Les entreprises font face à une responsabilité croissante, tout
particulièrement dans les zones de conflits où se commettent les
plus importants crimes internationaux et dont les acteurs sont
souvent financés par l’exploitation et l’exportation de ressources
naturelles. Si l’impunité a prévalu jusqu’alors car il a longtemps été
considéré que le droit pénal international ne s’appliquait pas aux
opérations commerciales des entreprises transnationales, depuis
quelques années les cas de poursuites engagées à l’encontre de
sociétés qui se sont rendues complices de violation des droits de
l’homme
se
multiplient.
Dès lors, le Conseil national des barreaux a décidé d’organiser avec
l’American Bar Association (ABA) un colloque sur le thème de la
responsabilité pénale des entreprises dans les zones de conflit, le 21
mars 2013 à Paris. L’objectif est de favoriser la prise de conscience du
monde des affaires et de sensibiliser les avocats à leur devoir de conseil
ainsi que les entreprises aux risques civils et pénaux qu’elles encourent
en s’engageant dans de telles activités.

Multinationals have strong powers to influence the economic and
social fabric of fragile countries or those in conflict.
Some of them sometimes provide logistical or financial support to
military dictatorships or to regimes that do not respect human
rights.
While for a long time the norm has been to let them do this with
impunity, the number of cases against companies having made
themselves accomplices to violations of this kind is growing.
Therefore the National Bar Council has decided to organize, jointly with
the American Bar Association (ABA), a conference on the topic of the
criminal liability of corporations in areas of conflict, on 21 March 2013 in
Paris.
The aim is to help stimulate global awareness of these matters, and to
sensitize both lawyers to their duty to provide advice, and the companies
to the criminal risks they are running if they engage in this type of activity.
