Taxation (?) • Interventions providentielles : « the Lord giveth and the Lord taketh away » (Job 1 : 21 cité par Bartle, SoP : 48). • Punitions : « the finger of death » • « Swich off » : destruction définitive de l’univers ou « reset » : remise à zéro. Finger of Death « (…) I added a command, FOD (‘Finger of Death’). If people swore, I FODded them. Theirs characters disintegrated. Hey, the program allowed me to do it, so it was OK! It didn’t allow anyone else to do it unless I set the flag on their character, but it allowed me » (Bartle, SoP, 2006 : 36). Les règles du jeu positives : EULAw “The EULAs*, TOSs**, rules of conduct, posting policies, naming policies, and other contracts that govern virtual worlds are the products of owners and lawyers engaging in a centralized process of lawmaking through a form of nonnegotiated, infinitely modifiable, proprietorfriendly regulation that I call ‘EULAw.’” • Critiques : – Contrat d’adhésion : « click-wrap contract » – Complexité – Problèmes d’accessibilité (30%) – Pouvoir de modification unilatérale sans notification (40%) EULAW de EVE Online (1) the End User License Agreement, (2) the Terms of Service, (3) Forum Rules, (4) Chat Rules, (5) EVE Subscription Fees and Payment Options, (6) Web site Terms of Use Agreement, (7) EVE Online User and Character Name Policy, (8) EVE Online Reimbursement Policy, (9) the Suspension and Ban Policy (10) the Legal System of EVE Online itself (11) the game-play and interface. Valeur juridique de la EULAw • La Jurisprudence la consacre généralement (sauf affaire Red Moon en Chine) • La Doctrine la critique souvent très sévèrement en raison de son contenu Le pouvoir souverain des « admins » • « You are in our world now! » (Everquest, Sony Online Entertainment Legal Notices) • « You will always follow the instructions of authorized personnel while in Anarchy Online » (quoted by Jankowich 2006). • « Anything an admin orders you to do is, by definition, the law » (anonymous comment by admin quoted by Koster, SoP, 2006 : 62) Le pouvoir souverain des « admins » • Pouvoir d’édicter et modifier les règles du jeu (naturelles et positives) • Gouvernance économique et financière : – Émission de monnaie – Régulation du marché des changes • Pouvoir de punir : – – – – Bannissement temporaire Confiscation des biens Rétrogradation (niveau) Suppression de l’avatar et « clôture du compte » • Pouvoir de surveillance et de contrôle : – Monitoring panoptique – Pouvoir de censure Pas de publicité des actions des « admins » “Warnings and bans are not to be discussed on the forum. Such matters shall remain private between the CCP and the user. . . . Likewise, discussions regarding moderator actions are not permitted on the forum.” (EVE Online, Rules & Policies, quoted by Jankowich 2006 : 20). – “Do these [rules] really apply to the guy with his finger on the power button? He is unbannable, after all” (R. Koster, SoP, 62 quoting an anonymous comment by an admin). – « (…) the designers are not ‘bound’ by the rules of the game in the same sense, they aren’t really ever ‘playing’ the game » (Grimmelmann, SoP, 2006 : 151). Recours des joueurs • Action en justice sur la base du contrat • « the right to log off » • Pression sur les « admins » via les exploitants et les marketers Justifications du pouvoir des « admins » • Propriété : « many mud* admins are of the belief that their muds are their private playgrounds » (Koster, SoP, 2006 : 55) • 1st Amendment : liberté d’expression des créateurs de jeux • Fonctionnelle : « Virtual-world administrators have absolute control over their world (…). While this state of affairs pertains, they can protect the game conceit » (Bartle, SoP, 2006 : 37) (*) MUD : Multi Users Dunjeon. Mythologie révolutionnaire • Tax Revolt (Second Life) • Censure de la presse (P. Ludlow et l’Alphaville Herald sur Sim’s Online) • Régicide : « In Brittania, the lead designer, Richard Garriot, appeared as the monarch Lord British and was reportedly once assassinated by one of his subjects when he forgot to make himself invulnerable » (Elizabeth Kolbert, 2001) Mythologie révolutionnaire • Declaration of the Independance of Cyberspace (J.P. Barlow, 1996) • Declaration of the Rights of Avatars (R. Koster, 2000) Principaux droits revendiqués par les joueurs • Droits civils : – Propriété intellectuelle – Liberté d’expression – Due process • Droits politiques : – Reconnaissance d’une communauté politique – Publicité des actions des « admins » Une expérience démocratique : LambdaMOO • A rape in cyberspace • Pavel Curtis, the chief « wizard » announces his abdication. The wizards decide to turn governance over the players • A system of petitions and ballots is established • An early ballot instituted a virtual court as a dispute resolution mechanism, and is used frequently. • The wizards still have superpowers and are urged by residents to use them. • Three years and a half later, Curtis posted a message giving public notice that he was reintroducing the practice of “wizardly fiat.” Metaverse Republic
