CONDITIONS OF SUBSCRIPTION (1st January 2013)
MC Vision Ltd operates an encrypted pay television service (“the Service”) and puts at the disposal of its subscribers a number
of programmes. The subscriber subscribes to the programmes that he selects (a) in the form set out overleaf, (b) over the
telephone (c) on the web site of MC Vision Ltd or (d) by such other method as may be in place from time to time (“the
Programmes”), for and in consideration of the payments and on the terms and conditions hereinafter set out (“the
Agreement”).

Subscription
A subscription gives access in digital or otherwise to the Programmes, with or without a digital satellite decoder to
receive those Programmes via the Eutelsat W3C satellite system or any other system which may replace it, or through
such other system as may be used from time to time by MC Vision Ltd.
For the purpose of the Service, MC Vision Ltd has appointed agents. The term “MC VISION” shall unless the context
otherwise requires, refer to MC Vision Ltd and its agents.
The term “subscriber” or “abonné” refers to residential subscribers only.
A subscriber subscribes to the Programmes for the exclusive use of his private domestic household. The subscriber
may subscribe to as many Programmes as the Service offers at the sole discretion of MC VISION. A new subscriber
is a person (a) who has never held any subscription with MC VISION, or (b) forming part of a household, none of
whose members has ever held a subscription with MC VISION.
MC VISION gives access to the Programmes to the subscriber subject to the conditions set out in this Agreement (“the
Subscription Conditions”).
TITLE I - GENERAL CONDITIONS OF SUBSCRIPTION

The minimum subscription period is 12 months.
For the first subscription period only: the number of days remaining between the first day of the subscription and the
last day of the calendar month during which the subscription comes into effect is added onto the 12 months period
referred to in article 2.1 of the present Title I above.
Unless notice of termination is given in writing one month before the expiry date of the then current period, the
subscription is renewed automatically for a further period of twelve months. The notice of termination shall be
addressed to the General Manager, MC Vision Ltd, presently at Leclézio Street, Curepipe, by registered post with
advice of delivery. Any change of address of MC VISION shall be notified to the subscriber by post or by
advertisement. Irrespective the mode of payment, termination at the subscriber’s initiative may only take place at the
end of the then current subscription period.
The subscriber may not cancel his subscription save and except in the manner provided for in article 2.3 of the
present Title I.
The only proof of cancellation of the subscription shall be the written notice of termination referred to in article 2.3
together with the receipt of the post office showing that the said notice was sent by registered post with advice of
delivery and duly delivered to the General Manager, MC VISION, at the then current address of MC VISION.
Access to certain options of the Service (such as the MULTIROOM 2nd screen Option) are only open to qualifying
subscribers. The criteria for qualification are set from time to time by MC VISION, and may be consulted on the web
site of MC VISION (currently http://www.canalplus-maurice.com), in the showrooms of MC VISION and are
available over the telephone at the Customer Service Relation of MC VISION (currently 602-1818).

Renewal of contract by tacit agreement
Equipment necessary for the reception of MC VISION Programmes
Depending on the type of system chosen by the subscriber to receive the Programmes, any one of the following units
of equipment is put at his disposal:

an MC VISION HD satellite decoder with its accessories (an HDMI or a Scart audio/video cable, an AC
cord and a remote control), and
an MC VISION digital only memory card (hereafter referred to as “the memory card”);

an MC VISION Multiroom 2nd screen Digital Satellite decoder with its accessories (an HDMI or a Scart
audio/video cable, an AC cord and a remote control), and
an MC VISION Multiroom 2nd screen digital only memory card (hereafter also referred to as “the memory
card”);

in the event that the subscriber is qualified for and has subscribed to the PVR option, an MC VISION external
hard disk, its power pack and USB cable (hereafter jointly referred to as “PVR”);
or such other equipment as may be used from time to time by MC VISION.
The MC VISION digital satellite decoders with its accessories, the memory cards and the PVR are hereafter referred
to as the “Equipment”, which expression shall include each unit of equipment or part thereof and any two or more
units of equipment or part thereof whether relating to them individually or collectively.
MC Vision will select the Equipment to be supplied to the subscriber under this Agreement at its discretion. The
Equipment is at present only put at the disposal of the subscriber on a loan basis for use exclusively for the purpose of
this Agreement, and must be returned to MC VISION immediately at first request as more fully set out in Article 8
hereunder.

High Definition (HD) Programmes may only be received through the use of HD Equipment and provided that the
subscriber uses a television compliant with HD specifications
Together with the Equipment (or such other equipment as may be used from time to time by MC VISION), the
subscriber shall acquire and install (1) an individual satellite dish and (2) an LNB (and/or an MC VISION Multiroom
2nd screen LNB twin) enabling programmes broadcast by MC VISION in digital by the EUTELSAT W3C satellite
system (or any other system which might replace it), to be picked up, or be linked to a collective system, distributing
the programmes in digital by MC VISION, or use such other method (e.g. an antenna, a collective antenna or a
telephone line) as may be designated by MC VISION.
Although the subscriber may from time to time purchase a satellite dish and an LNB at a discounted price from MC
VISION (or even free of charge depending on the available promotion), it is the subscriber’s responsibility to replace
those items as and when necessary to enable receipt of the Programmes. MC VISION shall not be responsible for the
deteriorating quality of the Programmes or their non reception due to the satellite dish and/or the LNB not being
changed when required.
MC VISION reserves the right (at its sole discretion) to refuse to supply the memory card(s), inter alia if after verifying
the source of the subscriber’s digital satellite decoder(s), it appears that the digital satellite decoder(s) has been
declared lost or stolen by any person, including by an MC VISION subscriber, an authorised MC VISION distributor
or MC VISION itself, or if the decoder has not been supplied by MC VISION.
MC VISION shall under no circumstances whatsoever be held responsible in case of disappearance, loss, destruction,
breakdown or malfunctioning and generally speaking, for any damage or event capable of affecting any equipment
or accessory not supplied by MC VISION.
In case of reception problems encountered by a subscriber, the subscriber shall notify MC VISION in writing within 7
days of the date on which the reception problems started, failing which the monthly subscription shall be deemed to
be due to MC VISION by the subscriber. MC VISION will not consider any claim relating to reception problems if
such claim is effected after that 7 day period. In the absence of any written notification within that 7 day period, the
subscriber shall have no claim against MC VISION, save that MC VISION may (if necessary and at its discretion)
offer to exchange the decoder during the subscription period specified on the subscription contract free of charge.
Article 4

The Equipment put at the subscriber’s disposal remains the exclusive, non-transferable and non-seizable property of
MC VISION.
The Equipment cannot be transferred or put at a third person’s disposal under any circumstance whatsoever.
The subscriber shall use the Equipment exclusively for his own personal use for one television set only or, in case of
the MULTIROOM 2nd screen Option, exclusively in the manner set out in TITLE III. The Equipment shall under no
circumstance be directly or indirectly used with a view to allowing a non-subscriber to receive MC VISION
programmes or any other programme which may be accessed by the Equipment. The use of the Equipment is
prohibited for all public broadcasts as well as for organising the reception of MC VISION programmes by third
parties. The subscriber shall keep possession of the Equipment put at his disposal throughout the duration of the
subscription. The subscriber undertakes to allow any representative of MC VISION to have free access to the
Equipment without prior notice.
This Agreement does not relieve the subscriber from his own civil responsibility as custodian (dépositaire) of the
Equipment put at his disposal.
MC VISION undertakes for the whole duration of the subscription to ensure the normal maintenance, or have the
normal maintenance performed, free of charge, of the Equipment put at the disposal of the subscriber by MC VISION
in accordance with this Agreement, and to maintain the Equipment in proper working order. This undertaking does not
extend to any accessory or memory card or any other piece of equipment, save for the first year when a new
subscriber subscribes to the Service.
In case of breakdown, the defective piece(s) of Equipment (including the accessory(ies) or the memory card(s)) shall be
handed over exclusively to MC VISION either at its place of business or at one of its authorised showrooms so as to
be replaced or repaired. The subscriber shall ensure that a receipt is remitted to him.
The subscriber is strictly prohibited from opening or effecting any technical intervention, transformation or modification
of any piece of Equipment put at his disposal (including an accessory or the memory card) for any reason
whatsoever.
The subscriber is expressly prohibited from damaging, removing or otherwise tampering with any labels fixed on a
piece of Equipment on which the serial number of that piece of Equipment and/or the logo of MC VISION is
displayed, more particularly the one fixed at the back of a digital satellite decoder.
In the case of disappearance, damage or destruction for any reason or by any means whatsoever of all or any part
of the Equipment put at the disposal of the subscriber by MC VISION, the subscriber shall inform MC VISION within
the following 48 hours and justify the circumstances (if need be by producing a declaration of having reported a theft
of all or part of the Equipment or of having returned damaged equipment or accessories to MC Vision or the nearest
authorised MC VISION stands).
The subscriber shall indemnify MC VISION of the cost of replacing or the expense incurred for the repair of any part
of or all the Equipment lost, destroyed or damaged, whatever be the cause of the loss, destruction or damage may be
other than fair wear and tear.
Article 5

Use of Equipment at disposal
Purchase of Equipment – obsolescence – non functional Equipment
Although the Equipment may not be purchased at present, should this option arise in future, or should the subscriber
have been allowed in the past to purchase the Equipment, the subscriber shall have no claim against MC VISION in

case of change of technology which renders the purchased Equipment obsolete, outdated or non functional either in
part or in whole.
In such an event, in order to continue to receive the Services, the Subscriber may decide to:
(i)
obtain the Equipment from MC VISION, and pay a monthly usage fee therefor,
(ii)
purchase new Equipment (if that option is available at the time).
In either case, the subscriber shall not be relieved of his obligation to pay his monthly fees and dues to MC VISION
until the Agreement is terminated in accordance with article 2.3 above.

If having taken up an installation offer, the subscriber ends this Agreement otherwise than in accordance with its terms
or otherwise breaches any term of the Subscription Conditions in the first 12 months of subscription, or if the subscriber
otherwise breaches any term of the installation offer, MC VISION reserves the right to charge the whole amount of
the standard installation offer stipulated in article 10.7 to the subscriber. The standard installation charges shall be
payable to MC VISION.
(i)
If the subscriber already has a satellite system and wishes to continue using it, or if the subscriber’s installation
is otherwise not to the required standard, the subscriber shall pay an additional installation charge to MC
VISION.
(ii)
The installer shall advise the subscriber of those charges before the satellite system is installed. The subscriber
is responsible for obtaining all consents required (e.g. landlord’s consent) before installation.
The date and time for the supply of the Equipment and installation thereof is subject to the availability of the Equipment
and of the personnel required to carry out the installation. As far as practicable and possible, MC VISION shall
endeavour to keep the subscriber informed of any delay thereby caused to the installation.
The subscriber shall pay to MC VISION all fees and costs incurred upon any further technical intervention after
installation at the place where any piece of Equipment, the LNB or the satellite dish are found. As at 1st January 2013,
the following fees (inclusive of VAT) shall be charged to the subscriber:

Use of Equipment at disposal of subscriber – hardware and software update
The warranties relating to the Equipment are those set out in Title II of these Conditions of Subscription.
All other warranties, express or implied, legal or contractual, are expressly excluded.
Periodical update of the Equipment and/or the software may lead to momentary interruption of the Programmes,
which is hereby accepted by the subscriber.
Article 8
8.1
Installation of Equipment – technical intervention
Return of the Equipment
On the expiry or earlier determination of this Agreement for any reason whatsoever, the Equipment put at the
disposal of the subscriber by MC VISION shall be returned by the latter within a delay of one month to MC VISION
at one of its showrooms. The subscriber shall ensure that a receipt is remitted to him.
In case all the Equipment is not returned within that delay, and by the mere fact of such Equipment not being returned
within that delay, the subscriber undertakes and binds himself to pay to MC VISION, until the date all of the
Equipment is in fact returned, a daily immobilisation indemnity equal to one tenth of the monthly price of the
subscription up to the full price of the Equipment. In the event that at the time of the return, any of the Equipment i.e.
the digital satellite decoder or any one of its accessories or the memory card or any part thereof, is found missing,
then the subscriber shall pay the cost of the missing Equipment or part thereof, and such charges shall be debited from
the account of the subscriber, including the deposit made by the subscriber, the whole without prejudice to MC
VISION’s right to apply Article 9 hereunder.
In case any one piece of equipment is found missing at the time of return, the following lump sum (inclusive of VAT as
at 1st January 2013) shall be charged to the subscriber for that piece of equipment:

The above sums may increase or decrease according to (1) the rate of VAT or other tax then prevailing or (2) the new
tariffs published by MC VISION from time to time.
Unless paid cash by the subscriber, the above sums shall be paid to MC VISION out of the guarantee deposit made
by the subscriber, and the subscriber hereby expressly agrees that all such sums be deducted from the guarantee
deposit. The subscriber shall immediately thereafter replenish the guarantee deposit to its initial amount.

In case of change of technology, the subscriber shall obtain up to date Equipment to enable him to continue to
receive the Programmes. The fact that the subscriber has not received the Programmes by reason of such change
shall not absolve him from the payment of the his monthly fees and dues to MC VISION, irrespective of the date when
the subscriber obtains up to date Equipment.
The Subscriber is informed that some Programmes may be blocked upon the request of channel
editors/broadcasters/suppliers for non-possession by them of broadcasting rights for Mauritius.
MC VISION reserves the right to cancel, modify or replace, without prior notice,
(i)
all or part of its announced programmes and/or
(ii)
all or part of any of its bouquets or commercial offers, and/or
(iii)
the contents of any bouquet or commercial offer,
due to any commercial issue, any broadcasting or sports rights issue or any other issue whatsoever, and the
subscriber shall have no claim whatsoever against MC VISION in that respect, other than cancelling his subscription
at the end of the then current period of subscription.
As MC VISION is not itself responsible for the broadcast of its programmes, MC VISION shall not be held
responsible for any breakdown, any delay or any interruption in the broadcast, retransmission or reception of the
Programmes and any prejudice which might be caused thereby.
MC VISION shall in particular not be held responsible for any temporary or permanent interruption in the functioning
of any satellite link used for the transmission of its programmes for any cause whatsoever, and more particularly
during periods of eclipse or of lunar or solar conjunction, as well as in case of force majeure affecting MC VISION
itself or any operator in the broadcast, retransmission or reception of its programmes.
Force majeure includes, but is not limited to, loss of satellite, loss of signal, natural catastrophes, earthquakes, floods,
cyclones, storms, cataclysms, volcanic eruptions, climatic disruptions, rioting, vandalism, attacks, civil commotion, wars,
strikes, or other work conflict actions and/or accidental causes such as fire, water damage, explosions, damage or
breakdown of transmission of a third party’s technical system, act of government or any other act of regulatory or
other authorities and bodies, and generally any act over which MC VISION has no control.
Nothing in the Subscription Conditions shall impose or shall be construed as imposing on MC V1SION the obligation
of providing an uninterrupted, continuous and regular service.
Should a momentary interruption be due to an act or omission of MC VISION and shall have lasted a minimum of ten
(10) consecutive days, MC VISION shall reimburse to the subscriber an amount prorata the subscription fee paid in
respect of that period of interruption.
Should the interruption be permanent and due to an act or omission of MC VISION, this Agreement shall terminate.
MC VISION shall reimburse to the subscriber the prorated amount of the subscription fee over the remainder of the
current subscription period and the subscriber shall return to MC VISION the Equipment.
No subscriber shall in the event by an interruption of the Service or change in programme, bouquet or channel, for
whatsoever cause, be entitled to any form of compensation, damage or indemnity from MC VISION other than the
aforesaid prorated refund of the subscription fee paid in respect of that period of interruption or cancellation of the
subscription at the end of the then current period.

Change in technology or Programme, blackouts and interruption of Service
Subscription Tariff
The amounts set out in this Agreement are indicative only. MC VISION reserves the right to increase any payment,
deposit or reimbursement to be effected, or any fee payable, under this Agreement, at any time after the first
subscription period of 12 months by giving the subscriber one month’s notice of any change in price.
All payments under this Agreement shall be effected by direct debit from the subscriber’s bank account in Mauritius.
Should payment be effected by any means other than cash, then an administrative and processing fee of up to 10%
the sum paid (+ VAT) may be claimed from and shall be paid by the subscriber.
The subscriber undertakes and binds himself to pay to MC VISION in advance a subscription fee for the Programmes,
at such interval as may be agreed upon by the parties. Should no interval be stipulated in writing, the payment shall
be effected monthly in advance. The subscription fees payable by the subscriber to MC VISION are those in force on
the day of subscription, and thereafter those in force on the respective renewal dates of the subscription.
A connection fee (or access fee) to the Service amounting at present to Rs2,000 (exclusive of VAT) is payable by the
subscriber as a fixed and non-refundable sum when subscribing to the Programmes. The access fee shall not be
refundable, irrespective of the actual duration of the subscription contract or of its termination for any reason
whatsoever. The access fee shall be payable upfront. MC VISION may in its sole discretion spread the payment of
the access fee or waive part or all of that access fee.
In the event of reconnection of the Service after an interruption, a cancellation or a suspension of the Service due to
an act or omission of the subscriber, the subscriber undertakes and binds himself to pay to MC VISION each and
every time he is reconnected, a late payment fee of Rs100 (+ VAT).
In the event of any refund to be effected to the subscriber, the subscriber undertakes and binds himself to pay to MC
VISION a processing fee of Rs50 (+ VAT) each and every time a refund is effected to him. The processing fee shall
be deducted from the amount payable to the subscriber, and the net amount shall be remitted to the subscriber.
The standard costs of installing the Equipment are Rs2,300 (including VAT) as at 1st Januray 2013.

Unless specifically stated otherwise, special offers may not be taken up in conjunction with any other offer(s).

Subject to article 11.5, an interest free guarantee deposit must be made by the subscriber to MC VISION at the time
of the subscription, when the Equipment referred to in Article 3 is handed over to him. The amount of such deposit
shall be
o Rs5,000 for each digital decoder and accessories,
o Rs500 for each digital memory card only, and
o Rs500 for a subscriber having breached the Subscription Conditions previously.
A separate deposit (of the same amount) shall be required for each of
(i)
the Multiroom 2nd screen decoder and accessories and
(ii)
the Multiroom 2nd screen digital memory card.
The subscriber expressly agrees that any deposit, which may have been made to MC VISION under a previous
contract, be reckoned towards the guarantee deposit under this Agreement and be transferred accordingly.
The deposit shall be reimbursed to the subscriber within a delay of 3 months of MC VISION or any authorised body
receiving the certificate of the return of the Equipment.
The reimbursement of the guarantee deposit shall be made after deduction of
(i)
any unpaid sum still owing by the subscriber as regards to his subscription to MC VISION,
(ii)
the cost of replacing or repairing the equipment and accessories or the memory cards put at the subscriber’s
disposal, as well as,
(iii)
any other sum owing to MC VISION.
The subscriber hereby expressly consents and agrees that such deduction be made and that he be refunded only the
balance owing to him, if any.
Notwithstanding the amounts set out in article 11.1, MC VISION reserves the right to ask for such deposit amount as
may be in its sole discretion deemed necessary, if the subscriber has not been ordinarily a resident of Mauritius in the
last three years, or may be leaving Mauritius in future.

Notification to subscriber – use of data
Any notification by MC VISION under this Agreement (including but not limited to a notice of change of tariff) may be
effected by any one or more of the following means:
(i)
telephone,
(ii)
SMS,
(iii)
e-mail,
(iv)
electronic message accessible on the television system of the subscriber (such as the « messagerie abonné »
which appears as an envelope on the television of the subscriber when watching the Programmes), or
(v)
advertisements
and may not necessarily be effected by letter.
Any notification by letter or e-mail shall be deemed valid and effective if sent to the last address or electronic address
of the subscriber known to MC VISION.
Any notification shall be deemed to have been received when sent by MC VISION (or its agent).
Any communication or conversation that the subscriber or any other person may have with MC VISION’s employees
or agents may be recorded and archived in MC VISION’s files, and the subscriber hereby expressly consents to such
recording and archiving.
The subscriber agrees that all data collected by MC VISION may be used to send commercial offers, effect surveys
and for that purpose, may be communicated to MC VISION’s agents or service providers.
Article 13

Guarantee Deposit
Termination
In case of viewing of the Programmes by the public or a non-subscriber through the use of any part (or the whole) of
the Equipment for any reason whatsoever, this Agreement shall terminate ipso facto without prejudice to any other
claim MC VISION may have against the subscriber.
Without prejudice to any claim it may have in damages as well as to any court action it may initiate, in case of:
o non payment of outstanding sums to MC VISION as regards the MC VISION subscription,
o unauthorised technical intervention of all or any part of the Equipment put at the disposal of the subscriber,
o putting all or any part of the Equipment at the disposal of third parties or making available to third parties all
or any part of the Equipment under any form whatsoever, or
o schemes aimed at enabling the reception by non-subscribers of MC VISION digital satellite decoder or the
memory card, and, more generally, in case) of abnormal use of the Equipment,
as well as in case where MC VISION has reason to believe that the Equipment has been used in contravention of the
Subscription Conditions, MC VISION may as of right without the need for any notice judicial or extra-judicial,
(i)
suspend the Service,
(ii)
cancel the subscription, or
(iii)
suspend the Service and then cancel the subscription.
In case of breach of any other term or condition of this Agreement, then MC VISION shall send a notice to the last
known address of the subscriber requiring him to remedy the breach (if capable of remedy) and after (or, if capable
of remedy, if same has not been remedied within) fifteen (15) days of posting of the notice, MC VISION may suspend
the Service, cancel the subscription or take both actions.

In any case of suspension or termination of the Services, MC VISION shall deactivate the digital memory card, or
cause it to be deactivated. The Equipment put at the disposal of the subscriber shall be returned to MC VISION or
one of its approved showrooms, in good working condition, fair wear and tear excepted, within seven (7) days from
the receipt of a notice to that effect (“the Notice”) without prejudice to the payment of all sums outstanding on the
account of the subscriber, and more particularly payment of any sum due as subscription up to the date of the return
of the whole of the equipment, the cost of repairing or replacing all or any part of the Equipment any debt recovery
costs, costs of recovery or reconnection of the Equipment, costs of standing orders, connection fees) and more
generally, any other amount due to MC VISION. The subscriber shall ensure that a receipt is remitted to him.
Notwithstanding anything to the contrary in the Subscription Conditions any outstanding sum owed by the subscriber
to MC VISION shall upon cancellation of the subscription or receipt of the Notice become due and payable and the
subscriber shall pay the said sum to MC VISION within seven (7) days from the date of cancellation of the
subscription or of the Notice failing which any such outstanding sum shall bear interest until final payment at the rate
of fifteen percent per annum.
The subscriber shall be liable for all costs incurred by MC VISION in the recovery of any outstanding amount, the
recovery or repair or replacement of the Equipment or any part thereof, including the attorney’s fees of 10% of any
amount recovered and VAT thereon.
Article 14

The rights and liabilities accruing to the subscriber are personal to him and may not be assigned or otherwise
transferred to a third party.
This Agreement shall be governed by, construed and interpreted in accordance with the provisions of the laws of
Mauritius and the courts of Mauritius shall have exclusive jurisdiction in relation to any matter or dispute arising out of
or connected with this Agreement.

Severability
In the event that any one or more of the provisions of the Subscription Conditions shall for any reason be held to be
invalid or unenforceable, the remaining provisions of those Subscription Conditions shall be unimpaired, and the
invalid or unenforceable provision shall be replaced by a provision which, being valid and enforceable, comes
closest to the intention of the parties underlying the invalid or unenforceable provision.
Article 17

Amendment(s)
MC VISION may from time to time amend this Agreement.
MC VISION shall bring all amendments to the notice of the subscriber by any of the means set out in article 12.1
above.
At the expiry of the then current period of subscription in respect of each subscriber, the amended Agreement shall
take effect quoad that subscriber and all renewals of the subscription thereafter shall be subject to the amended
Agreement.
Article 16

Assignment, applicable law and forum
Limitation of liability of MC VISION - Claims
Notwithstanding any other clause of this Agreement, the liability of MC VISION under this Agreement shall be limited
to the amount of subscription fees paid in the twelve months immediately preceding the event, matter or thing subject
matter of the complaint by or dispute of the subscriber.
Notwithstanding anything to the contrary in the Subscription Conditions, the subscriber shall, under pain of nullity,
make or serve whatever claim he may have against MC Vision within
(i)
one year of the first occurrence of the event giving rise to a claim, or
(ii)
three months of the date of MC VISION cancelling his subscription or posting the Notice set out in Article 13
above to him,
whichever is the earlier.
TITRE II - CONDITIONS DE GARANTIE DES MATERIELS
Article 18
Matériels Garantis
Les matériels couverts par la présente garantie sont:
(1)
le terminal numérique incluant le bloc d’alimentation, la télécommande, le cordon péritel ou HDMI, et le cordon
secteur pendant la durée de vie de l’abonnement ;
et, uniquement pour la première période d’abonnement d’un an (tel que décrit à l’article 2.2),
(2)
la tête TWIN de réception pour le décodeur numérique Multiroom ; et
(3)
l’antenne parabolique de 80 cm (ou autre) et sa tête de réception ou LNB (Low Noise Block).
Article 19

Risques
Le transfert des risques est lié à la délivrance matérielle de la chose vendue ou louée.
II appartient à l’abonné de faire toutes les constations nécessaires sur les vices apparents ou sur la non-conformité des
matériels achetés dans les 48 heures auprès de MC VISION. L’abonné s’engage à ne pas intervenir lui-même et à ne
pas faire intervenir un tiers aux fins d’y porter remède

En cas de vice apparent ou de non-conformité des produits dûment constaté par MC Vision dans les conditions
prévues à l’article 3.1 du présent Titre I, l’abonné pourra obtenir le remplacement gratuit des matériels à l’exclusion de
toute indemnité.

Garantie
Les matériels figurant à l’article 3.1 du Titre I achetés par l’abonné (au cas où cette option serait introduite) sont
garantis pour une durée de 12 mois à compter de la date d’achat chez un Distributeur Agréé MC VISION ou
directement auprès de MC VISION, cette date figurant au recto.
En cas de panne il sera procédé à un échange standard, l’appareil devra alors être restitué sous 48 heures à MC
VISION dans son emballage complet d’origine accompagné du présent bon et d’une copie de la facture pour test et
remplacement. La garantie ne jouera pas pour les vices apparents dont l’acquéreur doit se prévaloir dans les
conditions de l’article 19.2.
L’échange de matériel pendant la période de garantie ne prolonge pas la durée de la garantie qui viendra à
expiration à l’issue de la période initiale (exemple ; pour l’achat d’un premier matériel visé à l’article 3.1 du Titre I
effectué le 1er décembre 2013, la garantie du matériel de remplacement ne pourra être postérieure au 30 novembre
2014).
Cette garantie ne s’applique pas en cas de détérioration provenant d’une cause étrangère à l’appareil, en cas de
mauvais emploi de non-installation de la coque d’étanchéité sur le connecteur de la tête de réception de l’antenne,
d’intervenir technique, de dégradation, de transformation ou modification, d’installation défectueuse et plus
généralement en cas d’utilisation non conforme aux recommandations figurant dans les différents modes d’emploi et
notices des dits matériels ainsi que ceux des appareils et équipements qui y sont reliés et également pour le terminal
numérique en cas d’ouverture du terminal et d’utilisation d’un voltage différent de celui spécifie dans les
recommandations. L’abonné s’engage à ne pas intervenir lui-même et à ne pas faire intervenir un tiers aux fins de
réparation, entretien, modification ou démontage du matériel. La garantie ne couvre pas l’usure normale et le manque
d’entretien, les cas fortuits ou de force majeure. Sont notamment considéré comme des cas de force majeure les
catastrophes naturelles, tremblements de terre, inondations, cyclones, tempêtes, cataclysmes, éruption volcaniques,
perturbations climatiques, émeutes, vandalismes, attentats, mouvement populaires, guerres, grèves ou autre action de
conflit de travail et/ou causes accidentelles telles qu’incendies, dégâts des eaux, explosions, dégradations ou pannes
de transmission d’un système technique appartenant à un tiers actions du gouvernement ou de toutes autorités
compétentes ou toute autre cause indépendant de la volonté de MC VISION.
MC VISION ne serait en aucun cas être tenue pour responsable en cas de disparition, perte, destruction, panne ou
disfonctionnement et, plus généralement tout dommage ou événement susceptible d’affecter tout matériel ou
accessoire non fourni par MC VISION relié a l’un des matériels figurant à l’article 3.1 du Titre I.
MC VISION ne peut en aucun cas être tenue pour responsable des coûts de biens ou prestations de substitution, de
la perte de profits ou de tout autre dommage direct, indirect ou consécutif survenant du fait de la vente, de l’utilisation
ou du fonctionnement des produits que MC VISION ait été avisé ou non de l’éventualité de la survenance de tels
dommages.
TITRE III - CONDITIONS DE GARANTIE DES MATERIELS
OPTIONS MULTIROOM 2ème ECRAN ET PVR

Option MULTIROOM 2ème ECRAN
L’option Multiroom 2ème Ecran permet à l’abonné de recevoir son abonnement sur deux postes de réception différents
au sein d’un même foyer (même nom, même prénom, même payeur et même adresse).
La durée de l’option Multiroom 2ème Ecran est identique à celle de l’abonnement principal, la résiliation de
l’abonnement principal entraînant automatiquement la résiliation de l’option Multiroom 2ème Ecran. Elle se renouvelle
par tacite reconduction pour une durée identique à celle du contrat principal, sauf dénonciation ou résiliation dans les
conditions prévues à l’Article 13 du Titre I et à l’article 21.8 du présent Titre III ci-après.
Pour bénéficier de l’option Multiroom 2ème Ecran, l’abonné doit disposer d’un terminal numérique tel que défini à
l’Article 3 du Titre I, d’un module 2ème Ecran, d’une tête TWIN et accessoires mis à disposition par MC VISION (ciaprès dénommé les « seconds matériels »).
La souscription à l’Option Multiroom 2ème Ecran implique pour l’abonné l’obligation d’installation des seconds
matériels par un antenniste référencé MC VISION, au sein du même foyer (même nom, même prénom, même payeur
même adresse) que celui dans lequel sont installés les matériels nécessaires à la réception de l’abonnement principal.
La remise à l’abonné des seconds matériels est réalisée au titre d’un prêt à usage et ce exclusivement à titre
d’accessoire au contrat d’abonnement principal dans le cadre de l’option Multiroom 2ème Ecran. La mise à disposition,
l’utilisation et l’entretien de ces seconds matériels sont régis par les articles correspondants du Titre I.
Au terme de l’option Multiroom 2ème Ecran, quelle qu’en soit la cause, les seconds matériels devront être restitués
dans les conditions prévues à l’Article 8 du Titre I.
La souscription à l’option Multiroom 2ème Ecran implique le paiement par l’abonné du coût mensuel de l’option
comprenant la mise à disposition des seconds matériels, et par ailleurs du paiement par lui de l’installation des
seconds matériels par un antenniste référencé MC VISION, selon les tarifs en vigueur au jour de la souscription de
l’option. L’abonné verse un frais d’accès au service numérique et un dépôt de garantie séparé au titre de la mise à
disposition des seconds matériels restituables comme visé au Titre I.
L’échéance de l’option Multiroom 2ème Ecran est identique à celle de l’abonnement principal, seule la résiliation de
l’abonnement principal entraînant automatiquement la résiliation de l’option Multiroom 2ème Ecran. Elle se renouvelle
par tacite reconduction pour une durée identique à celle du contrat principal, sauf dénonciation ou résiliation dans les
conditions prévues à l’Article 13 du Titre I et au présent article 21.8.
En sus des conditions stipulées à l’Article 13, MC VISION pourra considérer l’option Multiroom 2ème Ecran résiliée de
plein droit, moyennant simple notification écrite, en cas :
o
de non respect des obligations particulières pesant sur l’abonné visées aux présentes,
o
d’intervention technique non autorisée sur tout ou partie des seconds matériels,
o
de mise à disposition de tout ou partie des seconds matériels à des tiers sous quelque forme que ce soit,
o
d’agissements visant à permettre la réception de tout ou partie des programmes auxquels permettent d’accéder
les seconds matériels par des non abonnés,
o
plus généralement, d’utilisation anormale des seconds matériels.

Option PVR
L’option PVR permet à l’abonné d’accéder, à partir du PVR (un disque dur externe, son bloc d’alimentation et un câble
USB compatibles au décodeur mis à disposition par MC VISION) à des fonctionnalités telles que, sans que cette liste
soit exhaustive, l’enregistrement de programmes sur le disque dur externe, la pause ou le retour en arrière sur le
direct.
Dans le cas où la mémoire d’enregistrement atteint son seuil maximum, l’abonné peut choisir les programmes à
supprimer. A défaut, les enregistrements non protégés par l’abonné sont supprimés automatiquement par ordre
d’ancienneté.
MC VISION ne saurait être tenue pour responsable :
des pertes d’enregistrement consécutives notamment à des opérations de maintenance (suite à une panne ou un
dysfonctionnement du décodeur ou du disque dur externe) réalisées par MC VISION ou en cas de force majeure
(exemple : foudre…),
des difficultés d’enregistrement résultant de l’interruption de fonctionnement temporaire ou définitive du système
satellitaire EUTELSAT W3C ou tout autre système qui pourrait lui succéder, qu’elle qu’en soit la cause,
des difficultés d’enregistrement résultant de la modification ou du retard de la programmation annoncée,
de la perte des données antérieurement stockées sur le disque dur externe.
TITRE IV
CONDITIONS PARTICULIERES DE
L’AVENANT DE TRANSFORMATION

Transformation
Sous réserve d’acceptation de la demande, une transformation d’abonnement (upgrade) peut être effectuée en cours
d’abonnement.
Une demande de transformation d’abonnement (upgrade) peut être effectuée par écrit, par téléphone (par opérateur
ou par Serveur Vocal Interactif), électroniquement (sur le site web de MC VISION, par SMS ou autre) ou par tout
autre moyen mis à la disposition de l’abonné par MC VISION.
En cas d’acceptation de transformation d’abonnement (upgrade) par MC VISION, l’abonné en est notifié par
l’ouverture des droits sur les canaux correspondants à la formule choisie. En ce cas, la durée d’abonnement reste
celle prévue à l’article 2.3 du Titre I.
Les dispositions du présent Titre IV sont susceptibles d’être modifiées pour toute transformation ultérieure.
