Christophe Imhoos, qui assumait auparavant seul la charge des « Brèves » et dont le travail considérable a permis aux « Brèves » d’exister et de prospérer au sein de la RDAI, pourra désormais se consacrer plus particulièrement à une nouvelle rubrique « Médiation » au sein des « Brèves ». First of all, as you can see, an English version is now available. Also, the writing team of “Briefing” is growing. Mr Christophe Imhoos, who previously assumed responsibility for “Les brèves” alone and whose work has allowed it to exist and prosper within IBLJ will now be able to devote himself more particularly to a new section on mediation. Ensuite, quant à leur structure, les « Brèves » seront désormais organisées en plusieurs sections, afin d’en faciliter la lecture et de mettre davantage en évidence la participation à l’actualité de l’arbitrage international des différents acteurs de la matière: Etats et institutions judiciaires, institutions internationales, et institutions privées. Par ailleurs, outre les informations concernant les divers évènements relatifs à l’arbitrage, ainsi que les publications de sentences et d’ouvrages, les « Brèves » s’enrichissent d’une partie « législation » et également, pour chaque édition, d’une version anglaise. The Higher Court of Frankfurt am Main held, on May 12, 2007, that a partial arbitral award, which admits a claim for damages but reserves judgment regarding the amount of the damages, does not constitute a final arbitral award and, as such, cannot be the subject of proceedings for annulment before the state courts. L’exigence du caractère définitif et contraignant de la sentence, tirée de l’article 1059 du BGB, doit s’interpréter en ce sens que la sentence doit résoudre, entièrement et définitivement, un litige ou une portion séparable de celui ci. An arbitral award in the sense of art.1059 of the BGB is given where the decision of the arbitral tribunal fully and finally resolves a dispute or a separable portion thereof. A dispute arose between Aliman and Meridiana, two companies who entered into a number of contracts containing an identical arbitration clause. 437 IBLJ_05NEWS.indd 437 6/10/08 5:34:29 PM ARBITRAGE INTERNATIONAL ET AUTRES MODES DE REGLEMENT DES CONFLITS The Italian Supreme Court held, on May 25, 2007, that no procedural rule prevents a single arbitral procedure from being instituted considering that the arbitration clauses are substantially similar and the contracts are related. Thus, the Italian Arbitration Law, amended in 2006, provides that: “In the event of doubt, the arbitration agreement shall be construed to mean that the arbitral jurisdiction covers all disputes deriving either from the contract or from the relationship to which the agreement makes reference.” In addition, it provides that: “A party which does not object in its first pleadings after the acceptance by the arbitrators that the arbitral tribunal lacks jurisdiction due to the arbitration agreement being either non-existent, invalid or incapable of being performed shall be barred from applying for the award to be set aside on these grounds, save if the dispute cannot be submitted to arbitration.” En effet, la Loi sur l’Arbitrage, réformée en 2006, dispose qu’ « En cas de doute, la convention d‘arbitrage doit être interprétée comme signifiant que la compétence arbitrale porte sur tous les litiges découlant, soit du contrat, soit de la relation à laquelle l‘accord fait référence. » En outre, « Une partie qui n’invoque pas, dans la première plaidoirie suivant la formation du tribunal, l’incompétence du tribunal arbitral en raison de l’inexistence de la clause d’arbitrage, de son invalidité ou de son caractère non exécutoire, ne devrait pas pouvoir invoquer ces motifs pour s’opposer à l’arbitrage, sauf si le différend ne peut être soumis à l‘arbitrage. » Unless agreed otherwise by the parties, a single arbitral procedure should be instituted. UNITED KINGDOM: An arbitration clause in a contract allegedly induced by bribery is severable ROYAUME UNI : La corruption n’atteint pas la validité de la clause compromissoire The House of Lords ruled on October 17, 2007, in Premium Nafta Products Ltd v Fili Shipping Co Ltd that an arbitration clause in a contract allegedly induced by bribery is severable. In addition, the arguments concerning the validity of the clause must be based on facts which are specific to the arbitration agreement. Le 17 octobre 2007, la Chambre des Lords, dans une affaire Premium Nafta Products Ltd v Fili Shipping Co Ltd, a décidé que la clause compromissoire, contenue dans un contrat dont l’obtention par corruption est alléguée, devait être considérée comme séparable de ce contrat. Although captioned differently, the House of Lords’ decision is the same as Fiona Trust & Holding Corp v Yuri Privalov. Le 8 août 2007, la Cour d’appel de commerce d’Argentine (Division D), a rejeté le recours contre le refus, d’un tribunal arbitral, d’annuler ou de réviser une sentence. The Supreme Court of Justice has set aside the award rendered by the Arbitral Tribunal of Public Works in Technint Compañía Técnica Internacional SACE eI v Empresa Nuclear Argentina de Centrales Eléctricas en liquidación SA and Nucleoeléctrica Argentina SA. It held that there was no arbitration agreement between Technint and the state-owned companies. La Cour suprême a rappelé: The Supreme Court concluded that: Then, the parties had agreed, pursuant to Art.28.6 of the International Chamber of Commerce Rules, to waive appeals and that the award made would be final and binding. Yet, the Arbitral Tribunal of Public Works was dissolved on October 26, 2001 by a Decree, and the parties could continue proceedings by administrative or judicial procedures. This fact certainly grounds the decision of setting aside the award. CANADA: Quebec: Validity of online consumer arbitration agreement CANADA : Québec : Validité d‘une clause compromissoire contenue dans le lien hypertexte dans un contrat interne de consommation Ruling on a lawsuit between Dell and the Union des consommateurs, on July 13, 2007, the Supreme Court of Canada held that the validity of an arbitration agreement contained in the hyperlinked terms and conditions of an online consumer purchase order ought to have been referred to the Arbitral Tribunal at first instance. It covers international dispute settlement, both from the point of view of private international law and of public international law and thus includes inter-state disputes, especially those brought before the International Court of Justice and the WTO, the differences between an individual and a state, such as proceedings between private persons, mainly commercial arbitration, as well as various alternative modes of settlement, including negotiation and mediation. The program is co-directed by Laurence Boisson de Chazournes, Jean-Michel Jacquet, and Marcelo Kohen. Le « Geneva Master in International Dispute Settlement », co-organisé par la Faculté de Droit de l’Université de Genève et l’Institut de hautes études internationales et du développement (anciennement HEI), essentiellement en anglais, s’adresse à des étudiants ayant une Maîtrise ou un Master en droit.
