The General Secretariat will conclude 1 or more contracts for an initial duration of 1 year, which may be renewed up to 3
times, each time for a period of 1 year.
Each separate lot for this procedure will be awarded separately. The purpose of the contract(s) is to procure various
promotional products for distribution to the general public and for more limited distribution as part of certain specific actions
in order to promote the image of the Council of the European Union and the European Council.
With an aim to encourage ethical and sustainable trade, the products, if indicated in the tendering specifications, must be
environmentally friendly ('eco-friendly'), i.e., manufactured using environmentally friendly materials (recycled, biodegradable
or organic) or sustainable production methods and they must not contain substances that may be hazardous to the health.
The General Secretariat reserves the right to award the 22 lots to 22 different tenderers, to only 1 tenderer or not to award any
of the lots.
Candidates must clearly specify the lots for which their request to participate is being submitted. Please note that the
functional and technical specifications will be indicated in more detail in the tender documents to be sent to the selected
candidates in the second phase of the tendering procedure.

The precise quantities of products to be ordered will depend on the rhythm of day-to-day activities and the frequency of
specific events to be organised; therefore it is not possible to specify exact numbers. The following approximate figures, which are based on planned or recurrent events, are provided for information only: regular
information visits attract approximately 20 000 visitors per year and other public events approximately 8 000 visitors, providing
an overall cost estimate of 60 000 EUR–90 000 EUR per year. Therefore, for each lot, the tendering specifications will allow
tenderers to submit different prices for different ranges of (estimated) quantities that could be ordered.

Participation is open to any legal entities participating individually or as part of a grouping of candidates.
1. Groupings:
If a grouping is awarded the contract, it does not need to take a particular legal form for contract performance.
However, all grouping members (i.e. lead company and all other partners) must be jointly and severally liable vis-à-vis the
contracting authority and undertake jointly to perform the contract.
Groupings must state the name of the lead company (joint representative) and the sole contact person, responsible for the
follow-up of the procurement procedure. They must also submit a copy of the documents (proxy) authorising this company and
its legal representative to submit a request to participate, to tender or to sign a contract on behalf of the grouping.
All members of the grouping must provide the documents indicated in points III.2.1, III.2.2 and III.2.3.
2. Subcontracting:
Tenderers wishing to subcontract must state in their offer the parts of the supplies to be subcontracted and give details of the

In accordance with Articles 93 and 94 of the Financial Regulation applicable to the general budget of the European Union,
candidates will be excluded from participating in the contract if they:
(a) are bankrupt or being wound up, are having their affairs administered by the courts, have entered into an arrangement with
creditors, have suspended business activities, are the subject of proceedings concerning those matters, or are in any analogous
situation arising from a similar procedure under national laws or regulations;
(b) have been convicted of an offence concerning their professional conduct by a judgment which has the force of 'res judicata';
(c) have been guilty of grave professional misconduct proven by any means which the contracting authorities can justify;
(d) have not fulfilled their obligations to pay social security contributions or taxes in accordance with the legal provisions of
their country of residence or with those of the country of the contracting authority, or those of the country where the contract
is to be carried out;
(e) have been the subject of a judgement which has the force of 'res judicata' for fraud, corruption, involvement in a criminal
organisation or any other illegal activity detrimental to the Union's financial interests;
(f) are currently the subject of an administrative penalty (exclusion from contracts financed from the budget of the European
Union for a maximum period of 10 years):

— either because they have been guilty, during another contract procedure, of misrepresentation in furnishing the information

In addition, candidates will be excluded from contract award if, at the time of the procurement procedure for this contract,
they:
(g) are in a situation where interests conflict;
(h) are guilty of misrepresentation in furnishing the information required by the contracting authority in order to take part in
the contract, or have not furnished said information.

submitted proving this person's powers of signature), clearly specifying that they are not in any of the situations mentioned in

1. General remarks:
The aim of this notice is to have interested parties submit requests to participate (applications). Only those candidates selected
on the basis of the requirements in this notice shall be invited to tender and, thus, will be sent the documents relating to the
invitation to tender. No additional documentation is available for candidates at this stage of the procedure.
There is no charge for taking part in this contract procedure. The specifications will therefore be available free of charge to
