weight RESTRICTIONS — PROVINCIAL HIGHWAY NO. 8-06-40 (Tantallon Access)
ORDER for Weight Restriction on Provincial Highway No. 8-06-40 (Tantallon Access).
Reference: Provincial Highway No. 8-06-40 (Tantallon Access) from the junction with Provincial Highway
No. 8 to the corporate limits of the Village of Tantallon.
Pursuant to section 35.1 of The Highways and Transportation Act, 1997, the Minister hereby orders:
Effective 12:01 AM, April 1, 2011 and until further notice,
Provincial Highway No. 8-06-40 (Tantallon Access) from the junction with Provincial Highway No. 8 westward
to the corporate limits of the Village of Tantallon;
Shall be restricted as follows:
• The maximum gross vehicle weight not to exceed 8,000 kg (17,600 lbs);
• The maximum gross weight on any axle not to exceed 5,500 kg (12,100 lbs).
The restriction does not apply to:
• Emergency vehicles;
• Ministry of Highways and Infrastructure vehicles and municipal maintenance equipment when conducting
maintenance or accessing sites on or along the restricted highway;
• SaskPower, SaskEnergy and SaskTel vehicles when accessing sites along the restricted route;
• Recreational vehicles;
• Buses;
• Farm Equipment operated or towed;

Conviction Appeal Rules
The following Rules were made by the Court of Queen’s Bench for Saskatchewan pursuant
to section 482 of the Criminal Code and section 28 of The Queen’s Bench Act, 1998, effective
April 1, 2011:
“Interpretation
1 In these Rules:
“appeal” means an appeal from a summary conviction court under Part XXVII of the Criminal
Code, R.S.C. 1985, c. C, and The Summary Offences Procedure Act, 1990, S.S. 1990-91, c. S.1, as amended
from time to time; (appel)

“appeal court” means the Court of Queen’s Bench for Saskatchewan; (tribunal d’appel)
“authority” means:
(a) a municipality;
(b) the Meewasin Valley Authority;
(c) the Wakamow Valley Authority;
(d) the Wascana Centre Authority;
(e) the University of Regina; or
(f) the University of Saskatchewan; (autorité)
“file” means file with a local registrar; (déposer)
“Form” mean a Form as set out in the Appendix to these Rules; (formule)
“judge” means a judge of the appeal court; (juge)
“local registrar” includes a deputy local registrar of the appeal court; (registraire local)
“prosecutor” means;
(a) with respect to an appeal in respect of an offence under the Criminal Code, a prosecutor as
defined in section 2 of the Criminal Code;
(b) with respect to an appeal in respect of an offence under an Act of Saskatchewan or a regulation
made pursuant to an Act of Saskatchewan, the following persons, including counsel or an agent
acting on behalf of any of them:
(i) the Attorney General for Saskatchewan; or
(ii) if the Attorney General for Saskatchewan does not intervene, the informant or person
who issued the ticket for the offence;
(c) with respect to an appeal in respect of an offence under an Act of the Parliament of Canada
or a regulation made pursuant to an Act of the Parliament of Canada, the following persons,
including counsel or an agent acting on behalf of any of them:
(i) the Attorney General of Canada; or
(ii) if the Attorney General of Canada does not intervene, the informant or person who
issued the ticket for the offence;
(d) with respect to an appeal in respect of a bylaw of an authority, the authority and includes
anyone authorized by the authority to prosecute bylaws on its behalf. (poursuivant)
Appeal by defendant
2(1) A defendant who commences an appeal shall file with the local registrar nearest to the place where
the decision was made a Notice of Appeal in Form 1 in accordance with the instructions on that form.
(2) The defendant shall commence the appeal under this Rule within 30 days after the pronouncement of
the order under appeal, or within 30 days after the imposition of sentence if a sentence has been imposed,
whichever is later.
(3) The defendant shall state their address for service on the Notice of Appeal, including:
(a) their telephone number; and
(b) if applicable, their fax number and email address.
(4) After filing a Notice of Appeal, the defendant shall notify the local registrar in writing of any change
to that information.

(5) Filing of the Notice of Appeal with the local registrar constitutes service on the prosecutor.
(6) The local registrar shall forward a copy of the Notice of Appeal to the prosecutor.
Appeal by prosecutor
3(1) A prosecutor who commences an appeal shall file with the local registrar nearest to the place where
the decision was made a Notice of Appeal in Form 2 in accordance with the instructions on that form.
(2) The prosecutor shall commence the appeal under this Rule within 30 days after the pronouncement of
the order under appeal, or within 30 days after the imposition of sentence if a sentence has been imposed,
whichever is later.
(3) The prosecutor shall state their address for service on the Notice of Appeal, including:
(a) their telephone number; and
(b) if applicable, their fax number and email address.
(4) The prosecutor shall serve the defendant with the Notice of Appeal not later than 10 days after it is
filed with the local registrar.
Service on defendant
4(1) The prosecutor shall serve the Notice of Appeal and any other document required to be served on the
defendant by personal service.
(2) The prosecutor shall file proof of service with the local registrar.
(3) If the prosecutor is unable to serve the Notice of Appeal or any other document that is required to be
served on the defendant personally, the prosecutor may apply ex parte to a judge of the appeal court for an
order to serve the defendant in the manner that the appeal court directs.
(4) If the prosecutor serves the Notice of Appeal or any other document that is required to be served in
accordance with an order for substituted service, the defendant is deemed to have been served with that
document.
(5) On the application of the defendant or prosecutor, the appeal court may:
(a) set aside or vary an order for substituted service as the appeal court considers just; and
(b) make any order respecting service of either or both of the Notice of Appeal and any other
document.
Material from summary conviction court
5 After the Notice of Appeal has been filed, the local registrar shall obtain the material provided for in
subsection 821(1) of the Criminal Code from the summary conviction court.
Transcripts
6(1) Within 14 days after serving the Notice of Appeal, the appellant shall furnish to the local registrar
proof, satisfactory to the local registrar, that transcripts of the trial proceedings have been ordered.
(2) Subrule (1) does not apply if the appellant has applied under Rule 8 for a trial de novo.
Transcript of evidence
7 Unless the appeal court otherwise orders, or an agreed statement of facts has been filed pursuant to
subsection 830(2) of the Criminal Code, the appellant shall, within 10 days after receipt of the transcript,
(a) if the appeal is against an order other than sentence;
(i) file:
(A) the original and one copy of the transcript of evidence; and
(B) the reasons for judgment from the summary conviction court; and

(ii) serve one copy of the transcript of evidence and the reasons for judgment on the
respondent;
(b) if the appeal is against sentence:
(i) file;
(A) the transcript of evidence, if any, of the sentencing proceedings, including the
submissions of the prosecution and the defence as to sentence; and
(B) the reasons for sentence; and
(ii) serve one copy of the transcript of evidence mentioned in clause (i)(A) and the reasons for
sentence on the respondent; or
(c) if the appeal is against both sentence and an order other than sentence, file and serve on the
respondent the material mentioned in paragraphs (a) and (b) within 10 days after receipt of the
transcript.
Application for trial de novo
8(1) An appellant who applies for a trial de novo under subsection 822(4) of the Criminal Code shall submit
a Notice of Application to the appeal court within 30 days after serving the Notice of Appeal.
(2) At least seven days before the hearing of the application, the appellant shall serve a copy of the Notice
of Application and any supporting material on the respondent.
Date, time and place of hearing
9(1) The appellant is not required to state a date, time or place for the hearing of the appeal in a Notice
of Appeal.
(2) On receipt of the material required to be transmitted by the summary conviction court pursuant to
subsection 821(1) of the Criminal Code and a transcript of the evidence, unless dispensed with by order of
the appeal court, the local registrar shall set a date, time and place for the hearing of the appeal.
Notice of date, time and place of hearing
10 As soon as the appeal is set for hearing, the local registrar of the appeal court shall give notice to the
appellant and to the respondent that the appeal has been set down for hearing as well as notice of the date
and time when, and the place where, the appeal will be heard.
Memorandum of argument required
11 Unless the appeal court otherwise orders, the appellant and respondent shall each file a memorandum
of argument with the local registrar.
Appellant’s memorandum of argument
12 The appellant’s memorandum of argument shall be in Form 3 and shall contain the following
information:
(a) a concise statement of the facts;
(b) a concise statement of the law to be argued;
(c) references to the relevant evidence;
(d) the authorities relied on; and
(e) the relief requested.
Respondent’s memorandum of argument
13 The respondent’s memorandum of argument shall be in Form 4 and shall contain the following
information:
(a) those facts in the appellant’s memorandum of argument that the respondent accepts;
(b) those facts in the appellant’s memorandum of argument that the respondent rejects;

(c) a concise statement of the facts to be argued in response;
(d) a concise statement of the law to be argued in response;
(e) references to the relevant evidence;

Service by appellant
14 At least 30 days before the date set for the hearing of the appeal, the appellant shall file their
memorandum of argument and serve a copy on the respondent.
Service by respondent
15 At least 15 days before the date set for the hearing of the appeal, the respondent shall file their
memorandum of argument and serve a copy on the appellant.
Application to dismiss appeal
16(1) The respondent may apply to the appeal court for an order that the appeal be dismissed if the
appellant fails to:
(a) pursue the appeal diligently; or
(b) comply with these Rules.
(2) The respondent shall serve the appellant with 14 days’ notice of the date, time and place of the hearing
of the application.
Reference to appeal court
17 If the local registrar considers that the appellant has not pursued the appeal diligently or has not
complied with these Rules, the local registrar may refer the matter to the appeal court.
Notice of reference
18 If the local registrar makes a reference under Rule 17, the local registrar shall serve the appellant and
the respondent with 14 days’ notice of the date, time and place of the hearing of the reference, by mailing
the notice to each party’s address for service.
Order of appeal court
19 On an application under Rule 16 or a reference under Rule 17, the appeal court may dismiss the appeal
or make any other order it considers just.
Power of court if appellant fails to file memorandum or to appear
20 If an appellant fails to file a memorandum of argument as required by Rule 14 and fails to appear at
the hearing on the date and at the time and place set out in the notice given by the local registrar under
Rule 10, the appeal court may dismiss the appeal or make any other order it considers just.
Abandonment
21 An appellant may abandon an appeal by
(a) signing and filing a notice in Form 5; or
(b) informing the appeal court in person or by counsel that the appeal is abandoned.
Time limits
22 Any judge may, on application, extend or shorten the time provided for the giving of any notice or the
doing of any act, even if an application for extension or an order granting an extension is made after the
time has expired.

Application for release or stay
23 An appellant who applies for release, a stay of a probation order, a stay of a driving prohibition, or any
other stay order, shall file with the local registrar:
(a) a Notice of Application in Form 6;
(b) an affidavit verifying the facts on which the appellant relies in support of the application; and
(c) any other material on which the appellant relies in support of the application.
Service of application on prosecutor
24 On filing an application under Rule 23, the appellant shall serve the application and accompanying
material on the prosecutor.
Notice of hearing
25 If an appellant applies pursuant to Rule 23, the local registrar shall:
(a) within three days after receiving the material from the appellant, set a date for the hearing of
the application; and
(b) notify the appellant and the respondent of the date and time when, and the place where, the
hearing will be held.
When appeal court may make orders re application without prosecutor
26 With the written consent of the prosecutor, the appeal court may make any order on an application
pursuant to Rule 23 without the attendance of the prosecutor.
General procedure and practice of appeal court to be followed
27 Unless provided otherwise by statute or by these Rules, the general procedure and practice of the
appeal court shall be applied, with necessary modification, in a summary conviction appeal, including an
application to dismiss an appeal and an application for release or stay.
Repeal
28 The Saskatchewan Court of Queen’s Bench Summary Conviction Appeal Rules are repealed.
Coming into effect
29 These Rules come into effect on April 1, 2011.

“Définitions
1 Les définitions qui suivent s’appliquent aux présentes règles:
«appel» Appel interjeté d’une décision d’une cour des poursuites sommaires sous le régime de la partie
XXVII du Code criminel, L.R.C. (1985), ch. C, et de la loi intitulée The Summary Offences Procedure
Act, 1990, L.S. 1990-1991, ch. S.1, avec leurs modifications successives. (appeal)
«autorité» Selon le cas:
a) une municipalité;
b) la Meewasin Valley Authority;
c) la Wakamow Valley Authority;
d) la Wascana Centre Authority;
e) la University of Regina;
f) la University of Saskatchewan. (authority)
«déposer» Déposer auprès d’un registraire local. (file)
«formule» Formule figurant à l’annexe des présentes règles. (Form)

Appel interjeté par le défendeur
2(1) Un défendeur interjette appel en déposant auprès du registraire local le plus près de l’endroit où la
décision a été rendue un avis d’appel établi en la formule 1 et conforme aux directives qu’elle renferme.

(2) Le défendeur introduit l’appel prévu au présent article dans les trente jours suivant la date du

(3) Le défendeur indique son adresse aux fins de signification sur l’avis d’appel, ainsi que:
a) son numéro de téléphone;
b) ses numéro de télécopieur et adresse de courriel, s’il y a lieu.
(4) Si, après avoir déposé son avis d’appel, ses coordonnées viennent à changer, le défendeur en avise le
registraire local par écrit.
(5) Le dépôt de l’avis d’appel au bureau du registraire local vaut signification au poursuivant.
(6) Le registraire local transmet une copie de l’avis d’appel au poursuivant.
Appel interjeté par le poursuivant
3(1) Le poursuivant interjette appel en déposant auprès du registraire local le plus près de l’endroit où la
décision a été rendue un avis d’appel établi en la formule 2 et conforme aux directives qu’elle renferme.
(2) Le poursuivant introduit l’appel prévu au présent article dans les trente jours suivant date du

Signification au défendeur
4(1) L’avis d’appel et tout autre document à signifier au défendeur lui est signifié à personne par le
poursuivant.
(2) Le poursuivant dépose auprès du registraire local une preuve de la signification.
(3) Le poursuivant qui s’avère incapable de signifier à personne l’avis d’appel ou tout autre document
à signifier au défendeur peut présenter à un juge du tribunal d’appel une requête ex parte demandant à
celui-ci d’ordonner un autre mode de signification.
(4) Lorsque le poursuivant se fonde sur une ordonnance de signification indirecte pour signifier l’avis
d’appel ou tout autre document, le défendeur est réputé en avoir reçu signification.
(5) À la demande du défendeur ou du poursuivant, le tribunal d’appel peut:
a) annuler ou modifier une ordonnance de signification indirecte comme il lui semble juste;
b) rendre toute ordonnance concernant la signification de l’avis d’appel ou d’un autre document.
Documentation de la cour des poursuites sommaires
5 Une fois l’avis d’appel déposé, le registraire local obtient de la cour des poursuites sommaires les
documents prévus au paragraphe 821(1) du Code criminel.
Transcriptions
6(1) Après avoir signifié l’avis d’appel, l’appelant a quatorze jours pour fournir au registraire local une
preuve, jugée acceptable par ce dernier, que des transcriptions des actes de procédure du procès ont été
commandées.
(2) Le paragraphe (1) ne s’applique pas si l’appelant a demandé un procès de novo conformément à l’article 8.

Dépôt et signification de la transcription et des motifs
7 Sauf ordonnance contraire du tribunal d appel ou dépôt d un exposé conjoint des faits conformément au
paragraphe 830(2) du Code criminel, l’appelant est tenu de prendre les mesures ci-après dans les dix jours
suivant la réception de la transcription:
a) si appel est interjeté d’une ordonnance autre que la sentence:
(i) déposer:
(A) l’original de la transcription des dépositions et copie de celle-ci,
(B) les motifs du jugement de la cour des poursuites sommaires,
(ii) signifier à l’intimé copie de la transcription des dépositions et des motifs du jugement;
b) si appel est interjeté de la sentence:
(i) déposer:
(A) la transcription des dépositions, le cas échéant, ainsi que des observations de la
poursuite et de la défense, présentées à l’occasion de la détermination de la peine,
(B) les motifs de la sentence,
(ii) signifier à l intimé copie de la transcription des dépositions mentionnée à la division (i)(A)
et des motifs de la sentence;
c) si appel est interjeté à la fois de la sentence et d’une ordonnance autre que la sentence, déposer
et signifier à l’intimé les documents mentionnés aux alinéas a) et b) dans les dix jours suivant la
réception de la transcription.
Demande de procès de novo
8(1) L’appelant qui demande un procès de novo en vertu du paragraphe 822(4) du Code criminel présente
un avis de requête au tribunal d’appel dans les trente jours après avoir signifié l’avis d’appel.
(2) Au moins sept jours avant l’audition de la requête, l’appelant signifie à l’intimé copie de l’avis de
requête et de tout document à l’appui.
Date, heure et lieu de l’audience
9(1) L’appelant n’est pas tenu d’indiquer les date, heure et lieu de l’audition de l’appel dans l’avis
d’appel.
(2) Sur réception des documents que la cour des poursuites sommaires doit transmettre en application du
paragraphe 821(1) du Code criminel et de la transcription des dépositions, le registraire local, sauf dispense
du tribunal d’appel, fixe les date, heure et lieu de l’audition de l’appel.

10 Dès que l’appel est mis au rôle, le registraire local du tribunal d’appel avise l’appelant et l’intimé de
ce fait et leur indique les date, heure et lieu de l’audition de l’appel.
Mémoires exigés
11 Sauf ordonnance contraire du tribunal d’appel, l’appelant et l’intimé déposent chacun un mémoire
auprès du registraire local.

12 Le mémoire de l’appelant est établi en la formule 3 et contient les renseignements suivants:

c) un énoncé succinct des faits qu’il plaidera en réponse;
d) un énoncé succinct des moyens de droit qu’il plaidera en réponse;
e) la mention des preuves pertinentes;
f) les sources invoquées;
g) la réparation sollicitée.

14 Au moins trente jours avant la date fixée pour l’audition de l’appel, l’appelant dépose son mémoire et
en signifie copie à l’intimé.
Signification par l’intimé
15 Au moins quinze jours avant la date fixée pour l’audition de l’appel, l’intimé dépose son mémoire et
en signifie copie à l’appelant.
Requête en rejet de l’appel
16(1) L’intimé peut demander au tribunal d’appel d’ordonner le rejet de l’appel dans les cas suivants:
a) l’appelant omet de poursuivre diligemment l’appel;
b) l’appelant omet de se conformer aux présentes règles.
(2) L’intimé signifie à l’appelant un préavis de quatorze jours des date, heure et lieu de l’audition de la
requête.
Renvoi au tribunal d’appel
17 Si le registraire local estime que l’appelant n’a pas poursuivi diligemment son appel ou ne s’est pas
conformé aux présentes règles, il peut renvoyer l’affaire au tribunal d’appel.
Avis de renvoi
18 Lorsque le registraire local fait un renvoi en vertu de l’article 17, il signifie à l’appelant et à l’intimé,
par envoi postal à leur adresse aux fins de signification, un préavis de quatorze jours des date, heure et
lieu de l’audition du renvoi.
Ordonnance du tribunal d’appel
19 Saisi d’une requête présentée en vertu de l’article 16 ou d’un renvoi fait en vertu de l’article 17, le
tribunal d’appel peut rejeter l’appel ou rendre toute autre ordonnance qu’il estime juste.
Pouvoirs de la cour quand l’appelant omet de déposer son mémoire ou de comparaître
20 Si l’appelant omet de déposer le mémoire prescrit par l’article 14 et de comparaître à l’audience aux
date, heure et lieu indiqués dans l’avis donné par le registraire local en application de l’article 10, le tribunal
d’appel peut rejeter l’appel ou rendre toute autre ordonnance qu’il estime juste.
Abandon
21 L’appelant peut abandonner son appel de l’une des manières suivantes:
a) en souscrivant et en déposant un avis établi en la formule 5;
b) en informant le tribunal d’appel – lui-même ou par le truchement de son avocat – que l’appel est
abandonné.
Délais
22 Tout juge peut, sur demande, prolonger ou écourter les délais prévus pour donner un avis ou accomplir
un acte, même lorsque la demande ou l’ordonnance de prolongation survient après l’expiration du délai.

Demande de mise en liberté ou de suspension
23 L’appelant qui demande sa mise en liberté ou sollicite une ordonnance de suspension visant notamment
la suspension d’une ordonnance de probation ou d’une interdiction de conduire dépose les documents ciaprès au bureau du registraire local:
a) un avis de requête établi en la formule 6;
b) un affidavit attestant les faits qu’invoque l’appelant à l’appui de sa requête;
c) tout autre document qu’invoque l’appelant à l’appui de sa requête.
Signification de la requête au poursuivant
24 Dès le dépôt d’une requête conformément à l’article 23, l’appelant en signifie une copie au poursuivant
avec les documents qui l’accompagnent.
Avis d’audience
25 Le registraire local qui est saisi d’une requête prévue à l’article 23:
a) fixe, dans les trois jours suivant la réception des documents de l’appelant, une date pour l’audition
de la requête;
b) avise l’appelant et l’intimé des date, heure et lieu de l’audience.
Ordonnances ex parte de mise en liberté ou de suspension
26 Moyennant son consentement écrit, le tribunal d’appel peut rendre toute ordonnance sollicitée en vertu
de l’article 23 en l’absence du poursuivant.
Applicabilité des procédures et pratiques générales du tribunal d’appel
27 Sauf indication contraire d’une loi ou des présentes règles, les procédures et pratiques générales du
tribunal d’appel s’appliquent, avec les adaptations nécessaires, aux appels en matière de poursuites sommaires,
y compris aux requêtes en rejet de l’appel et aux demandes de mise en liberté ou de suspension.
Abrogation
28 Les Règles de la Cour du Banc de la Reine de la Saskatchewan relatives aux appels en matière
d’infractions punissables sur déclaration sommaire de culpabilité sont abrogées.
Entrée en vigueur
29 Les présentes règles entrent en vigueur le 1er avril 2011.

PLEASE NOTE: The deadline for submissions to The Saskatchewan Gazette is 5 p.m. on the Monday of
the week of publication. If a holiday occurs within the week of publication, the deadline is set back to 5 p.m.
of the previous Friday. Please allow yourself at least one full week to ensure mail delivery of Gazette
submissions. Publication of any material received late will be delayed until the following week’s issue.
All material for publication in The Saskatchewan Gazette must be submitted electronically (WordPerfect
or Word) accompanied by a signed hard copy to the Office of the Queen’s Printer, Saskatchewan Justice,
B19-3085 Albert St., Regina SK S4S 0B1, tel. (306)787-2367, or by E-mail: [email protected].
Each document or disk must be complete in the form required for publication and must be separate from
the covering letter. Signatures on all documents must be typewritten or clearly printed immediately below
the written signatures.
Prepayment is required for ALL notices placed in The Saskatchewan Gazette by non-government clients.
Cheques or money orders must be made payable to the Queen’s Printer Revolving Fund. Please include the
GST in addition to regular charges at the rate of 5% each for those items listed below under “GST Payable”.
The minimum charge for publication of notices not specified below is $16.00 for each notice, which
sum shall accompany the material when forwarded for publication.

SACHEZ QUE: La date de tombée pour les soumissions à la Gazette de la Saskatchewan est le lundi
à 5 p.m., la semaine de la parution. En cas de jour férié à l’intérieur de la semaine de parution, la date de
tombée sera remise un jour avant, soit le vendredi à 5 p.m. Pour les envois de soumissions à la Gazette
par la poste, veuillez prévoir une semaine au complet. La parution de tout matériel reçu en retard sera
remise au numéro de la semaine suivante.
Tous les documents qui paraîtront dans la Gazette de la Saskatchewan doivent être soumis électroniquement
(WordPerfect ou Word) et accompagnés d’une copie papier signée et envoyée au bureau de l’Imprimeur
de la Reine, ministère de la Justice de la Saskatchewan, B19-3085, rue Albert, Regina SK S4S 0B1,
tél. 306-787-2367, ou par courriel: [email protected].
Chaque document ou disquette doit être complet, conformément aux normes de parution, et doit être séparé
de la lettre d’accompagnement. Les signatures sur les documents doivent être dactylographiées ou écrites

Le paiement d’avance est exigé pour TOUS les avis placés dans la Gazette de la Saskatchewan par les clients
