I . Augustin Ngirabatware was convicted o n 20 December 2012 by a Trial
Chamber of the tCTR. 1 The M ICT Appea ls Chamber affi rmed his co nvictions for
genocide and inciteme nt on 18 December 2014 and sentenced him to 30 years
imprisonment/
2. Ms. Mylene Dimitri of Canada represent ed Mr. Ngirabatware at trial and on
appeal.
3. On 17 Augu st 20 15, Mr. Ngirabatware signed a powe r of attorney with the
Mechanism designat ing Mr. Peter Rob inson of the United State s as his counsel for
purposes of seeking review of his conviction before the Mechanism.
4. Mr. Rob inso n is o n the List of Counsel admitted to practice before the
Mechanism .3
5. On 18 August 20 15, Mr. Robinson filed an undertaking with the Mechan ism
agreeing to serve as Mr. Ngirabatware's counsel and to respect the confidentiality of any
disclosur es made to him.
6. Mr. Ngi rabatwa re requ ests that Mr. Robinson be given acce ss to all of the
public and confide ntial material in his case. exce pt those docum ents filed by the
prosecution that rem a in cla ssified as ex pa rte. The purpo se of such acce ss is to allow Mr.
Robinson to prepare an applicat ion for review of his j udgement. Th e prep aration of such
an application requi res that Mr. Robinson have unrestricted access to protected witness
factual information as well as the legal plead ings filed in his case.
7. In the Kamuhanda case, the Single Judge held that such access should be
granted under similar circums tances." In the Brdjanin ca se. the Single Jud ge held that
such access should be granted even without a judicial o rde r in the ab sence of ex ceptional
circumstances.S
8. On 18 August 20 15. an inquiry was made to the Registry as to whe ther it was
was willi ng to provide access to Mr. Ngirebatware ' s case file without a j udicial order.
On 27 August 201 5. the Registry advised that it requ ired a judicial o rde r.
