Renégociations au titre de IJartiole XXVIII:^
Le gouvernement israélien a fait parvenir au secrétariat la communication
ci-après, datée du 28 décembre 1968.
Les PARTIES CONTRACTANTES ont pris connaissance dans le document L/3085 de
l'intention du gouvernement d'Israël de demander l'autorisation de renégocier, au
titre du paragraphe 4. de l'article XXVIII, un certain nombre de concessions reprises
dans la Liste XLII. Le Conseil a accordé cette autorisation lors de sa réunion du
11 novembre 1968 (voir le document C/fy/51).
Dans sa demande, le gouvernement israélien avait indiqué qu'il mettrait en
oeuvre la nouvelle phase de son programme de libéralisation à compter du
1er janvier 1969.
Par la présente, le gouvernement israélien informe les PARTIES CONTRACTANTES
que l'accord final n'a pas encore pu se faire, au cours des négociations susmentionnées, avec un certain nombre de ses partenaires commerciaux.
Ayant consulté à ce sujet ses partenaires dans les négociations, et reconnaissant
pleinement le fait que la mise en oeuvre de sa politique ne préjuge pas des droits
que leur confèrent les dispositions de l'article XXVIII de l'Accord général, Israël
effectuera, à compter du 1er janvier 1969, les modifications et retraits de
concessions ayant fait l'objet de la notification et appliquera à compter de la même
date les taux de droit qui ont été offerts à titre de compensation aux différentes
parties contractantes avec lesquelles des négociations ont eu lieu.

Renegotiations under Article,XXVIII;k
The following communication, dated 28 December 1968, has been received from
the Government of Israel.
In document L/3085 the CONTRACTING PARTIES were notified of the intention of
the Government of Israel to apply for authority to renegotiate under
Article XXVIII :4 a number of the concessions contained in its Schedule XLII.
This request was granted at the Council meeting of 11 November 1968 (see
document C/k/5l).
In its application the Government of Israel had indicated that it would be
implementing the new phase of its liberalization programme as from 1 January 1969.
The Government of Israel herewith notifies the CONTRACTING PARTIES that it
has not yet been able to reach final agreement with a number of its trading
partners in the above-mentioned negotiations.
Having consulted its negotiating partners on this matter, and in full

recognition of the fact that the implementation of its policy does not prejudice

their legal rights under the provisions of Article XXVIII of the General Agreement,
Israel will implement, as from 1 January 1969, the modifications and withdrawals
of the items notified, and will, as from the same date, apply the rates of duty
which have been offered as compensation to the individual contracting parties
with whom negotiations have been held.
