CONVENTION
BETWEEN : Point be sprl located: 19 Enghien Street 1080 Brussels – VAT number: BE 0464.652.071 - RC Brussels 629.728. Hereafter
"the registrar";
AND : __________________________ . Hereafter "the customer";
1. The registrar is approved by DNS Belgium asbl (hereafter DNS BE) to register and renew domain names of ".be" domain. The registrar
engages himself to register and/or renew the following domain name at DNS BE with the reception of the payment.
1bis. The registrar is approved by EURID.eu asbl (hereafter EURID.eu) to register and renew domain names of ".eu" domain. The registrar
engages himself to register and/or renew the following domain name at EURID.eu with the reception of the payment.
2. The customer accepts the terms and conditions of domainname registrations under the ".be" domain operated by DNS BE applying to the
contractual relation between the customer and DNS BE. The conditions are published on the Web site of DNS BE. A copy of the conditions
is annexed to the present convention for information purposes. The conditions are evolutionary and subject to modification.
2bis. The customer accepts the terms and conditions of domainname registrations under the ".eu" domain operated by EURID.eu applying to
the contractual relation between the customer and EURID.eu. The conditions are published on the Web site of EURID.eu. A copy of the
conditions is annexed to the present convention for information purposes. The conditions are evolutionary and subject to modification.
3. Present convention is concluded for one unspecified duration and can be finished by each part with one month notice.
4. The customer has to pay the registration fee or the renewal fee, amounting to 35,00 euro (VAT exluded) per year. The allowances can be
modified throughout this convention. All the invoices of Point Be are payable in Belgium. Any invoice famous will be considered accepted if
it is not protested in writing by registered letter in the eight days. Any amount not paid in the term will automatically be charged with an
interest of 2% per month, without further notice. Moreover, the amount of the invoice will be raised of 15% by way of penalty clause with a
minimum of 125,00 euro (vat excluded). The electronic invoice will be available on the website e-dna.be. You can ask for a paper version by
post at Point be sprrl. In case of litigation, the courts of Brussels are only qualified. The registrar reserves the clause of property on the goods
and services not-paid.
5. a) The customer represents and warrants that:

all statements made during the registration process and the term of the licence are complete and accurate;
registering the domain name will not infringe or otherwise violate the rights of a third party;
the domain name is not registered for an unlawful purpose;
the domain name is not used in violation of any applicable laws or regulations, such as a name that helps to discriminate on the
basis of race, language, sex, religion or political view;
the domain name is not contrary to public order or morality (e.g. obscene or offensive names);
b) The registrar is not liable for any damage, including direct or indirect damage, consequential damage and loss of profits, whether in
contract, tort (including negligence), or otherwise, resulting from or related to the registration or use of a domain name or to the use of its
software or web site, even if the registrar has been advised of the possibility of such damage, e.g. regarding :

registration or renewal (or the default of registration or renewal) of a domain name in favour of a licensee or a third party due to
•
an error concerning their identity;
termination of DNS BE's authority to register domain names in the ".be" domain; termination of EURID.eu , authority to register

domain names in the ".eu" domain
rights that third parties claim to domain names;
technical problems or faults;
acts or omissions of DNS.be/EURID.eu regarding the application, registration or renewal of domain names which may result in
the non-registration or cancellation of a domain name.
The customer must indemnify the registrar against any claim (and the resulting costs, including attorneys' fees) originating from the use or
registration of a domain name that infringes the rights of a third party.
