The response from the Privy Council Office (PCO) is as follows:
The Guide entitled Accountab/e Govemment: A Guide for Ministers and Ministers of State- 2011, sets out
the Government's policies with respect to Governor in Council (GIC) appointments. The specifie
appointment process for SIRC is set out in the Canadian Security Intelligence Service Act (CSISAct).
a
ln response to parts (a), (b) and (z)(i) of the question, attached at the Annex is list of individuals appointed
to the Security Intelligence Review Committee (SIRC) since February 5, 2005. The list includes the name
of the individual, the position to which they were appointed, the date of their appointment, their length of
term and, for those who have left SIRC, the date of termination of their appointment, as weil as the
organizations involved in background and security checks.
ln response to parts (c), {f), (h), (i), (k), (1), (u), (v) and (z), section 34 of the CS/S Act provides that SIRC
consists of a Chair and not Jess than two and not more than four other members, ali of whom shall be
members of the Queen's Privy Cou neil for Canada who are not members of the Senate or the House of
Gommons. Efforts are made to initiale the process to fi li an upcoming va ca ney before the end of the
incumbent's term, where possible. ln the case of an early departure, the Government's goal is to fiJI the
vacancy in a timely manner.
ln response to parts (d), (e), (h), {i) and 0), the criteria and process for appointing members of SIRC are set
out in section 34 of the CS/S Act.
-2A background check is conducted on ali candidates considered for appointment to SIRC, which involves the
following elements in response to parts (x) and (y):

a check by the Royal Canadian Mounted Police.
a security assessment on the candidate by CSIS.
a check by the Canada Revenue Agency.
a check with the Office of the Superintendent of Bankruptcy, lndustry Canada.
Ta support the GIC's decision-making with respect to appointments to SIRC, since 2012 individuals
considered for appointment to SIRC have been subject to Top Secret security clearance prior to being
appointéd, in addition to the background checks listed above.
ln respect of current processes underway, the positions of Chair and one member are currently vacant. The
Chair position is currently filled on an interim basis. Given the statutory requirement for SIRC members to
be members of the Queen's Privy Council, and in light of national security considerations, positions in SIRC
are not publicly advertised. As required by the CS/S Act, the government consulted with Messrs Mulcair
and Trudeau on December 8, 2014, on individuals being considered for appointment. An announcement
will be made by the Government once an appointment or appointments have been made.
ln response to parts (rn), (n), (o), (p), (q), (r), (s) and (t), PCO from time to time reviews its administrative
processes as part of its mandate in support of an efficient and effective GIC appointments system. With the
exception of the pre-appointment Top Secret security clearance requirement, the prescribed process and
criteria for the appointment of SIRC members have not changed.
ln response to parts (g) and (w), since 2005, there have been no costs associated with the appointment
process of individuals to SIRC over and above normal operating costs (Le., salary of employees doing the
work) associated with policy and operational advice in respect of GIC appointments.
ln response part (z)(ii), as mentioned above, since 2012, individuals being considered for appointment to
SIRC undergo a Top Secret security clearance prior to appointment. The only direct costs to PCO over and
above normal operating costs (i.e., salary of employees doing the work) are with regards to the travel
required to complete the subject interview and related briefings, as weil as credit check and fingerprint
inquiries. Since the addition of the Top Secret security clearance in 2012, the travel costs related to the Top
Secret security clearance are $3,787. The costs related to credit checks and fingerprints cannot.be verified
as PCO has no specifie coding for these items.

La réponse du Bureau du Conseil privé (BCP) est la suivante :
La politique du gouvernement concernant les nominations par le gouverneur en conseil est énoncée dans le
guide intitulé Pour un gouvernement responsable - Guide du ministre et du ministre d'État- 2011. Le
processus de nomination au CSARS est décrit dans la Loi sur le service canadien du renseignement de
sécurité (Loi du SCRS).
En réponse aux parties a), b) et z)(i) de la question, veuillez trouver ci-joint la liste des personnes nommées
au Comité de surveillance des activités de renseignement de sécurité (CSARS) depuis le 5 février 2005. On
y indique le nom des personnes, leur poste, la date de leur nomination, la durée de leur mandat, les
organisations responsables de l'examen des antécédents et des vérifications de sécurité, et, dans le cas
des personnes qui ont quitté le CSARS, la date de la fin de la nomination.
En réponse aux parties c), f), h), 1), k), /), u), v) et z), on peut lire à J'article 34 de la Loi sur le Service
canadien du renseignement de sécurité que la CSARS est composé d'un président et de deux à quatre
autres membres, tous des membres du Conseil privé de la Reine pour le Canada qui ne font pas partie du
Sénat ni de la Chambre des communes. Afin de bien gérer les postes vacants, on s'efforce de lancer le
processus de nomination avant la fin du mandat du titulaire. En cas de départ anticipé, le gouvernement a
pour objectif de doter le poste vacant le plus rapidement possible.
-2En réponse aux parties d), e), h), 1) etJ), les critères et le processus de nomination sont énoncés à
l'article 34 de là Loi sur Je Service canadien du renseignement de sécurité.
En réponse aux parties x) et y), les candidats considérés pour une nomination au CSARS font.!' objet d'un
examen approfondi des antécédents qui comprend :

une vérification par la Gendarmerie royale du Canada.
une enquête de sécurité par le Service canadien du renseignement de sécurité
une vérification par l'Agence du revenu du Canada (ARC).
une vérification auprès du Bureau du surintendant des faillites Canada (Industrie Canada).
Le processus administratif applicable aux nominations a été modifié en 2012. Depuis, afin d'aider le
gouverneur en conseil à prendre des décisions relativement aux nominations au CSARS, le Premier
·ministre exige que les candidats obtiennent la cote de sécurité Très secret avant d'être nommés, ce qui
vient s'ajouter à la vérification des antécédents.
En ce qui a trait aux processus de nomination en cours, le poste de président et un poste de membre sont
vacants. Le poste de président est pollrvu de façon intérimaire. Puisque la loi exige que les membres du
CSARS soient des membres du Conseil privé de la Reine et en raison de préoccupations liées à la sécurité
nationale, les ouvertures au sein du CSARS ne sont pas publiquement annoncées, et le BCP ne gère pas
le processus de sélection. En application de la Loi sur Je Service canadien du renseignement de sécurité, le
gouvernement a consulté M. Mulcair et M. Trudeau le 8 décembre 2014 au sujet des candidats retenus. Le
gouvernement fera une annon.ce une fois la ou les nominations confirmées.
En réponse aux parties m), n), o), p), q), r), s) et t), il arrive que le BCP se penche sur ses processus
administratifs afin de remplir son mandat qui consiste à assurer l'efficacité du système des nominations par
le gouverneur en conseil. Mis à part l'exigence liée à l'obtention de la cote de sécurité Très secret avant la
nomination, aucun changement n'a été apporté au processus administratif ni aux critères de sélection des
membres du CSARS.
En réponse aux parties g) et w), depuis 2005, les coûts engagés pour nommer des personnes au CSARS
n'ont pas excédé les coûts de fonctionnement normaux liés aux conseils stratégiques et opérationnels
(c'est-à-dire le salaire des employés) concernant les nominations du gouverneur en conseil.
En réponse à la partie z)(ii), depuis 2012, les candidats retenus doivent obtenir la cote de sécurité Très
secret avant leur nomination au CSARS. Les seuls coûts engagés par le BCP en plus des coûts de
fonctionnement normaux (c'est-à-dire le salaire des employés) sont liés aux déplacements nécessaires
pour procéder à des entrevues et à des séances d'information ainsi qu'à la vérification du crédit et des
empreintes digitales. Depuis l'ajout de la cote de sécurité de niveau « Très secret » en 2012, les coûts
associés aux autorisations de ce niveau dans le cadre des déplacements ont été de 3 787 $. Les coûts des
vérifications du crédit et des empreintes digitales ne peuvent être précisés, car le BCP n'a pas de codes
précis pour ces activités.
