The regulations listed below are a part of the General
Regulations for Exhibitors of the Watch and Jewellery
Show BASELWORLD. (Section 18)

Minimum working and wage conditions for
foreign stand builders and foreign stand
employees
Conditions minimales de travail et de salaire
applicables aux constructeurs de stands
étrangers et au personnel de stand étranger
Under the terms of the Swiss Federal Law on Employees
sent to Switzerland (EntsG; SR 823.20), the Swiss Federal
Law on the Residence and Permanent Establishment of
Foreigners (ANAG; SR 142.20) and the Ordinance Limiting
the Number of Foreigners (BVO; SR 823.21), exhibitors
have the following duties:
–Exhibitors must notify the Office of Employment and
Economic Affairs of the Canton of Basel-City eight days
prior to commencement of work, as a rule, of all employees of foreign nationality who will be working on
the exhibition site for eight days or longer in the framework of BASELWORLD.
–Exhibitors must observe the minimum wage and working conditions for their employees. In particular, they
must pay their full travel costs, board and lodging, and
also pocket money of at least CHF 30.– per day.
–The duty of notifying and the minimum working an
wage conditions are also applicable to foreign stand
builders and other service providers called in by the
exhibitors. The exhibitors must inform all called in foreign service providers about these duties.
Vu les dispositions de la Loi fédérale sur les travailleurs
détachés en Suisse (Odét; RS 823.20), de la Loi fédérale
sur le séjour et l’établissement des étrangers (LSEE; RS
142.20) et de l’Ordonnance limitant le nombre des étrangers (OLE; RS 823.21), les exposants s’engagent à remplir
les obligations suivantes:
–Les exposants sont tenus d’annoncer à l’Office de
l’économie et du travail, du canton de Bâle-Ville, en règle
générale 8 jours avant le début de la mission, l’identité et
la nationalité de tous les travailleurs employés pendant
8 jours ou plus sur le site de la Foire dans le cadre de
BASELWORLD.
–Les exposants doivent garantir à leurs employés les
conditions minimales de travail et de salaire. Ils sont
notamment tenus de leur payer intégralement les frais
de transport, d’hébergement et de repas et de leur verser à titre d’argent de poche un montant minimum de
CHF 30.– par jour.
–L’obligation d’annoncer les conditions de salaire minimum et de travail s’applique également aux monteurs
de stand étrangers travaillant pour les exposants ainsi
qu’a tout autre partenaire contractuel étranger sollicité.
Les exposants sont tenus de rendre les partenaires contractuels attentifs à ces obligations.
Exhibitors of foreign nationality, who call in foreign stand
builders for the designing, the setting-up and the dismantling of the stand are not allowed to make these persons
available to other exhibitors. The change of the purpose of
residence is not possible.
The Office of Employment and Economic Affairs and the
Security Department of the Canton of Basel-City shall be
entitled to check compliance with the minimum working
and wage conditions and also with the provisions issued by
the aliens’ police governing the employees’ entry into and
stay in Switzerland. The corresponding documents and
evidence, etc. must be handed over on request.

Les exposants étrangers qui emploient du personnel étranger pour la conception, le montage et le démontage de leur
stand, ne sont pas autorisés à l’envoyer et l’occuper sur
d’autres stands. Il est interdit de modifier le motif du séjour.
L’Office de l’économie et du travail ainsi que le Département de la sécurité du canton de Bâle-Ville disposent du
pouvoir d’exercer un contrôle des conditions minimales de
travail et de salaire ainsi que des dispositions de la police
des étrangers relatives à l’entrée et au séjour en Suisse.
Les documents, pièces justificatives, etc. correspondants
doivent être remis à la demande des autorités compétentes.

Minimale Arbeits- und Lohnbedingungen für
ausländische Standbauer und ­
ausländisches Standpersonal
Condizioni minime di retribuzione e di lavoro
per il personale addetto allo stand e gli ­
allestitori provenienti dall’estero
Gestützt auf die Bestimmungen des Bundesgesetzes über
die in die Schweiz entsandten Arbeitnehmer (EntsG; SR
823.20), des Bundesgesetzes über Aufenthalt und Nieder­
lassung der Ausländer (ANAG; SR 142.20) und der Ver­ord­
nung über die Begren­zung der Zahl der Ausländer (BVO;
SR 823.21) haben die Aussteller folgende Pflichten:
–Die Aussteller haben dem Amt für Wirtschaft und Arbeit
des Kantons Basel-Stadt in der Regel 8 Tage vor Ein­
satz­beginn alle Angestellten ausländischer Staats­ange­
hörig­keit zu melden, die während 8 Tagen oder länger,
jeweils vor, während oder nach der BASELWORLD auf
dem Messe­gelände tätig sind.
–Die Aussteller haben ihren Angestellten die minimalen
Lohn- und Arbeitsbedingungen zu gewähren. Insbeson­dere haben sie diesen die vollen Reisekosten, Unterkunft, Verpflegung und ein Taschengeld von mindestens CHF 30.– pro Tag zu bezahlen.
–Die Meldepflicht und die minimalen Lohn- und Arbeitsbe­dingnungen gelten auch für die im Auftrag der
Aus­steller arbeitenden ausländischen Standbauer und
andere beigezogene ausländische Vertragspartner. Die
Aussteller haben die beigezogenen ausländischen
Vertragspartner auf diese Pflichten hinzuweisen.
In base alle disposizioni della legge federale sui lavoratori
in trasferta in Svizzera (EntsG; SR 823.20), della legge
federale sul soggiorno e l’insediamento di stranieri (ANAG;
SR 142.20) e all’ordinanza sulla limitazione del numero di
stranieri (BVO; SR 823.21) gli espositori hanno i seguenti
doveri:
–8 giorni prima dell’inizio dell’attività gli espositori devono di regola comunicare all’Ufficio dell’economia e del
lavoro del Cantone Basilea-Città tutti i dipendenti di
nazionalità straniera che lavoreranno presso il quartiere
fieristico durante gli 8 giorni o più nell’ambito del Salone BASELWORLD.
–Gli espositori devono garantire ai loro addetti le condizioni minime di retribuzione e di lavoro. In particolare
devono provvedere al pagamento di tutti i costi relativi
a viaggio, soggiorno e pernottamento nonché riconoscere una diaria minima di CHF 30. /giorno.
–L’obbligo della communicazione e le condizioni minime
di retribuzione e di lavoro sono valide anche per tutte le
ditte straniere allestitrici di stand ed altre ditte che prestano servizio per conto dell’espositore. Gli espositori
devono segnalare a tutti i suoi partner interessati questi
obblighi.
Ausländischen Ausstellern, welche ausländisches Standbaupersonal für die Gestaltung, Montage und Demontage
ihres Standes beiziehen, ist es untersagt, dieses Personal
bei anderen Ausstellern einzusetzen bzw. an diese zu
vermitteln. Die Änderung des Aufenthaltszweckes ist ausgeschlossen.
A tutti gli espositori stranieri, che lavorano con ditte
straniere per la costruzione, allestimento, montaggio e
smontaggio dello stand non è permesso, di mettere a
disposizioni di altri espositori il personale. Non è possibile
mutare lo scopo del soggiorno.
Das Amt für Wirtschaft und Arbeit sowie das Sicherheits­departement des Kantons Basel-Stadt können die Ein­hal­
tung der minimalen Arbeits- und Lohnbedingungen sowie
der fremdenpolizeilichen Bestimmungen über Einreise und
Aufenthalt kontrollieren. Die entsprechenden Dokumente,
Nachweise, etc. sind auf Verlangen herauszugeben.

L’Ufficio per l’economia e il lavoro e il Dipartimento di
sicurezza del Cantone Basilea-Città possono controllare il
ris­petto delle condizioni minime di retribuzione e di lavoro
e le disposizioni dell’ufficio stranieri relative all’ingresso e al
soggiorno. I rispettivi documenti, prove, etc. devono essere
mostrate su richiesta.
