RÈGLEMENTATION DU SURVOL ET D'ATTERRISSAGE DES AERONEFS ÉTRANGERS SUR LE TERRITOIRE TOGOLAIS

REGULATION OVERFLIGHT THE TOGOLESE TERRITORY AND LANDING FOR FOREIGN AIRCRAFT
(Decree N°68 - 159/PR of 20 August 1968)
Article 1
Sous réserve de l'application des règlements en matière de
navigation aérienne, le droit de survol et d'atterrissage est accordé à tout
aéronef dans un des Etats membres de l'OACI, à l'exception des
aéronefs d'Etat, des aéronefs militaires et des aéronefs employés à des
services aériens internationaux réguliers qui ne peuvent se prévaloir
d'accords aériens particuliers signés par le Gouvernement de la
République Togolaise
Article 2
Le survol du Territoire et l'atterrissage sur un aérodrome de la République
Togolaise par des aéronefs d'Etat et des aéronefs militaires étrangers
restent subordonnés à l'obtention d'une autorisation spéciale délivrée par
le Ministre des Affaires Etrangères.
Article 3
L'atterrissage sur un aérodrome de la République Togolaise des aéronefs
assurant le transport de passagers, de marchandises ou de courrier,
moyennant rémunération ou en exécution d'un contrat de location en
dehors des services aériens internationaux réguliers, reste subordonné à
l'obtention d'une autorisation délivrée par le Ministre des Travaux Publics,
Mines, Transports, des Postes et Télécommunications en consultation
avec le Ministre des Affaires Etrangères, à moins que les aéronefs
n'effectuent aucun embarquement ou débarquement de passagers, de
marchandises ou de courriers pendant le temps de leur escale.
Article 4
Le premier atterrissage doit avoir lieu sur un aérodrome habilité à recevoir
les aéronefs en provenance de l'étranger. L'atterrissage sur un
aérodrome de la République Togolaise autre que celui de Lomé/
Gnassingbé Eyadema sera subordonné à un préavis de 12 heures qui
devra être adressé soit aux autorités de douane, de police et de santé de
la localité desservie par l'aérodrome, soit aux autorités aéronautiques à
Lomé, en utilisant tout moyen de communication disponible.
Article 5
Les Autorités compétentes se réservent le droit de visiter, à l'atterrissage
et au départ, les aéronefs des autres Etats et d'examiner les certificats et
autres documents concernant ces aéronefs et leurs équipages.
Article 6
Les autorités compétentes se réservent le droit de restreindre ou
d'interdire temporairement le survol de tout ou partie du territoire, à tous
ou certains aéronefs, si des mesures de sécurité particulières l'exigent

Article 1
Subject to the application of air navigation regulations, the overflight
and landing permission is allowed to aircraft belonging to one of ICAO
member countries, with the exception of state aircraft, military aircraft
and any aircraft used for scheduled international flights that cannot take
advantage of particular air agreements signed by the Government of
Togo Republic.
Article 2
The territory overflight and the landing on an aerodrome in Togo
Republic performed by state aircraft and foreign military aircraft is
submitted to the obtaining of a special permission delivered by the
Foreign Affairs Ministry
Article 3
The landing on an aerodrome in Togo Republic by aircraft performing
transport of passengers, cargo or mail, in exchange for remuneration or
in execution of a rental contract outside the scheduled international
flights, is submitted to the obtaining of a permission delivered by the
Ministry of Public Works, Mines, Transportation, Post and
Telecommunications in consultation with the Foreign Affairs Ministry,
unless the aircraft don't make any boarding or unloading of passengers,
cargo or mail during the time of stopover.
Article 4
The first landing must be operated on an aerodrome authorized to
receive aircraft arriving from stranger countries. The landing on an
aerodrome of Togo Republic, another one that Lomé/Gnassingbé
Eyadema , will be subordinated to a previous notice of 12 hours that
should be addressed, either to the autho- rities of Customs, Immigration
and Health of the airport locality, either to the civil aviation authority in
Lomé, while using any available communication facility.
Article 5
The competent authorities can reserve the right to do the inspection of
aircraft belonging to the other states, during the arrival and the
departure, and to examine certificates and other documents of the
aircraft and crew.
Article 6
The competent authorities can reserve the right to restrict or to forbid t
emporarily the overflight of the entire or a part of the territory by any or
some aircraft, in case of some particular measures of security require it.
Article 7
Le Ministre des Travaux Publics, Mines, Transports, des Postes et
Télécommunications, le Ministre des Finances et de l'Economie, le
Ministre des Affaires Etrangères, le Ministre de l'Intérieur, le Ministre de la
Santé Publique sont chargés, chacun en ce qui le concerne, de
l'exécution du présent décret qui entrera en vigueur dès sa signature et
qui sera publié au Journal Officiel de la République Togolaise
The Minister of Public Works, Mines, Transportation, Post and
Telecommunications, the Minister of Treasury and Finance, the Minister
of Foreign Affairs, the Minister of Home Office, the Minister of Health
are, each in what concerns it, in charge of the execution of the present
decree that will enter in force since its signature and will be published
in the Official Journal of Republic of Togo

NB : Take in account the requirement of AIC N° 05/A/16/GO relative to

REGULATION OF OVERFLIGHT THE TOGOLESE TERRITORY AND LANDING FOR FOREIGN AIRCRAFT

Tout aéronef étranger devra obtenir l'autorisation de la Direction de
l'Aviation Civile pour survoler ou atterrir au TOGO.
All foreign aircraft must have the permission of the Directorate of Civil
Aviation to perform an overflight or a landing in Togo.
La demande d'autorisation devra être adressée au moins 72 heures avant
le vol et comportera :
The permission request should be addressed at least 72 hours before
the flight and must include :
A - Type et Immatriculation de l'aéronef
B - Nom de l'exploitant
C - Provenance
D - Date et heure d'arrivée
E - Objet du vol
F - Nom et Nationalité du Commandant de Bord
G - Nombre et membres d'équipage
H - Nombre de passagers
I - Nature et quantité du chargement
J - Nom et adresse du destinataire du chargement
La demande d'atterrissage entre 0000 TU et 0600 TU devra être évitée.
