CONDITIONS OF AUTHORIZATION OF OVERFLIGHT AND LANDING ON THE TERRITORY OF THE UNION OF THE COMOROS
Article 1

Les aéronefs de nationalité étrangère ne peuvent circuler au-dessus du
territoire comorien que si ce droit leur est accordé en vertu d’une Convention
internationale ou s’ils reçoivent, à cet effet, une autorisation qui doit être
spéciale et dont la durée de validité ne peut dépasser douze mois
The aircrafts of foreign nationality cannot operate above the Comorian
territory unless such a right is granted under an international Convention or
unless they receive for this purpose, an authorization that must be special
and its validity cannot exceed twelve months

Le premier atterrissage en Union des Comores de tout aéronef de
nationalité étrangère doit impérativement se faire sur un aérodrome douanier, sauf cas particulier prévus à l’article 172 du code de l’Aviation civile
For any aircraft with foreign nationality, the first landing in the Union of the
Comoros must be absolutely done at a customs airport, except in special
case as provided in article 172 of the Code of Civil Aviation

1. Survol et/ou atterrissage non commercial

Les demandes d’autorisation de survol et/ou d’atterrissage non commercial doivent être soumises à l’Agence Nationale de l’Aviation Civile et de la
Météorologie de l’Union des Comores par écrit dix (10) jours avant la date
prévue du vol et par fax, email ou message du Réseau du Service Fixe de
Télécommunication Aéronautique (RSFTA), trois (3) jours au moins avant
la date prévue du survol et/ou de l’atterrissage en Union des Comores et
comporter les éléments suivants :
The requests of authorization for noncommercial overflight and/or landing
must be submitted to the National Agency of Civil Aviation and Meteorology
of the Union of Comoros, in writing ten (10) days before the scheduled
date of the flight, and by fax, email or AFTN message, no later than three
(3) days before the scheduled date of the overflight and / or landing in the
Union of Comoros and include the following elements :

type et immatriculation de l’aéronef ;
nature et limite de validité du certificat de navigabilité ;
références de la police d’assurance et limite de validité ;
numéro de vol ;
nom du propriétaire et/ou de l’exploitant ;
nom du commandant de bord, le nombre des membres d’équipage, le
nombre de passagers, l’identité et la qualité des personnalités à bord ;
itinéraire complet (avec les points d’entrée et de sortie du territoire
comorien), les jours et heures estimés d’arrivée et de départ ;
nature de la cargaison, quantité, poids ;
affréteur et destinataire ;
objet du vol et but de l’atterrissage

references of the insurance policy and limit of validity ;
flight number ;
name of the owner and / or the operator ;
name of the pilot-in command, the number of crew members, number
of passengers, the identity and quality of the personalities on board ;
complete itinerary (with the entry and exit points of the comorian territory), estimated days and hours of arrival and departure ;
nature of the cargo, quantity, weight ;
charterer and consignee
object and purpose of the landing
Les délais prévus dans l’introduction des demandes d’autorisation de survol
et d’atterrissage ne s’appliquent pas aux vols d’évacuation sanitaire et aux
atterrissages d’urgence pour des raisons de sécurité
The fixed deadlines in the submission of the requests for authorization of
overflight and landing are not applied to medical evacuation flights and
emergency landings for safety reasons

Les demandes d’autorisation de survol et/ou d’atterrissage pour les aéronefs
civils transportant des troupes ou ayant un chargement à caractère militaire
doivent être introduites par voie diplomatique en conformité avec les dispositions des articles 10 et 11 du présent arrêté et comporter les indications
citées à l’article 3.
The requests of authorization of overflight and / or landing for the civil
aircrafts carrying troops or with a military loading must be submitted through diplomatic channels in accordance with the provisions of
Articles 10 and 11 of this Decree and include the information specified in
Article 3

Les autorisations accordées pour les vols ponctuels sont valables pour une
durée de soixante-douze heures (72) sauf précision ou cas particulier
The authorizations granted for the punctual flights are valid for a period of

Les demandes d’autorisation pour opérer des séries de vols commerciaux
non réguliers en provenance ou en partance de l’Union des Comores doivent
être effectuées par écrit (correspondance, télécopie ou message aéronautique RSFTA) quarante-cinq (45) jours au moins avant la date prévue du
premier vol et comporter, outre les indications requises à l’article 3, les
éléments suivants :
The requests for authorization to operate a series of non-scheduled
commercial flights inbound for or outbound from the Union of the Comoros
must be done in writing (mail, fax or AFTN message) no later than forty-five
(45) days before the scheduled date of the first flight and include, in addition
to information required in article 3, the following elements :

- copie du permis d’exploitation aérienne ;
- copie de la police d’assurance, des certificats de navigabilité, d’immatriculation et d’exploitation des instruments radioélectriques de bord
des aéronefs utilisés
- nombre de vols ;
- prix de la rotation et par siège ;
- période ;
- Affréteur ;
- partenaire en Union des Comores ;
- nom et adresse complète de la personne physique ou morale représentant la compagnie aérienne en Union des Comores.

Outre les éléments spécifiés aux articles 3 et 6 ; les requêtes pour effectuer
du travail aérien doivent comporter
In addition to the elements specified in Articles 3 and 6, the requests for
aerial work operations must include :
- la lettre d’introduction de l’organisme officiel concerné (ministère,
service, organisation etc.) ;
- les zones d’évolution et altitudes ;
- les équipements spécifiques des aéronefs utilisés ;
- toutes autres autorisations obtenues.

department, organization etc.) ;
- the areas and altitudes of the flight;
- the specific equipments of the operated aircrafts;
- all other obtained authorizations.

L’exploitation de vols commerciaux réguliers est régie notamment par les
articles 324, 331, 332, 333, 334 du code de l’Aviation civile ainsi que les
Accords ou Conventions signés avec les pays tiers.
The operation of scheduled commercial flights is governed in particular by
Articles 324, 331, 332, 333, 334 of the Code of Civil Aviation as well as the
Agreements or Conventions signed with third countries.
Les compagnies sont tenues de respecter les délais prévus en matière
d’introduction et traitement de leurs demandes de vols.
Companies are required to comply with the fixed deadlines for the
introduction and processing of their flight requests.
4. Compagnies comoriennes exploitant des aéronefs d’immatriculation
étrangère

ÉQUIPÉS D’APPAREIL DE PRISE DE VUES, D’ARMEMENTS OU
D’ÉQUIPEMENTS DE GUERRE ÉLECTRONIQUE

EQUIPPED WITH FIELD VIEW CAMERA, WEAPONS OR ELECTRONIC WARFARE EQUIPMENTS

Les demandes d’autorisation de survol et/ou d’atterrissage relatives aux
aéronefs d’Etat, aux aéronefs militaires ou aéronefs équipés d’appareils
de prise de vues, d’armements ou d’équipements de guerre électronique
doivent introduites par le canal diplomatique.
The requests for authorization of overflight and / or landing concerning
the aircrafts of State, the military aircrafts or aircrafts equipped with field
view cameras, weapons or electronic warfare equipments are introduced
through diplomatic channels.
Elles doivent comporter les éléments cités à l’article 3 du présent arrêté.
They must include the elements listed in Article3 of this Decree.

Les autorisations diplomatiques permanentes, spéciales ou ponctuelles sont
accordées à toute mission diplomatique ou institution internationale régulièrement accréditée qui en exprime la demande au Ministère des Affaires
Etrangères dans les conditions et détails requis.
The diplomatic authorizations that are permanent, special or punctual are
granted to any diplomatic mission or international institution regularly accredited which applies the requests to the Ministry of Foreign Affairs under
the conditions and required details.
Les différents types de demandes d’autorisation sont :
The different types of requests for authorization are :
- les demandes d’autorisation annuelle (autorisation permanente) qui
couvrent une période allant du 1er janvier au 31 décembre de l’année
en cours, accordées au profit des aéronefs d’Etat ;
- les demandes de préavis qui informent l’Agence Nationale de l’Aviation
Civile et de la Météorologie et les services de la circulation aérienne de
l’arrivée prochaine d’un aéronef d’Etat déjà bénéficiaire d’une autorisation permanente ;
- les demandes spéciales, ponctuelles ou occasionnelles, sollicitées au
profit des aéronefs d’Etat, des aéronefs militaires ou aéronefs équipés
d’appareils de prises de vues, d’armement ou d’équipements de guerre
électronique.

- the requests for annual authorization (permanent), covering the period from 1st January to 31 December of the year, granted to the
aircrafts of State ;
- the requests notice that inform the National Agency of Civil Aviation
and Meteorology and the air traffic services the next arrival of a State
aircraft which has already obtained a permanent authorization ;
- The special, punctual or occasional requests, applied for the State aircrafts, military aircrafts or aircrafts equipped with field view cameras,
weapons or electronic warfare equipments.

La délivrance de ces autorisations est de la compétence exclusive du
Ministère des Affaires Étrangères, après coordination avec les services
compétents du Ministère chargé des Transports.
The issuance of these authorizations is the sole responsibility of the
Ministry of Foreign Affairs, after coordination with the relevant departments
of the Ministry in charge of the Transports.

Le présent arrêté abroge et remplace l’arrêté N°01-027/MTTPT du 07
mai 2001 portant procédure de délivrance des autorisations de survol et
d’atterrissage sur le territoire des Comores par les aéronefs étrangers
effectuant des vols non programmés
This Decree abrogates and replaces Decree N° 01-027/MTTPT dated
on 07 May 2001 relative to the granting procedure of the authorization of
overflight and landing on the territory of Comoros for the foreign aircrafts
doing nonscheduled flights

Le Directeur Général de l’Agence Nationale de l’Aviation Civile et de la
Météorologie de l’Union des Comores est chargé de l’exécution du présent
arrêté qui sera publié au journal officiel et partout où besoin sera.
The General Manager of the National Agency of the Civil Aviation and
Meteorology of the Union of the Comoros is in charge of implementing this
Decree that will be published in the official journal and wherever necessary.
