SUMMARY
The following document, entitled Terms of Reference (TOR) Consultation Record, has been
prepared to summarize public and agency consultation completed to date relative to
preparation of TOR for completion of an environmental assessment (EA) for the long term
expansion of the Mayer Waste Disposal Site-Domestic Landfill. This document is intended to
be reviewed in conjunction with the TOR submitted in accordance with clause 6(2)(c)and
subsection 6.1(3) of the Environmental Assessment Act (EAA).

Public and agency consultation for the TOR has involved the following activities:
An initial Public Open House was held on February 15,2000 to present the conceptual
expansion of the Domestic Landfill and to solicit preliminary comments and concerns from
members of the public regarding the proposed expansion. The initial Public Open House was
advertised in both English and French languages in the Hawkesbury Tribune and the Vankleek
Hill Review (Appendix A) and in Newsletter No. 1(Appendix B). Newsletter No. 1was hand
delivered to residents of the Township of Champlain located within an approximate
2.5 kilometre radius of the Mayer Waste Disposal Site. Newsletter No. 1was also-available at
the Town of Hawkesbury and Township of Champlain Municipal Offices and was also posted
electronically on CRA's web page. The initial Public Open House attracted approximately 35
attendees (Appendix C). Attendees were informed at the initial Public Open House that
proposed TOR in both English and French languages would be available for review in the near
future. Application forms were also available for interested members of the public to apply to
become a member of a Public Liaison Committee (PLC) being formed to ensure that the public's
concerns and input are recogruzed throughout the planning process leading to the proposed
long term expansion of the Domestic Landfill. Six applications were received in response to this
solicitation (Appendix D). All six applicants were subsequently informed of their acceptance as
a member of the PLC.
Also available at the initial Public Open House were Comment Sheets intended to solicit written
input on the proposed expansion of the Domestic Landfill. Such Comment Sheets were also
available at the Town of Hawkesbury and Township of Champlain Municipal Offices. There
were no Comment Sheets submitted in response to this solicitation.

Notwithstanding the absence of written Comment Sheet submissions, the general concern
expressed by the public at the initial Public Open House to the proposed long term expansion of
the Domestic Landfill involved the need to provide municipal piped water to residents located
north of the Site, specifically, those residents located in the Carillon Gardens subdivision and
adjoining residents located along Front Road. Such residents currently rely on private wells for
potable water supply purposes. Some attendees expressed a concern that the aesthetic quality
(i.e. taste, odour, colour) of many of the private wells north of the Site has deteriorated
significantly over the past several years, leading to a perception among some residents that the
Mayer Waste Disposal Site has had an impact on groundwater quality. CRA representatives
indicated, based on several years of groundwater monitoring both on Site and in the Carillon
Gardens subdivision, that no landfill-derived parameters above the RUC criteria have been
identified (refer to Annual Reports 1995,1996,1997,1998,1999 and 2000 as listed in Appendix
I). Nevertheless, CRA representatives concurred with such observations regarding the
deterioration of aesthetic water quality. In order to address this concern, CRA representatives
committed that a further evaluation of potential hydrogeological impacts associated with
properties north of the Site (i.e. Carillon Gardens subdivision) will be completed as part of the
EA.
On March 8,2000, the proposed TOR were submitted to the Director, Ministry of the
Environment, Environmental Assessment and Approvals Branch for review by a Core Review
Team of potentially interested government agencies. The Core Review Team distribution list
and responses are included in Appendix E. Core Review Team responses to the proposed TOR
are summarized in Table 1. These TOR have been amended to include the above responses
where applicable.
Three PLC meetings have been held to date. These meetings occurred on October 26,2000,
November 21,2000 and January 10,2001. Minutes of the above PLC meetings are included in
Appendix F.
In general, PLC members have indicated that they are supportive in principle of the proposed
long term expansion of the Domestic Landfill. However, the PLC has also indicated that such

The Mayer Waste Disposal Site
(Site) is a private waste
management facility owned by
781998 Ontario Inc. located
immediately east of the Town
of Hawkesbury along Highway
17 and is geographically
situated with the Township of
Champlain (formerlythe
Township of West
Hawkesbury). The Mayer
Waste Disposal Site has since
1955 served as the only solid
non-hazardous waste disposal
facility for the Town of
Hawkesbury and has also
served other municipalities and
industries in Eastern Ontario.
The Site consists of two distinct
landfills which have historically
operated under separate
Certificates of Approval: a
Domestic Landfill (Certificate of
Approval No. A471506) and an
Industrial Landfill (Certificate
of Approval No. A471507).
Based on a decision reached in
September 1996 by the Board of
Waste Management of the
Hawkesbury and Area Waste
Management System Plan
Study (WMSPS), six short-listed
candidate sites were released
from further consideration as
potential public landfill sites.
Additionally, effective
December 30,1996, the
Hawkesbury Area WMSPS
dissolved, thus ending the
twelve-year Waste Management
Master Plan (WMMP) process
without identdying a potential
long term solid waste disposal
facility. Given the
discontinuation of the WMSPS
and the need for provision of
long term waste management
services in the greater
Hawkesbury area,
781998 Ontario Inc. has
identified an opportunity to
provide such services through a
proposed expansion of the
Domestic Landfill. A
fundamental understanding of
exisling site conditions provides
insight into the potential
feasibility of long term
expansion of the Domestic
Landfill.

The proposed long term
expansion of the Domestic
Landfill will involve eastward
expansion onto the
existing bufferlands.
The proposed expansion will be
assessed based on
hydrogeologic conditions,
adjacent land use and
environment.
The Domestic Landfill currently
operates under Certificate of
Approval No. A471506
allowing the Domestic Landfill
to continue to operate until
Approximately March 31,2001
on an emergency basis.
Continued operation of the
Domestic Landfill will permit
the approved Domestic Landfill
Remediation Plan to be fully
implemented during the
emergency period.
It is intended that the Domestic
Landfill will be expanded
following the above emergency
period to permit the approved
landfilling of non-hazardous
solid waste for a period of
twenty years.
The proposed long term
expansion of the Domestic
Landfill will require the
support of an Environmental
Assessment (EA) prior to
obtaining approval from the
Province of Ontario.
Additional approvals will be
required under the
Environmental Protection Act
(EPA), the Ontario Water
Resources Act (OWRA), the
Aggregate Resources Act
(ARA) and the Planning Act.
In order to determine whether
the concept of long term
expansion of the Domestic
Landfill is plausible from an EA
approval perspective,
781998 Ontario Inc. completed a
preplanning and
economic.
feasibility study. The results of
this study indicate that
expansion to the east onto
approved bufferlands owned
by 781998 Ontario Inc. and the
establishment of an expanded
Contaminant Attenuation Zone
is the preferred method of
expansion of the Domestic
Landfill. Proposed Terms of
Reference to complete the EA
have been prepared and will be
reviewed and commented on
by the public and government
agencies prior to proceeding
with the work plan. Additional
investigations, studies and
designs will also be completed
to determine potential
environmental impacts
associated with long term
expansion and the need for
mitigative measures.
Completion of the above work
plan will, hopefully, provide the
basis for continuation of the long
term expansion concept through
the completion of an EA.

On March 09,2000,781998 Ontario lnc. submitted a Proposed Terms of
Reference for Completion, (TOR), of an Environmental Assessment (EA) for an
Expansion in the Landfill Capacity of the Mayer Waste Disposal Site. The
proponent has defined the undertaking for which they wish to prepare an E A as
the long term expansion of the Mayer Waste Disposal SRe. If you are not the
appropriate contact person in your agency, please fonward immediately to the
appropriate coordinator and notify me of the change.
The TORsets out how 781998 Ontario Inc. is proposing to assess the potential
environmental effects of this proposal. We believe your agency has an interest

in the review of this TOR. If this is not the case, please complete the attached
"Acknowledgment of Receipt (of TOR)"form indicating that your agency's .
involvement is no longer required for this TORandlor the future EA preparation
process.
The goal of the TORis to promote early identification of potential issues relevkt
to the completion of an EA for the proposed undertaking. This is to ensure that
proponents have clear, concise direction with respect to what is required by key
regulatory agencies when preparing their €A. This step has considerable
benefits for review agencies, as it allows for early participation and provides an
opportunity to sign off on a proposal at the TORstage, ifappropriate. This
emphasis on early participation will result in a more streamlined and focused EA
for all parties involved.

Based on the information provided to the ministry regarding this TOR proposed
by 781998 Ontario Inc., and our initial consideration of the undertaking
proposed, we are interested in knowing whether you feel your agency's
mandated responsibilities would be addressed if the EA were to be completed
as proposed in the TOR. The role of the TORdocument is to provide the
applicant with an approved framework for the completion of their €A in
consideration of relevant issues. Given this, you are asked to focus your review
on the identification of any concerns your agency may have with the manner in
which 781998 Ontario Inc. is proposing to complete their EA.
Should you identify any concerns you are asked to indicate, how you feel they
could be addressed by modifying the existing TOR. Please indicate any specific
modifications to this TORnecessary to address your agency's mandated
responsibilities, and provide your comments to the Environmental Assessment &

I have reviewed the proposed Tams of Reference (TOR)submitted to EAAB on Match 9,2000
by 781998 Ontario Inc.. The proposed TORsubmitted for the preparation of an individual
Environmental Assessment for a proposed long tenn expansion in the capacity of the existing
Mayer Waste Disposal Site Domestic Landfill (Provisional C.of A. A471506) in the Township
of Champlain (formerly the Township of West Hawkesbury) in the United Countics of Prescott
and Russell. The expansion is approximately an additional 400,000 cubic metres of landfill
capacity for solid non-hazardouswaste.
The TORsets out how the applicant is proposing to assess the potential environmental effects
associated with the proposed Site expansion and includes the following:

necessary relative to the proposed easterly expansion.
New Field work will be conducted as required to ensure that any changes in environmental
conditions at the Site and its vicinity are identified and dealt with in the updated assessments.

An updated biological analysis and additional hydrageological analyses will be completed..rvith
respect to the property to the east of the existing Site, being the former Hawkesbury Transport
and Excavation Ltd. property owned by Gilles R Mayer Sanitation Ltd..
The technical studies will be completed to ensure that all potential impacts to the environment
associated with the long term expansion o f the Site area assessed and that appropriate mitigative
measures are developed and implemented as required.

In summary,the above noted studies would provide the h e w o r k to satisfactorily address the
concerns relative to potential surface water impacts h m the proposed undertaking.The
proposed Terms of Reference ielative to providing for the assessment of impacts to the surface
water regime for the proposed undertaking are considered to be acceptable to the reviewer.

Having reviewed the above noted Terms of Reference by Conestoga Rovers Associates on behalf
of their client, 78 1998 Ontario Incorporated (G. Mayer), I offer the following comments.
There are two landfills located on the Mayer Waste Disposal Site property: a domestic landfill
(A471506) and an industrial landfill (A471507). The two landfills are physically separated by a
surface water course. The proposed expansion in the landfill capacity is to the domestic landfill,
The proposed expansion is an additional 400,000 m3. The industrial landfill is presently in the
process of being closed.
The alternatives being evaluated for the expansion of the site are:
-
Expansion of the domestic landfill to the east of the existing domestic landfill. .
-
Increase the height of the existing domestic landfill.
Section 9.0 Environmental Assessment Work Plan outlines the proposed work. ITIaddition the
consultants state that other supporting documentationwill be provided of which: detailed
hydrogeological investigation and assessment of the expansion area and a design and operation
plan for the expanded area.

In accordance with your request, this office has reviewed the Draft Terms of Reference (TOR)for the
preparation and review of an Environmental Assessment (EA) Report on the proposed expansion of the
Domestic Landfill at the Mayer Waste Disposal Site located in the Township of Champlain.
The following comments are offered based on our review of the aforementioned documcnt fiom the noise
aspect.

In brief, based on the 1996 studies which were conducted for the then proposed interim expansion of the
Domestic Landfill,it would appear that the noise impacts at the homes closest to the faeility due to the
operations at the site will be minimal. However, it should be pointed out that at present we have no
knowledge of either: (a) the level of activity which will occur at the expanded facility or (b) if any of the
lands within 500 metm of the faoility has since been zoned for noise sensitive use.
In addition to the above we note that the Draft TORdo not discuss the approach which will be used in
assessing the noise impacts fiorn the apanded faeility, or, for that matter any other impacts an the
environment, Instead, the TOR(Page 9) refers to a letter which will be sent to each aiTected agency
explaining the approach which will be used in assessing the environmental impact associated with that
agency's interest. The proposal in our opinion could cause problems in tha the approaches used fir
assessing the various impacts on the environment will not be located in one central document (i.e, the
TORdocument).This in turn could lead to a lack of readily available infomation when assessing issues
involving various types of impacts on the environment.

In light of the above, we recommend that the Drafr TORbe revised to incorporate rhis central approach
Wirh regard to noise, as a minimum requirement, the Revised TORmust indicate:
(a)
The location of the nearest existing or zonedfor fiture noise sensitive land we.
(b)
The scope o f the noise studies which will be conducted when preparing the ENEPA
Reports. The studies be they qualitative or quantitative must be conducted at a level of
detail sufficientto allow for an accurate assessment of the noise impacts which will be
generated by the activities at the site as well as those due to truck trafiic along the local
haul route to the facility. The studies must address the noise impacts which will be
generated during all stages in the life of the facility, i.e. during its construction, operation
and closure.
(c)
The Noise Criteriq which will be used to assess these impacts. ~ h criteria

new or expanding landfill sites are contained in the Ministry's Technical Publication

The Consultation Process which will be used by the proponent when conducting these
noise studies. The studies should be provided to our Ministry well in advance of their
incorporation into the draft EAIEPA documents. Sufficient time must: be given the
Ministry in order to allow it to conduct a meaningful review.

PLC Mandate:
i) MB noted that the mandate of the Public Liaison Committee (PLC) is to
act as a sounding board and to provide a clear, constructive unbiased
review of the Environmental Assessment (EA) activities being
completed. The PLC represent the public and are encouraged to
communicate and discuss issues with the general public.
ii) MB noted that the purpose of this first meeting is to give the PLC an
opportunity to review and comment on the Proposed Terms of
Reference (TOR) for Completion of the EA. The TOR provide a brief
background of the Site, describe the long term expansion objectives, and
outline what studies/reviews are to be completed as part of the EA. The
proposed TOR were mailed to those people who attended the Public
Open House in February 2000. French and English copies of the TOR
were available at the PLC meeting for those who required another copy.

Long-Term Expansion Program Status:
i) MB provided the PLC with an summary of what activities in the EA
process have been completed to-date and a time line for completion of
the remainder of the EA.
ii) MB noted that the first step in the EA is to have the Site designated by
the Minister. MB stated that the Site has verbally been designated with
formal confirmation pending. (Subsequently, on November 9,2000,
formal designation was received, see letter attached).

iii) In anticipation of designation, the proposed TOR were submitted and
circulated to the Ministry of the Environment's (MOE's) EA and
Approvals Branch and Core Review Team and were posted on the
Environmental Bill of Rights (EBR) electronic registry. Comments from
the Core Review Team and EBR were appended to the copy of the
proposed TOR distributed to the PLC members.

iv) The schedule for completion of the EA was handed out to the PLC
members. A copy of this schedule is attached.
v) As the focus of this initial meeting of the PLC shifted to the issue of
groundwater quality (refer to discussion below), it was not possible to
obtain PLC comments on the proposed TOR. MB instructed that the
PLC be prepared to submit its comments at the next meeting of the PLC
(subsequently scheduled for November 21,2000).
PLC's Initial Concerns:
i) In general the members of the PLC are concerned with the groundwater
water quality north of the Mayer Waste Disposal Site, primarily in the
Carillon Gardens area.
ii) CR outlined the semi-annual monitoring program currently
implemented at the Site and generally discussed the results of the
program.
iii) RD noted that the water quality in this area has deteriorated within the
last 6 years. The PLC members agreed that even if the source of
groundwater deterioration is not the Mayer Waste Disposal Site,
something needs to be done about the quality of well water. PLC
members further suggested that municipal water needs to be supplied to
the Carillon Gardens area. MB noted that the Town of Hawkesbury is
aware of the groundwater concerns of the residents in this area. AB
suggested that the supply of municipal water to the residents north of
the Site would address both drinking water quality and fire protection.
MB suggested that the PLC should raise these issues with the Town of
Hawkesbury's and the Township of Champlain's technical
representatives. MB agreed to try and arrange this meeting.
(Subsequentlythe meeting has been scheduled for November 21,2000).

iv) In general, the PLC members stated that they currently do not have any
problems with odour, noise, dust etc. as a result of landfill operations,
however given the groundwater quality issues, they feel it will be
difficult to provided unbiased review of the TOR
Election of Chair:
i) It was mutually agreed that the decision to elect a Chair would be
postponed until the next meeting.

Purpose of Meeting:
MK thanked the participants for attending PLC Meeting No. 2. MK also
noted that four of the six PLC members (AB, SD, HM and HP) were not
present although all members had been contacted and informed of the change
in meeting date from the 23'd to the 21". HP indicated, however, that she was
not informed of the change in date. M K noted that this meeting was
scheduled at this time (12:OO p.m.) in order that MB and RL could attend at a
mutually convenient opportunity. The purpose of this meeting, as stated by
MK, was twofold: first, to fulfill the PLC's desire as noted during PLC
Meeting No. 1to meet with technical representatives of the Town of
Hawkesbury (Town) and the Township of Champlain (Township) to express
concerns regarding potable water quality (well water) issues north of the
Mayer Waste Disposal Site and, second, to finalize PLC comments on the
proposed Terms of Reference (TOR). RD and GM noted that they would
have to leave the meeting at 1:00 p.m. in order to return to work.

PLC's Concerns:
RD and GM both expressed their concern regarding the deterioration of well
water quality at residential properties located north of the Mayer Waste
Disposal Site. RD and GM both indicated that although their wells have been

tested and have been found to be acceptable relative to applicable drinking
water criteria, the aesthetic quality of such water (i.e. primarily odour, colour
and taste) is poor. This problem is reportedly common to the majority of
residents in the area. RD and GM further indicated that these issues were
first noticed several years ago and that well water quality until that time had
always been excellent. RD and GM noted that notwithstanding assurances
provided by CRA on behalf of 781889 Ontario Inc. that landfill-derived
contaminants from the Mayer Waste Disposal Site have not deleteriously
affected well water quality north of the Mayer Waste Disposal Site,
particularly in the adjacent Carillon Gardens Subdivision, there is a
perception among residents that well water quality is nevertheless affected by
an upgradient source. According to RD and GM, such sources include the
Mayer Waste Disposal Site, the Parisien property, aggregate extraction
operations, adjacent cemeteries or a combination of the above.
MK indicated that CRA does not dispute the aesthetic well water problems
experienced by residents to the north. MK also noted that lower overburden
groundwater flow is in a general northerly direction from Mayer Waste
Disposal Site towards the westerly Catholic cemetery and not towards the
Carillon Gardens Subdivision.
GM indicated that the proposed long term expansion of the Mayer Waste
Disposal Site would not, in his view, improve the current well water quality
situation. GM further noted that both the Town and Township would benefit
from the long term expansion of the Mayer Waste Disposal Site by having
access to a cost-effective solid waste disposal facility. As a contingency
measure, both RD and GM suggested that the Town and Township should
work together to extend municipal piped water to the Carillon Gardens
Subdivision and other residents in the immediate area. Both RD and GM
indicated that they are supportive in principle of the proposed long term
expansion but that their concerns regarding well water quality must be
addressed regardless of whether the proposed long term expansion is
approved or not.
MB and RL acknowledged the PLC's concerns with respect to well water
quality. MB noted that should the proposed long term expansion of the
Mayer Waste Disposal Site not be approved that well water quality issues
will continue to persist. MK indicated that it was important that the issue of
municipal piped water supply to the area be viewed not in terms of a solution
to an impairment caused by the Mayer Waste Disposal Site but as a
contingency. MB and RL both noted that the cost implications of providing
municipal piped water will need to be addressed by the Town, Township and

move forward on this issue and will apprise the new Councils of the concern
expressed by the PLC at this meeting.

Purpose of Meeting:
MB explained that the primary purpose of this meeting was to finalize any
PLC comments on the Proposed Terms of Reference. It was noted that
previous PLC meetings had focussed on the issue of groundwater quality and
the provision of municipal water to residents north of the Mayer Landfill Site
along Front Road and in the Carillon Gardens subdivision and that the
content of the Proposed Terms of Reference had not yet been addressed. In
order to accomplish this, MB asked the PLC to engage in a round-table
discussion of the Proposed Terms of Reference. Written comments, if any,
were also requested to be submitted by January 17,2001. This approach was
considered to be acceptable to the PLC.
Prior to initiating discussion on the Proposed Terms of Reference, GM
proposed that AB be appointed as Chair of the PLC. This proposal was
endorsed by the PLC and accepted by AB. AB indicated that he would be
attempting to meet with Town of Hawkesbury and Township of Champlain
staff to further discuss water provision issues.

HM and HP indicated that they had not previously received the Core Review
Team comments on the Proposed Terms of Reference. MI3 stated that Core
Review Team comments were originally issued to HM and HP on April 17,
2000 and that PLC members who attended PLC Meeting No. 1had also
received Core Review Team comments. Nevertheless, MB indicated that a
copy of the Core Review Team comments would be forwarded to HM and
HP immediately.

PLC Comments on the Proposed Terms of Reference:
All PLC members indicated that they had read the Proposed Terms of
Reference. AB, RD and GM indicated that they had no further comments
beyond those previously submitted in writing or expressed verbally at
previous PLC meetings and as documented in the Minutes of those meetings.
HM indicated that this was the first PLC meeting he had attended and that
his concerns with the proposed long term expansion of the Domestic Landfill
were related primarily to the protection of groundwater quality. HM
indicated that there is a need for a long term solid waste management facility
in the Hawkesbury area and that he is supportive in principal of the
proposed long term expansion provided that protection of groundwater
quality is adequately addressed.
SD also indicated that this was the first PLC meeting he had attended and
that his concerns were reflected in those previously expressed by RD.
HP indicated that this was the first PLC meeting she had attended. With
reference to the second paragraph of Section 2.0 of the Proposed Terms of
Reference, HP questioned the intended service area of the proposed Domestic
Landfill expansion. MB stated that the intended service area was limited to
the Town of Hawkesbury and the Township of Champlain. HP requested
that this be more clearly identified in the Terms of Reference. All PLC
members expressed an interest in defining the intended service area as the
Town of Hawkesbury and the Township of Champlain. MB concurred with
HP's comment and indicated that service area definition would be more
clearly expressed in the Terms of Reference.
MB indicated that the Proposed Terms of Reference would be amended to
reflect all PLC comments (written or verbal) expressed to date as well as any
further PLC comments received in writing by January 17,2001. The Proposed
Terms of Reference would also be amended to incorporate all Core Review
Team comments and any comments received from the public at large. MB
indicated that such amendments would be made in bold type and that a final
draft of the Proposed Terms of Reference would be circulated once again to
the PLC for final comment. PLC members would be asked to respond to the
final draft within a specified period of time, following which the Terms of
Reference would be submitted for Ministerial review and approval.

The PLC asked what the next step in the process would be following
submission of the Terms of Reference. MB indicated that the Terms of
Reference would need to be approved involving a 12 week review period.

Assessment can proceed in full. MB indicated that work on the
Environmental Assessment has already commenced in the absence of
approval of the Terms of Reference in order to meet the overall project
schedule. The purpose of the next PLC meeting would be to review the draft
Environmental Assessment report. This meeting is anticipated to occur in
March 2001.

Expansion of Mayer landfill site
I have read the documentation remitted to me and have found that the plans and intentions
are good and proper. If this is followed, and I expect they will, the results should be
satisfactory. Exce~tfor one very serious omission. There is no provision to resolve the
serious water problems of the landowners in the immediate area of the site, especially north
and north west. We are being told that there is no well contamination but we are also told
that they are aware of the smell and color problem. If this situation is not addressed in
some form or other, I cannot support this expansion and will definitely make necessary
pressures to the different levels of authority to stop this project.
