The 49th Commonwealth Parliamentary
Conference was held in Dhaka, Bangladesh
from October 4 to 14, 2003. The Speaker of the
Senate, the Honourable Dan Hays, attended
the Executive Committee meetings and, as
Canada will be the host of the 50th
Commonwealth Parliamentary Conference, he
represented the Parliament of Canada at the
opening of the conference.
La 49e Conférence parlementaire du
Commonwealth s’est tenue à Dacca
(Bangladesh) du 4 au 14 octobre 2003. Le
Président du Sénat, l’honorable Dan Hays, a
assisté aux réunions du comité exécutif et,
puisque le Canada sera l’hôte de la 50e
Conférence, il a représenté le Canada à la
séance d’ouverture de la Conférence.
Following his participation in the 49th
Commonwealth Parliamentary Conference held
in Bangladesh, the Honourable Dan Hays,
Speaker of the Senate of Canada, paid a
working visit to the Kingdom of Cambodia from
October 8 to 11, 2003. The working visit
reinforced the friendship between Canada and
Cambodia.
Après avoir participé à la 49e Conférence
parlementaire du Commonwealth au
Bangladesh, l’honorable Dan Hays, Président
du Sénat du Canada, a effectué une visite de
travail au Royaume du Cambodge, du 8 au 11
octobre 2003. Ce séjour a raffermi l’amitié

Bangladesh hosted the 49th Commonwealth
Parliamentary Conference. With the next
Commonwealth Parliamentary Conference to
be held in Canada in 2004, the presidency of
the Executive Committee falls to a Speaker of
that host country as is the normal practice.
While the Hon. Peter Milliken, Speaker of the
House of Commons, holds the office of
President of the Executive Committee (EXCO),
as his alternate and by mutual agreement, the
Hon. Dan Hays, Speaker of the Senate,
attended the in camera EXCO meetings and
represented Canada by giving the opening
speech at the Official Inauguration of the 49th
Commonwealth Parliamentary Conference on
October 7, 2003. (Please find attached a copy
of these remarks.)

parlementaire du Commonwealth en 2003.
Comme il est d’usage de confier la présidence
du Comité exécutif (CE) de la conférence à un
Président du prochain pays hôte, qui en 2004
sera le Canada, c’est le Président de la
Chambre des communes, l’hon. Peter Milliken,
qui a assuré cette fonction. Après entente
mutuelle, l’hon. Dan Hays, Président du Sénat
et suppléant de M. Milliken au sein du CE, a
assisté aux réunions à huis clos du Comité et
représenté le Canada en prononçant le
discours inaugural lors de l’ouverture officielle

Context
Contexte
The Kingdom of Cambodia is currently
undergoing a time of political uncertainty. With
a government in transition and a lower house
yet to sit after the July 27 elections, Speaker
Hays was told about "democracy in
development" first hand in his exchanges with
the King of Cambodia and the leaders of
Cambodia’s three major political parties. The
Speaker also had meetings with Chairs of the
Senate Commissions and other Senators.
Le Royaume du Cambodge traverse une
période d’incertitude politique : le
gouvernement est en transition et la Chambre
basse n’a pas siégé depuis les élections du 27
juillet. M. Hays a entendu des témoignages de
première main sur la « démocratie en
développement » lors de ses échanges avec le
roi du Cambodge et les chefs des trois grands
partis politiques. Il a rencontré les présidents
des commissions sénatoriales et plusieurs
sénateurs.
During these numerous encounters, Speaker
Hays discussed democracy in Canada and, in
particular, the functioning of the Senate and
Canada’s political system.
Dans ses nombreux entretiens, M. Hays a
évoqué la démocratie canadienne et surtout le
fonctionnement du Sénat et du système
politique canadien.
Speaker Hays conveyed Canada’s support for
democracy and good governance and
expressed his fervent hope that the current
situation in the kingdom will be settled through
swift, non-violent negotiations.

faveur de la démocratie et de la bonne
gouvernance et il a dit espérer vivement que la
situation actuelle au Cambodge se règle par
des négociations rapides et non violentes.

Speaker Hays and Mr. Paul C. Bélisle had an
audience with His Majesty Norodom Sihanouk
and took part in a series of meetings with the
following officials: His Excellency Chea Sim,
the President of the Senate and Leader of the
Cambodian People's Party (CPP); HRH Prince
Ranariddh, the President of the National
Assembly and Leader of the Royalist
FUNCINPEC Party; and Mr. Sam Rainsy,
Leader of the Opposition, and his wife, Mrs.
Tioulong Saumura, who is also a Member of
Parliament.
Le Président Hays et M. Paul C. Bélisle ont été
reçus en audience par Sa Majesté Norodom
Sihanouk et ont participé à une série de
rencontres avec les responsables suivants :

A highlight of the visit to the Kingdom of
Cambodia was an audience with His Majesty
Norodom Sihanouk. In addition, Speaker Hays
and Mr. Bélisle had numerous other meetings
and discussions with various politicians and
officials. Among these were: Her Excellency
Mrs. Ty Borasy, Chairperson of the Fifth
Senate Commission, and several other
honourable senators.
L’un des temps forts de ce séjour au Royaume
du Cambodge a été l’audience accordée par
Sa Majesté Norodom Sihanouk. Le Président
Hays et M. Bélisle ont eu de nombreux autres
entretiens avec divers responsables politiques
et dignitaires, dont Son Excellence Mme Ty
Borasy, présidente de la Cinquième
commission sénatoriale, ainsi que plusieurs
autres honorables sénateurs.

Another feature of the visit was a Canada
Cambodia Legislative Support workshop. Mr.
Paul C. Bélisle held a private exchange with his
counterpart, Secretary General of the Senate,
Oum Sarith. The delegation also visited a CIDA
health and nutrition project in Kandal province
and a UNESCO heritage site in Siem Reap.
L’atelier d’appui législatif Canada-Cambodge a
été un autre moment important de ce séjour.
M. Paul C. Bélisle a eu un échange privé avec
son homologue, Oum Sarith, Secrétaire
général du Sénat. La délégation a pu visiter un
projet de soins de santé et de nutrition de

People's Party (CPP), His Excellency Chea
Sim

After expressing his gratitude to Canada for
development assistance over the years,
particularly in Pursat province, His Excellency
Chea Sim praised Canada for its participation
in the Canada Cambodia Legislative Support
project. Excellency Chea also requested
increased cooperation between the two
legislatures, partly in the form of "scholarships",
or training for human resources.
Après avoir remercié le Canada pour l’aide au
développement fournie au fil des ans,
notamment dans la province du Pursat, Son
Excellence Chea Sim a salué la participation
canadienne au projet d’appui parlementaire
Canada-Cambodge. M. Chea a demandé un
accroissement de la coopération entre les deux
assemblées législatives, notamment sous la
forme de « bourses », ou encore de stages de
formation pour les ressources humaines.
He then proceeded with an unprompted
explanation of the political negotiations now
underway, as seen by the CPP. He claimed
that the CPP was prepared to have the King
mediate but signalled that this would be after a
basic agreement had been secured on
distribution of key positions in the new
executive and legislature. CPP appears to be
standing firm that Hun Sen must remain Prime
Minister.

The principal theme of the discussion with HRH
Prince Ranariddh was the negotiating process
to resolve the dispute over the formation of the
new government. Prince Ranariddh explained
that while the Royalist FUNCINPEC Party
understood it was the CPP's right to propose
the cabinet, since that party had won the most
seats in the election, it was nonetheless the
right of the opposition to refuse such a
proposal. He suggested the best result would
be to have CPP in the executive with
FUNCINPEC and its "Alliance of Democrats"
partner, Sam Rainsy Party, sharing the top
seats in Parliament. FUNCINPEC seemed less

Mr. Sam Rainsy, and his wife, Tioulong
Saumura were pleased to have the opportunity
to share their views with Speaker Hays at this
delicate moment in Cambodian politics. They
explained their frustration with the current
parliamentary system. Under the present rules,
the passage of legislation requires a two-thirds
majority vote with 70% of members present.
While the SRP would like to negotiate terms for
an accommodation with CPP, Mr. and Mrs.
Rainsy claimed that they had been excluded
thus far from participating in the negotiations.

Note: One week following the working visit, the
"Alliance of Democrats" invited all foreign
missions in Cambodia to declare their
opposition to any resort to violence on the part
of the CPP should it become frustrated by
stalled negotiations. The "Alliance" was
seeking assurances, that the international
community would protest any breakdown in
civil order. During our meeting, the SRP
representative seemed to imply that they were
prepared to drop their pre condition regarding
Hun Sen's departure as Prime Minister, but
insisted that Hun Sen demonstrate he would
accept the other demands of SRP.
Note : Au cours de la semaine qui a suivi cette
visite de travail, l’« Alliance des démocrates » a
invité toutes les missions étrangères en poste
au Cambodge à déclarer leur opposition à tout
recours à la violence de la part du PPC, si
celui-ci s’avérait exaspéré par le blocage des
négociations. L’« Alliance » cherchait à obtenir
des assurances que la communauté
internationale protesterait contre toute rupture
de l’ordre civil. Au cours de notre rencontre, le
représentant du PSR semblait dire que son
parti serait disposé à ne plus exiger comme
préalable le départ de Hun Sen en tant que
premier ministre, mais il a insisté pour dire que
Hun Sen devrait se rendre aux autres
exigences du PSR.

The Speaker and the Clerk of the Senate were
graciously received by His Majesty Norodom
Sihanouk.

As Head of State, the King is playing a critical
role in the political dispute over the formation of
the new government. He is the father of the
Leader of the Royalist FUNCINPEC Party.

In addition to speaking about his life, the
history of Cambodia and his views on the
various party leaders, HM King Sihanouk
indicated that he would be prepared to mediate
at any time, on receipt of a letter asking him to

In meetings with the Chairs of the Senate
Commissions, notably the Commission on
Foreign Affairs, Speaker Hays discussed the
functions, roles and budgets of Cambodia’s
Upper House and agreed to provide more
assistance to the Cambodian Parliament in the
form of books and possible exchanges. He also
indicated that he would welcome a return visit
by the Cambodian Speaker.

commissions sénatoriales, dont celle des
affaires étrangères, le Président Hays a discuté
des fonctions, des rôles et des budgets de la

Canada Cambodia Legislative Support
Workshop

The Royal Kingdom of Cambodia is currently
involved in a legislative support project with
Canada, funded by CIDA and administered
through the Parliamentary Centre of Canada.
The goal of the Cambodia Canada Legislative
Support Project (CCLSP) is to contribute to
good governance and democratic development
in Cambodia. Three main outcomes are
anticipated:
Le Royaume du Cambodge et le Canada
conduisent actuellement un projet d’appui
parlementaire financé par l’ACDI et administré
par le Centre parlementaire du Canada.
L’objectif du Projet d’appui parlementaire
Cambodge-Canada (PAPCC) est de contribuer
à la bonne gouvernance et au développement
démocratique au Cambodge. Trois résultats
principaux sont attendus :
1. Enhanced capacity of the National
Assembly, the Senate and their
Commissions to effectively draft and
review legislation;
2. Increased responsiveness of MPs to
their constituents;
3. Improved capacity of the Secretariats
to manage, administer and support the
work of the National Assembly and
Senate.

The Speaker and Clerk joined in a workshop
attended by Oum Sarith, Secretary General of
the Senate of Cambodia, and an exceptionally
large number of staff members who wished to
discuss how the Senate functions in Canada
and, in particular, the role of the support staff at
all levels.
Le Président et le Greffier se sont joints à un
atelier auquel assistaient Oum Sarith,
Secrétaire général du Sénat du Cambodge,
ainsi qu’un nombre exceptionnellement

Both the Speaker and the Clerk spoke of
Canada’s model of politically neutral service to
parliamentarians. A lively question and answer
period ensued. While the Cambodian
participants demonstrated a genuine interest in
all matters, discussion centred on
parliamentary procedure, constitutional matters
and the division of power.

The Clerk also took the opportunity to meet
separately with his counterpart to discuss the
possibility of future cooperation.

A tour of a CIDA Health and Nutrition project
and the UNESCO heritage site temple complex
at Siem Reap allowed the Speaker and the
Clerk an opportunity to appreciate in a concrete
way the needs of the Cambodian people.
La visite du projet de soins de santé et de
nutrition de l’ACDI, ainsi que du complexe des
temples Siem Reap inscrit au patrimoine de
l’UNESCO a permis au Président et au Greffier
de constater concrètement les besoins du
peuple cambodgien.

Conclusion
Conclusion
The working visit helped to advance an
awareness within the Cambodian government
of Canada as a modern, democratic country.
From the Canadian perspective, the Speaker
and Clerk gained a perspective on recent
political developments within the Kingdom. It
also received positive coverage in the
Cambodian media.
Cette visite de travail a fait avancer, au sein du
gouvernement cambodgien, la connaissance
du Canada en tant que pays moderne et
démocratique, tandis que le Président et le
Greffier ont pu mieux comprendre les récents
événements politiques survenus au Royaume

In closing, the Speaker wishes to thank HM
Norodom Sihanouk for his warm welcome to
the Kingdom of Cambodia. He also extends his

President of the Cambodian Senate and leader
of the Cambodian People's Party (CPP), HRH
Prince Norodom Ranariddh, President of the
National Assembly and Leader of the Royalist
FUNCINPEC Party, and to Mr. Sam Rainsy
