For over 31 years David has restricted his practice to insurance disputes and related litigation. He advises insurers,
self- insured corporations, non- profit organizations, small and medium businesses and individuals on insurance,
commercial, employment and human rights litigation.
David has acted as Counsel at Trial on coverage issues and in personal injury, accident benefits, property and casualty, commercial general liability, fire , fidelity, excess and reinsurance as well as in life and disability claims.
He continues to act as trial and coverage counsel on complex multi-party, multijurisdictional catastrophic losses.
David has the expertise to quickly identify key issues and fully develop appropriate strategies to successfully
advance our client's position on any insurance, inter-jurisdictional, commercial or civil litigation related dispute.
Fluently bilingual, David is also an Accredited Mediator which he uses daily in negotiating on behalf of the firm's
clients in court connected or private mediations, arbitrations and neutral evaluations. David is committed to finding the most cost-effective resolution for our clients which include local, national, and international insurance and
reinsurance carriers and self insured companies.
Reflecting on his substantial experience in insurance litigation, David has been invited to write and speak on complex issues of interest to insurers and self-insured corporate clients. He has spoken on such cutting edge topics as
the use of DNA in the Insurance Industry, Catastrophic Impairment and the AMA Guides, Aggravated and Punitive Damages, Employer and Commercial Host Liability, Uninsured and Underinsured Liability, Forum NonConveniens, and on Spoilation in the Trucking Industry.
David has spoken at the request of the Advocate’s Society on the Art of Cross-Examination and on several
Insurance matters by: The Law Society of Upper Canada , The Ontario Bar Association, the Canadian Society of
Medical Evaluators, The Canadian Chamber of Commerce, Canadian Defence Lawyers, The Federation of Defence & Corporate Counsel, the Canadian and the International Association of Life Care Planners. David has also
spoken at a number of higher learning institutions including at Carleton University, the University of Ottawa, the
University of Windsor, the Richard Ivey School of Business at the University of Western Ontario, Memorial University and at Dalhousie University.
David also taught courses in Business Law at Carleton University, on Civil Procedure at the Bar Admission
Course for the Law Society of Upper Canada and at the International Institute for Research and at the Advocates
Society on the Art of Cross-Examination.
David's high-profile role as a speaker and writer ensures that he is familiar with the most recent decisions and the

Résumé de la pratique
Pendant 30 ans, David a limité sa pratique au droit des assurances et aux litiges connexes. Il conseille les
assureurs, les sociétés autoassurées, les organisations à but non lucratif, les petites et moyennes
entreprises et les particuliers sur les litiges commerciaux et les litiges en matière d’assurance, d’emploi et
de droits de la personne.
David a agi en qualité de conseiller juridique sur les questions de couverture et les questions touchant les
préjudices personnels, l’assurance individuelle, l’assurance IARD, l’assurance de la responsabilité civile
entreprise, l’assurance de la responsabilité des produits, l’assurance de la responsabilité en matière de
construction, l’assurance des chaudières, l’assurance couvrant la responsabilité des administrateurs et
dirigeants et la négligence professionnelle, l’assurance incendie, l’assurance détournement et vol,
l’assurance de risques successifs et la réassurance ainsi que les sinistres vie et invalidité.
Il continue d’agir en qualité d’avocat plaideur et de conseiller en matière de couverture dans les litiges
complexes mettant en cause plusieurs parties ou plusieurs juridictions ou concernant des sinistres graves
et catastrophiques.
David possède l’expertise voulue pour déterminer rapidement les enjeux clés et élaborer des stratégies
qui permettent de faire évoluer favorablement la position de nos clients dans tout litige commercial ou
civil, litige interjuridictionnel ou litige en matière d’assurance.
Parfaitement bilingue, David est également médiateur accrédité et utilise tous les jours ses compétences à
ce titre pour négocier pour le compte des clients du cabinet dans le cadre de médiations, d’arbitrages et
d’évaluations neutres privés ou rattachés au tribunal.
David s’efforce en tout temps de trouver la solution la plus rentable qui soit pour nos clients, y compris
des sociétés d’assurance ou de réassurance locales, nationales ou internationales.
Grâce à sa grande expérience dans les litiges en matière d’assurance, David a été invité à adresser la
parole sur une panoplie de sujets, y compris les désignations de déficience invalidante et les guides de
l’AMA, les dommages-intérêts majorés ou punitifs, la responsabilité des employeurs et des hôtes
commerciaux, la responsabilité relative aux garanties non assurées et sous-assurées, la question « Forum
Non-Conveniens » (tribunal qui ne convient pas), le droit du camionnage et du transport, la responsabilité
des produits, les frais médicaux futurs et la planification des soins de fin de vie ainsi que la façon de
présenter la preuve d’expert devant les tribunaux.

l’Advocate’s Society, et sur différentes questions liées aux assurances à la demande du Barreau du
Haut-Canada, de l’Association du Barreau de l’Ontario, de la Société canadienne des évaluateurs
médicaux, de la Chambre de commerce du Canada, de Canadian Defence Lawyers, de la Federation of
Defense & Corporate Counsel, de la Canadian Association of Life Care Planners et de l’International
Association of Life Care Planners.
Par ailleurs, David a pris la parole lors de différents événements tenus dans plusieurs établissements
d’enseignement supérieur, dont la Carleton University et l’Université d’Ottawa, la University of
