CONSOLIDATED NOTICES TO MEMBERS OF THE BAR
COMMERCIAL DIVISION: COMMON LIST OF JURISPRUDENCE
The common list of jurisprudence – commercial division – includes the reported
decisions frequently cited before the Superior Court in commercial cases.
Following publication of this notice, parties are no longer required to fully
reproduce the decisions identified in the attached list in the book of authorities
filed prior to a hearing. If a party intends to cite a decision appearing on the list,
its book of authorities need only contain a copy of the page bearing the relevant
extract from the decision, duly highlighted, a copy of the page immediately
preceding and following the extract, and a reference to the common list of
jurisprudence.
The usual practice will continue to apply to decisions that do not appear on the
common list of jurisprudence. When a case is cited, the entire decision must be
reproduced, the relevant pages must be identified and the cited extracts must be
highlighted in accordance with section 31 of the Rules of Practice of the Superior
Court in Civil Matters.
Please note that the decisions appearing on the common list of jurisprudence
were selected according to certain criteria, including the number of times a
decision has been cited by the courts of other instances. It is not an exhaustive
list of the relevant decisions in any area of the law, nor does the list constitute an
opinion regarding relevance.
