The Assessment Management Agency Act
[clause 12.1(4)(a)]

2011 equivalency assessments
Whereas:
1 Clause 2(h.2) of The Assessment Management Agency Act (the “Act”) provides that:
(h.2) “equivalency assessment”, with respect to the City of Lloydminster, means an assessment based
on an aggregated value for the city created from individual property assessments that are calculated
pursuant to clause 12(1)(l.1);
2 Clause 12.1(1)(d) of the Act requires ministerial approval of orders of the Board of Directors of the
Saskatchewan Assessment Management Agency (the “Board”) relating to determining the method for
calculating, preparing and maintaining equivalency assessments pursuant to subclause 12(1)(l.1)(ii) of
the Act.
3 The Board has made an order dated January 28, 2011 to establish a method for calculating, preparing
and maintaining equivalency assessments for Saskatchewan properties within the City of Lloydminster
for the 2011 year (the “Board Order”).
4 The Board has applied to the Minister to have the Board Order approved.
5 It is in the public interest to approve the Board Order.
Therefore, pursuant to subsection 12.1(4) of The Assessment Management Agency Act, I hereby approve

2011 Lloydminster Equivalency Assessment Formula
This is an order pursuant to subclause 12(1)(l.1)(ii) of The Assessment Management Agency Act to determine
the method for calculating, preparing and maintaining equivalency assessment for the properties located on
the Saskatchewan side of the City of Lloydminster,
For 2011, the equivalency assessments will be determined by applying the following process:
1 The Saskatchewan side of the City of Lloydminster Property Assessment Data Source to be used shall
include:
(a) the “ASSET” report (from Alberta Municipal Affairs) containing the assessments for the year
having a valuation date that corresponds to the current Saskatchewan base year (base year report);
(b) the “ASSET” report (from Alberta Municipal Affairs) containing the assessments for the current
assessment year (current year report); and
(c) the report (from Alberta Municipal Affairs) containing the current year assessments for linear
property.

2 The Equivalency Assessment Process shall consist of:
(a) using the “ASSET” reports for the applicable base year and current assessment year:
(i) match the base year report roll numbers to those in the current year report, and remove
roll numbers from the current year report that are not present in the base year report (new roll
numbers) and remove from the base year report any roll numbers not in the current year report
(those roll numbers no longer valid); and
(ii) remove from the current year report those roll numbers that represent the properties valued
under the rules for regulated property, namely Agricultural – ‘PROPERTYDESCTYPE’ = F,
Railway Right of Way – ‘PROPERTYDESCTYPE’ = NRR; and Machinery and Equipment –
‘PROPERTYDESCTYPE’ = ME. (this revised file is called the ‘Comparison File’);
(b) using the ‘PREDOM_ACTUAL_USE_CODE’ group the properties in the comparison file into one
of the five following general property groups:
(i) Vacant Commercial/Industrial Land
(1) PREDOM_ACTUAL_USE_CODE = C000000, and M000000;
(ii) Vacant Residential/Institutional Land
(1) PREDOM_ACTUAL_USE_CODE = P000000, and R000000;
(iii) Improved Commercial/Industrial/Institutional
(1) PREDOM_ACTUAL_USE_CODE = C100000, C101000, C101010, C101020, C101030,
C101080, C101090, C101100, C102010, C102020, C103000, C103020, C103030, C103040,
M100000, M101000, M101010, M101040, M101050, M101060, M101070, M106000, P100000,
P101020, P101040, P101050, P102000, P102010, P102020, P102040, and P102050;
(iv) Improved Residential/Condo
(1) PREDOM_ACTUAL_USE_CODE = R101000, R101010, R103000, R104010, R104050
and R105000; and
(v) Improved Multi-Family
(1) PREDOM_ACTUAL_USE_CODE = R102000.
(a) calculate a market activity factor being the ratio of current year’s assessments divided by the
base year’s assessments for all matched properties (i.e. indicator of property’s value change arising
from real estate market activity);
(b) using the factors calculated in (a) for each property group, compute the equivalency market factor
using the weighted mean as the measure of central tendency;
(c) statistically identify and remove those equivalency market factors for each property group that
fall outside of two standard deviations;
(d) repeat step (c) on the statistically normalized property groups and calculate the weighted mean
factor. This will be known as the equivalency adjustment factor (EAF) for each property group;
(e) using the properties (excluding Alberta based assessments for Machinery and Equipment) from
the original “ASSET” current year report, add the linear assessment information for pipelines and oil
wells into the equivalency calculation and then apply the property group code to all properties from
step (b);
(f) calculate the pre-equivalency assessment for each property by dividing each property’s current
year’s assessment by the EAF for that property’s property group (i.e. 2008 Assessment/EAF = 2009
Equivalency Assessment);
(g) compute the equivalency assessments by applying the Saskatchewan tax class percentages to
each property’s pre-equivalency assessment that is force for the current assessment year as set out in
the regulations under The Cities Act (Saskatchewan);

(h) calculate the total taxable and exempt equivalency assessments by Saskatchewan Tax Class;
and
(i) using the apportionment ratios provided by the school divisions prepare an equivalency assessment
report, summarizing equivalency assessments by Saskatchewan Property Tax Class, and further
delineated by school division.

En vigueur à compter du 15 décembre 2010
Prééminence de la directive de pratique: En cas de conflit ou d’incompatibilité entre la présente directive
de pratique et les Règles de la Cour d’appel, la présente directive de pratique l’emporte.
Dépôt électronique
1(1) Dans le
présent article et les articles 2 et 4, «déposant agréé» s’entend d’une personne qui a reçu
l’agrément du greffier conformément au paragraphe (3).
(2) La personne qui entend déposer un document électronique peut demander au greffier de lui décerner
le statut de déposant agréé.
(3) Saisi d’une demande présentée en vertu du paragraphe (2), le greffier peut décerner à la personne le
statut de déposant agréé, si les conditions suivantes sont réunies :
a) la personne fournit une adresse de courriel et les autres renseignements que lui demande le
greffier;
b) la personne accepte les conditions d’utilisation rattachées au dépôt électronique ou s’engage à les
respecter;
c) le greffier juge la chose opportune.
(4) Le greffier peut :
a) assujettir le déposant agréé visé au paragraphe (3) à certaines conditions;
b) retirer son approbation si le déposant agréé omet de respecter les conditions d’utilisation et celles
imposées en vertu de l’alinéa a) ou enfreint la présente directive de pratique.
(5) Le déposant agréé qui présente un document électronique pour dépôt doit :
a) présenter le document dans un format électronique qui convient au greffier et l’assortir d’une
preuve de signification;
b) à la présentation du document, payer les droits exigibles au moyen d’une carte de crédit (Visa ou
Mastercard).

(6) Un document présenté pour dépôt n’est pas déposé tant que le greffier ne l’a pas accepté aux fins de
dépôt.
(7) Une fois que le greffier a accepté que le document électronique présenté en vertu de la présente règle
soit déposé, le document, si son dépôt est conforme aux Règles, est déposé :
a) si le greffier le reçoit au plus tard à 16 heures un jour ouvrable du greffe, le jour de présentation
du document;
b) si le greffier le reçoit après 16 heures un jour ouvrable du greffe, le premier jour ouvrable suivant
du greffe;
c) si le greffier le reçoit un jour non ouvrable du greffe, le premier jour ouvrable suivant du greffe.
(8) Au moment d’accepter un document électronique, le greffier le tamponne électroniquement.
(9) Lorsqu’un document est déposé sur support papier au greffe, le greffier peut le numériser, auquel
cas:
a) il verse le document numérisé dans une mémoire électronique qu’il juge convenable;
b) il conserve le document sur support papier.
Accès à un dossier électronique
2(1) S’il le juge à propos, le greffier peut accorder aux déposants agréés suivants l’accès à un dossier de
la Cour sous forme électronique :
a) un appelant, un intimé ou un intervenant dans le dossier;
b) l’avocat ou le cabinet représentant un appelant, un intimé ou un intervenant dans le dossier;
c) un employé de l’avocat ou du cabinet visés à l’alinéa (1)b) qui est autorisé par eux à avoir accès
au dossier électronique.
(2) La partie, l’avocat ou le cabinet qui présente pour dépôt un document introductif (avis d’appel ou
motion de demande de permission d’appel) n’a pas besoin de l’approbation prévue au paragraphe (1) pour
avoir accès au dossier électronique.
(3) L’avocat ou le cabinet qui a accès à un dossier électronique en vertu des paragraphes (1) ou (2) est
tenu d’aviser immédiatement le greffier des cas suivants :
a) il cesse de représenter l’appelant, l’intimé ou l’intervenant, selon le cas;
b) il désire révoquer l’accès d’un employé.
(4) Le greffier peut annuler l’accès à un dossier électronique qu’il a accordé à un déposant agréé dans les
cas suivants :
a) le cas exposé au paragraphe (3);
b) à son avis, le déposant agréé n’a pas respecté les conditions d’utilisation ou celles imposées en
vertu de l’alinéa 1(4)a) ou a enfreint la présente directive de pratique.
Transcription
3(1) Malgré la règle 21, l’appelant n’est pas tenu de déposer un praecipe exigeant une transcription.
(2) Dans les 14 jours qui suivent la conclusion d’un accord sur les parties de la transcription qui seront
nécessaires pour l’appel, l’appelant commande une transcription complète des actes ou des parties convenues
du Service des transcriptions ou de tout autre service de sténographie judiciaire commercial dans un format
que la Cour a approuvé.

(3) L’appelant a le choix :
a) soit de déposer une copie électronique de la transcription au greffe dès réception;
b) soit de prendre les dispositions nécessaires auprès du Service des transcriptions ou du service de
sténographie judiciaire commercial, selon le cas, pour qu’une copie électronique de la transcription
soit déposée au greffe dès qu’elle est achevée et prête à déposer.
Dépôt électronique – présentation matérielle
4(1) Sous réserve du paragraphe (2), le déposant agréé qui dépose un document électroniquement doit
immédiatement après en déposer un exemplaire imprimé au greffe.
(2) Le déposant agréé qui dépose un dossier d’appel ou un mémoire électroniquement doit immédiatement
après le déposer, en trois exemplaires imprimés et reliés, au greffe.
Dépôt sur papier – présentation matérielle
5(1) La présente directive de pratique n’empêche aucunement une partie de déposer un document sur
papier au greffe.
(2) Lorsqu’une partie dépose un dossier d’appel ou un mémoire sur papier :
a) l’original n’est ni relié ni perforé;
b) les trois copies sont reliées.
Signification, adresse aux fins de signification et communications du greffier
6(1) Malgré le paragraphe 67(2) des Règles, lorsque la signification est prescrite par les Règles, les parties
peuvent l’effectuer par tout moyen prévu à la partie 3 des Règles de la Cour du Banc de la Reine, avec les
adaptations qui s’imposent.
(2) Outre les prescriptions de la règle 65, les parties à un appel doivent fournir au greffier une adresse de
courriel valable, sauf dispense du greffier.
(3) Malgré la règle 68, les avis et autres communications émanant du greffier peuvent se faire
électroniquement pourvu qu’ils soient imprimables.

Taxation
1 Pour l’application de la règle 54, une partie qui désire saisir le greffier d’une taxation de note de frais
procède de la façon suivante :
a) elle organise une séance de taxation à l’aide du formulaire A après avoir obtenu les date et heure
nécessaires du greffier;
b) elle dresse un projet de note de frais à l’aide du formulaire B;
c) elle signifie l’avis de séance de taxation et le projet de note de frais à la partie condamnée aux
dépens;
d) elle dépose au greffe l’avis de séance de taxation, le projet de note de frais et la preuve de
signification.

2 Pour l’application de la règle 57, le certificat de taxation des dépens est établi à l’aide du formulaire C.

EXTRACTS FROM THE RULES AND PROCEDURES OF THE
LEGISLATIVE ASSEMBLY OF SASKATCHEWAN RELATING TO PRIVATE BILLS

PETITIONS
14(1) A petition to the Assembly may be presented by a Member at any time during the sitting of the Assembly
by filing the same with the Clerk of the Assembly.
14(6) Petitions may be either written or printed; provided always that when there are 3 or more petitioners,
the signatures of at least 3 petitioners shall be subscribed on the sheet containing the prayer of the petition.
14(9) No petition can be received which prays for any expenditure, grant or charge on the public revenue,
whether payable out of the Consolidated Fund or out of moneys to be provided by the Assembly.
NOTE: A form of Petition can be obtained on application to the Clerk of the Legislative Assembly.
PRIVATE BILLS
75(1) All petitions for Private Bills shall be in duplicate and shall be filed with the Clerk of the Assembly
not later than the twentieth sitting day of the Session.
75(2) No petition for any Private Bill shall be received by the Assembly if presented after the first twentyfive sitting days of the Session.
75(3) No Private Bill may be introduced in the Assembly after the first thirty sitting days of the Session.
76(1) Every applicant for a Private Bill shall deposit with the Clerk of the Assembly, along with the petition
for same, 2 copies of the bill, with marginal notes inserted, and an accepted cheque payable to the Minister of
Finance for the sum of two hundred and fifty dollars, if the said bill does not exceed ten pages, and fifteen dollars
additional for each page over that number; four hundred and fifty words shall be held to constitute a page.
76(2) In the case of a bill incorporating a company, a receipt from the Registrar of Joint Stock Companies
for any statutory fees required shall also be deposited with the Clerk of the Assembly.
77 No remittance of a deposit on account of a Private Bill or any portion thereof shall be ordered by the
Assembly unless the same has been recommended by the committee charged with its consideration, or unless
the bill has been withdrawn, rejected or not reported upon, in which cases the actual expenses incurred shall
be deducted from the deposit received before making such remittance.
79(1) All petitions to the Legislature for Private Bills of any nature whatsoever, shall require a notice, clearly
and distinctly specifying the nature and object of the application, and where the same refers to any proposed
work, indicating generally the location of the work, and signed by and on behalf of the petitioners, with the
address of the party signing the same; and when the petition is for an act of incorporation, the name of the
proposed company shall be stated in the notice.
79(2) Such notice shall be published prior to the filing of the petition with the Clerk of the Assembly as
required in Rule 75(1) in 2 consecutive issues of The Saskatchewan Gazette and 4 consecutive issues of a
newspaper, published in English and having circulation in the locality affected.
79(3) A copy of the notice with a statutory declaration of the several publications of advertisement shall be
filed with the Clerk of the Assembly along with the petition and bill.
80(2) Every bill for an act of incorporation, where a form of model bill has been adopted, shall be drawn in
accordance with such model bill, copies of which may be obtained from the Clerk of the Assembly. Any provisions
contained in any such bill which are not in accord with the model bill shall be inserted between brackets and
shall be so printed.
83 When any bill for confirming any agreement is filed with the Clerk of the Assembly, a true copy of such
agreement must be attached to it.

COMMITTEE RULING
In cases where the proposed bill provides that the property to be used or occupied by the petitioner be exempt
from taxation, either in whole or in part, the petitioner must file with the Clerk of the Assembly, along with the
petition, a written statement from the local municipal authority in which the said property is situated approving
the intent of the provisions of the proposed bill which provide for the exemption from taxation.
The name of the Member who is to present the petition and Private Bill must be furnished to the Clerk of the
Assembly at the time of filing the petition. Such Member should not, of course, be a Member of the Cabinet.

14(6) Les pétitions sont écrites ou imprimées; s’il y a plus que 2 pétitionnaires, au moins 3 de ceux-ci inscrivent
leur signature sur la feuille qui expose la requête.
14(9) Ne sont pas recevables, les pétitions qui demandent que soient faites des dépenses, des subventions
ou des charges sur les revenus publics, y compris sur le Trésor ou sur des sommes allouées par l’Assemblée.
AVIS — Un formulaire de pétition est disponsible sur demande auprès du greffier de l’Assemblée législative.
PROJETS DE LOI D’INTÉRÊT PRIVÉ
75(1) Deux exemplaires des pétitions introductives de projets de loi d’intérêt privé sont déposés auprès du
greffier de l’Assemblée dans les vingt jours de séance de l’ouverture de la session.
75(2) Seules sont recevables par l’Assemblée les pétitions introductives de projet de loi d’intérêt privé qui
sont présentées dans les vingt-cinq jours de séance de l’ouverture de la session.
75(3) Les projets de loi d’intérêt privé ne peuvent être déposés à l’Assemblée que dans de les trente jours de
séance de l’ouverture de la session.
76(1) Les personnes qui demandent un projet de loi d’intérêt privé déposent auprès du greffier de l’Assemblée,
outre la pétition connexe, 2 exemplaires du projet de loi qui portent les notes marginales ainsi qu’un chèque
visé payable au ministre des Finances, au montant de deux cent cinquante dollars si le projet de loi est composé
d’au plus dix pages; ce montant est majoré de quinze dollars par page supplémentaire. Une page est réputée
renfermer quatre cent cinquante mots.
76(2) Si le projet de loi prévoit la constitution d’une société, le récépissé des droits réglementaires donné par
le registraire des sociétés par actions est également déposé auprès du greffier de l’Assemblée.
77 L’Assemblée ne peut ordonner la remise totale ou partielle des dépôts relatifs aux projets de loi d’intérêt
privé, sauf recommandation du comité chargé d’étudier le projet en question ou si celui-ci est retiré ou rejeté
ou encore n’est pas rapporté. Les dépenses réelles sont déduites du dépôt avant de le remettre.

79(1) Toutes les pétitions introductives de projets de loi d’intérêt privé à l’adresse de la Législature nécessitent
un avis qui expose clairement la nature et l’objet de la demande et qui est signé par les requérants et en leur
nom, avec mention de l’adresse des signataires. Les avis qui visent des travaux proposes font état de leur
emplacement; ceux qui visent une loi de constitution en société font état du nom de la société.
79(2) Les avis requis en vertu du paragraphe 75(1) sont publiés, avant le dépôt de la pétition auprès du
greffier de l’Assemblée dans 2 numéros consécutifs de la Gazette de la Saskatchewan ainsi que dans 4 numéros
consécutifs d’un journal anglais diffusé dans la région touchée.
79(3) Sont déposées auprès du greffier de l’Assemblée, outre la pétition et le projet de loi, copie de l’avis ainsi
qu’une déclaration solennelle qui atteste les diverses publications de l’annonce.
80(2) Si une formule-type de projet de loi a été adoptée, les projets de loi portent constitution des sociétés
sont rédigés selon cette formule, dont les exemplaires peuvent être obtenus chez le greffier de l’Assemblée.
Les dispositions de ces projets de loi qui ne se conforment pas à la formule-type sont indiquées et imprimées
entre crochets.
83 Une copie conforme de l’accord est annexée aux projets de loi portent ratification d’un accord, qui sont
déposés auprès du greffier de l’Assemblée.
dÉcision en comitÉ
Dans les cas où la proposition de projet de loi prévoit que les biens devant être utilisés ou occupés par le
requérant soient exempts d’impôts, que ce soit dans leur ensemble ou partiellement, le requérant devra déposer
au bureau du greffier de l’Assemblée en plus de sa pétition, une déclaration par écrit des autorités municipales
locales où se trouvent les biens en question approuvant l’objet des dispositions de la proposition de projet de
loi qui prévoit l’exemption d’impôts.
Le nom du député qui présentera la pétition et le projet de loi doit être fourni au greffier de l’Assemblée lors
du dépôt de la pétition. Il est entendu que le député en question ne peut être un membre du Cabinet.

SACHEZ QUE: La date de tombée pour les soumissions à la Gazette de la Saskatchewan est le lundi
à 5 p.m., la semaine de la parution. En cas de jour férié à l’intérieur de la semaine de parution, la date de
tombée sera remise un jour avant, soit le vendredi à 5 p.m. Pour les envois de soumissions à la Gazette
par la poste, veuillez prévoir une semaine au complet. La parution de tout matériel reçu en retard sera
remise au numéro de la semaine suivante.
Tous les documents qui paraîtront dans la Gazette de la Saskatchewan doivent être soumis électroniquement
(WordPerfect ou Word) et accompagnés d’une copie papier signée et envoyée au bureau de l’Imprimeur
de la Reine, ministère de la Justice de la Saskatchewan, B19-3085, rue Albert, Regina SK S4S 0B1,
tél. 306-787-2367, ou par courriel: [email protected].
Chaque document ou disquette doit être complet, conformément aux normes de parution, et doit être séparé
de la lettre d’accompagnement. Les signatures sur les documents doivent être dactylographiées ou écrites
lisiblement en lettres moulées et doivent apparaître immédiatement en dessous de la signature écrite.
Le paiement d’avance est exigé pour TOUS les avis placés dans la Gazette de la Saskatchewan par les clients
non gouvernementaux. Les chèques ou les mandats doivent être établis à l’ordre du fonds renouvelable de
l’Imprimeur de la Reine. Veuillez y inclure la TPS en plus des tarifs réguliers au taux de 5 % pour chaque article
cité ci-dessous dans la catégorie « soumis à la TPS ».
