Reservations
In accordance with Article 9, paragraph 4, of the Convention, the Government of the United Kingdom of
Great Britain and Northern Ireland reserves the right not to apply Article 9 (2) (b), which states that “child
pornography” includes “a person appearing to be a minor engaged in sexually explicit conduct”, as this
provision is incompatible with domestic law regarding indecent photographs of children.
In accordance with Article 9, paragraph 4, of the Convention, the Government of the United Kingdom of
Great Britain and Northern Ireland declares that it reserves the right not to apply Article 9 (2) (c), as Scotland
has no offence covering a ‘realistic’ image which is not, and is not derived from, a photograph of a real
person.
In accordance with Article 22, paragraph 2, of the Convention, the Government of the United Kingdom of
Great Britain and Northern Ireland reserves the right not to apply Article 22 (1) (d). The UK can extend extraterritorial jurisdiction over most of the offences in Articles 2-11, although not over fraud committed in
Scotland, under specific circumstances. As there is no overarching arrangement that extends extra-territorial
jurisdiction, the UK cannot say that it will apply in every case.
In accordance with Article 29, paragraph 4, of the Convention, the Government of the United Kingdom of
Great Britain and Northern Ireland reserves the right not to apply Article 29 where execution of the request
for preservation requires the exercise of coercive powers and where dual criminality cannot be established.

Conformément à l'article 9, paragraphe 4, de la Convention, le Gouvernement du Royaume-Uni de GrandeBretagne et d’Irlande du Nord se réserve le droit de ne pas appliquer l'article 9 (2) (b), qui stipule que la
«pornographie enfantine» comprend «une personne qui apparaît comme un mineur se livrant à un
comportement sexuellement explicite », car cette disposition est incompatible avec le droit interne en
matière de photographies indécentes d'enfants.
Conformément à l'article 9, paragraphe 4, de la Convention, le Gouvernement du Royaume-Uni de GrandeBretagne et d'Irlande du Nord déclare qu'elle se réserve le droit de ne pas appliquer l'article 9 (2) (c), car en
Ecosse il n’y a pas d'infraction portant sur une image «réaliste» qui n'est pas une photographie d'une
personne réelle, ni un dérivé d’une telle photographie.
Conformément à l'article 22, paragraphe 2, de la Convention, le Gouvernement du Royaume-Uni de GrandeBretagne et d’Irlande du Nord se réserve le droit de ne pas appliquer l'article 22 (1) (d). Le Royaume-Uni
peut étendre la compétence extra-territoriale sur la plupart des infractions visées aux articles 2-11, mais pas
sur la fraude commise en Ecosse, dans des circonstances spécifiques. Comme il n'y a aucun arrangement
global qui étende la compétence extra-territoriale, le Royaume-Uni ne peut pas dire qu'il l’appliquera dans
tous les cas.
Conformément à l'article 29, paragraphe 4, de la Convention, le Gouvernement du Royaume-Uni de GrandeBretagne et d’Irlande du Nord se réserve le droit de ne pas appliquer l'article 29 si l'exécution de la demande
de conservation exige l'exercice de pouvoirs coercitifs et si la condition de double incrimination ne peut pas
être remplie.
