Mohtashami, A Guide to the LCIA Arbitration Rules, Oxford University Press, 2009): • 9 “Whatever limits may apply in different civil procedure rules will generally not apply in international arbitration, where it is well recognized that witnesses may be interviewed and prepared prior to giving oral testimony. Article 20.6 conforms to this practice and is consistent with Article 4(3) of the IBA Rules.“ Conseil de l’Ordre des Avocats de Paris Résolution adoptée lors de la séance du 26 février 2008, à l’unanimité (Bulletin du Barreau 2008 n°9): • 10 “Dans le cadre des procédures arbitrales internationales, situées en France ou à l’étranger, il entre dans la mission de l’avocat de mesurer la pertinence et le sérieux des témoignages produits au soutien des prétentions de son client, en s’adaptant aux règles de procédure applicables. Dans cet esprit, la préparation du témoin par l’avocat avant son audition ne porte pas atteinte aux principes essentiels de la profession d’avocat et s’inscrit dans une pratique communément admise où l’avocat doit pouvoir exercer pleinement son rôle de défenseur.” Restatement (Third) of the Law Governing Lawyers (2000) Section 116, Reporter’s Note to Comment (b): • “In preparing a witness to testify, a lawyer may invite the witness to provide truthful testimony favorable to the lawyer's client. Preparation consistent with the rule of this Section may include the following: - discussing the role of the witness and effective courtroom demeanor; - discussing the witness's recollection and probable testimony; - revealing to the witness other testimony or evidence that will be presented and asking the witness to reconsider the witness's recollection or recounting of events in that light; - discussing the applicability of law to the events in issue; - reviewing the factual context into which the witness's observations or opinions will fit; - reviewing documents or other physical evidence that may be introduced; and - discussing probable lines of cross-examination that the witness should be prepared to meet. Witness preparation may include rehearsal of testimony. A lawyer may suggest choice of words that might be employed to make the witness's meaning clear.
