Bruxelles, le 28 janvier 2016 Concerne: Demande d’offre pour - n°2016_002_Contract Research Organization_Clinical Trials. Madame, Monsieur, Le Centre Fédéral d’Expertise des Soins de Santé (KCE) a démarré ses activités en 2003. Son activité est décrite dans ses rapports annuels disponibles sur son site web : http://www.kce.fgov.be Jusqu’à présent, les études de HTA (Health Technology Assessment) réalisées par le KCE reposaient principalement sur les données de littérature déjà disponibles, une approche qui peut être suffisante pour parvenir à des recommandations stratégiques claires dans certains cas mais qui se heurte parfois aussi à un manque d’études comparatives appropriées. C’est pourquoi est lancé cette année un programme d’études cliniques pragmatiques directement axées sur la pratique et financé via le KCE par des fonds publics. Ces recherches devraient contribuer non seulement à une meilleure prise en charge des patients mais aussi à un usage plus efficient des moyens publics. Le KCE se chargera de financer ces études concrètes mais ne les réalisera pas lui-même. Ce rôle de trial sponsor sera assumé par un contractant : par ex. un hôpital ou un groupe de recherche. Dans ce cadre, le KCE désire s’adjoindre les services d’un Contract Research Organization (CRO) for Clinical Trials, pour l’assister aussi bien dans la phase de démarrage (on site gapanalysis of the candidate trial sponsor) que dans la phase opérationnelle du programme d’études cliniques. Le marché fait l’objet d’une procédure négociée directe avec publicité, conformément à l’article 26, § 2, 1°, d) de la loi du 15 juin 2006. La charge de la preuve de l’envoi de l’offre dans les temps repose sur le soumissionnaire. L’ouverture des offres se fera à huis clos. Contenu de l'offre Elle doit impérativement contenir les renseignements suivants: la description des services proposés et la manière dont le soumissionnaire répond aux demandes et exigences décrites au point 2. le bordereau des prix unitaires (1) par visite sur site du trial sponsor candidate, (2) par visite sur site du candidate trial centre, et (3) par heure de prestation pour les autres tâches, ainsi que tous les frais possibles grevant les services, et le montant de la TVA la signature de la personne compétente pour signer l’offre + la qualité de la personne qui signe l’offre + date à laquelle la personne a signé l’offre tous les documents demandés dans le cadre des critères de sélection (voir rubrique C.1. ci-après) Cahier des charges _CRO_clinical trials Page 2 of 8 Il est fortement recommandé au soumissionnaire d’utiliser le formulaire d’offre joint en annexe. Prix Le marché est un marché à bordereau de prix, ce qui signifie que seuls les prix unitaires sont forfaitaires. Le prix à payer est obtenu en appliquant les prix unitaires aux quantités de prestations effectuées. L’offre mentionnera distinctement : - Le prix forfaitaire de l’analyse sur site d’un ‘trial sponsor candidate’ (on site gap analysis of the candidate sponsors) (point 2.I. list of tasks) - Le prix forfaitaire de l’analyse sur site d’un ‘candidate trial centre’ (point 2.3.c) list of tasks) - le taux horaire des autres prestations (le cas échéant par type de prestation, et par type de personnel l’effectuant (junior, senior, …) - le tarif des frais de déplacement (…€/km). Les prix comprendront les éventuels frais de secrétariat ou de matériel utilisé. Facturation et paiement La facture est adressée par le prestataire de services au KCE au fur et à mesure des prestations effectuées, à intervalle régulier selon l’importance des prestations effectuées au cours d’une période donnée. Aucune avance n’est consentie. Seuls les services exécutés de manière correcte pourront être facturés. Toute facture est accompagnée d’un état détaillé, comprenant au minimum : - La date de prestation ; - La durée de la prestation (exprimée en minutes et en heures) ; - Le nom de la personne ayant effectué la prestation ; - Le type de prestation (visite sur site du ‘trial sponsor candidate’ ; visite sur site du ‘candidate trial centre’ ; autre tâche : réunion au KCE, note de consultation, etc.) ; - Un bref descriptif de la prestation (réponse au courrier de Me X, recherche, etc.). Le KCE contrôlera ces relevés et la durée des prestations et se réserve la possibilité de refuser le paiement des heures excessives, compte tenu de la nature des tâches à effectuer. Le paiement est effectué dans les trente jours de calendrier à compter de la réception de la facture, pour autant que KCE soit, en même temps, en possession de l’état détaillé visé ci-dessus. A défaut, le délai de paiement est suspendu jusqu’à la communication de ce document au pouvoir adjudicateur. Devoir de réserve Le prestataire de services et ses collaborateurs sont liés par un devoir de réserve concernant les informations dont ils ont connaissance lors de l’exécution de ce marché. Ces informations ne peuvent en aucun cas être communiquées à des tiers sans l’autorisation écrite du pouvoir adjudicateur. Le prestataire de services peut toutefois faire mention de ce marché en tant que référence. Pas d’exclusivité Cahier des charges _CRO_clinical trials Page 3 of 8 L’attribution du marché sur la base du présent cahier des charges ne donne au prestataire de services aucun droit d’exclusivité ; Le KCE peut, pendant la durée du marché, faire exécuter des prestations, identiques ou analogues à celles décrites dans le présent cahier des charges, par d’autres prestataires de services ou par ses propres services. Le prestataire de services ne peut de ce chef prétendre à aucune sorte d’indemnité. Contrat intuitu personae Le prestataire de service reconnaît que le contrat est intuitu personae en raison des qualités du personnel mentionné dans l’offre. Il s’engage à faire exécuter le marché par les personnes indiquées dans l’offre, sauf cas de force majeure. Les éventuels remplaçants doivent être agréés par le KCE. Durée du contrat Le contrat est conclu pour une durée de 2 années à compter du lendemain de la lettre d’envoi de la notification d’attribution du marché. B. Description des services demandés 1. Background - Context Many questions in healthcare are currently not sufficiently studied using clinical trials, despite their high societal importance. The KCE concluded in the summer of 2015 that public funding of such trials would be beneficial ("Report 246-2015"), under certain conditions. These trials not only contribute to a better care for the patient but also to a more efficient use of public means. The Minister of Public Health Maggie De Block decided in the fall of 2015 that KCE should start a programme of pragmatic and practice-oriented clinical trials. The available budget for the KCE Trials Program in 2016 and 2017 is €5 mio, increasing to €10 mio from 2018 onwards. The KCE will select and fund the trials but will not conduct the trials. The development of the protocol, the initiation and management of the trial will be done by the trial sponsor which needs to have the capacity to fully conduct a trial in accordance with the applicable regulations. KCE plans to use the services of a contract research organization (CRO) to assist KCE as described hereunder in the start-up phase (mainly for the on-site gap analysis of the candidate sponsors) and in the operational phase of the KCE Clinical Trials Programme. 2. Non exhaustive list of tasks: 2.1. On-site gap analysis of the candidate sponsors, the Belgian clinical trial units at universities and hospitals with respect to sponsor obligations and regulatory requirements to run multicenter RCTs. This should include procedures to assure the continuity of service in case of key personnel leaving, and SOPs for all sponsor Cahier des charges _CRO_clinical trials Page 4 of 8 obligation (logistics, centralized randomization, development of eCRFs, monitoring and safety reporting, data management and statistical analysis, reporting and archiving, etc.). This gap analysis may be extended to large non-university hospitals. 2.2. Estimate of the efforts needed to bridge the gap for each candidate-sponsor. 2.3. Before a contract is signed with the candidate-sponsor, funding eligibility check on-site for each full proposal that has passed the selection process. a. The candidate sponsor clinical trial unit meets all criteria (if not checked before). b. The final protocol is available and is part of the contract. c. Each candidate trial center is checked (on site for selected trials) 1. capacity to run the trial 2. equipoise condition for randomization is met 3. access to a multiple of the required number of patients 4. documented absence of competing trials After the start-up phase, some of the tasks may decrease in intensity (after the learning curve of candidate-sponsors). For other tasks, the CRO will provide the service during the period KCE personnel is being hired and trained. The CRO will assist KCE in the organization and execution of the KCE Trials programme by making available to KCE dedicated personnel familiar with pragmatic practice-oriented clinical trials. The tasks can include 1. support in the selection of study topics, trial outlines and full proposals, 2. appreciation of the workload and the budget requirements for each trial, as part of the contract discussions with the candidate -sponsor. 3. After a contract is signed and the contract start date, assist in the collection from the sponsor of the following a. List of members of the trial oversight committees b. Project management plan c. Registration information (including the registration in a public trial registry) d. Any updates on CTU involvement e. Evidence of ethical approval f. Evidence of FAMPH approval (if required) 4. Once the trial is active: d. Monthly key progress figures e. Six-monthly project progress report f. Daily open sessions g. Quarterly Red Orange Green review h. Quarterly report for KCE management i. Fortnightly visits / skype conferences j. Extension requests 5. Provide or coordinate advice to candidate trial sponsors, where needed and appropriate, on issues on regulatory issues, data management tools and eCRFs, study outsourcing, logistics, insurance, use of reimbursed procedures, intellectual property and international collaboration. A good knowledge of written and oral English is needed. Estimate of workload: (estimated value excluded VAT) 200.000,00 euros C. La sélection – régularité des offres – critères de sélection Les soumissionnaires sont dans un premier temps évalués sur la base des critères de sélection repris ci-après. Seules les offres des soumissionnaires qui satisfont aux critères de sélection sont prises en considération pour participer à la comparaison des offres sur la base des critères d’attribution repris au point C.2. du présent cahier spécial des charges. La comparaison des offres sur la base des critères d’attribution se fera en vue de constituer une shortlist de soumissionnaires avec lesquels des négociations seront menées. Le KCE envisage de sélectionner un maximum de trois soumissionnaires dans cette shortlist. C.1. Selection criteria: The specific conditions for participation are as follows. The candidate must: a) be a legal person or an association of natural persons, and not be disqualified (bankrupt, failure to meet social security or tax obligations); The Belgian tenderer shall provide the Registration number with the Kruispuntbank van Ondernemingen/Banque Carrefour des Entreprises. The foreign tenderer will provide a certificate issued by the relevant authority, certifying that he has fulfilled obligations relating to the payment of social security contributions under the law of the relevant state in which he is established, as well as a certificate that he is not bankrupt or otherwise apparently insolvent, emanating from the relevant administrative body, and a certificate demonstrating that he has fulfilled obligations relating to the payment of direct and indirect taxes under the law of the relevant state in which he is established b) have sufficient economic and financial capacity; The tenderer shall provide his turnover in the concerned domain over the financial years 2015 and 2014 (if 2015 is not available, than 2014 and 2013) c) substantiate good technical capacity. The technical capacity will be evaluated on the basis of 4 selection criteria: 1. Global experience of the CRO with the oversight of pragmatic, practice-oriented clinical trials and with the tasks as described in the tender specification 2. Specific competency and experience of the personnel who would work on the project 3. Procedure in place to guarantee the continuity of the service Cahier des charges _CRO_clinical trials Page 6 of 8 4. No conflict of interest. Global experience of the CRO with the oversight of pragmatic, practice-oriented clinical trials and with the tasks as described in the tender specifications. This can be documented by a description of the CRO activity including activities with regard to the scope of this call for tenders, and by a description of the most recent relevant Clinical Trial reference. Specific competency and experience of the personnel who would work on the project. It is required that the CRO personnel who should work on the project is fully trained for the tasks as described. They should have at a minimum: University diploma, minimum MSc level or equivalent. Familiar with all aspects of multicentre clinical trials and an overall minimum experience of 10 years in various aspects of clinical trials. This can be at the side of the trial regulator, funder, sponsor or investigator. The field of clinical trials includes logistics, interactions with regulators and third parties, centralized randomization, development of eCRFs, monitoring and safety reporting, data management and statistical analysis, reporting and archiving, etc. Minimum of 5 years of experience developing/auditing quality systems/SOP for clinical trial funders/sponsors and up to date knowledge of GCP and clinical trial regulations in Belgium. Minimum 5 years of experience with contracts and payment schedules for clinical trials Good knowledge of English (very proficient in written English + fluent in spoken English), Dutch (fluent) and French (fluent) The tenderer will have to substantiate this with precise references in enclosed CVs, and explain in what way the competencies and experience of the person would be useful for the mission under consideration. Procedure in place to guarantee the continuity of the service. The tenderer has to explain or make documents available which describe the procedures in place at the CRO in order to guarantee a continuity of service in case personnel is leaving or sick No conflict of interest The tenderer has to describe and document any potential conflict of interest.
