KABUGA (the "Accused")filed on 25 February2013;
andan Orderfor Transferof IIIICIEN
CONSIDERING the IndictmentsagainstFELICIEN KABUGA confirmed on 26 November
1997by JudgeLennart Aspegren,on 29 August 1998 by JudgeNavanethemPillay, on 12
October2005 by JudgeDennis Byron and on 13 April 20ll by JudgeDennisByron of the
InternationalCriminal Tribunal for Rwanda("ICTR");
CONSIDERING the Warrant of Arrest and Order for Transferand Detentionof FELICIEN
KABUGA dated8 November2001,which is currentlyin force;
CONSIDERING United Nations Security Council Resolution 1966 (2010) regarding the
cooperationof Stateswith the MICT;
QQN$IDERING Article 28 0f the MICT StatuteandRule57 0f the Rules;
NOTING the needto vacatethe Warrantof Arrest and Orderfor Transferand Detentiondated8
November2001 requestingtransfer of tr'ULICIEN KABUGA to the ICTR, and the need to
replaceit with a requestfor his transferto the ArushaBranchof the MICT;
HEREBY RESPECTFULLY REQUESTS ALL MemberStatesof the united Nationsto:
I.
SEARCH FOR, ARREST AND TRANSFER to the custodyof the ArushaBranch
of the MICT FELICIEN KABUGA, a Rwandan citizen born in 1935 in Muniga
secteur, Mukarange commune,Byumba prefecture, Rwanda, who is accusedof
havingcommittedduring 1994in Rwandathe followingcrimes:genocide,complicity
in genocide(in the alternativeto genocide),direct and public incitementto commit
genocide,attempt to commit genocide,conspiracyto commit genocideand crimes
againsthumanity(persecutionandextermination);

SERVE on the Accusedat the time of his arrestor as soonas practicableimmediately
following arrest, in a languagehe understands,a certified copy of this warrant of
arrest,accompaniedby a copy of the indictmentcertified in accordancewith Rule 48
(G) and a statementof the rights of the accusedset forth in Article 19 of the Statute
and in Rules40 and 4l:

INFORM the Accusedat the time of his arrestor as soonas practicableimmediately
following arrest, in a languagehe understands,that he is being transferredto the
ArushaBranchof the MICT;

SEEK AN ACKNOWLEDGMENT of receipt from FELICIEN KABUGA of a
copy of the warrantof arrest,the indictmentand the statementof rights in a language
and returnone set of documentstogetherwith proof of serviceto the

SEARCH AND SEIZE all physicalevidencerelatedto the crimes allegedagainst
FELICIEN KABUGA;

CREATE an itemizedinventoryof all seizedmaterials,includingdocuments,books,
papersor any other objects,that is properly witnessedand is acknowledgedby the
Accused;

TRANSFER all seizedevidenceandthe inventoryto the Prosecutorof the MICT;
VIII.
NOTIFY the Registrarof the MICT and the Prosecutorof the MICT of the arrestof
the Accusedfor the purposesof arranginghis transferto the custodyof the Arusha
Branchof the MICT without delay;

RBPORT forthwith to the Registrarof the MICT and the Prosecutorof the MICT if
unableto executethis Waruantor Order for Transfer,indicatingthe reasonsfor the
inabilityto do so; and
X.
MAKE INQUIRIES to discoverwhetherthe Accusedhas assetslocatedwithin the
territory of the Member Stateand if so, to adoptprovisionalmeasuresto freezesuch
assets,without prejudiceto the rightsof third parties;
ORDBRS that, upon his transfer,AccusedFELICIEN KABUGA be remandedin custodyin
the UnitedNationsDetentionFacilityat the ArushaBranchof the MICT; and
