OPENING
Call to order by Mayor Barton at 7:00 p.m.
Mayor Barton stated that the purpose of this special meeting of Council was to consider the
proposed Drainage Engineer’s Report known as the Gauthier Municipal Drain, as prepared
by Mr. Pascal Pitre, with respect to the petition for a drainage scheme as filed by Mr.
Robert Gauthier owner of the subdivision “Place Rivièra”.
Mayor Barton stated that the property owners within the drainage basin, as identified by Mr.
Pitre, had all received a copy of the Engineer’s Report and explained to the pubic in
attendance that the purpose of this meeting was to consider the proposed works and not
the issue of individual costs assessed against the property owners. Mayor Barton
continued by stating that should the Township Municipal Council adopt the Engineer’s
Report in two (2) readings, as required by the Drainage Act, that a court of revision would
be convened by the Township of Champlain which would consider any appeals regarding
the assignment of costs for the construction of the proposed municipal drain.
Mayor Barton subsequently introduced Mr. Pascal Pitre, author of the Drainage Report,
including Mr. Michel St-Jean, C.E.T., Drainage Superintendent for the Township of
Champlain.
Mr. Pascal Pitre proceeded to mention that a petition was filed by Mr. Robert Gauthier with
the Township of Champlain on February 11th, 2003 for drainage works and the Municipal
Council subsequently appointed his engineering firm with the responsibility of preparing the
Engineer’s Report. Mr. Pitre stated that a site meeting was held on March 23rd, 2004 with
the abutting landowners only to the proposed municipal drain.
Mr. Pitre stated that the existing ditch is reflective of a “natural watercourse” and in
preparing his report designated the ditch including the undefined water flow on Mr. Dorila
Cusson’s land as a municipal drain outleting to the Ottawa River.
Mr. Pitre also stated that he had inquired if other property owners upstream were interested
in having designated the existing ditch south of County Road Number 24 as a municipal
drain and stated that no interest had been demonstrated.

Mr. Pitre stated that his first function was to determine the drainage basin and that the
Drainage Act establishes how to distribute costs between benefit and outlet liability. Mr.
Pitre stated that this meeting was to discus the physical aspect of the drain and that the
issue of costs are considered by the court of revision to be established by the Township
Municipal Council. Mr. Pitre stated that the distribution was proportioned 40% benefit and
60% outlet liability.
After Mr. Pitre’s presentation, Mayor Barton requested comments from the persons present
and the following general comments were made:

that the drainage problem should be resolved by the
subdivider, being Mr. Robert Gauthier;
stated that he had the highest assessment of costs, being
approximately $10,000 and that these costs should also be
borne by the subdivider;
that the Municipality should be responsible for the maintenance
of the ditch or other alternatives should be evaluated;
stated that has never seen a ditch on Mr. Cusson’s property
(Mr. Pitre later mentioned that Ms. Seguin was correct and that
there appears to never have been a ditch on Mr. Cusson’s
property);
stated he was against the Engineer’s Report and any problem
of drainage should be the full responsibility of the subdivider.
Mr. Cusson also stated that the proposed ditch on his land
does not account for a culvert in order to gain access to the
remainder of his lands. Mr. Cusson also stated that Mr.
Gauthier should provide a drainage ditch on his lands directly
to the Ottawa River. (Mr. Pitre stated that he believed the
culvert was on his lands but is now aware that it is located on
the lands of Ontario Hydro and that the Report would have to
be amended to provide for a culvert for crossing);
stated that before the construction of the subdivision that this
area was the lowest point and also mentioned that it should be
the responsibility of the subdivider;
stated that when he purchased the property he had the Hydro
and other easements removed prior to acquisition and did not
want a future easement on his property, being 12 meters wide,
for this drain;
stated that he was representing the owner, Mr. Ron Firek, and
thought that drainage of the property was towards the Smith
Drain (Mayor Barton stated that he would request the Engineer
to discuss this issue with Mr. Charrette during the recess of the
meeting);
why was he not made aware of a potential drainage problem
when he acquired his property from the subdivider;

Mr. Vernon Graves -
stated that he believed the petition was invalid because,
according to his calculation, only represented approximately
35-45% and did not meet the required 60% for a valid petition
for drainage purposes. (Messr. Pitre and St-Jean explained
that for a valid petition 60% of the area requiring drainage
qualifies for a valid petition and not 60% of the drainage basin,
however, Mayor Barton requested Mr. Pitre to verify if the
petition meets the requirements of the Drainage Act for a valid
petition).
Mr. Robert Gauthier -
stated that he had a right for drainage even if his lands were
not a residential subdivision but a vacant field for a farmer and
further stated that he had only seven (7) percent of the water
meaning that he was receiving ninety-three (93) percent of the
water from upstream property owners. (Mr. Pascal Pitre later
corrected this statement by mentioning that approximately
seven (7) percent was an increase in water being drained by
Mr. Gauthier as a result of his lands being a residential
subdivision in comparison to a vacant field);
the Municipality should have done the drainage and the
Township be responsible for the costs;
does not want a 12 meter right-of-way on his vacant parcel of
land;
stated that she was concerned as to how the drainage of these
lands would affect her private well (Mr. Pitre stated that
although not being a hydrogeologist that he did not foresee any
problems as it relates to the proposed municipal drain);
stated that he had been requesting drainage of his lands (on
County Road No. 4) for the past four (4) years with nothing
being accomplished and stated that he did not send his water
there. (Mayor Barton stated that the Clerk and himself have
discussed this issue with the County Roads’ Engineer who is
to be completing road ditching along County Roads No. 4 and
24 that will be sending the water into the proposed municipal
drain).

Mayor Barton concluded the meeting by stating that the Municipal Council would not be
adopting this evening the Engineer’s Report in two (2) readings due to the issue of reverifying if the petition filed is valid under the Drainage Act. Mayor Barton also indicated
that once this is completed that a second public meeting would be held and that all property
owners would again be invited to attend. Mayor Barton also stated that the Municipal
Council is simply an agent of the Province of Ontario as it relates to the provisions of the
Drainage Act and are required to consider any requests for drainage if it complies to a
petition filed under the Act.
Mayor Barton subsequently invited Mr. Michel St-Jean to explain the process of appeal.
Mr. St-Jean stated that once Council adopts the Engineer’s Report on the assumption that
the petition is valid, the Municipality must appoint a court of revision to consider any
appeals as to costs. Mr. St-Jean stated that the Clerk will notify all property owners of the
date, time and location of the court of revision, however, any property owner may appeal
directly to the Ontario Drainage Tribunal. Messrs. St-Jean and Lefebvre also mentioned
that the petitioner of the drain, being Mr. Robert Gauthier, could also appeal to the Ontario
Drainage Tribunal.
Mayor Barton concluded this portion of the meeting and re-iterate that all owners would be
advised of the second meeting to consider this proposed municipal drain.

Tender Results - Diesel Tractor with Snow Blower
The Clerk-Treasurer presented to Council the tender bids received and after a brief
discussion, it was

being Curran Farm Equipment Limited, at their quoted price of $ 43,991 exclusive of taxes

equal portions for the fiscal years 2004, 2005 and 2006.

Ritchance Bridge
The Clerk-Treasurer submitted the recommendation of Mr. Gaetan Lascelles, P.Eng., with
respect to bridge inspection, soil tests including considering various alternatives for either
bridge extension or replacement by a culvert and after discussion, it was

located at 968 Pleasant Corner Road East that the property owner accepted the offer at the
price of $36,000.00.

OUVERTURE
À 19 h 00, le Maire Barton procédait à l’ouverture de la séance.
Le Maire Barton indiquait que l’objectif de cette réunion extraordinaire du Conseil consistait
à discuter du rapport d’ingénierie du drainage proposé, connu sous le nom du drain
municipal Gauthier, tel que préparé par M. Pascal Pitre, concernant la demande d’un
système de drainage déposée par M. Robert Gauthier, propriétaire de la subdivision “Place
Rivièra”.
Le Maire Barton indiquait que les propriétaires à l’intérieur du bassin de drainage, tels
qu’identifiés par M. Pitre, avaient tous reçu copie du rapport d’ingénierie et expliquait au
public présent que le but de cette réunion visait à discuter des travaux proposés et non des
coûts individuels estimés rattachés aux propriétaires. Le Maire Barton poursuivait en
indiquant que si le Conseil adopte le rapport d’ingénierie lors des deux (2) premières
lectures, tel qu’il est requis par la Loi sur le drainage, un tribunal de révision sera convoqué
par le Canton de Champlain lequel devra considérer tout appel concernant l’assignation
des coûts de construction du drain municipal proposé.
Le Maire Barton subséquemment présentait M. Pascal Pitre, auteur du rapport de
drainage, ainsi que M. Michel St-Jean, C.E.T., Surintendant du drainage pour le Canton
de Champlain.
M. Pascal Pitre débutait en rappelant qu’une demande avait été enregistrée par M. Robert
Gauthier auprès du Canton de Champlain le 11 février 2003 pour des travaux de drainage
et le Conseil municipal nommait la firme d’ingénieur de M. Pitre afin de compléter un
rapport d’ingénierie. M. Pitre mentionnait qu’une réunion sur le site s’était tenue le 23 mars
2004 dont prenaient part uniquement les propriétaires adjacents concernés par ce drain
municipal.
M. Pitre indiquait que le fossé existant reflétait l’état d’un “cours d’eau naturel” et dans la
préparation du rapport désignait le fossé, ainsi que le flot indéfini sur la terre de M. Dorila
Cusson, à titre de drain municipal se déversant dans la rivière des Outaouais.
M. Pitre mentionnait qu’il s’était informé s’il y avait d’autres propriétaires en amont
intéressés à désigner le fossé actuel situé au sud du chemin de Comté 24 à titre de drain
municipal et indiquait qu’aucun intérêt n’avait été démontré.

M. Pitre indiquait que sa tâche principale était de déterminer le bassin de drainage et que
la Loi sur le drainage établissait la façon de distribuer les coûts entre les avantages et la
responsabilité de la sortie. M. Pitre mentionnait que cette réunion avait pour but de discuter
l’aspect physique du drain et que l’item traitant des coûts sera considéré par le tribunal de
révision devant être établi par le Conseil municipal du Canton. M. Pitre indiquait que la
distribution était établie de manière proportionnelle à 40% avantages et 60% responsabilité
de la sortie.
Suivant la présentation de M. Pitre, le Maire Barton demandait aux personnes présentes
de s’exprimer sur cette question et les commentaires généraux suivants furent émis :

que le problème de drainage devrait être résolu par
l’entrepreneur, soit M. Robert Gauthier;
indiquait qu’il avait obtenu l’évaluation la plus élevée, soit
approximativement 10 000,00 $ et que ces coûts soient
absorbés par l’entrepreneur;
que la municipalité devrait être responsable de l’entretien du
fossé ou que d’autres alternatives soient envisagées;
mentionnait qu’elle n’avait jamais aperçu un fossé sur la
propriété de M. Cusson (M. Pitre mentionnait un peu plus tard
que Mme Séguin n’avait pas tort et qu’il semblait n’y avoir
jamais eu de fossé sur la propriété de M. Cusson);
mentionnait qu’il était contre le rapport d’ingénierie et que tout
problème de drainage devrait être l’entière responsabilité de
l’entrepreneur. M. Cusson mentionnait de plus que le fossé
proposé sur son terrain ne tient pas compte d’un ponceau de
façon à accéder au reste de ses terres. M. Cusson mentionnait
aussi que M. Gauthier devrait fournir un fossé de drainage sur
ses terrains s’écoulant directement vers la rivière des
Outaouais. (M. Pitre soulignait qu’il croyait que le ponceau était
sur ses terrains mais est au courant maintenant qu’il est situé
sur les terrains d’Hydro Ontario et que le rapport devra être
modifié afin d’y inclure un ponceau pour traverser );
soulignait qu’avant la construction de la subdivision cette
région se situait au plus bas point et que le drainage devrait
être la responsabilité de l’entrepreneur;
mentionnait que lorsqu’il a effectué l’achat de sa propriété il
avait fait retiré la servitude d’Hydro Ontario et tout autre
servitude et qu’il ne voulait pas d’une autre servitude, soit 12
mètres en largeur, pour ce drain;
mentionnait qu’il agissait au nom d’un propriétaire, M. Ron
Firek, et croyait que le drainage de la propriété se dirigeait vers
le drain Smith (le Maire Barton indiquait qu’il demanderait à
l’ingénieur de discuter de ce sujet avec M. Charest pendant la
pause de cette réunion);
pourquoi n’avait-il pas été avisé par l’entrepreneur d’un
problème potentiel de drainage lors de l’achat de sa propriété;

mentionnait qu’il croyait que la demande était invalide parce
que d’après ses calculs elle représentait approximativement 35

expliquaient que pour une demande valide , 60% de la région
requérant le drainage se qualifiait et non 60% du bassin total,
toutefois, le Maire Barton demandait à M. Pitre de vérifier si la
demande rencontre les exigences de la Loi sur le drainage).
M. Robert Gauthier -
soulignait qu’il avait droit au drainage même si ses terrains ne
constituaient pas une subdivision résidentielle mais un terrain
vacant pour un fermier et indiquait de plus qu’il avait seulement
sept (7) % de l’eau signifiant qu’il recevait quatre-vingt-treize
(93) % de l’eau de propriétés en amont. (M. Pascal Pitre
corrigeait plus tard cette affirmation en indiquant
qu’approximativement sept (7) % constituait une augmentation
de l’eau drainée par M. Gauthier en raison de ses terrains
modifiés en subdivision résidentielle en comparaison à un
terrain vacant);
la municipalité aurait du effectuer le drainage et le Canton
prendre la responsabilité des coûts ;
ne veut pas un droit de passage de 12 mètres sur son terrain
vacant ;
indiquait qu’elle était inquiète des conséquences de ce
drainage sur son puits privé (M. Pitre soulignait que même s’il
n’était pas hydrologiste qu’il ne voyait aucun problème relié au
drain municipal proposé);
mentionnait qu’il avait demandé le drainage de ses terres (sur
le chemin de Comté 4) depuis quatre (4) ans sans que rien ne
soit accompli et indiquait qu’il n’envoyait pas d’eau à cet
endroit. (Le Maire Barton indiquait que le greffier et lui-même
avaient eu des discussions concernant ce problème avec
l’ingénieur des chemins de Comté et qu’il était à compléter
l’approfondissement de fossés le long des chemins de Comté
4 et 24 qui enverront l’eau vers le drain municipal proposé).

Le Maire Barton mettait un terme à la réunion en indiquant que le Conseil municipal
n’adopterait pas le rapport d’ingénierie en deux (2) lectures ce soir en raison de la
vérification de la validité de la demande en conformité à la Loi sur le drainage. Le Maire
Barton soulignait aussi que lorsque les vérifications auront été effectuées une deuxième
réunion publique se tiendra et que tous les propriétaires seraient de nouveau conviés à y
assister. Le Maire Barton indiquait de plus que le Conseil municipal est simplement un
agent de la province de l’Ontario en ce qui concerne les provisions de la Loi sur le drainage
et le Conseil doit considérer toutes demandes de drainage en conformité avec cette Loi.
Le Maire Barton invitait par la suite M. Michel St-Jean à expliquer le processus d’appel.
M. St-Jean mentionnait que lorsque le Conseil adoptera le rapport d’ingénierie, en
assumant que la demande est valide, la municipalité doit nommer un tribunal de révision
afin de traiter tous les appels concernant les coûts. M. St-Jean indiquait que le greffier
avisera tous les propriétaires de la date, de l’heure et de l’endroit de la rencontre du
tribunal de révision, toutefois, tout propriétaire peut en appeler directement au tribunal de
drainage de l’Ontario. Messieurs St-Jean et Lefebvre mentionnaient aussi que le
demandeur, M. Robert Gauthier, pourrait aussi en appeler auprès du Tribunal de drainage
de l’Ontario.
Le Maire Barton terminait cette portion de la rencontre en réitérant que tous les
propriétaires seraient avisés des coordonnées de la réunion concernant ce drain municipal
proposé.
