The Railway Act
[section 31]

Pursuant to the authority conferred on the Minister of Highways and Infrastructure by section 31 of The
Railway Act, the Minister orders that:
Reportable Accidents
All railway companies must report the following classes of accidents to the minister:
(a) a person is killed or sustains a serious injury as a result of:
(i) getting on or off or being on board the rolling stock; or
(ii) coming into contact with any part of the rolling stock or its contents;
(b) the rolling stock or its contents:
(i) are involved in a collision or derailment;
(ii) sustain damage that affects the safe operation of the rolling stock;
(iii) cause or sustain a fire or explosion; or
(iv) cause damage to the railway that poses a threat to the safe passage of rolling stock or to the
safety of any person, property or the environment;
(c) there is an accidental release on board or from a rolling stock consisting of a quantity of dangerous
goods or an emission of radiation that is greater than the quantity or emission level specified in Part 8 of
the Transportation of Dangerous Goods Regulations (Canada);
(d) an incident where:
(i) a risk of collision occurs;
(ii) an unprotected track switch is left in an abnormal position;
(iii) a railway signal displays a less restrictive indication than that required for the intended
movement of rolling stock;
(iv) rolling stock occupies any track, or track work takes place, in contravention of the rules or any
regulation or order made under The Railway Act (i.e. unauthorized occupancy of track);
(v) rolling stock passes a signal indicating stop in contravention of the rules or any regulation or
order made under The Railway Act (i.e. movement exceeds limits of authority);
(vi) there is an unplanned and uncontrolled movement of rolling stock;
(vii) a crew member whose duties are directly related to the safe operation of the rolling stock is
unable to perform their duties as a result of a physical incapacitation which poses a threat to the
safety of persons, property or the environment;
(viii) a person gains unauthorized entry onto railway property;
(ix) the railway line sustains damage that affects its safe use, that is not a direct result of the
operation of a train or;
(x) a death or serious injury occurs involving railway property that is not a direct result of the
operation of a train.

Contents of Report
The report to the minister must contain the following information, where available:
(a) the train’s number, direction, tonnage, length, and authorized speed;
(b) the number of loaded cars and empty cars on each train and cut of cars;
(c) the names of the operator of the rolling stock and the operator of the track;
(d) the date and time of the occurrence;
(e) the number of crew members, passengers and other persons involved in the occurrence and the number
of those who were killed or sustained serious injuries as a result of the occurrence;
(f) the number of rolling stock or intermodal platforms that are damaged or have derailed and their
reporting marks;
(g) for each rolling stock that is damaged or has derailed, whether the rolling stock is loaded, empty or
contains residue;
(h) for each damaged or derailed rolling stock a list of all the dangerous goods on board the rolling stock,
including the shipping name or UN number of the dangerous goods;
(i) if dangerous goods are released:
(i) the shipping name or UN number of each dangerous good;
(ii) the reporting marks of each rolling stock from which the dangerous goods were released;
(iii) a brief description of each of the means of containment from which the dangerous goods were
released, including the specification of the means of containment;
(iv) a brief description of the condition of each of the means of containment from which the dangerous
goods were released;
(v) the quantity of the dangerous goods on board each rolling stock or in each means of containment
prior to the occurrence; and
(vi) the quantity of each dangerous good that is known or suspected to have been released;
(j) the local weather conditions at the time of the occurrence and any climatic conditions such as snow,
ice, wind, fog, dust and severe heat;
(k) the location of the occurrence, including the mile, the subdivision and/or the track designation;
(l) a description of the occurrence and the extent of any resulting damage to the environment and to the
rolling stock, the railway and other property;
(m) a description of any action taken or planned to protect persons, property and the environment, including
any evacuation as a result of the occurrence;
(n) the name and title of the person making the report and the phone number and address at which they
can be reached; and
(o) any information specific to the occurrence that the minister requires.

Definitions
For further clarity, the following definitions apply to this order:
“Collision” means an impact, other than an impact associated with normal operating circumstances, between
(a) rolling stock;
(b) rolling stock and a person or vehicle; or
(c) rolling stock and an object or animal, if the rolling stock is damaged or derailed;
“Derailment” means any instance where one or more wheels of rolling stock have come off the normal running
surface of the rail;
“Risk of collision” means a situation in which rolling stock comes so close to being involved in a collision
that a threat to the safety of any person, property or the environment exists;
“Rules” means the Canadian Rail Operating Rules (CROR), as amended from time to time, or a railway’s
documented operating instructions or procedures which may be submitted to the minister pursuant to the Act;
“Serious injury” means any injury that will require a person to be admitted to a hospital as an in-patient
for a period of 72 hours or more;
“UN number” has the same meaning as in section 1.4 of the Transportation of Dangerous Goods Regulations
(Canada).
Reporting Period
Reportable accidents of the class described in subclauses (a)(i) to (ii), (b)(i) to (iv), and clause (c) must be
reported to the minister as follows:
(a) a verbal report must be made within 24 hours after the accident;
(b) a preliminary written report must be made within 48 hours of the accident; and
(c) a final report must be filed as soon as possible and no later than 30 days after the accident, or any
other period requested by the railway company and approved in writing by the minister.
Reportable accidents (incidents) of the class described in subclauses (d)(i) to (x) must be reported to the minister,
in writing, on the first of every month for all accidents occurring in the preceding month.

NOTICE IS HEREBY GIVEN that, effective immediately, pursuant to section 20.1 of The Highways and
Transportation Act, 1997, the Minister establishes a speed zone under Schedule B by erecting official signs
stating the speed limit at the following location:
• 80 km/hr along Provincial Highway No. 10 from a point 90 m south-west of its intersection with Bay
Ave. in the Town of Fort Qu’Appelle to a point 500 m south-west of this intersection.

REGULATORY BYLAW AMENDMENTS
The Regulatory bylaws of the Saskatchewan Association of Licensed Practical Nurses are hereby
amended as follows:
2(1) The following definition is added after clause 2(a):
“(a.1) “authorized professional” means a member of a regulated profession who is authorized to issue
a prescription or order;”.
2(2) The following definition is added after clause 2(d):
“(d.1) “regulated profession” means a profession that is regulated pursuant to an Act;”.

3 The following heading and sections are added after section 21:
“SPECIALIZED AREAS OF LPN PRACTICE
“Advanced orthopedics
21.1(1) In this section, “advanced orthopedics” includes the provision of practical nursing care related
to orthopedics for the purpose of applying orthopedic devices or casts.
(2) No member shall provide advanced orthopedics unless the member:
(a) has successfully completed the formal post-basic education certificate program, known as the “Advanced
Education in Orthopedics for LPNs” program from Norquest College in Edmonton, Alberta, or an equivalent
program recognized by council;
(b) is registered with SALPN as qualified to provide advanced orthopedics; and
(c) practises pursuant to an order of an authorized professional and in collaboration with other members of
the health care team, while assisting an authorized professional under his or her direction with the setting
or resetting of a fracture of a bone.
“Hemodialysis care
21.2(1) In this section, “hemodialysis care” includes the provision of practical nursing care related to
hemodialysis.
(2) No member shall provide hemodialysis care unless the member:
(a) has successfully completed:
(i) prior to January 1, 2016 a post-basic education program that was recognized by council; or
(ii) on or after January 1, 2016, the formal post-basic theoretical education certificate program, known
as the “Care of the Patient with Kidney Disease” from the Saskatchewan Polytechnic, or an equivalent
program recognized by council, together with clinical experience obtained through a practical program
provided by an employer and recognized by council;
(b) is registered with SALPN as qualified to provide hemodialysis care; and
(c) practises pursuant to an order of an authorized professional and in collaboration with other members
of the health care team.
“Perioperative care
21.3(1) In this section, “perioperative care” includes the provision of practical nursing care to patients in
a perioperative setting and assistance to an authorized professional who is performing surgery in an operating
theatre.
(2) No member shall provide perioperative care unless the member:
(a) has successfully completed the formal post-basic education certificate program in perioperative
practical nursing, known as the “Perioperative Nursing LPN/ Advanced Certificate” from the Saskatchewan
Polytechnic, or an equivalent program recognized by council;
(b) is registered with SALPN as qualified to provide perioperative care;
(c) practises in accordance with the Standards of Practice and Competencies for Perioperative Licensed
Practical Nurses approved and adopted by Canadian regulatory agencies as of December 2010; and
(d) practises pursuant to an order of an authorized professional and in collaboration with other members
of the health care team”.

The Wascana Centre Act
[section 11 and subsection 73(1)]

RESOLUTION OF WASCANA CENTRE AUTHORITY IN ENACTMENT OF BYLAWS
IT WAS RESOLVED pursuant to section 11 of The Wascana Centre Act that Wascana Centre Authority
hereby enacts the following amendments to its bylaws to be of force and effect on and after December 3, 2015.
This bylaw is an addition to Section 3 – Conduct of Persons and is new bylaw 3C. It does not replace any
previous bylaw.
This bylaw has also required an addition of “public land” to the Definitions Section (Bylaw 1) of WCA Bylaws.
Bylaw 1 is amended by adding the following definition:
“Bylaw 1 - Definitions
“(h) “public land” means public land as defined by The Wascana Centre Act, as amended from time to
time”.
Bylaw 3 is amended by adding the following after section 3B:
“Bylaw 3 – Conduct of Persons
“3C No person shall defecate or urinate in any place on public land, except in a designated washroom
facility”.

is a true copy of a resolution duly passed by Wascana Centre Authority on the 3rd day of December, A.D. 2015.

LEAVE PROCEDURE FOR CERTAIN CRIMINAL APPEALS
Effective: February 1, 2016
Application of Practice Directive
1 This practice directive applies to criminal appeals relating to:
(a) summary offence ticket proceedings taken under The Traffic Safety Act, S.S. 2004, c.T-18.1; and
(b) bylaw proceedings such as proceedings taken pursuant to a bylaw of a municipality or an authority
as defined in The Summary Offences Procedure Act, 1990, S.S. 1990-91, c.S-63.1.
Registrar shall refer matter to chambers
2 On the filing of a notice of appeal in an appeal described in paragraph 1 of this practice directive, the
Registrar shall refer the matter to a judge of the Court in chambers for a determination as to whether leave
to appeal is granted or denied.
Note: This Practice Directive is issued by the Court under the authority of The Court of Appeal Act, 2000
and Rule 74 of The Court of Appeal Rules.

Application de la directive de pratique
1 La présente directive de pratique s’applique aux appels en matière criminelle qui ont trait :
a) à une procédure sommaire régie par la loi intitulée The Traffic Safety Act, L.S. 2004, ch. T-18.1,
relativement à une contravention routière;
b) à une procédure régie par un arrêté, tel qu’un arrêté municipal ou un arrêté d’une autorité suivant
la définition du terme authority dans la loi intitulée The Summary Offences Procedure Act, 1990,
L.S. 1990-1991, ch. S-63.1.
Renvoi en cabinet par le registraire
2 Sur dépôt d’un avis d’appel relatif à un appel visé au paragraphe 1 de la présente directive de pratique, le
registraire renvoie l’affaire à un juge de la Cour pour qu’il statue en cabinet sur la permission d’appel.
REMARQUE : La présente directive de pratique est arrêtée par la Cour en vertu de la Loi de 2000 sur la Cour
d’appel et de la règle 74 des Règles de la Cour d’appel.

Consent Adjournments
1 Where all parties involved in an application have consented to adjourn a matter scheduled for chambers,
appropriate notice of the request to adjourn by consent pursuant to Rule 6-16(1), must be provided to the local
registrar as soon as possible, and in any event, no later than 4:00 p.m. on the:
(a) Thursday preceding Monday chambers;
(b) Friday preceding Tuesday chambers;
(c) Monday preceding Wednesday chambers;
(d) Tuesday preceding Thursday chambers; or
(e) Wednesday preceding Friday chambers.
2 Where appropriate notice of the request to adjourn by consent is received in accordance with the time set
out in paragraph 1, the local registrar shall adjourn the matter to the date agreed upon and no party will be
required to attend chambers to speak to the adjournment unless the presiding Judge otherwise directs.
3 Where appropriate notice of the request to adjourn by consent is not received by the local registrar in
accordance with the time set out in paragraph 1, the parties must:
(a) notify the local registrar as soon as possible that a request to adjourn the matter will be made; and
(b) attend chambers to speak to the adjournment unless the presiding Judge otherwise directs.
4 Pursuant to Rule 6-16, “appropriate notice of the request to adjourn by consent” means a written request to
adjourn signed by all parties involved in the application (or their lawyers or agents), unless the local registrar
considers it appropriate to accept an oral consent.
Adjournment Requests without Consent
5 Any party seeking to adjourn a matter scheduled for chambers, without the consent of all parties involved
in the application must, as soon as possible:
(a) advise the local registrar of their intention to seek an adjournment; and
(b) whenever possible, serve and file a written explanation of the reasons for seeking an adjournment and,
if known, the reasons why consent from the other parties involved in the application has not been provided.
The Child and Family Services Act Matters
6 This practice directive does not apply to proceedings under The Child and Family Services Act, S.S. 1989-90,
c.C-7.2.
