Some background.
The Quebec Act respecting the professional status and conditions of
engagement of performing, recording and film artists (S.Q. 1987, c. 2; R.S.Q. ,
c. S-32.1) applies to artists and to producers who retain their professional
services in the following fields of artistic endeavour:
(a)
the stage (including theatre, opera, music, dance and
variety entertainment)
(b)
the making of films,
(c)
the recording of discs and other mode of sound recording,
(d)
the dubbing, and
(e)
the recording of commercial advertisement.
An "artist" means any natural person who practises an art on his own account
and who offers his services for remuneration, as a creator or performer in any
field of artistic endeavour. However, the services of the artist can be furnished
through a business firm. An artist who regularly binds himself to one or several
producers by way of engagement contracts pertaining to specified
performances is deemed to practice an art on his own account.
This Act is binding on the Crown but does not apply to a person whose
services are retained for an occupation contemplated by a certification

granted under the Labour Code (R.S.Q., c. C-27) or a decree passed under
the Act respecting collective agreement decrees (R.S.Q., c. D-2).
Every artists' association which is a professional syndicate (see Professional
Syndicates Act; R.S.Q., c. S-40) or an association having a similar object and
which comprises the majority of artists in any negotiating sector is entitled to
recognition.
Once recognized, the artists' association become the sole representaive of
the Artists in the negotiating sector concerned This artists'' association is then
empowered to, inter alia,
(a)
defend and promote the economic, social, moral and
professional
interests
of the artists;
(b)
to represent the artists;
(c)
to fix the dues for the artists and collect them;
(d)
to establish model contracts;
(e)
to negotiate a group agreement;
The recognition procedure and the negotiation of group agreement is set out
in the Act
The Act respecting the Professional status and Conditions of Engagement of
Performing, Recording and Film Artists also established an administrative
tribunal under the name "Commission de reconnaisssance des associations
d'artistes", the principal duties of which are:
(a)
to decide any application for recognition submitted by an
artists' association;
(b)
to define a negotiating sector
(c)
to decide as to the conformity to this Act of the by-laws of
recognized associations regarding membership requirements and
see to it that the associations enforce those by-laws;
(d)
to appoint a mediator at the request of a party to the
negotiation of a group agreement;
(e)
to arbitrate any dispute submitted to it jointly by the parties
negotiating a group agreement;
(f)
to advise the Minister on any matter relating to the
administration of this Act, particularly on the implementation of
appropriate measures to foster protection of the professional
status of artists in harmony with the development of production
entreprises.
Furthermore, the Commission de reconnaissance des associations d'artistes
established by the Act respecting the Professional status and Conditions of
Engagement of Performing, Recording and Film Artists has similar duties and
powers under the Act respecting the professional status of artists in the visual
arts, arts and crafts and literature, and their contracts with promoters (S.Q.
1988, c. 69; R.S.Q., c. 32.01), which covers the following fields:
(a) visual arts (painting, sculpture, engraving, drawing, illustration,
photography, textile arts, installation work, performance, art video
and the like);
(b) arts and crafts (which are conveyed by the practice of a craft
related to the working of wood, leather, textiles, metals, silicates
or any material);
(c) literature (i.e., a written work, be it a creation or a translation).
Both acts provides for offences and penalties. The Act respecting the
professional status of artists in the visual arts, arts and crafts and literature, and
their contracts with promoters (S.Q. 1988, c. 69; R.S.Q., c. 32.01), however,
provides also to the compulsory form and content of individual contracts
between artists and promoters.

heard, as artistic interpreters in all areas of artistic production, to
the exclusion of artists who pratice the art of instrumental music in
all areas of artistic production, including all persons who sing with
the accompaniment of a musical instrument for the instrumental
part of their performance, and this, int he territory of Quebec, and
to the exception of productions made and carried out in English
and intended mainly for English-speaking audiences, and without
restricting the generality of the foregoing, all persons acting in
one of the functions or one of the following capacities: actor,
host, announcer, circus artist, variety artist, stuntman, singer, choir
master, troop leader, columnist, clown, comedian, commentator,
dancer, demonstrator, fortune teller, folklorist, illustrator, imitator,
interviewer, reader, magician, master of ceremonies, technician,
model, puppeteer, mime, narrator, panelist, reporter.

Translation: All set, costume, lighting and sound designers in the
following areas of artistic production:
stage, including the
theatre, lyrical theatre, music, dance and variety shows.
However, when a physical persons used to carry out such a
production and that, within this framework, they are otherwise
considered an employee within the meaning of the Labour
Code, whether aimed at or not by an agreement or a collective
work contract, they are excluded from the negotiating sector
covered by the present application for recognition.

Translation: All persons working on the production of documents
or audiovisual works supported by videotape in the following
functions: director of photography, cameraman, cameraman
(baby-boom, steady-cam), off line editor, head designer,
designer, costume designer, head make-up artist, make-up artist,
assistant make-up artist, head hairdresser, hairdresser, special
effects make-up artist, sound editor, set photographer, special
effects technicians in infography, scene painter and puppet
creator, when these persons carry out artistic production and
within this framework, they carry out other functions for which
they are otherwise employees aimed at by an accreditation
granted in virtue of the Labour Code (R.S.Q., c. C-27) or by a
collective work contract entered into with the producer, they are
reputed to be excluded from the negociating sector for all work
carried out.
