In recent years the legal landscape covering arrest, search and the right to silence has been the subject of a number of leading Supreme
Court of Canada decisions. After Coté, Grant, Suberu and Sinclair, what is the law on searching, questioning and arresting in compliance
with the Charter of Rights and Freedoms? Has anything changed and, if so, how can criminal practitioners in motions court best advance
their position? What constitutes a search incident to arrest? What is investigative detention? When should an accused person speak to
the police? And how should the Crown and the defence question witnesses called on a Charter motion?
All of these questions and more will be answered in a full day program dealing exclusively with sections 7, 8 and 9 of the Charter of
Rights and Freedoms.
The program will offer a mix of panels featuring some of the most experienced and knowledgeable members of the Canadian criminal
justice system, and live demonstrations by both Crown and defence counsel.

a-t-il changé et si oui, que doivent faire les praticiens en droit pénal pour convaincre un tribunal de la valeur de leur point de vue? Comment
circonscrire une fouille accessoire à une arrestation? Comment définir une détention aux fins d’enquête? Dans quelles circonstances une personne
accusée devrait-elle parler à la police? Et, comment l’avocat de la Couronne et l’avocat de la défense doivent-ils interroger des témoins convoqués
dans le cadre d’une requête relative à la Charte?
Pour répondre à ces questions et à d’autres, vous êtes invité à participer à un programme d’une journée complète, portant exclusivement sur les
articles 7, 8 et 9 de la Charte des droits et libertés et mettant en vedette une brochette imposante de panélistes, dont certains des plus éminents
spécialistes en droit pénal canadien.
