Quelques Expériences ou Tentatives d’Intégration: Ahmed Mahiou En introduction de son cours, Ahmed Mahiou, professeur de l’Université d’Alger, fait remarquer que si les rapports internationaux en général ne sont pas simples, ils sont encore plus complexes et plus insaisissables lorsqu’ils sont internes au sud. En empruntant une démarche de droit économique, le Professeur Mahiou s’intéresse dans un premier temps à la situation et à la perspective de la coopération Sud-Sud (situation de la coopération Sud-Sud et dialectique de la rupture et de l’autonomie). L’auteur présente ensuite successivement le marché commun centraméricain, la Communauté économique de l’Afrique de l’Ouest, et la Communauté économique africaine. The Legal Framework of the South-South Co-operation.Some Experiments or Attempts at Integration: Ahmed Mahiou In the introduction to his course, Ahmed Mahiou, Professor of the University of Algiers, points out that if international relations in general are far from being straightforward, they are even more complex and elusive in a South-South context. Looking at this from the point of view of economic law, Professor Mahiou focuses his attention in the first chapter on situating the SouthSouth cooperation and defining its prospects (South-South cooperation with respect to international relations and the dialectic of breaking away from the North and collective autonomy). In the following chapters, the author successively presents the Central American Common Market, the Economic Community of West Africa, and the African Economic Community. Obligations Arising for States without or against their Will: Christian Tomuschat La place assignée à la volonté des États est cruciale à la compréhension du droit international, relève Christian Tomuschat, professeur à l’Université de Bonn. Si la volonté des États joue un rôle considérable dans l’apparition d’obligations à la charge des États, elle ne peut à elle seule expliquer toutes ces obligations. Le Professeur Tomuschat étudie les obligations incombant aux États hors de leur volonté ou contre leur volonté, en analysant, après une introduction en grande partie consacrée à la constitution de la communauté internationale, le rôle des traités, celui de la coutume internationale, celui des principes généraux du droit, et le rôle joué par le droit dérivé des organisations internationales (Communautés européennes et Nations Unies). Le Professeur Tomuschat consacre également de longs développements à la mise en œuvre et à l’application du droit. Obligations Arising for States without or against their Will: Christian Tomuschat According to Christian Tomuschat, Professor at the University of Bonn, the place to be assigned to the will of States is crucial for the understanding of the international legal order. But though the will of States plays a considerable role in the appearance of obligations that are the States' responsibility, it alone cannot account for all these obligations. Professor Tomuschat studies the obligations that fall to States without or against their will, while analyzing, after an introduction mainly devoted to the constitution of the international community, the role of the treaties, of customary law, that of the general principles law, and the role played by the secondary law of international organizations (European Communities and the United Nations). In the final chapter Professor Tomuschat pays special attention to the place of implementation of the law and its enforcement.
