In a first development, the thesis engages in a meta-historical and philosophical-legal approach
of the concept by seeing its formation and emergence in a semantic and semiotic study
especially through the Jewish and Christian canonical sources: Secularism is born in Religion

particularly in Judaism. Anti-Semitism constitutes the main breaking of the “laïque” pact. But,
the real philosophical-legal and modern basis of the concept is based on the philosophy of the
“Lumières” and it is revolutionary essence. Indeed, the “French Revolution of 1789” is the
repository of the juridical principles of secularism. Finally, the Republican School is the living
crucible of symbiosis of cultural differences and of the "will to live together".
The second development concerns the juridical transcription of the concept in the French legal
and educational system and its European influence. Its "highlight" is the Law of 9 December
1905 on the separation of Churches and State and issues of European integration of the concept
are subject to a dual approach. The concept is a "broad spectrogram" in the European context,
halfway between “secularism” and “secularization”. Two well differentiated groups of
European states exist: On the one hand, countries with tradition of "institutional churches", on
the other hand, countries with “shared etatico-ecclesiastical tradition”.
