Considérant que, le 6 avril 1950, la Conférence des Nations Unies sur la déclaration
de décès de personnes disparues a arrêté le
texte de la Convention concernant la déclaration de décès de personnes disparues*) et
déclaré la Convention ouverte à l'adhésion
des Etats,
Considérant que la validité de la Convention
devait expirer le 24 janvier 1957, conformément aux dispositions du paragraphe 1 de
son article 17,

Considérant qu'un protocole portant prolongation, pour une nouvelle période de dix ans,
de la validité de la Convention a été ouvert à
l'adhésion des Etats le 16 janvier ‫׳‬1957 et,
conformément aux dispositions de sa section
III a), est entré en vigueur le 22 janvier
1957‫) ׳‬,
C o n s i d e r i n g that a Protocol for extending the
period of validity of the Convention for a
further period of ten years was opened for
accession on 16 January 1957 and, pursuant
to the provisions of its section III (a), entered
into force on 22 January 1957 ),
Considérant que la validité de la Convention,
telle qu'elle a été prolongée par ledit Protocole, expire le 24 janvier 1967,

Convention^ as extended by the said Protocol,
expires on 24 January 1967,

Nonobstant les dispositions du paragraphe 1
de l'article 17 de la Convention concernant la
déclaration de décès de personnes disparues
et de la section I du Protocole portant prolongation de la validité de la Convention,
qui a été ouvert à l'adhésion des Etats le 16
janvier 1957, la Convention restera en vigueur entre les Etats parties au présent Protocole pendant une nouvelle période de cinq
ans, dans les conditions stipulées dans ledit
Protocole.
Notwithstanding the provisions of paragraph
1 of article 17 of the Convention on the De­
claration of Death of Missing Persons and
section I of the Protocol for extending the
period of its validity, opened for accession on
16 January 1957, the Convention shall remain
in force for a further period of five years,
subject to the provisions of this Protocol, as
between States Parties to this Protocol.

1) Le présent Protocole sera ouvert à
compter du 15 janvier 1967 à l'adhésion des
Etats parties à la Convention, telle qu'elle a
été prolongée par le Protocole ouvert à
l'adhésion le 16 janvier 1957, et des autres
Etats visés à l'article 13 de la Convention.
2) L'adhésion s'effectuera par le dépôt d'un
instrument d'adhésion auprès du Secrétaire
général de l'Organisation des Nations Unies.
3) Tout Etat qui adhérera au présent Protocole après le 2 4 janvier 1967 sera réputé
adhérer également à la Convention telle
qu'elle est prolongée par le présent Protocole.
ARTICLE
3
1) L e présent Protocole entrera en vigueur
à la date à laquelle le deuxième instrument
d'adhésion aura été déposé conformément
aux dispositions du paragraphe 2 de l'article 2
du présent Protocole.
2) Pour chaque Etat qui adhérera au présent Protocole après le dépôt du deuxième
instrument d'adhésion le Protocole entrera
en vigueur à la date du dépôt, par cet Etat,
de son instrument d'adhésion.

ARTICLE
4
1) Tout Etat partie au présent Protocole
pourra, à tout moment, le dénoncer par
notification adressée au Secrétaire général.
2) L a dénonciation prendra effet six mois
après la date à laquelle le Secrétaire général
en aura reçu notification.

ARTICLE

(1) This Protocol shall be open for accession
as from 15 January 1967 to the States Parties
to the Convention as extended by the Proto­
col opened for accession on 16 January 1957
and to the other States referred to in article
13 of the Convention.
(2) Accession shall be effected by the deposit
of an instrument of accession with the
Secretary-General of the United Nations.
(3) Accession by any State to this Protocol
after 2 4 January 1967 shall be deemed also .
to be accession to the Convention as extended
by this Protocol.
X\RTICLE
3
(1) This Protocol shall enter into force on
the day of deposit of the second instrument
of accession in accordance with the provisions
of paragraph 2 of article 2 of this Protocol.
(2) For each State acceding to this Protocol
after the deposit of the second instrument of
accession, the Protocol shall enter into force
on the date of deposit by such State of its
instrument of accession.
A R T I C L E 4•
(1) This Protocol may be denounced by any
State Party to it at any time by means of a
notification to the Secretary-General.
(2) Denunciation shall take effect six month;
after the date of receipt of the notification by
the Secretary-General.

3) Les instances engagées avant l a dénonciation mais qui seront en cours à l a date à
laquelle la dénonciation prendra effet pourront être poursuivies sur les mêmes bases
jusqu'à décision passée en force de chose

effet que si elle était intervenue avant la
dénonciation de la Convention telle qu'elle
est prolongée par le présent Protocole.

Proceedings initiated prior to, but not
concluded before, the date on which such
denunciation becomes effective, may be
continued on the initial basis until a final
decision is reached, and the effects with regard to such decisions will be the same as if
they had been rendered before the denunciation of the Convention as extended by this
Protocol.

d'entrée en vigueur du présent Protocole,
ainsi que des dates des adhésions audit Protocole et des dénonciations dudit Protocole.
The Secretary-General shall inform the
States referred to in article 13 of the Convention of the date of entry into force, accessions to and denunciations of this Protocol.
ARTICLE 6
ARTICLE 6
Le présent Protocole, dont les textes anglais,
chinois, espagnol, français et russe font également foi, sera déposé auprès du Secrétaire
général de l'Organisation des Nations Unies,
qui en transmettra des copies certifiées conformes à tous les Etats visés à l'article 13 de
la Convention.
This Protocol, of which the Chinese, English,
French, Russian and Spanish texts are equally
authentic shall be deposited with the Secretary-General of the United Nations, who
shall send certified copies thereof to all States
referred to i n article 13 of the Convention.
