialement, des sources suivantes peuvent être transférés dans le régime : (a) les fonds d’un régime de retraite agréé régi par la Loi; (b) un régime complémentaire de retraite non régi par la Loi, à savoir : (i.) un régime complémentaire de retraite régi par une loi émanant d’une autorité législative autre que le Parlement du Québec et accordant droit à une rente différée; (ii.) un régime complémentaire de retraite établi par une loi émanant du Parlement du Québec ou d’une autre autorité législative; (c) un autre compte de retraite immobilisé, enregistré en tant que régime d’épargne retraite conformément à la Loi de l’impôt sur le revenu (Canada) et conforme aux exigences du Règlement; (d) un fonds de revenu viager considéré comme un fonds enregistré de revenu de retraite selon les dispositions de la Loi de l’impôt sur le revenu (Canada) et conforme aux exigences du Règlement; (e) un contrat de rente, selon l’article 30 du Règlement et en conformité avec le paragraphe 146(1) de la Loi de l’impôt sur le revenu (Canada). Tous les transferts dans le régime doivent être effectués en report d’impôt selon la Loi de l’impôt sur le revenu (Canada). 5. Obligation de versement d’une rente. À moins de disposition contraire dans le présent addenda, le solde du compte du régime ne peut être transformé qu’en une rente viagère garantie par un assureur et établie pour la durée de vie du titulaire seul, ou du titulaire et de son conjoint. Le titulaire pourra demander la conversion en tout temps, à moins que le terme convenu des placements ne soit pas échu. Les montants périodiques versés au titre de la rente viagère doivent être égaux à moins que chaque montant à verser soit uniformément augmenté en fonction d’un indice ou taux prévu au contrat ou qu’il soit uniformément modifié en raison d’une saisie pratiquée sur les droits du titulaire, du nouvel établissement de la rente du titulaire, du partage des droits du titulaire avec son conjoint, du versement d’une rente temporaire selon les conditions prévues à l’article 91.1 de la Loi ou de l’option prévue au paragraphe 3 du premier alinéa de l’article 93 de la Loi. La rente viagère doit être un placement admissible à titre de rente, selon l’article 146 de la Loi de l’impôt sur le revenu (Canada). 6. Rente viagère du conjoint. Le solde du régime ne peut être converti en rente viagère garantie par un assureur que si, au décès du titulaire qui est un participant ou un ancien participant, il est accordé à son conjoint qui n’y a pas renoncé une rente viagère au moins égale à 60 % du montant de la rente du titulaire incluant, le cas échéant, pendant la durée du remplacement, le montant de la rente temporaire. 7. Interdiction de retrait. Sauf dans les conditions prévues par la Loi, le Règlement ou le présent addenda, les retraits, conversions, rachats ou transferts partiels ou totaux du solde du régime sont interdits, à moins qu’un montant ne doive être payé au titulaire afin de réduire le montant de l’impôt applicable aux excédents de cotisation en vertu de la partie X.1 de la Loi de l’impôt sur le revenu (Canada). 8. Transferts hors du régime. Le titulaire peut, en tout temps avant la transformation du solde total du régime en une rente viagère conformément aux dispositions du paragraphe 5 du présent addenda, transférer tout ou partie dudit solde du régime dans : (a) les fonds d’un régime de retraite agréé régi par la Loi; (b) un régime complémentaire de retraite non régi par la Loi, à savoir : (i.) un régime complémentaire de retraite régi par une loi émanant d’une autorité législative autre que le Parlement du Québec et accordant droit à une rente différée; (ii.) un régime complémentaire de retraite établi par une loi émanant du Parlement du Québec ou d’une autre autorité législative; (c) un autre compte de retraite immobilisé, enregistré en tant que régime d’épargne retraite conformément à la Loi de l’impôt sur le revenu (Canada) et conforme aux exigences du Règlement; (d) un fonds de revenu viager considéré comme un fonds enregistré de revenu de retraite selon les dispositions de la Loi de l’impôt sur le revenu (Canada) et conforme aux exigences du Règlement; (e) un contrat de rente, selon l’article 30 du Règlement, lorsque le transfert est effectué conformément à l’alinéa 60(l) de la Loi de l’impôt sur le revenu (Canada) à moins que le terme convenu des placements du régime ne soit pas échu. Tous les transferts hors du régime doivent être effectués avec report d’impôt en vertu de la Loi de l’impôt sur le revenu (Canada). 9. Début du service de la rente avant l’expiration. Le régime arrive à expiration à la fin de l’année civile au cours de laquelle le titulaire atteint 69 ans, ou l’âge plus avancé autorisé par la Loi de l’impôt sur le revenu (Canada). Le titulaire a jusqu’à la date d’expiration pour commencer à recevoir une rente viagère conformément au paragraphe 5 ou pour transférer le solde du régime conformément au paragraphe 8 du présent addenda. Si l’émetteur du régime ne reçoit aucune instruction du titulaire avant la fin de l’année du 69e anniversaire du titulaire, il peut, à sa discrétion, transférer le solde du régime conformément à l’alinéa 8(d) du présent addenda, sachant que le titulaire sera responsable de tous les frais administratifs connexes. 10. Invalidité et espérance de vie réduite. Le titulaire peut retirer tout ou partie du solde du régime et recevoir un paiement ou une série de paiements lorsqu’un médecin certifie, sous une forme agréant à l’émetteur du régime, que son invalidité physique ou mentale réduit son espérance de vie. Le certificat du médecin doit être remis à l’émetteur du régime. 11. Versement en cas de résidence à l’étranger. Le titulaire peut, à moins que le terme convenu des placements ne soit pas échu, exiger que la totalité du solde du régime lui soit payée en un seul versement, à condition de fournir à l’émetteur du régime une preuve agréant à ce dernier qu’il ne réside plus au Canada depuis au moins 2 ans. 12. 13. 14. 15. 16. 17. 18. 19. 20. 21. 22. 23. 24. 25. Paiement de sommes modiques en un seul versement. La totalité du solde du régime peut être payée en un seul versement au titulaire, si ce dernier était âgé d’au moins 65 ans à la fin de l’année précédant la demande et tant que le total des sommes accumulées pour son compte dans les instruments d’épargne-retraite suivants : (a) les régimes de retraite à cotisation déterminée; (b) les régimes de retraite à prestations déterminées ou à cotisation et prestations déterminées, en application de dispositions identiques à celles d’un régime à cotisation déterminée; (c) les fonds de revenu viager; (d) les comptes de retraite immobilisés; (e) les régimes enregistrés d’épargne-retraite dont le solde doit être converti en rente viagère (REER immobilisés) n’excède pas 40 % du maximum des gains admissibles établi conformément à la Loi sur le régime de rentes du Québec pour l’année au cours de laquelle le titulaire demande le paiement. La demande du titulaire doit être accompagnée d’une déclaration conforme à celle prévue à l’annexe 0.2 du Règlement. Décès du titulaire. Si le titulaire, qui est un participant ou un ancien participant, décède avant la transformation du solde du régime en rente viagère, ce solde sera versé : (a) au conjoint survivant si le participant a un conjoint qui lui survit à la date de son décès, sauf si le conjoint a renoncé à son droit aux prestations prévues en cas de décès, conformément au paragraphe 14 du présent addenda, et s’il n’a pas révoqué cette renonciation avant le décès du titulaire; (b) aux ayants droit du titulaire, si ce dernier décède sans conjoint survivant admissible conformément à l’alinéa (a); (c) aux représentants successoraux du titulaire, si ce dernier décède sans bénéficiaire désigné. Renonciation aux prestations de décès ou à la rente viagère réversible. Le conjoint du titulaire peut, par avis écrit transmis à l’émetteur du régime, renoncer à son droit de recevoir le versement prévu au paragraphe 13 ou la rente viagère mentionnée au paragraphe 6 du présent addenda, et il peut révoquer une telle renonciation. Le conjoint du titulaire doit aviser l’émetteur du régime par écrit de sa renonciation ou de la révocation de sa renonciation sous une forme agréant à l’émetteur avant le décès du titulaire, dans le cas visé au paragraphe 13, ou avant la date de conversion de tout ou partie du solde du régime en rente viagère, dans le cas visé au paragraphe 6. Rupture de mariage. Le conjoint du titulaire cesse d’avoir droit aux prestations prévues au paragraphe 6 ou 13 du présent addenda en cas de séparation de corps, de divorce, d’annulation du mariage ou, dans le cas d’un conjoint non marié, en cas de rupture du lien conjugal, sauf dans les cas suivants : (a) en ce qui a trait aux prestations prévues au paragraphe 13, le conjoint est un ayant droit du titulaire le jour du décès de celui-ci; (b) en ce qui a trait aux prestations prévues au paragraphe 6, le titulaire a avisé par écrit l’émetteur du régime de verser les prestations à ce conjoint, conformément à l’article 89 de la Loi. Insaisissabilité. Sauf dispositions contraires de la Loi, du Règlement, du présent addenda ou de toute autre loi pertinente, les montants suivants sont incessibles et insaisissables : (a) toute somme transférée dans le régime en vertu du paragraphe 4 du présent addenda, ainsi que les intérêts accumulés; (b) toute somme transférée dans le régime d’un conjoint lorsqu’elle est attribuée au conjoint à la suite du partage ou d’une autre cession de droits visés au chapitre VIII de la Loi, avec les intérêts accumulés, ainsi que les prestations constituées avec ces sommes; (c) toute somme remboursée ou toute prestation versée en vertu des alinéas (a) et (b) sauf dans la mesure où ils proviennent de cotisations volontaires ou représentent une part d’excédent d’actif attribuée après la résiliation d’un régime de retraite. Saisie pour pension alimentaire impayée. La totalité ou une partie du solde du régime peut être payée en un seul versement en exécution d’un jugement rendu en faveur du conjoint du titulaire et donnant droit à la saisie pour dette alimentaire. La somme attribuable au conjoint à la suite d’un tel jugement doit lui être payée à la réception des documents appropriés par l’émetteur du régime, quel que soit le terme des placements. Le montant payé par le régime ne peut dépasser 50 % du solde du régime au moment de la saisie. Le titulaire n’aura plus aucun droit à la rente afférente au montant payé et l’émetteur du régime ne peut en aucune façon être tenu responsable pour avoir effectué le paiement à la suite de la saisie. Responsabilité de l’émetteur du régime. Si une somme est payée sur le régime en contravention des dispositions du présent addenda ou du Règlement, le titulaire peut, à moins que ce paiement ne soit attribuable à une fausse déclaration de sa part, exiger que l’émetteur du régime lui verse, à titre de pénalité, une somme égale au paiement irrégulier. Indemnité. Si l’émetteur du régime versait ou était contraint de verser une somme au titulaire en application du paragraphe 18 du présent addenda, le titulaire ou ses héritiers et/ou ses représentants successoraux indemniseront l’émetteur du régime, dans la mesure où les actifs du régime ont été reçus ou acquis au profit de tout prestataire. Relevés. Le titulaire a le droit de recevoir, au moins une fois par an, un relevé sur lequel figurent les sommes déposées, leur provenance, les gains accumulés, les frais débités depuis le dernier relevé, ainsi que le solde du régime. Tous les versements. Tous les transferts et autres versements effectués en vertu du présent addenda (en dehors des paiements visés au paragraphe 17) sont assujettis aux modalités des placements du régime ainsi qu’à la retenue de l’impôt applicable et à la déduction de tous les frais requis. Transfert de titres. Le transfert visé aux paragraphes 8 et 24 du présent addenda peut, à la demande du titulaire, au gré de l’émetteur du régime et sauf dispositions contraires, être effectué par la remise des titres de placement relatifs au régime. Modifications générales. Sous réserve des dispositions du paragraphe 24 du présent addenda, l’émetteur du régime peut, à l’occasion et à sa discrétion, modifier le présent addenda sur présentation d’un préavis de trente (30) jours au titulaire, à condition que cette modification reste conforme au contrat type modifié et enregistré auprès de la Régie des rentes du Québec et qu’elle ne soit pas contraire aux dispositions de la Loi, du Règlement ou de la Loi de l’impôt sur le revenu du Canada. L’émetteur du régime ne peut, si ce n’est pour satisfaire aux exigences légales, apporter des modifications sans en avoir au préalable avisé le titulaire. Modifications entraînant une réduction des prestations. Aucune modification du régime susceptible d’entraîner une réduction des prestations ne peut être apportée, à moins que le titulaire ne soit autorisé à transférer le solde du régime, conformément au paragraphe 8 du présent addenda, avant la date de la modification, et qu’un avis lui indiquant la nature de la modification et la date à partir de laquelle il peut exercer son droit de transfert ne lui soit adressé au moins quatre-vingt-dix (90) jours avant la date autorisée du transfert. Désaccord ou incompatibilité. En cas de désaccord ou d’incompatibilité, les dispositions du présent addenda prévaudront sur celles de la Déclaration de fiducie du régime.
