MERCER COUNTY BOARD OF EDUCATION Regular Session - October 12, 2010 Seminar Center LOCAL SCHOOL IMPROVEMENT COUNCIL SESSIONS The Board members met with the Local School Improvement Councils of the following schools on Tuesday, October 12, 2010, at 6:00 PM in the Mercer County Technical Education Seminar Center: Bluefield High Montcalm High PikeView High Princeton High Mercer County Technical Education Center Dr. Akers presented a brief overview of items completed since the last meeting. The principals introduced members of their school councils. The LSIC session was concluded at 7:50 PM. A brief recess was taken, and the meeting reconvened in regular session at 8:10 PM. Members present were Gregory Prudich, Gilbert Bailey, Edward (Ted) Gillespie, Mary Alice Kaufman, Lynne White, and Deborah S. Akers, Secretary. PLEDGE OF ALLEGIANCE Roger Daniels, Administrative Assistant/Director of Human Resources, led the Pledge of Allegiance to the Flag. RECOGNITIONS / PRESENTATIONS None CITIZENS INPUT None APPROVAL OF MINUTES On motion of Mr. Bailey, seconded by Mr. Gillespie, and by a 5-0 vote, the Minutes of the regular meeting held on September 28, 2010, were approved as submitted. UNFINISHED BUSINESS None NEW BUSINESS Change Order - Swope Construction Company PikeView Middle School Board Memo #73 The original specifications for the front door hardware at PikeView Middle School called for a Precision product. In order to maintain consistency throughout the building and the county, the superintendent requested this hardware be changed to Von Duprin which is the hardware Mercer County Schools is currently installing in other schools. On motion of Mr. Gillespie, seconded by Mrs. White, and by a 5-0 vote, the Board approved the following Change Order in behalf of Swope Construction Company on the PikeView Middle School project: Revise storefront hardware manufacturer from Precision to Von Duprin. Increase of $4,344.01 Resolution to Participate in Appeal of OPEB Law Suit Board Memo #74 Mercer County previously elected to participate in litigation filed by the law firm of Bowles Rice on behalf of fifty West Virginia county boards of education against the Public Employees Insurance Agency. The Circuit Court of Kanawha County dismissed the OPEB law suit by order entered on September 23, 2010. The plaintiffs intend to appeal the Circuit Court decision to the Supreme Court of Appeals of West Virginia. On motion of Mr. Gillespie, seconded by Mrs. Kaufman, and by a 3-2 vote, the Board consented to participate in the appeal and be represented by Bowles Rice. Mr. Bailey and Mrs. White voted against the motion. The following Resolution will be signed by the superintendent and returned to Bowles Rice: RESOLUTION TO PARTICIPATE IN APPEAL OF OPEB LAW SUIT WHEREAS, the Mercer County Board of Education previously elected to participate in litigation filed by the law firm of Bowles Rice McDavid Graff & Love LLP (“Bowles Rice”) on behalf of fifty West Virginia county boards of education (“Plaintiffs”) against the Pubic Employees Insurance Agency, the Public Employees Insurance Agency Finance Board, and the West Virginia State Auditor (“the OPEB Law Suit”); and WHERE, the Circuit Court of Kanawha County dismissed the OPEB Law Suit by order entered on September 23, 2010; and WHEREAS, it is the intent of the plaintiffs to appeal to the Supreme Court of Appeals of West Virginia from the decision of the Circuit Court of Kanawha County dismissing the OPEB Law Suit; and WHEREAS, it is the desire of the Mercer County Board of Education to participate in such appeal, NOW THEREFORE BE IT RESOLVED: The Mercer County Board of Education hereby consents to participate in the appeal of the OPEB Law Suit as an Appellant and to be represented by Bowles Rice in such appeal under the same terms and conditions as the Board of Education participated in the Circuit Court proceedings. /s/ Deborah S. The motion was seconded by Mr. Prudich, and by a 2-2-1 vote, the motion failed. Mrs. White and Mr. Bailey voted against the motion and Mrs. Kaufman abstained.
