Differing International Approaches
The struggle for land has always been a major political and economic issue; in fact, there have been few political or economic
subjects throughout history which have been the source of as much controversy or as many conflicts as land tenure. This question, overlooked for several years, has been given center stage in a world of globalization. The difference in worldwide organization with regard to access to the land and its use increases the global complexity of this issue. The objectives of the Congress
are to give prominence to the diversity of land policies which have been implemented in different parts of the world, as well as

The relationship between people and the land influences economic and societal organization, whether the societies be predominantly urban or rural, developed or developing. Furthermore,
this interaction influences the establishment of contractual relationships, as well as the development of social links. Yet, all of the
land policies on different continents must deal with the demands
of an environmental and social sustainability which transcend the
entirety of land functions: food production, natural resources and
energy; support of economic activities and living areas; causes
of conflicts and competition; sources of social connections and
of fundamental rights, etc. In this context, the objective of this
overview is to highlight the major land use problems and issues
particular to each continent in the hopes that societies make
them a priority.

Workshop 1
The Urban Environment
Each city has its own ideas about growth. Some town planners address the overcrowding of their historical city centers by conquering new spaces located in the suburbs, while others prefer to
convert those neighborhoods previously involved in industrial
activities into residential areas. There are those who set out to
create extensive programs aimed at rehabilitating dilapidated
neighborhoods, and still others who prefer a mixture of different
approaches. Istanbul and Nantes serve as examples of cities which
have implemented an extraordinary diversity of procedures aimed
at a carefully thought-out distribution of the urban environment.

The Rural Environment
If the question of available space was the key to rural organization in the past, nowadays there are new factors which have
fundamentally modified behavior. Globalization, the pressure of
large distributors, the biotechnologies boom, the recognition of
sustainability principles as well as other phenomena have sparked
profound changes and radically altered the manner in which the
rural environment is currently being distributed. Argentina and
the Pays de la Loire Region serve to illustrate how formerly dissimilar systems now have a great deal in common.

Delimitation of Land
Land use rights cannot be applied until they are clearly identified
with reference to a particular object. Within all legal systems, the
law manifests itself through the delimitation of land. French law
grants a distinguished place to this fundamental and declarative
procedure. Land-surveyors play a major role; their monopoly on
topographical work allows them to define land property limits.
This workshop encourages us to consider land delimitation not
only through its role in establishing law, but also by examining its
various practical details.

Ownership of Land
All over the world, land ownership is an issue. Depending on which
legal system one considers, the ownership rights to which a person may be entitled present themselves in a variety of forms.
Ownership signifies something different from one country to another. The scarcity of land and its resources requires that from
now on we consider ownership from the perspective of its usefulness. In this workshop we will analyze new forms of ownership
which have come about in direct response to this evolution.

Land Use Conflicts
Land, by its very nature and by the diversity of its uses, is at
the center of multiple conflicts. The competition over how
to use different spaces is exacerbated today by an increase in
population, impoverishment of natural resources, the realization
of the economic, social and environmental consequences of man’s
actions, and a commitment to sustainable development. We must
find new ways of governance of land uses and functions, as land is
one of our most important common goods. How can we organize the
distribution of resources and the competitive function of the land?
How can we regulate the geographical coexistence of activities
which are economically, scientifically or socially incompatible ?
How can we draw the line between legal mechanisms of land use
conflict prevention and legal systems of damage compensation?
How can we strike a balance between individual responsibility
and collective solidarity? The coexistence of genetically-modified
crops and non-genetically-modified crops, the equitable use of
water, and dealing with problems of neighbors who live in closeproximity all serve as examples of sources of conflict which
societies must learn to cope with.
